Stark for pla'Ulic hearing on Zone 7ar-Lance No. 191. CONDITIONALLY APPROVED Locati6h- So'utheast corner of Hollenbeck Street and Garvey Avenue. Request: Variance to permit operation of flashing sign. Existing Zone: C-1. Approved by the Planning Commission with limitations o.n January 16, 1957 by .Resolution No. 460. Action of the Planning Commission appealed by applicant • by letter., Set for hearing this date by the City Council, at their meeting of January 28., 1957. Resolution No. 4609 of the Planning Commission, giving conditional -approval. on this Zone Variance -that this sign be permitted as it now stands., but with- out animation, was read by the Planning Commission Secretary. All those wishing to present testimony on this matter were sworn in by the City Clerk. Mrs,. E. B. Samuels of 333 No. Citrus Street., Covina stated as follows: I wish to call -attention to the fact that in December,, 1956.,-this zone variance • was requested for permission to operate the existing sign. This sign has three fingers extending a bove the top of the sign\ which is not a true flashing sign in that.it does not go on and off but simulates movement. Two nights before this matter was scheduled for public hearing (before the Commission) the restaurant burned. 0 At that time it became even more impprtant that some special consideration be given in this case and a request was made on the night of the (Commission) hearing that Mr. Stark be"permitted to re-;-installl the sign the previously had, while the original construction of this restaurant was going on --attach it to the front of the 'building with proper lighting so as to indicate this build- ing would be reconstructed. Th6 purposeoP this would be to inform those people coming in at night seeking; m! the restaurant that this buildiwould be 9 reconstructed in the near future. Otherwise there would be no indication of this and future customers would be lost. The need is so evident in.this case that the only thing I.can do is request the Council to grant permission for the owner to use the presently -existing sign as it was intended to be used, and as it now is for awhile, also temporary use of the original construction sign noting the re -building. Mr. Gerschler: Councilman Kay - I believe that in the matter of the construction sign. it was to be processed in the usual manner which would 4 be under a zone varl2nce. Councilman Kay'. Mrs. Samuels is the request for the old construction 6 i(Tn in addition to the sign up at the present time? Mrs. Samuels: The present sign is not adequate. The owner desires permission to also use the sign that he had while the original building was under construction and to repaint it to indicate the restaurants being rebuilt and -Lf possible to permit this sign to also be considered tonight. We feel there may be one of two ways of - -doing thi5, either as a time extension of the original variance or as an addenda to the zc)n-- variance request so as to include that temporary sign in this same variance request. It seems rather inequitatle a thing to consume another month or six -weeks from tonight in handling- what is'actually'an emergency matter. New construction would take approximately five months. Councilman Pittenger.- The construction sign would be only while rebuilding is being done? Mrs. Samuels: That is correct. The owner wants the sign in the front of the building indicating the re-construction,9 and with proper lir �hting so it c,,.n be seen. Councilman Pittenger: I think this should be considered as two separate matters. I believe this particular sign is in the nature of an emergency, Mr. J. Morgan of 107 South Fircroft Street, West Covina spoke as follows. Is this the appeal. on the original -variance for the animated sign or is it to be a variance to allow the emergency.sign? Mayor Browne Mr. Morgang Mayor Brown. The hearing; before us is in regard to the animated sign. The animated sign is denied? We have taken no actin, as yet. Mr. Morgan: I speak as a representative of those residents living . on Fircroft Street and we opposed'this animated sign at the public hearing held before the Commission. We thought that we were representing the feelings of the majority of the people on that street when we stated to the ' Corranission that we did notmind the use of the three prongs on the top- of the sign, or the green light, provided they were not animated. C.' 2-25-57 Page four • Zone Variance No. 191 - Continued Mr. Morgan - Continued- However., we have found out since that hearing that the majority of the ,people are against the three prongs above the sign, whether they are animated or not. also considerable objections have been voiced to the heart with the arrow through it which is also on the sign and which, 'blinks. That was on the sign as it was originally erected and in itself makes it an animated sign. Mr. J. Burgess of 118 South Fircroft Street, West Covina, spoke as followsg This sign that we have been'discussing with the extended fingers is a nuisance with its flashing in the bedrooms of my home, and is even a bother when it • is not animated. If even our street lights are shaded I do not see why we have to put up with this sign. Even if the, -Light is not fl.ashi ng it makes quite a light in the neighborhood. A resident of Fircroft Street spoke as follows: I believe. it was stated that the 'three pr6ngs on this sign could not be considered as -flashing but I think that anybody living in the near vicinity of that sign and being annoyed 1-y its animation would consider it a flashing sign. The bedrooms in my home are at the back of the hnuse, but we like to sit on the front porch of our home,. and our den is in the front of the house, Even • with shades and curtains drawn there is still the shadow cast of the blinking on the sign and is very disturbing. I think the sign can be seen clearly from the -freeway without the animation and anyone going to the restaurant can easily see where it is. There being no further testimony, the hearing was declared closed. Councilman Pittenger: I would still like to separate the two signs spoken of this evening, and.I do think the temporary sign' as regards re -construction is necessary. • Motion by Councilman Pittenger, seconded by Councilman i,'Tottinger and carried that the Council grant variance to permit the temporary construction sign to be placed during re -construction of this restaurant and referred to the Director.of Planning.with power to act and process the permit. Councilman Pittenger:. I took a ride through our business center and on Glendora Avenue noted that we have several flashing signs existing without proper variance, I -think Mr. Gerschler is doing a study of our sign ordinance and I think we should hold the matter of this animated sign over as I feel this original sign is not needed right now* If we deny this variance we are going to,have quite a job to stop others., • Councilman Crumley.- We invite 'business to come into this City, we want it. We want, to bring it in in order to make this a good balanced City, and we,want the revenues that come frorTi,these commercial zones. Then we turn around and tell a. man who is in business not to do something which brings business to his property. C. C. 2- 2 5- 557 Page five Zone Variance No. 191 - Continued. • Councilman Crumley - Continued: He has had this sign in the past and I believe he, should 'be able to use it until the sign. ordinance is revised -and we can take a look at the entire thing., As you. said., Councilman Pittenger, the're are flashing signs all o-,.,er the City- at the present time and I believe that here we are trying to ellmate a "Lashing sign which is less obnoxious than many of these others. This is in an isolated area and the o-vzier feels this -type of sign.brings business to his restaurant, and if it does I feel the City should encourage the business. • Councilman Pittenger: i vmild-not argue with your, comments, Councilman. I think it- would be pi)ssible I t 6 " shield't-,he people from the annoyance of this sign and gi-;.re a temporary -variance. • Councilman Kay: Since this matter came up before the Planning Commis- sion you had many siNns under non -conforming, use and considering the location of those the intersection of Hollenbeck Street Is no different than any other intersection except this is a little closer to home,-, than in othor areas. I -think the situation car. be solved from both sides if the course is taken as suggested by Councilman Crumley. Mayor Brown: I believe -there is no doubt that this can be buffered • and I do not believe that we can take frOM one person and allow others to have flashing signs. On December 5. 1956, the'Flanning Commission denied the request by Resolution No. 447, On December 10,, 1956, the applicants appealed to the City Council. On January 14, 1957, the City Council held public hearing. The hearing was continued until January'28th and the matter was under advisement pending receipt of Planning Commilssion's-repbrt"on Precise Plan No. 100. On January 1619 19579 the Planning Commission r4ission reviewed the case and submitted informal report to the City Councii. Held over from the regular meeting of January 2F, 1957, pending the result of talks between Cityvs legal counsel and the - post office authortibs. Held over from the regular meeting of February 11, 1957 until this date. City Attorney: I haVe spoken to Mr.. Dechter of the Post Office Depart- ment, Mr. Dechter is in the department of Mr. Presley who has been iLL lut expected back tomarrowo Mr. Dechter checked on this matter in the absence of 1,1r. Presley and was: familiar with the matter. He stated this was only one of three sites that the post office had under consideration. It was said that it was the policy of their department to proceed in this manner, --acquire an option on a piece of property --advertise for bids to one who w ' ill acquire property and erect a suitable building --lease it fora term.of ten to twenty years, However, sometimes for one reason. other they outgrow the building, or the locality becomes less desirable 19 aryl they have to move so they try tp protect the sites available for another use. They feel that about the only use that could come in to such a building would be retail store, type of use. Mr. Dechter- Stated that they probably would not move into an area where such a uses was prohibited. He thinks that C-R Zoning would be rather restricted for their use and would prefer to be in 6 zone where retail establishments are permitted generally, rather than just a variance granted for a particular.building, It was indicated there are two other sites under consideration and he was not sure whether this site was even still under consideration. Councilman Kay: Was it expressed, for example, that if this particular site had C-2 and the rest C-R Zoning.it would affect their building here? City Attorney: . So far it has been Mr. Dechter's opinion which may or may not be official., Mrs. A. Jett of Danes Drive, West Covinag spoke as follows Why should other areas in Wost Covina get C-2 zoning when houses are all around them and here. :we are,, sitting'with',in empty field with no residences around it, with no'Dne objecting tb'our wanting this C-2 and we have*to,have C-R zoning 6n'this propefty. Braun, subdivider9 stated that the City, had been asked to participate in these improvements and had been unable to do so. "We have two bids on this work.for �89,1000 and the other for $919000. We are paying 4% for inspection fees amounti,nh to $4200. We ask -if some considera- tion might be given to this matter of fee amounts since ordinance calls for 4% on the entire deal and we feel that is quite a lot to pay for inspection fee. It might be possible tcconsider the flood control as a separate item and Possibly make it 10 instead of 4 0. Councilman Crumleye Considering the improvements on this property perhaps the matter should be looked into and see if anything can be done about it . Mayor Browne The matter could be looked into and I would instruct the 'City Manager and the City Attorney to do so, but we would have to be sure that we were in no way establishing a precedent. However, we know that this area was a vital part of our Master Plan of Park and Recreation and I feel that some consideratiori'could be -given to the possibility of procuring this property to salvage some of -our park -program. I believe this perhaps should be held over. Mr. Garvey-, Attorney and Representative for the applicant stated that the intention to consult on this matter !qas appreciated, and. that they were open to such consultation but would like the .record to show that they did not consent to this matter being held over. The City Manager stated that the survey on this matter is now being completed, with most of. the questionnaires returned, and that this, matter will be completed for report by the time of the next .regular. meeting of the Council. 0 REVISION OF RECREATION A meeting of County officials,, City Managers and AID TO CITIES other administrative officers was held last Wednesday morning. In view of the nature of our particular district no facts were revealed which were enlighten- ing t'o use This whole arrangement grew out of, contracts -with city school districts and the County, but oui district involves actually three school districts and two cities. We have asked for a special meeting on our particular casse and. that will be arranged in the near future. m14_ C.C. 2-25-57 Page fifteen The Council suggested the investigation into the possibility of control.li.-ng thie installation of private sewage facilities on residential developments. We have given members of the Council a summary of the thoughts of the Engit.eer• ing and ruilding Departments in this matter and find that certain phases of the Uniform Plumb Code that we can use but these particular supplemental requirements are based on the findings of the State and County Health Departments. If you are in accord with the thinking we can prepare a resolution that would control issuance of btl:ilding permits where these particular conditions are not met and it would save owners and subdividers the problem of installing seweage facilities -u-hat cannot be used. This is in the way of a progress report that this can be done. • Motion: by Councilman Mottinger, 'seconded by Councilman Kay and car°ried that the City Mana er and the City attorney be instructed to proceed on the necessary resolution or ordinance in regard to Cesspools to give our citizens the necessary protection on sewage problems. In the matter of employing additional police officers -as set .forth within the budget requirements we'are.faced with the policy of training these new recruits who, in most cases, have had no previous police experience. While this is an administrative matter and-we'have made arrangements with the She:riff's Training Center to place these men in -that Center beginning March 4 and cons• tinuing for eight weeks training for all phases of po=Lice work before being placed. on patrol, we would like to inform your Council and to have your opinion on this proposal, Councilman Crumley: Are there any other men on the Force who might might also be helped by this training? City Manager: There possibly are but it would be difficult to sort and take these men out that might need such training. However. many are attending classes at Mount San Antonio College for further training while still on full duty. Councilman Crumley: Perhaps some review could be made on each man to • indicate what training he has had so he could get additional. training if needed or refresher courses. City Manager: We are definitely going to do that and we have F.B.I. courses at certain intervals. The Los Angeles Police Academy .is having a short course for Police administra- tive matters and our Police Chief is going to attend that. It was general consensus that this matter was looked upon favorably. This matter was discussed at time of making up the_ budget with the possibil4_.ty of additional.,funds for an actuarial. study by the Statt o-f what it, might in- lTolve. However. because of the complexity of the State Retirement and Social Security as a combined program, we have parti=112r x�robl.ems,. I would recommend heartily going along with this request of the employees. It is something that sooner or later we must come to, With ,your approval we • can request the State to make such a study and it; would not involve great cost; it would give us an idea of the city"s and employees? share in this program in future ,years. I would recommend we proceed with such an actuarial study. The cost might be around two h.undred.or three hundred dollars.
