Chairman of'Azusa Golden Days, inviting the Council to the eighth annual
Azusa Golden Days to be held October 19, 1957, and to enter a float in this
parade to represent the City of West Covina.

COUNCIL COMMITTEES,REPORTS- Student Officials
Mayor Brown requested that all City Councilmen and other Youth Day City Officials
receive a copy of the Minutes of this meeting.
Councilman Kuhnhofer: I would like to.bring to the attention of the Council
the 'up -side -downs. stop sign located at Vine and
Hollenbeck Avenues. Perhaps
rhaps our Public 41orks
Commissioner could tell us what might be done on this matter.
Councilman Gigar: I would like to request that the City Engineer investi-
gate this matter of the 'up-side0down' stop sign.
Mayor Brown: Would the City Engineer please present a report on
this matter at the next regular meeting of the Council.
City Engineer: Yes, we will see this is done.
Councilman RayMondo- I would like to know of the development going,on at
Service and Valinda Avenues.
Planning Director Roberts: In adopting the,zoning map the property was
R-A, Potential R-PI., The property owner has
removed the Walnut trees and prepared the.land
for farming. We have not, to date,, received any applications for firm zoning
or change of zoning status.
Mayor Brown.-.. Does the Council have any questions they would
like to ask?
I would like to ask the Chief of Police how the
Police Department is doing.'

• Police Chief Getches: Everything seems to be Going along satisfactorily.
We ha�ve'some plans to present in the near future, to
the City Manager, regarding the matter of expanding
our Police Department building.
Councilman Kuhnhofer: It is my understanding that the West Covina High
School was broken in to. Has there been investigation
into this matter or anything done about it?
Police Chief Getches: That is a matter for the Covina Police Department
to investigate, as it is in Covina.
• Mayor Brown: I would like to ask Judge Sharon Barath of the Citrus
Municipal Court if there are any figures in regards
to monies collected?
Judge Sharon Barath: The figures are not available at this time.
Mayor Brown: Has the Fire Chief any information as to whether the
rescue truck is available yet?
Fire Chief Brown: This rescue truck has been received by the Fire.
Department but the siren, fire horn and red lights
are to be installed. When that is done the truck
will be ready to respond to emergencies.
• Mayor Brown: I would like a report from the Chief Building
Inspector on the number of new homes that have been
started in the last month.
Building Inspector Sommers., There have been about 50 new homes started.
Mayor Brown: Could we have the status of the general fund from the
Finance Officer at this time?
Finance Officer Lokken: I show the amount of $66,938.31.
Mayor Brown: Is that the current balances or the incumbent balances?
• Zinan6e. Officer Lokken: The cash balance Was the figures just read. The
incumbent balance is 43,710.96.
Mayor Brown., What does the Planning Director plan to do about
beautification of our freeways?
Planning Director Roberts: We will do all that is possible, within our
duties, to beautify it.
Mayor Brown: Are there any more questions from the Council?
Councilman Gigar: I would like to ask the Planning Director if he has
• some idea when the Fox Theater will be built?

Planning Director Roberts: No specific date for building this has been set.
To obtain .firm zoning on this property a zoning
application will be submitted and presented to
both the City Council and Planning Commission,
Councilman Sweeney: Has there been a map submitted on that?.
Planning Director R:oberts: Not .to date.
REPORTS - CITY MANAGER
City Manager Baer: I have a report relating to the Civil Defense.
• Arrangements have been made for a joint meeting of
Civil Defense group and City Council persorinel
on Thursday, May 23, at 8:00 P.M. in the Civil Defense Building at Cortez
Park. At that time there will be a review of the Civil Defense program,
organization and other phases of this important community activity. .
The Federal Civil Defense Association has announced an annual Civil Defense
Test which is to be on July 12th based on a simulated enemy attack. It is our
plan to participate in this test and bring into play as many divisions as
may be required.
We will keep the Council advised of the developments in this matter.

Mayor Brown: What is the progress report on the budgetY

Planning Director.Roberts: What are the people of WestCovina going to do
at the time of these test trials?
Mayor Brown, Could the City Manager answer that question?
City Manager Baer: Announcements will be made to that affect as the
attack is planned.
Planning Director Roberts: Would those be to the Council or to everyone
in West Covina?
City Manager Baer: That will be to the Council.
Councilman Gigar:

I would like to remind everybody in regard to the
Civic Improvement Committee meeting to be held
Saturday morning at 9:00 A,M< at Cortez Park.
Would the City Manager please answer the previous
question in regard to the budget.
Interdepartmental hearings are about one-third of
the way through.

• Councilman Sweeney: What will. they discuss at the Civic Improvement
meeting Saturday morning?
Mayor Brown.- Councilman Sweeney you are out of order.
When will the Council get the first draft on the
budget?
City Manager Baer:
That will depend upon the amount of work required
in conjunction with capital improvements program,
Councilman Sweeney:
What are they going to discuss at this Satia.rday

They will study matters of sewers, food controls,
parks and streets.
Mayor Brown:
Are there any further comments on that?
Do we have anymore City Manager reports?
City Manager Baer:
That is all the reports at this time.
Sanitation Engineer Slattery: I. would request that Item No. 1.1 on the Agenda
be considered at this time.

Mayor Brown:
That has been put on as the last item of our Agenda.
Is there anyone in the audience who wishes to bring
anything before the Council?
Planning Director Roberts: In relation to the ,juvenile de:liquency problem --
what is being done for the young people in so
far as putting up a recreation center for them?
Councilman Raymondo:
We had a bond issue for this but it failed. The
matter is going to be restudied by the Civic Improve-
ment Committee.

Planning Director Roberts: I would like to know if we can be told now of
the progress of Youth Official Day in so far as -
money is concerned?
Mayor Brown:
I would like to request that Nor. Sein give us this
report, if possible, at this time.
Mr. Sein:
We are pleased to announce that we will have, when
all funds are turned in, at least $3000000 to turn
in to the West Covina High School for lighting
equipment for the new
Football field.

Mayor Brown:
Mr. Sein9 would you report on the program of Youth
Officials Day.

• Mr. Seino The program that is scheduled is for all of the new officials
to report to work tomorrow .Mrrning at 9 oUclock A.M. From
9 A.M. to 12 Noon you will participate in the regular work
of the various offices. At noon you are invited to join all the officials and
ourselves for a luncheon at the.South Hills Country Club. After that there
will be a tour of the various city offices and dgpartments which will also
include a tour. of the Citrus Municipal Court. Following all this, we will
return to the City Hall and close the activities.
Planning Director Roberts: I would like to know, as a point of information
from the Police Department, which are our main
• traffic offenders, the young people 'or adults,
or is there an equalization of both?
Police Chief Getches: The largest offenders are our adults in this area.
Mayor Brown: I have been asked by several students at school to proclaim
Friday as a holiday so I am going to do it. I would like
to entertain a motion to declare Friday as a school holiday
for Youth Officials Day.
Motion by Councilman Kuhnhofer, seconded by Councilman Sweeney that Friday
be declared a. school holiday for Youth Officials' Day.

Mr. Harold L. Johnson: Pursuant to Mr. Petrie's instruction a joint
• Public Works Director conference was held with Mr. Nollac and the
City.Attorney and we discussed at some length
the various aspects of the sewer ordinance and
more particularly with respect to what we call co-operative improvement
matters that have been presented before you several times.
Before I give the conclusions reached, I wish to state that one of the greatest
misconceptions we have about sewers is that the governing -body should put in
these sewers. It is held bylaw that seT,rers will benefit private property and
as a result their installation is'to be paid by those parties that are benefited.

Mr. Johnson a Continued. Some of the laws with respect to what we can
do or not do are vague in respect to administra®
Live procedure on matters such as those It has
been the policy of the previous Council, and this Council, that we do every-
thing we can to encourage the installation of aewers in the interest of public
welfare and health. As a result we got this considerable sewer program, which
has grown greatly, started in a small way.
I found upon checking the statutes.that an action of the Council on February
llth of this year with a motion and second by members of the Council and a
roll call, ?'that the City of West Covina participate in the installation of
sanitary sewers in Tract Nogg 18205 and 1P575 in the amount of $3100000"
should be rescinded°'because the City Attorney has interpreted the law that
we cannot participate -in excess of `12000.00 without managing this project
and putting it out for bid. You are familiar with this in regard to the matter
of amount, in spending city funds.
We are faced with two alternatives. One is that we could reject the bids and
call for bids under city inspection, but it is the belief of Mr. Nollac, and
I concur, that.if that is done the bids would come in excess of what is before
us now. With that in mind, Mr. Nollac proposed to the group that we accept
the bid, that they (South Hills Estate Sewer Committee) enter into a contract
accordingly with the contractor, and that the city contribute the amount of
1950.00, as the bid is considerably lower than the estimate.
There has been a communication to the City Council dated May 8, 1957 from the
South -Hills Estate Sewer Committee, per Dr. Kunath, requesting the waiving
the construction inspection fees in the amount of $1,621.59. It is our opinion
that this is interpretive, makes it an administrative matter and that we can
take care of it accordingly. In general you -would accomplish pretty much what
you had set out to accomplish in your. motion of February llth and I would request
that you rescind that action by Minute motion. and then subsequently pass a
Minute motion that would authorize the Mayor and City Clerk to enter into an
Amendment of Agreement with the South Hills Estate Sewer Committee, provided
that they posted the necessary funds to cover the amended agreement,
it is our opinion that in the future, inasmuch as we have accomplished what
we.intended to do when we started the Sewer Department on January of 1955
in'that we have accomplished most of the -trunk sewers by subdivision reimprove®
went and other methods, we believe that no more cooperative agreements as such
should be considered. That does not mean we wpntt allow citi.zsns to participate
in a cash deal where he can install sewers in front'- of his property for less
price than assessment price. If people.wish to do that we will take deposits
and do nothing until we have complete amount of deposits. We will take bids
on signed plans and authorize bid contract and pay for contract as the work
progresses, which is in a similar manner to how we do with curb cooperative
deals that you are familiar with.
Since the new City Attorney was hired I have requested that he restudy all the
procedures with respect to sewer rei.mprovement anti other procedures that we
have devised with the view of improving.and checktngl their legality. He is
in the process of doing that now.

Mayor Kay; Perhaps the first thing we should do,, if. the Council
is in agreement,, is to rescind our action of February

that the previous action of the Council at their meeting of February 11,
1957 for the participation of the City,in the installation of sanitary
sewers in Tract No's 18205 and 18575 1'ri the amount of $3100-00 be rescinded.
• Sanitation Engineer: I contacted Dr. Kunath and informed him of the
discussion that took place. He indicated he would
be here this evening. Perhaps., if he is in the
audience, he would like to speak on this matter.

Mayor Kayo Dr. Kunath, I believe that you can understand the
various reasons for our action this evening. Does
your group feel it can go along with the suggestions
made?
• Dr. Kunath.- We have some legal technicalities that we would like to
have unwound also in respect to this matter,, but I do
not feel that we should bother the Council with this
at the present time.
Mayor Kay: Our City Attorney is not present this evening. 1 believe
that anything on this-matterwould require his opinion
and we would not care to act without that advice. If
we cannot now reach an agreement on the contract as it was read then -it
might be advisable to adjourn this meeting until next Monday evening and work
with our City Manager, City Attorney, Sanitation Engineer and Director of
Public Works',.
• Dr. Kunath: I Would like to suggest that if it is at all possible.,
the Council take action on the amount stated in the
agreement this evening.
Councilman Brown- Perhaps we could authorize this agreement, subject
to the money being Posted.
Motion by Councilman Brown., seconded by Councilman Mottinger that authoriza-
tion be given to the Mayor and City Clerk"to enter into the AMEND14ENT OF
AGREEMENT as regards city participation in the amount of $1950.00 for
sanitary sewer construction in Tract No's 18205 and 18575 upon completion
of the work, SUBJECT TO THE MONETBEING POSTED.

• Mayor Kay: It has been a real, real pleasure working with these
young people who were present tonight and I think that
with one or two meeting they would 'run rings around usO.-
I think they have done a wonderful job of asking questions, speaking and
'passing the buck' like the Council seems to do sometimes.
I think it is a wonderful thing that these young people have come out and
worked,so hard to raise funds for theii- school and that everyone has done
a fine job.
