The meeting was called to order by Mayor Brown at 8:08 P.M. in the West
Covina City Hall The Reverend Howard Mickel, St. Timothy's Lutheran.

Mayor Brown opened the public hearing, and all those wishing to present
testimony on this matter were sworn in by the City Clerk.
Mr. Ray L. Anderson, applicant spoke in favor.
I ask the Council to confirm the action of the Planning Commission. I have
with me, as one of the requirements noted, the suggested landscaping which,
I can turn in now to the Planning Commission Secretary and I also have the
unit to supply the vacant land next to the gas station.
Mr. Anderson quoted Section 1701, Article 17 of the Zoning. Ordinance
is "Purpose of Variance" and stated'
Directly moss the street, a gasoline station is already approved and there
is a gas station on Citrus and Garvey Avenues with the same traffic pattern
and almost the exact set-up as here. Approval was granted by the Planning
Commission for a gas station on the opposite side of the freeway.
There is evidence on file that this business of a gas station on this property
has been under consideration, and blown hot and cold, since 1950.
Mr. Anderson quoted Section 17024 Paragraph 1 of Article 17 of the ?one
Ordinance P9Required showing for varinaces" and stated-
• This site, among other sites, was selected for potential gas station. The
site is a part of a complete block of CWl zoning so it pretty.well stands on
its own feet zoning wise.,
The distribution of gas stations, which can be verified by, gas station
representatives that are here this evening, is such that the.gas stations on
the south side of the freeway is plus or minus 9/10ths of a mile from the
Richfield station on Glendora, to Azusa Avenue, and 3/10ths of a mile to a
station on Citrus Street.
In relationship to the Master Plan, in.diew of the fact that there are gas
stations along the periphery of the freeway I see no way this would intefer
• with the Master Plan or the freeway and since this was incorporated in the
original Master Plan there is no drasitc change by the recommendations'of the
Planning Commission.
Mr. Anderson referred to Section 1702, Paragraph 2, of the Zoning Ordinance
and stated -
If this is denied it would seem this statement would hold true in that potential
Cml has been on the property since 1947 and a letter is on file that this
was under consideration for a gas station since 1950 and prior to the present
ordinance making a zone variance necessary for the use involved here.

Mr. Anderson quoted Section 1702, Paragraph 3, of the Ordinance and stated. -
All the property involved here is in the same zone, C-lo The vicinity is the
southeast corner of the freeway and it was pointed out by the Planning Commission
that there will obviously.be 'C' use here of some sort, no matter what happens
to it. Varinance 195 was granted in a similar situation at Hollenbeck Street
and again on Citrus Street.
The granting of such a variance will not affect the-gendral plan. The site
was, for a long time, eligible for a gas statio-n. The site across the street
is going to be utilized for a. gas station. I am no expert as regards the
comprehensive plan but it seems that whatever traffic is generated for West
Covina in coming off the freeway in distress this can 'be reached without
crossing the intersection, get necessary service, and..get back on the freeway
without causing any increase in congestion at the intersections.
There are many gas stations in West Covina but they are situated particularly
north of the freeway. This would make such service available south of the
freeway without use of the underpass and add a service for this side of the
freeway without adding congestion to the north side of the freeway.
There are representatives of the oil company involved who are present here this
eveni.ng.and will answer any questions that the Council may have.
Mr. John D. Stiles.of 1829 Norma Street, West' Covina spoke in opposition.
I%Te feel that the proponents statement of the sufficienvy of gas stations in.
West Covina, in a particular area should eliminate the necessity of any
further stations.
In this particular area there is a problem created by the Division of Highways
in regard to 'stops' when traveling south and coming up from the underpass and
I believe this site will create even more confusion .with traffic going east
and west. The location is not at a 'Cloverleaf' interchange and there is not
easy access to this particular property.
• We recognize the right of the applicant to C-1 use here "but we feel there could
be a development more compatible to the residential area.

Mr.'Anderson stated in rebuttal that he would be very happy if those in
opposition would tell him what they would like to have on this piece of property
that would give him as a good a land use.
There being no further testimony, the hearing was declared closed.
Councilman Crumley: It appears to me that several months ago the applicant
came in with a plan for this property on the southeast
corner of Azusa which had a medical building in there
and a drive -,in. Is that still contemplated?

Mr.„Anderson: Yes, it is. This is a residual piece to complete the
Precise Plan.
Mr. Andersen presented a photograph of the use 'to be made of the 100 feet
'behind the ,gas station.
Councilman Mottinger, I think we have a traffic hazard in the boulevard
stop on Azusa. However, that is not the owners problem,,
it is part of our nego`,itations with the Highway
Department to straighten out traffic flow problems we have. I doubt if any
9C9 uses here is t7oing to make it come out any better.
Mr. Anderson: I have designed the whole property to get the cars off
of both Azusa and the freeway. The whole thing will be
a mutual ingress and egress and I have done the best
I can to relieve the 'traff is situation here.
Councilman Kay: I nntir there is a 1t x 6 wheel bumper shown.

The representative of the Shell. Oil Company stated this was a temporary
measure until the adjacent property is developed and then it will be removed.
This is being done since there is no fence to be put up here and we do not
• want traffic to cut across to the service station.
Councilman Kay: In view of previously established zoning within the
area, dating back many years, and the action of the
Council on property across the street I feel we are
almost obligated by the previous action, so long as this is within reason,
well controlled and well screened.
Motion'by Councilman Kay, seconded by Councilman Pittenger and carried
that Zone Variance No. 197 'be approved subject to the conditions of the
Planning Commission and Planning Department.

GENERAL MATTERS
• ORAL COMMUNICATIONS
Mr. J. Sein, Chairman and Mr. George Odle, spoke in regard to the City of West
Covina Youth Officials' Day. Mr. Sein requested opinion of Council on a
tentative date for these young people to take over at the Council meeting and
various city offices for the evening of Tuesday, May 14th and the day of
�hTednesday, May 15th. Council was extended an invitation to attend the Parade
to be held in West Covina on Saturday, April 27th, from 11 A.M. to 1 P.M.
It was consensus that the dates suggested by Mr. Sein be accepted.
WRITTEN COMMUNICATIONS
• "POPPY DAYS" The City Clerk read communications from the VFW Post
5/24/57 W 5-25/57 No..P620 of West Covina and American Legion Post No.
APPROVED 790 of West Covina requesting permission to sell and
display Poppies on May 24th and 25th, 1957.

ANNEXATION REQUEST The City Clerk read a communication from Harold L.
Johnson, Registered Civil Engineer, on behalf of
Vincent P. Schilz qnd John Q Schilz requesting_ the
. City of West Covina consider the proposed annexation of a portion of their
property which is located on the west side of Range .Avenue, south of Walnut
Creek Wash.

It was consensus that there being a Tgentlemen's agreement' with the City
of Covina regarding unnaxation of certain areas, some discussion should be
held with that City in regard to this matter before any decision was made.

that the Mayor of West Covina contact the Mayor of Covina and attempt to
work out a solution to this problem in that the location could effect some
change in the gentlemen's agreement' between the two cities.

• CARNIVAL The City Clerk read a communication from Mr. A. Peters,
May 30 - June 3 President of Temple Sholom, requesting permission to
APPROVED hold a carnival from May 30th through June 34d, 1957
on a site located on State Street, between Glendora
Avenue and the Garvey Service Road (Approximately 2 Acres).
Mr. Wyckhoff, who manages the carnival, stated $$200,000.00 worth of insurance
to protect the show and parties concerned will be guaranteed. It was further
stated this carnival is being brought into 1a Puente one week previous to the
date requested in West Covina and that it had been carefully investigated and
approved by the school board of La Puente.
• Motion by Councilman Kay, seconded by Councilman Crumley and carried that the
request for the Carnival. during the dates of May 30th through June 3rd, 1957
and the site requested, be approved subject to proper liability insurance
covering this event (by the applicants); deposit to guarantee the cleaning of
the property and streets; subject to proper police and fire inspection; subject
to police protection during the time of the carnival to be paid by the applicants
and waiving of the $50.00 per day license.
Councilman Crumley: Where a commercial show is used, the City License is
$50.00, which in several instances in the past has
been dropped because the carnival was. put on by the
Chamber of Commerce -r a service organization. I think some thought should
• be given to this,matter so that in the future the matter of a charge would
be made definite ie; either charge -the $$50.00 in all instances or make it
free., one or the other.
UNCLASSIFIED USE PERMIT NO. 19 City Engineer-. This is in regard to the
Cesspool construction Miniature Golf Course to be constructed on
CONDITIONALLY APPROVED Azusa Avenue. We have a request for permission
to use Cesspools on this property rather than
hooking up to a sewer, which was recommended.
The nearest sewer is 1.380 feet away. This request might be.granted for a
limited time since it is a conditional use which comes before the Council
for review each year.
Motion by Councilman Kay, seconded by Councilman Mottinger and carried that
the installation of Cesspools on the property under Unclassified Ilse Permit
No. 19 be permitted to the maximum of the first year's permit but if sewers
are available during that time, the applicant is to hook-up to sewers.

PENDING TENTATIVE MAPS of pending tentative maps.
City Engineer: After compiling this information we found twenty-seven
• tentative maps pending that have not reached the final
map stage. Of those 27 maps, 4 maps have gone beyond
the time limit. Of the 4 that have expired, 2 are involved in school land
purchase and condemnation. One other map seems to be in an impossible location,,
located on high ground at the South end of Citrus Street. I doubt if that one
will ever be finaled. The fourth map has a location at the northeast corner
of Francisquito and Sunset Avenues and is the'th ird section of a large tentative
map and I believe the subdivider will want this renewed,
We have written to all sµbdividers and their engineers sv-that they are
acquainted with all necessary information.
PLANNING COMMISSION
. UNCLASSIFIED USE PERMIT NO. 15 RE: "Kiddie Land" Rides., located on the
Request of Mr. Samuel J. McKay northwest side of Glendora Avenue, between
Garvey Avenue and State Street.
Applicant requests permission to install more rides than permited by approved
Unclassified Use Permit No. 15. Planning Commission recommended approval at
their meeting of April 17, 1957.
Mr o Gerschler: The request was to increase the number of rides from
4 to 8 as sho;,m on the Plot Plan. It was the feeling
of the Commission that the number of rides was not the
main consideration provided the same conditions were maintained. It was the
• recommendation of the Commission this request be granted to increase the rides
as shown on the Plot Plan and in conformance with the Plot Plan.

STREET IN TRACT NO. 20551 TO THE R-1 and R-3 ZONES."
Motion by Councilman Kay, seconded by Councilman
Pittenger and carried ordinance for Zone Chamge No. 98
be introduced..

CITY TREASURER
. Report - March, 1957. Motion by Councilman Kay, seconded by Councilman
Pittenger and carried that the City Treasurer's
report for March., 1957 be accepted and filed for the
record.
COUNCIL COMMITTEES, REPORTS
Councilman Mottinger: A problem has arisen regarding action taken at our last
meeting concerning the construction ®f a temporary water line to the Pony League
Diamond at the Orange -Merced Park Site. I believe Mr. Gershhler can give you
some information regarding this matter.
Mr. Gerschier: We were hoping to construct a line from Walnut
• Creek Parkway across the Wash to the Park site.
However, in contacting; the water company we were
advised the water pressure drops in summer and there would not b'e enough to +
bring the water to the park through this way. We then went to the school
district, who are 'bringing their administrative facilities in at Orange and
Merced, to see if some arrangement could be made. The water company prepared
a plan and the cost estimate for our pro -rated share would be $3500.00. In
going 'back to the water company it was found they were not in a position to
issue a meter on Walnut Creek Parkway and the cheapest water line to be"offered
is $3500.00.
We have investigated every possibility, none of which can'be expected to do the
job that the $3500.00 cost will.

as we were instructed to proceed in the idea
of a water line from Walnut Creek Parkway and
now find this is impossible.
Councilman Mottinger'. There are no recommendations for further action
at this time, unless some further solution is
reached to this problem through recommendation
of the Parks and Recreation Commission and Planning Committee.
CONSIDERATION BY Councilman Mottinger., Before any nominations
COUNCIL OF SECTION are made I would like to cormnent on the services
1.1 OFF ORDINANCE NO. 502 given by Mayor Brown during the last year and
• the extreme amount of time he has devoted to
the job. I hope there will 'be the proper
recognition of the time he has given. The job he has done as mayor is very
commendable.
Last year when the ordinance was drawn up there was in our, minds the sharing
of the load o.f being Mayor, which is a very large one, and I would put in
nomination the name of James Kay as Mayor for the next year.
Councilman Pittenger: I move that nominations be closed.
Councilman Brown. I wish to express my sincere thanks for the
• comments made and the cooperation of the council
during my office as Mayor. This has been the
hardest working Council I know of and I would now like to , at this time, turn
my chair over to James Kay -as Mayor.
Mayor Kayo I heartily agree with 'the comments of Councilman
Mottinger. I know I will have a difficult
time trying to follow the pace set by our
former mayor.
With the consent of the Council I would like to put in nomination the name of
Vernon Mottinger to serve as Mayor Pro®Tempore this year9 and if there are
no objections, I will assume Mr. Mottinger is so designated.

I would like to see the Commission positions held as they are, with Councilman
Brown representing the Fire Department as Fare Commissioner.
It was consensus this be done.
So far as other duties are concerned, I would like Councilman Mottinger to take
over the work of Director of the Los Angeles County Division of the League of
California Cities, representing t^rest Covina. That Councilman Brown continue
to represent the City in the East San Gabriel Planning Committee and to also
serve as delegate on one of the Sanitation Districts either No. 15 or 22.

• The City Attorney stated that he believed a resolution would be needed in
regard to delegate and alternate to serve on the Sanitation District.
Mayor Kaye If that, is the case I believe we should instruct the City
Attorney to bring in the appropriate resolution regarding '
delegates and alternate for Sanitation District No. 15 and 22.
It was consensus this be done.
APPOINTING REPRESENTATIVES Motion by Councilman Crumleyq seconded by

REPORTS m CITY MANAGER
MAINTENANCE OF CITY STREET On the basis of studies and review of a letter
AND FRONTAGE ROADS ON FREEWAY, from the State Division of Highway regarding
control and maintenance of city streets and
frontage roads on the freeway, I would like
to get an expression from the Council, as a matter of record,, that the city would
maintain an agreement with the State on the basis of certain things being accom-
plished. These things have been outlined in a previous report to the State., and
the letter discussed with the Council. This was concerning a proposal of local.
studies being made and minor repairs and revisions being completed, that we sign
a maintenance agreement on that basis --they would do certain things in connection
with this particular matter.
I think more things should be spelled out at this point but not tie up those
things that are necessary and we could do this based on the early report of
Mr. Johnson and the City Engineer that those things 'be accomplished. I think
that things to be accomplished should be in black and white, but with your
general consent we can proceed on such a general basis.
It was consensus that this be done.
• LEGISLATIVE MATTERS We have had previous reports on the matter of
Azusa Avenue's resturati.on of that portion of
the Highway system deleted some years ago.
This has gone through the committee and as former Mayor Brown reports,
Assembylman Erwi.n's bill is included with the Thomas Route Bill No. 3168.
We do have a confirming resolution from La Puente indicating their desire to
go along with this legislations, along with that of Covina and we expect some
indication from the City of Azusa very shortly. These will 'be sent to legisla-
ture from the cities of this area.

LEGISLATIVE BILL AB 1502 This is in regard to freeway agzeaements between
State and other agencies proposed among other things
is to permit the inclusion of the extension of
city streets by contracting agreement between State and City of County agencies
in regard to improvements, restoration, extension. Any contracts for improve-
ments on city or other streets directly related to state projects could be
combined with the State to get this work done.
With you approval I would see that endorsement is sen° to the committee
studying this legislation.
Motion by Councilman Brown, seconded by Councilman Mottinger and carried that
this matter receive endorsement and to be so indicated by letter to the proper
• . parties.
PROPOSED BY=LATr]S AND We have discussed the report of the special committee
REORGANIZATION OF THE of the East San Gabriel Valley Planning Committee with
EAST SAN GABRIEL regard to reorganizing, and the proposed bylaws and
PLANNING COMMITTEE regulations of the Committees,. 1-would like some expj�e`s_
• sion from the Council that could be taken back to this
Committee at their meeting this Thursday night to
approve this re -organization, at least in principle and the desire to see it
move forward. This report indicates the scope and intent of the -proposed
revision and from that, bylaws will be derived.
• Motion by Councilman Brown, seconded by Councilman Crumley and carried that
endorsement be given to the reorganization of the bylaws of the East San
Gabriel Valley Planning Committee and a letter designating Councilman Brown
as representative to -this Committee from this City.
It was noted that Mr. Gerschler should bring before the Planning Commission
the matter of appointing a representative from that body to the East San
Gabriel Valley Planning Committee.
FIRE PREVENTION DAY We have lined up May 4th as Fire Prevention Day and
the intent is to burn a two-story residence located on
Mr. Pick's property on San Bernardino Road. Our
firemen will go in under actual fire fighting conditions. This also sets the
• stage for the long awaited regarding the Fire Underwriters of the Pacific who
will come ih May 6th to start their survey.
AUDIENCE PARTICIPATION
Mrs. M. Van Dame again reminded.the members of the Council to attempt to
obtain a rais for members of the Planning Commission.
Mayor Kay stated this matter should probably be referred to the City Manager
for budgetary consideration.

• LETTER OF RESIGNATION Councilman Crumley presented and read his letter of
Councilman Crumley of resignation from the City Council to become effective
May 5. 1957a Communication stated his resignation
was necessary due to his being transferred to his
companyas plant in Houston, Texas, as managero
Mayor Kay stated that since request is not to become effective until May 5,
that no action be taken on this letter and it be held Over until next regular
meeting of the Council, Mayp.r Kay presented the letter to the City Clerk for
the record.
It was consensus that possible date of meeting with civic improvement committee
• be discussed at the meeting of April 29th,
DEMANDS APPROVED
Motion by Councilman Crumley, seconded by Councilman Pittenger and carried
that Demands in the amount of $58,257.69 be approved as shown on Demand Sheets
B-19; C-32 and C-33, and which includes fund transfers in the amount of
$30, 51o0930.
There being no further business, the meeting was adjourned at 1Os00 P.M.
