Ordinance was introduced and given its first reading at the regular meeting of
the.City Council on August 12, 1957. Because of the public.interest in this
Ordinance,.a.hearing wag: set for August 26, 1957.
• Mayor Kays I would suggest to the audience, since I would assume that most
of those people here in regard to this matter are in protest,
that -those who.are-here merely in opposition or in favor and have no particular
• testimony to ,state that they.wait until a.recess:is called., which will be after
all testimony..is heard,. and.register their name.in.favor.or opposition with the
secretary. In this_.way an testimony given will be in regard to new points,
changes or.modifications,in regard to.the;zoning ordinance and.yet all those who
so desire.will have their opinions. recorded in the minutes of this meeting.

Mr, Joseph Bloom,of 229 Myrtlewood Street,.West Covina spoke in favor as follows:
I wish.t o.go on.record as favoring this ordinance.as.it.is stated,. The reasons
are that. we.. do_. not -wish -to. have strangers -wandering -on. our. property or invading
the privacy of our homes.... and -we feel -that -we -are adequately provided elsewhere
with. the services that_ solicitors . offer, We want. to_ alleviate_. any dangers of
nuisance, fraudulent intentions. or. mis-representation_that..might.be.perpetrated by
irresponsible persons.
As a taxpayer in West Covina it is my opinion that the opposition to this ordi-
nance should be confined to those with a. legal business license in West Covina
or a license to do business in West Covina.
Mrs, Charles Varney of 1540 E. Portner Street, West Covina stated as follows:
At this time_I would like to introduce Mr, John Finley who is the Executive
Director of. .the.American.Cancer Society,. I am District Chairman of this society.
Mr. John.Finley,-.Executive Director of the American Cancer Society, Los Angeles
County Branch.stated as follows.
I would -only like -'to say that on the basis of reading this ordinance I would see
nothing.in it that we of the American Cancer Society would .not support, I am
mostly interested in the clarification as to whether we are included in Section
3 and -which. I assume that we_ are.
Mayor Kays It was the intent of,the Council in regard to the section you
have referred to, Mr. Finley, to include organizations of the
nature of yours o
All.of the.various statements by the following persoi4s were made by those in
opposition,
Mr. Edward Waters, President of the Pasadena -San Gabriel Valley and Pomona
Life Underwriters stated.as follows. '
There has been a written communication.to the Council asking that we might have
• the time to appear here__a_o__indicate to you the feelings of. the other communities
that -have c.onsidered.an.ordinance of this type and to give the reasons why they
have.put.it aside
iI am sure there are members of your own community who.would like to be heard but
I would like to speak for the association which has some 400 members and also to
have the Vice -President and'the State Legislative Chairman speak in regard to
this -_matter. We will confine our remarks to a time limit of 20 minutes,
Mayor Kay: That is in opposition to the ordinance of this City. Ordinance
502 permits 3 minutes for each person to present their case and
to deviate.from that must be by consent of the Council.
• The Council discus.sion..indicates that the total speaking time to be -allotted will
be 10 minutes.

Mr. Waterss I would like to venture that what you are about to do here is in
affect to establishing a "Chinese Wall" around the City to
determine who..c4n.come-in and who- must stay out. At the present -time I would
point out._that -you have_.a law in effect in West Covina which., if a complaint is
registered..in.regard...to annoyance or disturbance, the.party can be picked up at
your door. You..are._about.to goone step further in reserving the right of each
member of the.community to state who has the right.to come.to his door and who Ohs

I think.you...already.have the type of law to deal with the kind of thing you are
concerned..about.
Many.of the_good things you have had ,happen to you areEthose that have been brought
directly to you.
I would now..call on Mr. George Holt who is the Vice -President of this association
• to speak.. -in regard to..what-life insurance is.doing_inyyour _own community.
Mr. George Holt: Aside from being Vice -President of the Pasadena -San Gabriel
Valley -Pomona Life Underwriters Association, I have,an agency
_located at_157 E. Rowland Avenue.in.Covina.
We are trying to build up an organization in the area but find that with the
fast growth of the various communities the telephone situation is such that it is
difficult to contact people coming into the city without knocking at their doors.
We have on an -average of 50 Equitable.Life Insurance policy holders being trans-
ferred int.o.California every -gay. Now in transit several things can happen that
can.cause-these policies to go into lapse and many who are caught in the confusion
of moving ignore their.life.insurance premiums resulting in a lapse and unless we
can get.to.se.e..these.people we are doing them an injury.
We would like to tell -.you about what we are doing in West Covina in the way of
• life.insuran ce by supplying money and,re-financing homes where there is large
amounts..of outstanding taxes on these homes--re-financing homes and giving suffi-
cient money.. over and above the mortgage.
You will come.to_realize that the life insurance industry is.greatly responsible
• forr your privilege.to turn on.a light switch or the key, to your auto-
mobile to.start its..engine.and.get.the"car into motion... Life insurance industry
finances many large.ins.titu.tions.
. Life insuran'c.e..goes out.in the field to solicit money to give protection and
retirement..b.enefits and .they make the loans to many of the great industries in
the country.
I spoke.to a.fellow in Colorado who was in a city outside of Pueblo which had
adopted this law.(Green..River) and he told me that one man had.made an appointment
with an Equitable.Lif.e_Insurance man and invited him to his home t.o.keep the
appointment.. When he got there two policemen were standing. -in front of the home
• and they asked him.if he had received permission to solicit to which he replied
in the affirmative... However;_when the man who had requested the interview was
asked about it he stated he had never seen him (the insurance man) before.
Undoubtedly the man was a crank but this copld be a fallacy in the Green River Law.

Mr. R. Hayes,. Jr..s I am here tcnight in the capacity.of the.Legislative
Chairman for the State Underwriters Association.
I would point out that there are some 1500 to.1600 career life underwriters in
Los,Angeles County who are members of one of the..six local life underwriters
associations._in._the_.County.. These are eareers salesmen in that their principal
function .1s._to..c.ounsel and serve people in regard -to life insurance. These
people that_.sell._life insurance are highly trained, bonded and carefully selected
by life _insurance . companies
I would draw to your attention that 85% of most estates that are left is in some
form of life insurance, .yet life insurance must be sold. It is not often bought
on its -own. Thousands and thousands of families are_h'eld together because the
salesmen have initiated.the interest of the buyer.and contact is made mbstly
in the.home_.because many.men do not have the ability to make such contacts on
their own time..except after working hours and in their homes.
• We beLi-eve.. the_ Green. River Ordinance should not be passed and that it'.is detri-
mental..to.the...small business man. We =feel the life underwriter is a typical
small.husingss_.man_working.in the community. Direct selling.is.traditional in
this --industry. We therefore feel it is un-American, in violation of the free
enterpris.e.system.and suggest it not be passed.
Mayor Kayo You gentlemen have held to the time allotted exceptionally
well and I would say that if there are any further remarks you
feel might have been made by.you..but because of the time limityouu.did.not make
them,.a letter be directed to the City'Clerk containing anything further you
might., like. ..to. say.
Mr. Sol Hirschhorn% I am the Executive Director of the California.Credit
Merchants Association, a member of the Supreme Court
Bar and very familiar.with the original decision that gave vent to these Green
• River Laws... I particti:pated in this decision that was handed€down by the Supreme
Court and see in the copy of your ordinance that there is an attempt to come
within those ri.es.
I have prepared a memorandum, which I -believe is in the hands of the Ge mcil,
However,. to discuss it in full would take a lot of time and I believe the pages
• of the memorandum elaborate the points I would wish to bring out. In brief,
these facts that..resolve themselves around this brief all have transpired since
• the_original_..decision handed down by the Supreme Court and this memorandum is as
free .froin._prejudice..of .an industry as anything you can possibly find. These facts
are confinedto those...agencies directly concerned with the control of all industry.
The Better Business -Bureau went on record as attacking this Green River Law.and
I would refer you to the fourth 'paragraph of Page 3 of -the. -memorandum.. This is
not myself talking.but is from that of_a policing business -organization.
Then we have the -statement by the Chamber of Commerce of the United Staten which
went.directly on record as attacking this ordinance.

Then.I would.draw your attention to Page 5 of the memorandum in relation to the
statements of -.the Chamber -of Commerce of a city adjacent to the original city in
Louisiana -..which. -passed. -this Green River Ordinance and.their.feeling of opposition
to .its
Then.we..come...down.to. a more Iocal.situation when I received__A.telephone call
• from Mr. Robert .Bauer, the.president of.the..Los Angeles.Better Business Bureau
requesting permission.to appear with me before -the City Council' of -Los Angeles
to set fortli his reasoning in `opposition to this lawn
Mr. Eugene.Whitmore,-,publisher of American Busness states in no uncertain terms
what.has..already been referred to about the building of a "Chinese -Wall" against
all ,business.
• These statements are not by people who might.fear their.own business might be
affected.but from.organizations charged with the -responsibility of supervising
and control,
From the legal point of view, I must file objection to the introduction to this
ordinance.in.the following statements
"A proposed ordinance having been'. in before this City Council
of. the City of. -West Covina which:.ordinance embodies the exercise of
°police.powerl and no proof having been presented of any exigency
existing which warrants or justified the exercise of such power as a
condition precedent to the introduction of such ordinance, it is re-
spectfully submitted that this proposed ordinance is unconstitutional,"
I would.c all attention to the original Green River Ordinance in which it was
stated.
"It.. has.. been .de.eme,d by the Council.. of the City of Alexandria that an
emergency exists."
I believe your ordinance failson that particular ground and you must prove those

Mr. Henry.Healys (Attorney for Susan°s of Hollywood) I think.we..should be

reminded.of WillRoger?s statement.that "If you do not like
everything..on.the.radio.you can turn`it off," In this case, if you do not wish
to be solicited.you can -close the doors
I feel there_has.been no showing of"public nuisance to.found this ordinance un4r
the_.,Va� .ce...powers given..to you by the State of California. If there is any kind.
of emergency in this matter or any real,opposition to this kind of thing (soli-
citing) --anything .that really makes it a nuisance --it has 'not been shown here
this evening. I feel the ordinance as it is now written is.not..constitutional in
•
the police power vested -in the City of West Covina.
It is not fair to an accepted method of doing business in this country, and if
there are 'evils' they can be taken care of. I ask the Council to reject this
ordinance as having no proper showing for need or necessity of such a regulation
in this.citye

Mr. Frank Loys I am representi.ng.the.National Association of Direct Selling
which is a.national.group.of companies engaged.in door-to-door
selling.
I do not intend.to discuss the legality of this, although I am an attorney, but
if I were.. considering_anis:ordinance of -this type as a City Councilman, first I
would decide. the_..need._.and._pr.essure of this ordinance.. Is there a great need for
• this ordinance? You have got. to decide .that -people are sick. of salesmen coming
to their doors. but you must also keep in mind that there, aro..many types of merch-
andise -brought to the.people in this manner and indications of what is sold at the
door would s.e.em, that.. it. is wanted.
Ther.e.i.s..nothing that has happened at this hearing which indicated a great
pressure -.in this town for legislative proceedings for this proposed ordinance.
. Before.the Council.takes the serious .step such as this to deprive certain people
of a.livelihood they ought -.to be sure there is not a better thing than this restric-
tive ordinance suggests. One of.the tests is to ask if there...isn't.a.better way
of doing _.a -thing -without being so unnecessarily harsh.,. I think that. -is a good
standard.for.this Council to consider.
I believe. there is an alternative and that it is being used -by many communities
in Southern California and I believe, that many companies would be willing to sit
down with..you__(Council) and the City.At_torney or,the City Manager to discuss
these -alternatives.
It is a very serious step when you deny persons the right to make a living in a
manner that is not dangerous or repugnant to public welfare and you have got to
be pretty sure that.it is necessary -to justify that sort of action.. I know of
nothing happening in West Covina that can justify this.
Many -people in this particular field,are employed on a part time basis and it
helps to supplement the income of those"irrho are retired or on pension and do not
have the time nor strength to work'a full day at a particular. job.
This is.a_serious.step to deny a legitimate way of making a living for certain
pens ons __and_.feel_. you , should find certain alternative methods.
• Mr. Paul Pitinio I make a statement of the official position of Sears, Roebuck
& Company relating to the considered.ordinance.
•The.people of West -Covina are of -ital concern to Sears and many of their employees_
reside;._her.e._ and. many. are customers of ours.
We have -business --plans that we wish toresolve but we .do not intend to be involved
in any business activity in a City that might take steps which could limit our
business here. We have many represeihtatives who seek out customers by house -
to -house canvass and who are well indocrinated in public relations but who are
under.control of the -company and, if there is anything.detrimental in their way
. of dealingwith...customers they are immediately discharged.

Our people do not believe this Council desires to -hinder our business and this
type of ordinance would hinder it.
Our legal..department has investigated this-type.of Green -River Ordinance, in its
varying degrees and feel it is restrictive., discriminatory and unconstitutional.
• Regulation of legitimate..trade.is one thing and prohibition is another and even
regulation.is illegal..when you find it makes too many prohibitions to carry on
particular work.
Sears, Roebuck goes on record as being opposed to this ordinance, and_.p'
company is more than -prepared -to attest.its. legitimate right to carry on its
legitimate. -business and..to go in.to court in.regard._to this -ordinance... If it
is passed, Sears. shall. sue.
• Our company has.a quick and sure method to deal with personnel who may be dis-
courteous or dishonest.. You have the duty of handling public nuisance and fraud
and can discharge this duty without wielding a total stoppage .of legitimate
business.
Councilman_ Browns Does Sears have.a license .from this City?
Mr. Pitinis I do not know. .
Councilman Browns As of the other day they did not.
Mr. R. Millers (2157 Mesa,,Drive, West Covina) These people who have
talked are from -put of town but I am appearing. as a
resident.of West.Covina.and selling life insurance.is my business.
I have.heard very few people proposing that this ordinance be adopted here
tonight. As a taxpayer of WestCovina.I do not feel you should come out with
this ordinance; to tell me I cannot make a living to pay those taxes, and I am
of the .opinion_ it is unconstitutional'.
If adopted.you must go, in my opinion, all the way or kick.it aut.all the way.
• There..is..no_ organization doing more for the community than the life insurance
men,in.the community and I would suggeat that this ordinance be -knocked ..out.
• Mr. William Corfield, 633 North Butterfield, West Covina stated as follows. -
I canet look with favor on anything that tends to put me out of business. How
many have ever. gone out of their own free will and bought life insurance. It
has. to. be.. solicited.
Mrs. R. S. Finley of Home Reapers Service and Look Magazine, stated _.as_follows;
I am. not..a_.taxpayer, nor do I solicit here but I received word from Look Magazine
• to inform them_of what decision was reached on this ordinance tonight.

The.Green.River Ordinance does not seem to be working out too.well and Camp
Fire.Girls..were_._stopped...from soliciting their cookies during their fund raising
campaign because of -it and._which would indicate.somethi.ng.additional against
this Green River.. Law.
• I have talked to people in Colorado Springs and they feel that they have the
right_to. decide..whether.they wanted this or not.
Look Magazine...is..definitely opposed...to. this..ordinance.
Mrs. M. Hunt__of .the. branch office of Stanley Home . Products-.
This is a sales.organization and we feel that we are being discriminated against
in not being.able to make a living. Most of us like to do this type of work and
. to us. it is.our profession.
Salesmanship -has an original American heritage and many big businesses today were
built on such a.start--selling things from pu,$)a carts.
We.ask that we be allowed to make a living in a legitimate manner and that all
any person has to do when a salesman comes to their door is to state they are
not interested and shut the door.
We are against any sharp or illegitimate salesmansIfLp, and no good type of sales
.-orgAnization.objects to being licensed to sell in any particular city.
West Covina -should remember that it is not a separate entity of itself and that
many.people desire to..buy merchandise in the manner prescribed, and.this..City is
.a ...pant ..of .Southern . California .. and the whole State and of the ._Unite.d States.
• Mr. A. Jett.: As president of the Covina Valley Board .of -Realtors
I have been instructed to register our opposition to
this ordinance.
Mr. J. Lawlor; (184 2 Ranchero, West Covina) I,am in the life insurance
• business, it is my livelihood.and.I.would register a
protest.-against.the type. of ordinance to be passed.
• Mr. Joseph..Bloom.spoke.in rebuttal.
After listening to these arguments I would present that Page 414 of the year book
of the Encyclopedia .Brittanica of 1952, particularly turning to the . City of.
Alexandria, shows that.the United States Supreme;Court upheld the ordinance
because it.does.not violate the freedom of the press, nor pertain to interstate
commerce, etc,
A municipality has the right .to defend against doorbell ringing of sellers or
soliciting magazine subscriptions.

It is.becaus.e_.of.some experiences we have had, for example a truck and car
coming.onto.my property.with equipment to spray orange trees. I asked what these
people.were_doing.on.my"property and was.told.that they had,been.given authoriza-
tion-by.my..wif_e. to.spray the trees.four months prior and.that a statementhad been
signed that they could_.come into the yard at four month intervals_..until.;a.statement
was signed. -that.. service was. no --longer needed,. I did .not. know. of- this arrangement
and.did.not -Want the service.so told a little white_lie_in that:I had..cut down
my orange -tree.
There are'many such instances on record toward authorizing this ordinance or it
would not.be before the Council this evening.
A resident of 1614 N. Yaleton stated as follows:
We have heard very well organized arguments primarily from those out of the city
and . npposed . to .this ordinance,
I have only lived here two years and in that time we have been under constant
pressure.from door-to-door sales people and on one particular Saturday I kept a
record of those coming to our door and had some 28 people. If that isnft a
nuisance I do. not know what' is.
City Clerk: I have -an -affidavit of -publication of notice of this meeting
in.the San Gabriel Valley Tribune and the ?asadena Star News
on.August...15,. 1957.
I have petitions.if favor of this ordinance signed by 64 people within the
corporate limits of the City of West Covina.

. Councilman Mottingers.. In the light
of the testimony heard this evening I feel,
it is encumbeilt to study this matter further. We are
interes.ted..in .doing.what is proper" for the businessman as well as for the resi-
..dents.of the community.. They need protection, so does the business man.

Councilman Pittengers.. .I do not think it was Councilvs intent to run anybody
out of ''business whb'operates"a legitimate business.
Most of the people.spoke.as if we were trying to run out legitimate,
business, and...possibly.the _ordinance may have a tendency to read that way, but
it is_certainly.not the._casee..However,.l hope you people wont be so naive as
to have us....believe that there has been no abuses.because_that_is what has brought
forth.:the_discuasion of the ordinance in the -first place. That should be made
• clear. We_ did_ not. dream_.this up --there is a .need for this . and.. a.. need.. for something
of this. type.. in the... coin ty.
_,Mayor Kays I had hoped there would be testimony evidence that would suggest
possible alternatives. This has come before many city councils
and.many have turned it down although they have adopted new ordinances in'relation
to.the.subject.. It would-be of extreme value to our Council that.as this is being
..takenfunder.study, possibly at a study session next.Mon day evening, if specific
revision suggestions might be forthcoming to control abuses and still enable us
• to have legitimate enterprises operate., Anyone testifying may submit.such written
recommendations or amendments or possibly sample ordinances.from other cities,
if they are.available, to our City Clerk within a week°.s time so that this matter
may iie...given thorough. study by the Co=CAI.
This matter would. no longer be open to public hearing but -it would save a lot
of time and reference work if some of this information was provided, for us by
those interested.
Councilman Mottinger: It may be in order after the'study session thaftwe
will want to ask representatives from various businesses
in the community to sit down with us and discuss the.matter.and it may not be.
ready.to act.upon at the next regular meeting.
Councilman.Brown, I do not believe there will be a study session on this
next Monday -as that is the Labor Day holiday weekend.

out.. and_. the. ditch. has. been.. opened_ ups We. expect to have.. our Street- Department

In summary., the following -two items would be.effective in relieving the flo6d

seepage.pits filled -up causing raw sewage.;to.back up'into the house plumbing fix-
tures or to overT-low on.to the surface, of the ground, also.that.frewuent pumping
and-cleaning...out of the seepage pits or the construction of new pits was necessary.
The soil withih the..area.of this proposed.sanitaryysewer district consists of

and Merced. Avenu es_Sanitary Sewer. District .V 11-5-7-1, City
of .West Covina., asshown on the attached map. During.. the. course. of this
investigation 76 house -to -house calls were.mades. Of this number 30 occupants
were.. not_. at. home. or did ;,not . answer the. dogre Of the 46 property owners(or
tenants actually contacted 23 of 50% reporte-d. that. they had.experienced trouble
with their individual..subsurface sewage disposal systems. They complained that
the..seepage.pits.filled up causing.raw sewage to back up into the house plumbing
fixtures.or to..overflow on to the.surf ace..of the ground. Also. that frequent
pumping....and...cleaning.out of the pits or the construction of new.seepage pits was
ne.cess.ary.
The soil within the boundaries of this.proposed..sanitary sewer district consists
mostly. of_ heavy clay and. -adobe. This type of soi.1_16 not,conducive..to the.
proper. functioning. of any type of individual. subsurface..sewage disposal as it
has practically no leaching..qualitiese.-.

PLANNING COMMISSION Councilman Brown stated that the Committee of one had found
SALARY RAISE it would be expedient to raise the salary of the Manning
APPROVED Commission by five dollars ($5,00) more for,:each meeting they
are now being paid for, Councilman Mottinger-stated that
since this matter is being done it might also be in line for the P & R Commission
to be given some.remuneration..

monthly budget -report for the m6nth ending July 31, 1957 to members of the
Council.
The City Manager stated that a notice had.been received.of.the formal release
of the C.$.A. Award.. to. the. City and..presented AemberE. of the Council with
• copies.. of. the.. award. winnin_g. brochure.
STATE COMPENSATION The City Manager stated.that.a dividend in the amount
AND INSURANCE FUND of $3376.00 had..been..re.ceived.from this division and
MONETARY RETURN that the.departmentsof the. -City should.certainly
be commended.for their excellent record that made
this possible.
• LEGAL CITY HOLIDAY Motion by Councilman.Brown, seconded by Councilman
ADMISSION DAY Barnes.and..carried that Admission Day be. declared a
legal holiday in West Covina.
SALARIES City Managers In review of police and fire depart -
POLICE AND FIRE DEPTS ment salaries, we found there needed to be.some adjust-
ment and certain clarification within these groups.
We have.already made same adjustments to relieve compression between the rates
of Chief., Captains and Sergeants, and are increasing Police Captain one step
and Fire Engineer by two steps, retroactive to July 1st. Fire Engineers who
act as captains are -to receive captaines pay provided they are on full shift
basis.

menWuions of the.City Manager be accepted.in.relation.rto the salaries discussed.

salary might be a step off and -that should be.looked into.
CITY OPEN HOUSE City Managers The Employees° Association thought
it would be.well,to hold another open house at the
City Hall and suggested a time shortly after the
holidays or in early spring.

TRACT NO. 16.876 I believe there was..something considered in the pastr-
pertaining to participation with Mr. Ferguson on
Tract No. 16876 for opening.of a.street; We have a.letter on this matter indi,..
eating that_.he is interested -in proceeding -but does not feel this.matter has
been equitable.negotiated on the Right -of -Way and improvement costs He would
like to have_ this. matter reconsidered.and_.see if it is possible to negotiate
further.
• It was consensus that Mr. Ferguson be contacted and. requested to appear at
the next study session of the Council.
Mrs. Van Dame questi.oned..as to whether any _steps could.be taken to alleviate
the disposal. of litter and cuttings -:on the. service road between Dark Ellen
Avenue and,Azusa Avenue, It was.further.stated regarding the weeds inside the
jo fence on the freeway and.that a fire had.evidently been started- in the area
where the weeds.are.
City Manager; Inside the fence is -a State Highway problem and we
have been discussing:the'City's acceptance regarding
the freeway. -_I feel.that.because of.some.conditions perhaps various areas
should be accepted but yet we are doubtful if it would actually be a good
policy to da this, that is partial acceptance.
Our ordinance prohibiting dumping on.private property does not seem to be
adequate.. I would -like to see something -perhaps more stringent in the ordinance
in.r.e.gard to dumping on private property; -especially since we will soon be
faced with more. of these -problems after October lst when incinerators are
outlawed.
It was suggested that perhaps:.the traffic..engineer.should_take...up the matter
of stop signs at California and. Vincent. It was_ stated. that property owners
on California are willing to sit with,City officials.,for discussion of the
matter.

for the regional center and they request to have these
signs .changed. .to. read.Eastland. Shopping Center instead of -Citrus Street Shopping
Center, They have agreed.to pay -for and.ifistall-these signs as.originally
proposed . on a temporary basis- until such. time 4ben a..uniform policy has been
established -..along the freeway.
