Mr. Ge113chler- .1 would like to point out that.at the same time -this matter was considered by the Planning Commission they also approved a,zoning variance for the service station and auto dealership. Lorencito Drive, Covina,, stated as f oll 0�rs • I just want to appear in support of this proposal to firmly zone it C-2 because even though variances.were-grented it is impossible to obtain any financing on the development or improvements.until the zoning is firm. If there are any questions that the Council may have I will 'be glad to answer them to the best of my ability.' There being qo,further testimony, the hearing was declared closed. City, Attorney.- The variances would stand as approved and this particular application would allow any other use permitted in a C-2, zone. Mayor KAY6 Are the variances for these specific uses? Mr..'Ge.rschler- Yes, it is for auto dealership and service station. ..Councilman Pittenger: Is there to be a sidewalk alDn;- Walnut Creek Wash and the proposed extension of Vin.'wnt and California? If this petition comes in and the district proceeds and is under- way when development of this property is started, what happens then? Does he (applicant) have to go ahead with sanitary sewer improvements or be cut out of the district or will that part be waived? City Attorney: It can be eliminated or if far enough along he can be included and if he puts his own sewer in he would receive no assessment on the grounds he put in his own sewer. Mr. Bowker-. • Councilman Brown - I am planning on joining the sewer district but can I operate on a.Septic Tank arrangement until the sewer goes in? - I believe this installation should have the stipula- tion that sewers be put in when available. Mayor Kay- I believe the position that would be taken by the Council would be temporary use of septic tank. • operation until sewers are.in, Motion by Councilman Brown,seconded by Councilman Barnes and carried that Precise Plan and Reclassification No. 112 (1405) be approved subject to the recommendations of the City Engineer and Planning Commission and if not included in the recommendations the stipulation is made that sewers are to go in when available. AMENDMENT TO ADOPTED LOCATION-. Northwest corner of Cit.ras and Workman PRECISE PLAN NO. 17 Avenues, Eleanor B. Green REQUEST: Amendment to adopted Precise Plan. APPROVED EXISTING ZONE: C­2 Recommended for approval by the Planning Commission at their meeting of May 1. 1957. Set for hearing this date by the City Council at their meeting of May 13, 1957. Maps were presented by the City Engineer. The Planning Commission Secretary" read Resolution No. 498 of the Planning Commission recommending approval, with the condition that -a minimum building set -back of 20� be shown along Citrus Avenue, with this area being properly landscaped to insure compatibility with properties in the vicinity to the south and southeast', and subject to all the conditions of Adopted Precise Plan No. 17. Mayor Kay opened the public hearing. All those wishing to present testimony on this matter were sworn in by the City Clerk. • Mr. W. Lynch of 1032 Spring Meadow Drive, West Coving, with business address at 333 North Citrus, and, representing owner of this property sta,:.,(-,d as follows- -4- 0 DID 0 C.C',, 5-27-57 Page five --Mr,, Lynch-. If.the Council approves this Prec"J'se Plan,, we -propose to place a Goodyear store on this property which is adjacent to the 'Shell Station. It is a, chain of national retail stores with several outlets in neighboring and major cities in the country. The buildings -are uniform and readily Ldentif iable. (Mr. Lynch presented photographs of such stores located in several southland cities and plans of the building as proposed on this property.) Mr. Pearsa' Ll., a Goodyear representative, is here and will answer any questions that the Council may have, At the time of the hearing before the Commission -there was no opposition to this plan and as pointed out, we are merely changing the location of the small stores as shown on the original plan. If this is granted, we propose immediately to improve -the full length of the property on Citrus Avenue -167 feet --and to widen and improve,the full length of 480 feet on Workman Avenue. The Planning Commission at their hearing, suggested a 209 set -back on the • property. The reason given for this was to' provide a clear view of the traffic on Citrus Avenue. However, I believe the fact was over -looked that there is a 100 set -back that is public property and it would seem unreasonable to request a further set -back from the property line of 20�. We have discovered since the hearing that the. pumps of the Shell Station set 13', from the property, line. Goodyear would appreciate every Consideration you Could give them for a position of prominence on Citrus Avenue, particularly since the stores in Covina to the • north are built to the sidewalk line. There being no further testimony,, the hearing was declared closed. Councilman Pittengerg I feel it might be penalizing these.people to request they have a 201 set -back when it seems a 131 set -back has been established at the Shell Station. Mr. Gerschler.- That Would seem true in this case and I would be inclined to say that there is very little difference between.the 13� and 20� set -back as stipulated if the 13a setback has already 'be established. Mayor Kay- They show 21 set -back on their map so in order to be in line with the service station a further set -back of 11 feet would be required. Mr. Gerschler.- That would be correct. Mayor Kay:. Mr. Pearsall, does 131 seem to unreasonable set. -back to you in order to be in line with the service station? - q_ • C. Co 5- 27-57 Page Six Mr. Pearsall.- No, it is' * not unreasonable because we can s.ee the city3s desire to maintain a uniform street. Councilman.Pittengera. Do you make any reference to the Sign Ordinance in the recommendations? Mr. Gerschler: I do not believe so as that is consiLde-red as an automatic stipulation, although to be consistent, with the past policy of the Commission it'should.have been included in this. Councilman Browno I am wondering about that 1.31 set back. The pumps on the station are set back 1,3j but they use that ground. -existing. between the property line and the gas pumps, for services. I would like to see the distance cut in this case so there Would 'be no danger of parking at the front. I feel the 132 would give enough room have cars par -king at the front of the building. I would 1e more in favor of 51 or 7" set- back. Councilman Pittenger: I do not object tO i-tuch to 101 set -back with stipula- tion of no parking in front of the building. Mr. Pearsall: Even if there is no parking in front of the building and • everyone will have sufficient parking space beside the build- ings, people will attempt to park in front anyway if there is an area large enough to park in. Amendment to adopted,Precise Plan REFERRED BACK TO THE EXISTING ZONE: C-2 PLANNING COMMISSION Recommended for approval. by the Planning Commission at their meeting of May 1,, 1.957. Set for hearing this date by the City Council at their meeting of May 13, 1957. Maps were presented by the City Engineer. The Planning Commission Secretary read Resolution No. 497 of the Planning Commission recommending approval with the 7onditions that the buildings shown at the south of the service station area be deleted from the plan pending the development of the westerly portion of the property as 'shown on the plan; subject to all CDnditions attached to approval of the original precise plan No. 17� that sanitary sewers 'be provided to all buildings and subject to the conformance of the sign structure on the restaurant building with the Zoning Ordinance (45 feet). GO 'Crandell of W. 1. llo]'_lingsworth & Company located at 606 So. all St6 Los Angeles, and speaking for the applicant,:stated as follows-, We have worked this plan over and have done ' everything possible to meet with the desires of the Planning Commission. `v1e have encountered no opposition. My purpose in speaking now is to affirm to you that this, is a step-in an over all development whichq in part, has been sort,of dwarfed by the activity of the regional center across the street from this property. The development is well , under way and at present we are in the process of negotiation, the extend of which I do not want to over -emphasize. • While the word I . I hamburger standv: may not sound too well this project, as .proposed, will be governed with careful supervision and will be a handsome unit, throughout. Mr. Scofield., applicant, of 641 South Fernwood, Covina stated that this is a necessary step and the final result i4ould 'be a good one. • There being no further testimony, the hearing was declared closed. Councilman Pittenger-. I believe it was mentioned that there was no parti.- cular reason why a hamburger stand should be excluded from a planning standpoint. I cannot reconcile this use across the street from the May Company site and a restaurant as an architectural stipulation. Mr. Gerschler: This area is zoned C-2 and the ordinance permits this use so in permitting that you have granted a property right that U has to be, permitted in some degree. Councilman Pittenger, The corner involved is a bad traffic corner and what is going to happen when there are 29 parking spaces ther6? I think you will have more than 29 cars here pretty fast. The traffic hazard alone should -rule this out. Mr. Gerschler.- The location on the property, T do not believe.9 will:further complicate the traffic situation since you are entering and leaving one driveway. Whether this drive-in per square foot will create More cars than another type of commercial enterprise is questionable as it might be that other uses would do the same thing. It is my opinion that when you grant commercial zones you accept certain traffic loads. Councilman Pittenger.- I understand the only control is approval of a Precise Plan. 1. Mr..'Gerschler-. The Precise Plan only controls physical lf)CatiDn of uses within that area. Councilman Pittengert Moving this back from the corner and from the curb will eliminate further traffic danger tlklan that already there now. 0 0 0 C.C. 5-27-57 Page eight Councilman Pittenger - Continued: I have no answer for where this should be but I do not think it should be near the corner. This is our one chance to control it and I think we should. Councilman Barnesg I would go along with Councilman Pittengervs coirnents. You are going to get a youngerclientele here. I believe it would be dangerous and a hazard t"D get in and out, and that is a safety problem. Councilman Brown.- From a safety problem and architectural problem it sounds like this is not a good development. You contend that since this was C-1 and C-2 we had to grant this here. However, the original Precise Plan did not call for this building and we do riot have to accept'it. The original Precise Plan did not include this building on the cornero It would seem to, -be the feelings of the Council that this will cause undue traffic problems, that it does not cbnformwith the, original, Precise Plan and does not blend with the development directly east of it. Councilman Pittenger: I think that'is true. We also do not know how much more traffic increase there wj21. be when the regional center opens. Mr. Crandell.-. I would dislike to see this voted upon without the full knowledge that we have set this set -back to cDnf-.rom to the requirements of Your ordinance and that the ordinance is partially to protect against traffic hazard on this corner as well as any eorner.,You have a traffic L divider fU or raffic'CDming the opposite way that will. protect this from the hazards you mention. We are not setting this on the corner. This is a drive-in take -,out ' food place and I believe..,perhaps that the name "hamburger standu is a misnomer. We certainly do not want to add to any traffic hazards but hope -there is no discrimination between an eating business and any other kind of bus .hers in this area. Mayor Kay.- Ibelieve the Council is'aware the use is permitted but the location.6f buildings on the. Property as submitted in the original Plan, which was approved,, intended these buildings tobegrouped and set -back a good distance from Citrus to blend with the east side.- -It -was specifically stated that you could develop a'regional type of development and not have a group of small stores starting that would hurt the regional develop- ment. Mr, 'Crandell.- One thing that attracted us to this use was t find job of 4e building of a first class Place. The other is the hampering here due to the development across the street. We are trying to blend -Ath those uses and we still have this property to develop. This request for change toallow an eatin-, house is what we have had in mind as suitable for the area. -8- 5 7.57 Page nine .'Mr e Crandell u Continued.- If a food use cannot be put on this property on a relocation orconsideration given undex° what we feel are reasonable circumstances that is one thing. . However, we dofeel we have.gone to extreme expense in this matter in order to get the right :improvement in here and this is an appeal to further consider it.. We have considered this heavy traffic and taken out 'buildings that would not conform to this plan 'which is next to the service station. However, from an economical standpoint considerations should be given. - Mayor Kay: If you located the. eating establishment within the area of buildings.proposed, you would not have.to have any change. Mr. Crandello That -is true 9 but I believe i.t*i.s difficult to set it ahead of the rest of the development. We had a meeting with the entire Ci:vi_l Defense personnel staff and volunteer personnel1 from the community. We.made a preliminary announcment based on prior discussions with the Council at a personnel session in regard to Mr. Pinkney Randal,, Jr. as Director of Operations and Horace R. Greeley as Director of Special Services. iWe have recommended that these positions be created at the rates as were indi- cated and would recommend this now be done by the Council so this work can go forward. PUBLIC WORKS CITY ENGINEER PROJECT C­40 LOCATION- Merced Avenue and Willow Avenue, Accept Street Improvements (Crowell & Larson) Upon recommendation of the City Engineer, motion APPROVED by Councilman Pittenger', seconded by Councilman Brown and carried that street improvements be accepted in Project C-40-,4nd authorization be given for the release of the Travelers Indemnity Company Bond No. 606942 in the amount of $69797.18. The following communication was presented and read by the City Engineer. - "In conjunction with the construction of the sanitary sewers and appurtenances to be installed under the provisions 'of the 1.91.1. Assessment Act, it is necessary for the City to amploy the field surveying services of a private concern. At th6 present time the Engineering Department does not have sufficient personnel to attempt a project of this size and nature. This office has received proposals from and made a su:_,rvey of several of the local'engineering firms. Consideration was given tr, the unit rates for various services and time required to perform specific task"D. These costs wall be covered in the bonding for this 1911 Act? .City Engineer - Mayor Kays- City.Engineer.- That is correct. Was this amount the highest or lowest price? It was actually the highest. Mayor Kay.- I cannot see where you can jusq.fy taking this unless'you have,, knowledge we do not,have- is; hiring the most expensive firm. City Engineer- As I stated, we received the work of three engineering firms Vhi ch we have confidence enough in and that have done this type of work., We feel from knowing their w6rkig methbds that this particular firm could ' get' the Tiork done more rapidly and consequently we have made this recom- mendation. Mpyor Kay- How -soon is this wort to begin? I might add that when you request proposals on engineerinrr work the engineers cannot bid,and you have to select therm on the. basis of your -own knowledge of their operations, personnel and what you feel their capacities are, WA cannot see too much difference here in thecost and have indicated that we. feel we have enough work coming up,tha6 [ai_1. need to be done and we will be able to spread that workaround among the various engineer�aig firms. Councilman Pittenger: You feel this work qan be done a little faster 'by this particular firm? Sanitation Engineer: In so far as t i.s.project is concerend yes s-ir. In the -total cost a: variation of a 1 2'day more would make a sizeable difference in a project of this size. Councilman Pittengerg On that basis I feel it; might be false economy not to accept the recommendation of `the City. Engineer^. Councilman Barnes: Is there any other- enginec;i°i_ng firms in this area besides those mentioned. City Engineer: There are others but —we have not heard from them.,, particularly on this matter. City Manager._. I have-not gone into this matter but as it has been stated,, -you do not take bids- on professional work butI would.recom.mend`i.f there is any question n your` minds of retaining these professional'servicess that the volume of work that we will probably have could be spread between our various local engineer°ing offices. It is difficult to have a standard of measurement on this type work. Whether or not those who charge less `could do the work :for less is hard to say. On this type of work it is customary to'pass the work among those of the profession who are doing work in the ..local area. Motion by Councilman Brown, seconded by' Councilman Barnes that the firmi of Ted M. Walsh- be. hired for field'surveying services for sanitary sewers and appurtenanees to be installed under the provisions of the 1.911. Assessment Act No. 56-1 at the amounts stated for three men field crew and. office work as stated in the recommendation of the City Enginee".. Motion passed on roll call as follows: Ayes. Was there any report given. or is there a report that could be given now? - This was in regard to the Orange Avenue construction project. Isn't there funds available or have been made available.for this project? City Engineer-. I couldn4t say they.have 'been available as we have had to do a great deal -of searching to -get funds. We have some financial aid in the budget to spend,on this project, some from gas tax, county aid and a few contributions from local citizens. along the street. The school coming in and takirg up their location at Puente Avenue has complicated our plans. We had previously planned to do the work in front of the school. In working with the school district we have been able to appbrtion as much as $5000.00 of this work to the school district.*.We would have had to improve this property and by waiting, the City benefited to that extent. -17 • 0 C.C. 5-27-57 Page eighteen City Engineer Continued. The State Gas Tax amount is $25,000.00,, we have negotiated this with the Division of Highways people. The $20,000.00 that should come from the County Special. Projects Funds,, we are using our County Aid to the City funds on this. That amount represents two-thirds of all monies -obtained from the County Aid in one particular year. It is,a great deal to 'bea..plowr-d on one project. The last County Special Project Funds we had to spend were obtained in 1955..West Covina should be receiving their, share of these funds in as much as other communities are receiving theirs. Orange Avenue is the San Dimas Wash in the City of West Covina. Before I came to the City _the County threatened a previous Council in this City with an injunction,, if it was necessary to do so,.to keep the water confined within Orange.Avenue and they would not permit it to govia Badillo Street to the Big Dalton Wash. Support for that threat was procured from residents living in the County along Puente Avenue. They -seem to be able to make that action stick with the City because we have found it to be an almost impossible barrier to.overcome. Every:time.we try to promote a storm. drain there.it is brought. out. 'If we did not have to keep it on Orange Avenue there C'OIUu be otner solutions that would prove more practical and feast.ble.' The proposed Badill.o, Storm Drain can be built only after the improvement of Big Dalton. Wash by'the Army Engineers.. This plan before you represents the.results of negotiations with the County Flood Control, Army Engineers, and cities of CoV:l.na, Baldwin Park and West Covina and the Metropolitan Water District. They'have all been very interested in this plan, We were required to show this plan as evidence of our intentions of providing a storm drain. This particular plan assures the Army Engineers that we intend i to go into the Big Dalton ch6nnel when it,is improved.i At the time they construct the Big Dalton improvements 'they will provide_ an inlet structure as part of their improvements-.' Before the Badillo Drain can-be`built,'it will be necessary to provide financing in the amount of $5009000.00. In,regard to street improvement plans for Orange Avenue, I 'beli.eve they could be before the Council for bids in from 4 t' 6 weeks. Councilman Pittenger. Councilman Brown.- There was a discussion with the City Manager and Director • of Pulbic Works in regard to an additive being put into the pavement on Orange Avenue since it is proposed to carry so much Water.. This would aid in preventing ustripping7 from water flow, although it wfiuld mean an added costa CityEngineer° I do not -think it would cost too much more and I believe there would be justification to include this additive in the pavement mixture, • RED CROSS City Managers Councilman Mottinger has a letter SWIMMING PROGRAM ..in regard to this matter,, although he is.nDt USE OF PRIVATE POOLS present at this time. However,, we have had a recommendation from the Parks and Recreation Commission tYrat the Council should participate if it can do so in this water safety program,, it being a supplemental recreational program. We find that we can contribute up to the amount of $1000.00 to aid this program conducted by the Red Cross, but not the $2000.00 as requested 'by -them. In discussing this with the City Attorney he feels this kind ofcontract arrangement could be carried out with the Red Cross. I would suggest .,'if the Council sordesires to proceed, that the matter be referred to me, and to the City Attorney., to develop the details .that may be related to the conditions but l cannot tell dust hew it will be done at this time. These facilities will 'be available to'the public but we do not know exactly where the locations will be at present. That matter is being worked on and we feel that the distribution will be pretty well throughout the city. We passed on Colonel: Wellings offer of his services to:the Area in addition to his being the Director of Civil Defense in:Claremont and ,he was so appointedo However' the City of Glendora did not vote and now I find that they announced, after I had to leave the meeting, they 'will very possibly pull out of this program which will cast more of a financial burden on the other cities remaining:. According to a joint agreement we had to act on this matter prior to June 1. • I would, however, propose'we do nothing.regarding this until I find out what is'happening in this area. I cannot see contributing the amount of money required in that it will bring no more than it has in the past year. .Glendora will act on this -tomorrow and I would like to contact the other cities to get their feelings on this matter. As we"have to act on this I presume you will do as last year in that if all other cities will continue,) we will also, but if other cities do not, we • would question as to staying with this organization. CIVIC IMPROVEMENT COMMITTEE This committee is progressing nicely and we are working on the structure of sub committees and hope to have those out very shortly. LEGISLATIVE MATTERS A.B. 316.8 ROUTE BILL: This is under consideration by the Senate Com- mittee on Transportation and has not been acted on as yet.. It was slated last week'for action and none was forthcoming, but we expect some action this week. -20- I • C&C. 5-27-57 Page twenty-one A.B. 2440 This bill was proposed 'by California Peace Officers Organizations as an amendment to Government Code minimum standards of all Police personnel... Most cities and the League recommend opposition to it as we feel that the State should not retain the right to say ,how, when and under what conditions we employ such personnel.. Motion bF Councilman 'Brown, seconded 'by Councilman Pitte)ige-r and carried that -the City of West Covina goes on record as being opposed to A.B. 2440. A.B. 4172 This would make the sales tax records of the State available to cities. Cities have been trying to do this in<conjunction with uniform sale's tax throughoiat the State. Sales Tax has been collected but there is no way of knowing what these amounts are. I believe this is a,goDd thing for the community to know. The State has asked us to accept the Work on the Frebway'Frontage Roads and we are at variance with them in stating that it has not 'been completed and the work is not acceptable at this time. Now there is some indication that the State is willing to do some of the things we had in, mind. • I have discussed this mat -ter with the City Attorney and he feels that we should put down in writing those things that we feel are acceptable, with those matters that were discussed some weeks ago,, and -we will submit a report to you. 0 Councilman Brown., Can.we-put boulevard stops at the off -ramps where they join to our streets? City Manager.- I do not say at the moment whether we Could do it or : not, although probably the State would like us to do that as it might be an indication we will accept this work. The State now admits that certain additions and betterments are needed and that the Contract was let under the design we.havo now and there was not much that could be done about it. LEAGUE STORM DRAIN COMMITTEE This committee is progressing and a report will be made at the entire Board at the Directors meeting in June. It has been strongly urged that all cities prepare a Master Plan of Storm Drains.
