Others Present: Cit°; Manager; City Clerk and Assistant Administrative Officer; City .Attorney; City Engineer; Sanitation Engineer; Planning Commission Secretary "Absent- City Treasurer APPROVAL OF MINUTES Motion by Councilman Kay, seconded by Councilman Pittenger and carried that the Minutes of March 119 1,57 be'approved as amended to include the approval of the Minutes of February 25, 1957. Sanitation Engineer: At the Council meeting of January 28, 1957, three resolutions were passed for (Sewer) Assessment Districts No's 1, 2 and 3, which have now been made into one district. These .resolutions were adopted after the reading of the letters from . the Los Angeles County Health Officer. The law states that these letters shall be spread upon the Minutes i.e; the letters actually be typed into the minutes. I wou.l.d recommend. that authorization be given to have this done. Motion 'by Councilman Kay, seconded by Councilman Pittenger and carried that the Minutes of January 28, 1957 'be corrected to have the letters of the Los !Angeles County Health Officer typed into these Minutes, preceeding the resolutions that accepted the reports. All those wishing to present testimony in this matter._were sworn in by the City Clerk. • Mr. Frank Smith, owner of the property, introduced Mr. Russell Uhl who is to construct and operate this use and stated that he would answer any questions that the Council may desire to ask in regard to this matter; Mr. Russell Uhl of 1936 San Pasquale Street, Pasadena, stated as follows: For the past five or six years I have operated a Golf Driving Range in conjunction with Miniature Golf Courses. At the present time, and for a little over a ,year, I have been operating such a Miniature Course in the City of Arcadia. on the corner of. Baldwin and Las Tunas. The operation has been very successful and I have had hundreds of compliments primarily from mothers who have held birthday parties there for their children and from various other organizations such as the Boy Scouts,, Girl Scouts, etc. who have used the .facilities for special. occa7siorl.s, lrte have had absolutely no trouble from the standpoint. of rowdiness as we do not stand for it and have not done so from the start. Asa result it is really the kind of a place to take your family -for an hour or so. I have talked with the Chief of Police of Arcadia and he has stated that he wished there were more such well operated places like it, in that during; the year it has been in operation no occasion has arisen to call for the services of his department. I do not know just how far you would like me to go into this matter but if you • have any questions I would be glad to answer them. Mr. Uhl presented a picture of this installation and also letters from those people located in the neighborhood, which is primarily residential, stating this has been an excellent operation and they havehad no objections to it whatsoever. There 'being no further testimony presented, the hearing was declared closed. It was consensus that there seemed to be no need for the alley at the northerly property line since it serves no purpose and would cost the City to maintain it at the present time. It was further.stated that this plan seemed a good one,, acts as a buffer and that a point in favor was that no objection had been registered by the school district involved near here. • • C.C. 3-25-57 Page fieie Unclassified Use Permit No. 19 - Continued Motion. by Councilman Mottinger, seconded by Councilman Kay and carried that Unclassified Use Permit No. 1.9 be approved subject to the recommendations of the Planning Commission and City Engineer with the stipulation that Item No. 9 of the Recommendations "that a 19dfoot alley be improved and dedicated to the City of West Covina along; {.he northerly property line from Azusa Avenue to a point 280 feet easterly therefrom if and when the property to the north is developed for commercial. uses" be deleted. GENERAL MATTERS ORAL COMMUNICATIONS • City Engineer: Under Item 5-A a=resolution has been presented to the City Attorney for opening 11 Lots for access to Tract No. 20199. The Final Map of Tract No. 20199 is on the Agenda. • City Manager: Mr. Johnson, our Director of Pulbi.c Works, has prepared a proq-ress report and summary to give the Council an idea of the. status of the sanitary sewer projects. The report has been filed with you in written form but I believe that Mr. Johnson would like to make some oral statements regarding this and with your permission would like to place this on the Agenda at this time. It was consensus that Mr. Johnson could present this at this time. - 5® • C.C. 3. 25-57 Oral Communications - Continued Pale six Mr. Johnson: Pursuant to ,your instructions we have been gathering an. Inventory of the needs in all districts and trying to analyze how and where some of the income may come from to build the needs of the City. This progress report represents the first step in the Sanitation Departme_t, of summarizing those needs. We will follow at your next regular meeting with a monthly report showing the progress of all the projects .under design so you will have a record to keep of and what is being done and in what way in. the City. • There are 23.36 miles of sanitary sewers in West Covina, not including 11-1/2 miles installed by the Los Angeles Sanitation District. I mention the latter because we have participated in some small way in those (sewer) lines. This represents in frontage charges collected along existing lines in this last two years a little of $33,000.00 which will be used in this department for other projects. In an over all report some two ,years ago of where to place a ,Storm Drain, Section Department it was decided to place it in the Sanitation Division., so we have added in those drains that are now in excess of 18,000 feet of conduit and storm drains. • The total -value of sewers constructed under reimbursement agreements is $128,1 55. These are lines that are installed outside of subdivisions and lines installed larger than would normally be required in the subdivision itself and represent about seven extra miles of mainline sewers. Under the assessment act type of sewer installation we expect to see more and more of that and we now have 16 districts in process. We are working on engineer- ing design and have one in excess of 50% complete and the balance less than 50% complete. As a step to crystalize future thinking we are undertaking a master plan, laying out ill main line sewers for the City. 'Jde expect to complete this in the next • couple of weeks and will have an outline for the petition areas under 1911 Act or future cash improvement acts. If we then receive a request for installation we have the area of the district involved and know the approximate cost and can present petition forms to those. interested parties with the request they obtain the necessary signatures. Primarily the engineering is basically complete. WRITTEN COP I)UNICATIONS City Clerk presented and read a communication from the Los Angeles County Health Department, dated March 12, 1957, confirming a telephone conversation for the use of the Civil.Defense Recreation Building by Dr. Meehan, M.D., District Health Officer., for the purpose of giving Polio Immunization injections on the lst and 3rd Tuesdays. 0 • C.C. .3-25.-,57 Page seven PUBLIC WORKS CITY ENGINEER TIME EXTENSION LOCATIONS South of Puente Avenue, west of Lark Ellen Tract No. 20199 Avenue. 0. Mayor Brown- I think the owner should improve.this and include that, improve- ment in the sales price instead of our taking from a fund, money that could be put to so much better use in the City. We.have other developers that would have put in complete street improvements and I do not see why we should not get it in here rather than use Gas Tax funds to put • these improvements in. _10- C.C.. 3-25-57 Page eleven • Pioneer School Street - Continued Councilman Kay: Has the property been sold to the district? Mayor }gown: I believe it is under option subject to buying upon approval of zoning. Councilman Mottingerm I be.11eve the school district could purchase this property as improved property and the State Allocations provide for the improvements. Councilman Kay: There is no reason why the whole width of the street • could not be improved and that could 'be condition of the sale that it 'be purchased as improved property. Mayor Brown; It is ,lust that I firmly 'belie-re we can use this money from County Aid for a more vital and better use in the City. Motion by Councilman Kay, seconded by Councilman Pittenger and carried that this matter be referred back to the City Engineer for further study (and report) PROJECT C-54 City Engineer presented and read a report on cost of Merced Avenue improvements requested by petitioners on the south STREET IMPROVMENIENTS side of Merced Avenue between Lark Ellen Avenue and • CONDITIONAL APPROVAL Primeaux Avenue. City Engineer: In line with our presentpolicy., the owners would deposit their share of cost of improvements with the City at the rate of r2.00 per lineal foot, totalling $2,o66.00. The City's participation cost to complete the pavement on this secondary or extra width street would be %.600.0o. -A project for City 's share ;,Tould be obtained from County Aid Funds and incorporated in the 1957-1958 fiscal year budget. Since there is a pending sanitary sewer assessment district involving this section of street, it'is our recommendation that the project be approved on the above mentioned basis., to 'be constructed after sanitary sewers have been • installed. It is estimated that it will require from 9 to 12 months to complete the sanitary sewer project. The Sanitation Engineer stated'that his department was now preparing a preliminary report for the Council on this area and the matter was in its 'infant' stages of the district, and would probably not go into constructi.on until about a ,year from now. Discussion of the Council indicated that perhaps this matter should be held over temporarily since there seemed bo be such a great length of time involved. C.C. 3-2557 Page twelve • Project C-54 - Continued The City Manager stated that it would be his suggestion that some action should be taken indicating the city's desire to participate depending on construction of sanitary sewers and in that way there would be knowledge of how to budget this.. "In the event it is budgeted and the project not completed or the sewer defeated we can proceed or carry it over. However, we iiould like your expressions on this, at this time to anticipate where the money is going in the 'budget" Motion by Councilman Mottinger, seconded by Coun6ilman(,rumley and carried that this proposal be approved subject to determinings of sewer planning in this area and to receipt of deposits from the property owners for their share of the work. • PLANNTNG COMMISSION Subdivisions = METES & BOUNDS LOCATION: San Bernardino Road near Azusa Canyon Road. SUBDIVISION NO. 135136 Romac Oil Company 2 Lots - Prea District I HELD OVER Recommended for approval by the Planning Commission on March 23, 1957. The maps were presented by the City Engineer and the recommendations read. • 1) That all street improvements outlined in Section 49, of Ordinance No. 225, including utilities, be installed accordingl y and meet the approval of the City Engineer, this to include sanitary sewers. 2) That the map conform to Block Study No- 43. 3) That a Dnefoot lot at the end of the proposed street be dedicated to the City of West Covina in fee simple. 4) That the disposition of existing buildings be shown. 5) That a 30' 0" wide future street'R.O.Wl. be shown along the easterly side of Parcel No. 2. Discussion was held on this matter and it was consensus that further study and report be made as regards street layout as shown on the Flock Study as it was thought it might 'be unfair to property Droperty owners to have a 30' set -,back as designated in the recommendations and then h21re the other street fro in and find the set, --back was not needed. It was also stated since the property owners had not been notified it might be iiell to do so. Motion by Councilman. Denied by City Council on March 11,' 1957;Referred to the Planning Commission for report. Mr. Gerschler- The motion of the Planning Commission at their meeting of March 23, 1957 shows that they concur with the action of the City'.rDuncil as taken at Council meeting of March 11, 1957. Mr. Floyd Morgan, real estate broker stated as follows: The Rowland Village Corporation has this property in Escrow and it is their intention of trying to present a new Precise Plan.acceptable to the Council and Commission. They would like to work this out in some manner and form. T%Te understand that plans are being made by the Covina School District to accuire this land for a school site but it seems to us that the school district should be able to take property and make planS.2ccordingly a lDn.,., time in the future instead of waiting to the last minute to acquire certain land that has become desirable property in the way of revenue 'to the City. I also understand that this would have attendance of pupils in the Count: who are going to Covina School District, We would like to appeal this or take it up with the Planning Commission for further study, I think it is proper for multiple dwellings and professional use, and do not think it is a good location for school use. The school district .in the past has indicated they were not in favor of schools being located so near heavy trafficked roads or the freeway and evidently the desire to use this property, with its near freeway location, indicates a change. There is another piece ofpropertyfor a school location, w1lich might also 'be less expensive property, at Workman and Puente. • Mayor Browne You can submit another Precise Plan and "one Change. The denial was on the Precise Plan and on some of the uses. Mr. Morgan: I believe there was objection to the two-story plan in rear near houses on Morada. Mayor Brown- The complete layout of the plan was poor and also the traffic flow. Mr. Morgan: There were no objections -to professional zoning and multiple dwellings. -13- C • 0 • C.C. 3-2 5-5i Page fourteen Zone Change No, 96 and Precise Plan No. 107 - Continued Mayor Brown: Zoning objections were to the C-1 zone in there. Councilman Kay: You should 'get proper traffic flow in here and other uses than the C-1 uses indicated.. You can reapply with a better layout of R-3 and R-P. Mayor Brown The zoning and the Precise Plan run together and I would think the whole thing would need to be re -vamped. Councilman Kay: Are you asking if we are grilling to consider R-P and R-3 on the property? Mr. Morgan: That is corrects Councilman Crumley: Perhaps that would be in order but rased on a correct Precise Plan beinn submitted. Councilman Pittenger- I do not think we should leave a wrong impression as regards the school. The school. district does not waif, any particular time to purchase property. It is purchased as needed and as the money exists. They cannot get funds until the need does exist. The school board knows they should have purchased land way ahead', perhaps 10 years ago, but they did not have money to purchase sites then. Councilman Kayo Mr. Gerschler stated in a report on this school matter the shifting of the children out of the County into city school and the shifting of the balance which may create a future problem. Councilman Pittenger: I am not arguing on location but that money was not available in the past to purchase land that could have been available then, Mayor Brown: I think it might be the general feeling of the Council that the Covina '"school District has waited until prices have gone up and land becomes valuable to the City. Construction Industries vs City of West Covina and County of Los Angeles re construc- tion of Merced Walnut Drain. SOUTHERN CALIFORNIA ASSOCIATION City Attorney: This involves a great number OF CAPINET MAKERS vs of cities in Los Angeles County with the CITY OF WEST COVINA AND 32 exception of the City of Los Angeles. Since OTHER CALIFORNIA CITIES there are so many involved it is possible that one counsel may represent all the cities • involved and I would like the Council's expression on this possibility. It was consensus that if such a decision was made the City of West Covina would go along with such a plan. CITY CLERK REPORTS None CITY TREASURER REPORTS None COUNCIL COINMITTEES, REPORTS • Councilman Pittenger: We are starting action on Civic Improvement Committees and quite a bit of work will be required by various City departments to get the basic information for these committees. I would like to bring the Council's attention to this matter in getting their opinion of permitting some overtime of various people in some of the City departments in order to get this plan on its way. It wa.s consensus this matter should be left up .to the City Manager and the Director of Public Works. The City Manager concurred in this opinion so long as an understanding could be reached and there could be a working, relationship, =19 C.C. 3°25-57 Page twenty Councilman Kay: Several zoning matters were discussed at the last • meeting with the Commission and a tentative date for a joint.meeting'of discussion between Council and the Commission was designated for March 30th. However, now it appears that as too many will be unable to appear on that date perhaps some other time and date can be designated. It was consensus that the matters of Personnel and interviewing of Planning Consultant should take precedence over this and that the joint meeting arrange- ment on March 30th be cancelled until another arrangement can be made for such a meeting. INITIAL AND SUPPLEMENTAL Motion by Councilman Kay,, seconded by Councilman LIST OF PERSONS ON CIITIC Mottinger and carried that the persons named on the • IMPROVEMENT COMMITTEE initial listings of March 11, 1957 and on the supple - APPROVED mental listings of March 259 1957 for the Civic Improvement Committee be approved; REPORTS m CITY MANAGER PETITION FOR ADEQUATE Petition containing 27 property oumers names in the FLOOD CONTROL vicinity of North Lark Ellen and 4orkman Avenues., Mr. Richard Gates requesting the City of West Covina to.'contact the 323 N. Lark Ellen Ave. County in an effort to obtain adequate flood control. REFERRED BACK TO Presented at regular meeting of the Council of CITY MANAGER March 119 19579 and referred to City Manager for report. • City Manager: I have looked over this matter with the Acting Director of Public Works and.drainage problems do exist here but they are purely local in character and could not be referred to the.Los Angeles County Flood Control.. However, for necessary relief there could be programming in one of several ways ie- improvements district; speci.al'assewsment; bond program or some other special means in the drainage district. I discussed this with Mr..Gates who has seeemd to take the initiative in this matter as the petitiq^ r and told him of the plans in connection with civic improvement program and that it would.include storm drains. There would be • a master plan of storm drains in the area and'it would include minor drains, but what the program would be it is hard to say. It might be ,your desire to refer this particular group to the civic improvement committee and find ways and means to accomplish this but it won't give the relief that these people have in mind. 'In order to find another way I would suggest this matter be referred back to me to discuss this further with these people as to what their desires and ideas might be. Motion by Councilman Crumley, seconded by Councilman Mottinger and carried that this matter be referred back to the City Manager for further discussion and work with those.involved in this petition.. C.C. 3-25-57 Page twenty-one MAINTENANCE SERVICE We attempted ,to arrange this with the State Highway • ON FREEWAY UNDERPASSES, Department but found that much of this work is farmed PUMPING PLANTS AND out to maintenance contractora, this would be in ELECTRICAL INSTALLATIONS connection with electrical equipment. In working with the Highway Department we have an offer that in brief would contract with the Reion Company (Frank R. Thorp) who are general electrical maintenance contractor at the price of maintenance of $8.33 a pumping station per month. I am sure that some of this can be paid back out -of gas tax money- and at best would be only $33.00 per month on the underpasses as there would only be four we would have to take care of as Azusa Avenue underpass would not be included. If this meets with your approval and I have the recommendation of the Public 'Korks Department, we will prepare the necessary papers. • It was consensus that the City Manager proceed with the necessary work on this matter. STREET LIGHTING DISTRICT The City Manager stated the contracts with ASSESSMENTS PREPARATION Mr. Thompson for the prepararion of street iighting APPROVED district assessments had been received and su?gested that the same agreement as wa.s made last year be approved provided the form is approved by the City Attorney-. Motion by Councilman Pittenger, seconded by Councilman Kay and carriedthat authorization be given for the execution of said contract vTith Mr. Thompson. • TRAFFIC SIGNALS We have tried to eliminate the use of additional standards for traffic signals and would recommend they be hung on street lighting poles. We have a special agreement that will save us considerable money for purchase of standards and eliminate additional poles from intersection area:5. An agreement, must be signed 'between the Edison Company and the City to make these additional installation facilities available. Motion by Councilman Kay, seconded by Councilman Mottinger and carried that authorization be given for the Mayor and City Clerk to execute the necessary agreements to.make poles available for installation of traffic signals, with the Edison Company. • COUNTY COURT HOUSE We have a notice from County Engineers of confirma- tion of the Board of Supervisors of Los Angeles County on approving preliminary work for the County Court House and the probability of it being under construction by September of this year. TRANSITION OF AZUSA AVENUE, The City of Covina has.confirmed their thoughts SOUTH, TO STATE HIGH4TTA Y on the transition of Azusa Avenue to the State DI71SION Highway Division south to Whittier Boulevard and copies have been sent to various Assemblymen and Chairman of Highway Commission. No report has, as ,yet, been received from the City of Azusa or La Puente. 0 -21- C.C. 325-57 Page twenty-two SENATE BILL NO. 2208 Motion by Councilman Mottinger9 seconded by • Councilman Kay and carried that authorization be given to'the City Manager to proceed with the proper legislation required for the approval of Senate Bill No. 2208. AUDIENCE PARTICIPATION Mr. DePietro: I have a request to put in a bowling alley on MY property at the north side of the freeway of about 249000 square feet. There will be $4009000 in equipment and building will be $240,000 plus land, If I had the least hope that. I could have the zoning on this property I would feel that I could work with these people on the preliminary work b.t if not • I will not, do anything. Right now there is C-1 zoning. We have land on the north side and they have land on the east side that can be included for parking. They want to open this proposed use by September if it is possible to obtain such a use. Mayor Brown We can make no official, committment on your suggestion and proposal but only suggest that a Precise Plan be filed with the Planning Commission and it will be given every consideration possible, i APPROVE DEMANDS Motion by Councilman Crumley, seconded by Councilman Pittenger and carried that Demands in the amount of , .619.81 be approved as shown on Demand Sheets P-17y C-28 and C-29 and which includes fund transfers in .the amount of 359774040.
