MINUTES OF THE ADJOURNED REGULAR MEETING OF 'CYR. CITY COUNCIL
CITY -OF WEST COVINA, CALIFORNIA
May 20, 1957
The meeting was called to order by Mayor Kay.at 8:02 P.M. in the West Covina
City Hall.
ROLL _ CALL
Present: Mayor Kay, Councilmen Barnes, Brown, Mottinger, Pittenger
Others Present: City Manager; City Clerk and. Assistant Administrative Officer;
Sanitation Engineer; Planning Commission Secretary
Absent: City Enigneer; City Attorney; City Treasurer
GENERAL MATTERS
Discussion of the request of H. L..Johnson, Registered Engineer, to consider
property of Vincent P. Schilz and John Q. Schilz for annexations Held over
pending receipt of communication from the Covina City Council.
Mayor Kay: I spoke with the Mayor of Covina andwas informed
• that no action had been taken on -'this matter, as yet,
but the matter would come up at -their meeting this evening.
I would suggest this item be moved to the end of tonights Agenda, as Item No. 8.
pending further word.
• Further discussion of Amendment of Agreement between the City of West Covina
and the South Hills Estates Sewer Committee. Held over pending opinion of the
City Attorney.
City Manager: I believe there is nothing further in regard to this
• matter unless something has transpired within the
last two hours.
Councilman Brown- Was the action that was taken on this matter at our
regular meeting acceptable?
City Managers Dr. Kunath accepted this for the South Hills Estates
Sewer Committee at the last.meeting and if it was unsatis-
factory he was supposed to contact us. G.e have heard nothing from him.
Sanitation Engineer: There are still some details to be worked out regarding
other matters and'when that is doneI believe the
• contract will be executed and Dr. Kunath will present himself at our office.
Mayor Kay: The only reason we set this matter up for this evening
was that we would take any final act;i,on that might
be necessary.

,Sanitation Engineer: There is no further action or discussion necessary
..So far .:as this agreement is concerned.
Councilman' Brown: Usually, i.n any agreement there is a stipulated time
from the contractor when the bid must be accepted.
I imagine that holds true in this matter?
Sanitation Engineer- ° YC..S y the time is for 30 days. However, there are a
few details the Committee must work out in getting
their own agreement"s,-submitting fees, get contract approved, negotiating with
the contractor, etc.As..soon'as he, and the Committee sign this they will submit
• it to our office for approval so they can go ahead with -the work.
Councilman Mottinger: I believe there' was some discussion about this
Committe0 s liability problems. Is there anything the
city should get in on that?
• Councilman Brown: `Wasn't the City to assume their contract?
Sanitation Engineer:. They have an agreement with:the City that they will
cause improvements to be made. We have agreed tp
contribute, 1950.00 for this and for that amount we will be reimbursed and
collect money for those lots not participating in the.collection charges.
Those participating will'not.be-charged collection charge on the permit fee..
• The agreement -we have with them i,s they have all the financing and liability
with the contractor" this'_committee is held completely responsible.
It will be recommended they purchase a Lein and Completion Bond.

• It was consensus in the matter .of jetting these iteirts f or public hearing this
evening that there might be a questi6n of_ legality in tl-iat the decision of
the Commission was reached after the regular m.eeti ng of the Council was held
and adjourned to this date. I However., 1J" was felt that if the necessary space
in the newspaper was reserved at once by the City Cle-rk9 these matters would
have sufficient time to be heard on June 1,09 19.57.
JUNE9 1957 RE.- Letter from Mr. Victor;° M. Carter of the City of
CITY OF HOPE MONTH Hope informing us of :their intention to. conduct a
fund raising campaign ixi West Covina during June, 1957
and requesting the City Councilto proclaim June, 1957
as City of Hope Month.
• Councilman Pittengeri I would 'bring -up a question here. In the Covina United
fund the City of Hope participates in the collections
of the United Fundand for that reason they agree not to conduct a -.,campaign• -
there. We have a newly formed United Fund Association in this City and I
hesitate to.see this allowed as we do not know if the City of Hope will parti-
cipate'in.this drive in the future or not.
I believe the Board of this - United Fund group here in the City meets .on the
second Monday of each month.
Mayor Kay: I am wondering if perhaps we might get some opinion
from the United Fund Board in West Covina regarding
• this and then perhaps we could take proper action.
Motion by Councilman Pittenger, seconded by Councilman ',Iottinger and carried
that the Citv Clerk be instructed to make necessary inquiries of this group
and present further recommendations on the matter.

APPROVED Brown and carried that.permission be granted for this
exhibition in the City of West Covina per letter filed
• with the City Clerk.
The City Clerk presented and read a le'tter from Louis D. Cummings thanking
the City Hall staff for their cooperation while he was representing his
clients on the matter of Unclassified Use Permit No. 190

• AUDIENCE. PARTICIPATION
Mr. Urban Hayden of 117 So. Fernwood9 West Covina stated he had presented a
"Good Will1' letter from the City of West COV-1, 10 to the Mayor of the City of
Oakland which he (Mr. Hayden) had recently visited. The letter was well
received and the Mayor and Council will recieve a communication.from the Mayor
of the City of Oakland inappreciation of the hand -of -friendship extended to
him. Mr. Hayden further stated that he had made an extended trip into Oregon',
spoke of West Covina and -v.,as gratified with the response received as regards to
what he had to say.
Mr.Hayden also stated that he had contacted various Airlines in Oregon stating
• in regard to possibility of an Airport or Helioport in the `:°Jest Covina Area
and this also was -favorably received as a.suggestion by the Airlines.
Mayor Kay: This.gentlemeh spoke to me in regard to sending a
letter of goodwill with him from this City to the .
• City of Oakland and which I was glad to do and on behalf
of the Council I would like to thank him for his efforts on behalf of the
City of West Covina.
Motion by Councilman Mottinger, seconded by Councilman Pittenger and carried
that this meeting be recessed until such time as further word of the action
taken by the City of Covina in the matter of 'the property of Vincent P o Schilz
and John Q. Schilz for annexation is received. (See Item No. 1 - this Agenda).
• The meeting was recessed at 8-25 P.M.
Council reconvened at 9:30 P.M.
GENERAL MATTERS
1) Discussion of request of Ho L. Johnson, Registered Engineer to consider
• property of Vincent P. Schilz and John Q. Schilz for annexation. Field
over pending receipt of communication from the Covina City Council.
Telephone call was received from Covina City Council. at 9:20 P.M. After
discussion at their regular meeting tonight, they, have decided not to release
• the City of West Covina from the agreement regarding the boundaries of the.two
cities which involves this property. They indicated this property would
someday provide additional access to the City of Covina and would also possibly
be developed to valuable commercial property.
After discussion, City Manager Petrie was directed to arrange a meeting between
the Councils of both cities at the earliest possible date to resolve this
problem. .

Mayor Kay opened discussion regarding service roads a'nd dedicated, parking
streets in fIxont of the C®3 area can Garvey Boulevard and also the Cm3 and
Cml area on Glendora Avenue,
It was concensus that this problem requires discussion with and opinion from
our City Attorney with assistance. from the staff ,in the form of information
and statistics.
COUNCIL COMMITTEES REPOT?TS
With the approval of the Council, Mayor Kay appointed IvLr. Sidney Pink,
805 Coral Tree Drive, West Covina, as Park and Recreation Commissioner to
finish out the term of Mr. Claude Barnes who was appointed to the City Councils
Meeting adjourned at 9:50 P.M.
