The Reverend Don Locher of the Methodist Church of West Covina gave the invocation. ROLL CALL Present: Mayor Brown, Councilmen Mottinger; Crumley, Kayo Pittenger • Absent-. On January 11t, 1957 the City Council held public hearing. Hearing was continued until January 2Rth and the matter was under advisement.pending receipt of the Planning Commission's report on Precise Plan No. 100. On January 16, 1957 the Planning Commission reviewed the case and submitted an informal report to the City Council. Held over from regular meeting of January 28, 1957.pending the • result of talks between our Legal Counsel and the Post Office authorities. Maps were presented by the City Engineer. Mr. Gerschler- Our new City Attorney was advised at a late date of the reference made in regard to legal counsel in this matter by the City Council. I believe he has not had.the opportunity to make a report'. I have nothing further to add from the Planning Commission's previous report. APPEAL WITHDRAWN On December 19, 1956 the Planning Commission denied this request by Resolution No. 453. On December 28, 1956 the applicant appealed to the City Council'from the decision of the Planning 'Commission. Set for hearing on this date by the Council at their regular meeting on January 14, 1957.. Mayor Brown stated that it was the understanding of the Council that this appeal • had been withdrawn, The City Clerk answered'in the affirmative. UNCLASSIFIED USE Mayor Brown stated that this was the time and place PERMIT NO. 17 for public hearing on Unclassified Use Permit No. 17. Maps were presented by the City Engineer. Mr. Gerschler presented and read • Resolution No. 457'of the Planning Commission recommending approval of this matter. The recommendations were read as follows° 1) That hours of use be restricted to 8.00 A.M. to 9200 P.M. daily. 2) That the area be totally enclosed with a minimum .5' 041 high chain link fence. 3) That no loudspakers or noise making devices be allowed. 4) That a competent attendat be place in charge of the facilities during all • hours of operation. 5) That a1.1 rides shall be installed, maintained and operated in a safe manner. 6) That no more than five (5) 'tKiddy Rides" be all owed, each of which are to be inspected and approved by the Chief Building Inspector., 7) That no mechanism, device or structure shall exceed a height of 201 Ott above the ground level. 8) That the groi:Lnd area within the facility be surfaced with 21, asphaltic pavement unless maintained in a clean dust -free condition. 9) That failure to comply with any or all of .these cond-itions.shall be the cause for revocation of this permit. -2- 0 0 C..C. 2-11-57 Page three Une� assified Use Permit No. 17 - Continued 10) That no food be prepared or served on the premises. There was no testimony presented for or against -this .matter,, and the hearing was declared closed. Councilman Pittenger: Are not these recommendations basically the same restrictions as placed on a similar use on Glendora, Avenue?' Mr. Grerschler.- Yes, they are. However*, this allows five rides the other request had four, but the other applicant requested only four. Councilman Pittenger- What is the experience encountered regarding a dust repellent versus black -top?. Mr. Gerschler: It has been found that some surfacing, such as decom- posed granite, is moresatisfactory then black -top, particularly in areas where children may be involved in a fall. Councilman Mottinger: I think that in view of the fact that a similar request • has been granted in a C-2 area and the restrictions 0 .9 suggested are basically the same, I believe it might be in order to grant this permit. Councilman Kay. I believe the first application was in a C­3 Area.. However, I would like to ask if there is anything here in regard to the, length of time thi$. use would be there. Mr. Gerschler: Yes,,,a statement was made which was not in the reSDlUL Lion, that this was a temporary placement in that it will from this particular site to one of the other empty lots.within the development when this lot is built ofi. This site was primarily for use during the opening of the stores in the area. Motion by Councilman Kay., ~econded by Councilman Mottinger and carried that Unclassified Use Permit No. 17 be approved, subject to the conditions recommended by the Planning Commission. ZONE- CHANGE NO-. 93 Mayor Brown stated that this -was the time and place Herman Rosen & C. Sid Dybee for public hearing on Zone Change No. 93. (In conjunction with Location- Southeast corner of Azusa and BadillD Tentative Map No. 23537) Avenues. Request: R--P and R«3 Uses. Existing APPROVED Zone:. R-1 Recommended for apprO-Tal by the Planning Commission for R­3 uses only at their meeting of January 2, 1957, Resolution No. 459. Mr. Gerschler presented and read Resolution ' Noa 459 of the Planning Commission recommending approval of Zone Change No. 93. All those wishing to present testimony,on this matter were sworn in by the City Clerk. Mayor Brown: I wish -to remind those presenting testimony that the Council. is now workinr,, under Ordinance No. 502 which is sworn. • testimony that all the facts presented be true or else are. punisha'ble under the. penal code, and allowing a ti.rTp- allo tment' of 'tHree.. minutes for presentation of Testimony by each of those wishing to do So. Mr. L. Cummings of 18336 E. Rowland Avenue,.Covina,, sPoke in favor as follows: Our Tentative Map and that five acre subdivision is the property of Mr. Bybee, the balance of the corner belongs to Mr. Rosen. There are several owners on the J.,zUSa Avenue frontage, but the five acres is a separate parcel. I think Mr. Gerscliler has corered so many points about traffic on streets, high school site and R-P zoning in West Covina adjoining this property that I do not think it is necessary to take your time on those matters. • The important thing is there were three residential. subdhviSiOnS on Azusa Avenue subdivided in,1946 1949 and 1953--three to ten years - ago. There are sixteen lots on Azusa, five of which stand vacant as of today. In addition to these vacant lots, there are seven key lots Qts unimproved. This, I feel, shows that Azusa is not g interesting to sin L, _,le family residential builders. The other point is the fact that all types of people do not require single family 1 dwellings.. Many like apartments. 'These -apartments, if properly done on large lots with plenty of free space and air space around them, make. ideal homes for a certain class of peDple-'such as people whose families are grown and they do not need a large home site, school teachers, both single and married, who have not the time to take care of yards. • Judge Miller called me and said 'to be sure and reserve him one of the apartments here if they are going to be built', showing the type of person who will be interested in an apartment location like this. Mr. G. McKeon of 17321 E. Grove 'Center Avenue, Covina stated as follows: Is'this for t . he back section only or the entire corner section of Azusa . and Badills? Mr. Cummings.- 'It is the full .ten acre parcel. • Mr. McKeon- Initially we had wondered whether this was only for the back section as R-3 leaving -the corner section for some other use. However, on behalf of the Badillo Square Property Owners Association this has been a key corner of combat for all there yea.rs.. We do want to see the best develop- ment on the corner. We want to keep this whole area near Badillo Square including the corner in question, as residential area. -4- C.C. 2-11-57 Page five Zone Change No. 93 - Continued Mr. McKeon Continued: I am on the southwest corner and there were 30 homes built in that section and in seven years only two have vacated. It has a high percentage of permanent residents and is suitable for real good residences. 1 think there are ten acres involved and this only mentions five and I Would recommend you check on the matter. I think the whole area should be Toned in total in relatio ns-hip to the entire area rather than 'piece -meal' to alleviate any possibility"Of Commercial zoning on the remainder. • A resident of 117 No. Elspeth Way, Covina stated as follows: This could be developed in such a way that the remainder of the property could go commercial. Supposing the developer wants to set this development back far enough So that the property remaining would be good. for no otheruseexcept,for commercial? Wouldn't you want to protect yourself from this being developed just to a point where it would leave nothing but comme , rcial development for the remainder? That is what we are thinking of now and I -think that such a possibility should be forestalled. Mr. D. Leggett of 205 No.'ElsDetih 1,Tay, Covina stated as follows: • Before beginning the testimony I would like to start with the comment that all of us in this particular !hot spot° area have a great deal of confidence and respect for the opihions"of Mr. Cerschler, your Planning ConsifLt;,ant and we do feel that lie has probably made some technical comments that are worth considering and the technical viewpoint lends itself to t?p reality. However, as residents we feel we do have intimate knowled7e of our area and we presented a petition of some 200 sio-natures in opposition to this. These signatures included people from West Covina, Covina and in the County --east, west, north and south. The people in the area do have a great deal of interest in the neighborhood and are interested in the correct and careful development of the neighborhood. In looking into the history of zoning here the County originally zoned the land RA-'7000 and pointed out in testimony that it was being zoned to give buffering protection to nearby r ' esidences--and thatthe100 foot highways were on the drawing board and were going to be put in. We have tried to let along with that iand when the school was coming in we cooperated with them --met tith the schools board., and it is going 'to be a beautiful school. I would suggest that the portion of the Property that is subdivided have two (2) streets in there going east and west and that portion could support about 20 lots in the rear part and that you use other types of zoning along Azusa --not commercial that is given to other nearby property --thus avoiding heavier traffic and 'strip zoning'. • We are very concerned that on Azusa the R-1 remain -on that part shown as the subdivision and we feel it can be done with R-1 and 20 lots for this development. C.C. 2-11-57 Page six • Zone Change No. 93 Continued Mr. Cummings had nothing further to state in rebuttal. There being no further testimony, the raring was declared closed. Councilman MDttinger: It seems to me that -the type of zoning requested here lends itself to good protection to the people to the south and that it makes a buffer zone of R-3 for the entire width of the property, with R-P to the north against Badillo Street. There has been considerable discussion in regard to this property for ICI zoning which would be objectionable to the home owners. However, in this case it seems they are getting reasonable protection and it should not be objectionable. Councilman Kay., I would point out to the people raising., objections in regard to commercial that we had commercial, zoning previously asked for and denied. At this time, as we have the opportunity to firm up this area and develop it in a reasonabld manner, I feel that with the surrounding uses already granted we should go ah6ad with the Planning Commissions recommendations. Councilman Pittenger.- I would concur with Councilman Kay. This is the best thing that has been offered to us and it gives us some buffer next totheschool. I think it could be developed • very nicely and I would be in favor of accepting the Planning Commissions recom- mendations.. Mr. Leggett- Taking the easterly half of the property from which the tentative map is shown you. CDljld,-u,.se about 110 or 1201 lots, put in two east -west streets and get la -.Ls on that easterly half. The west half could 'be set up for regular type buffer ",Dning as used on property south of there. That Would be consistent with surrounding properties. Councilman Kay: The Planning Commission -proposed R-3 on the whole zoning rather than"A-P on the corner and R-3 is slightly more restrictive than R-P. • Councilman Crumley- 'This has been discussed for quite a long time. It was .,primarily ICI uses which this Council. did not approve. I.think Mr. Cummings has come up with an.exce.1len,t plan and I cannot think of any possible better use than R­3 here, being so cl6se.to two 100 foot highways. Mr. Leggett: I suggest that if the property here is to be zoned all R-3 that a tentative map be submitted for the whole pi6ce of - property because actually it has 'been a p.rtnership that has owned this piece of property and they have gone in together on other types of zoning. I'fe'el it is a bad thing to split up this piece of property and have it possibly lend itself to other types of future developments. I suggest a • tentative map be submittedforthe whole piece of property rather than have a vacant lot set for years, and years waiting for commercial zoning. Mr. Slater Mr. Rosen, Mr. Bybee and another gentleman., who I do not know, should all come in together for zoning the -whole piece of property and for.developing it as a unit. APPROVED The recommendations of the City Engineer and Planning Commission were read as follows: 1) That all street improvements outlined in Section 49 of Ordinance 225, includ® ing utilities, be installed accordingly and meettheapproval of the City Engineer, 1his-to include Sanitary Sewers. 2) Provide storm drains and easements where required, satisfactory to the City Engineer. 3) Dedicate vehicular access rights along Badillo Street to lots 1 through 4. 4) That the map conform to proposed R.O.W. of.Lhe State Division of Highways. 5) That the easterly portion of the map be reduced to twelve (12) approximately equal sized lots. Mayor Browns r would like to point out in regard to the suggestion made for 120 foot lots --this would not meet too well with our subdivision ordinance and would gi�re'sub­par lots, detracting from tracts in West Covina and would look a lot worse than R-3 heree Mr. Gerschler: The recommendation.of the Planning Commission was that the easterly portion of the map be reduced to twelve (12) approximately equal size lots. Motion by Councilman Mottinger, seconded by Councilman Crumley and carried that Tentative Map of Tract No. 23537 be approved, subject to the recommendations of the City Engineer and Planning Commission. AZUSA AVENUE The City Clerk stated -these petitions contained almost 175 signatures of persons in favor of this request. The City Manager stated that the City had been aware of this problem and had been cooperating with the school authorities in the matter of providing sidewalks on the south side of the bridge on the west side of Azusa Avenue. They are not connected with the parkway and the school will make the connection.- The City proposed to make this connection on the northerly side of the bridge as part of the street. It was further-stated-that'there had been discussions held with various City departments, as well as Mr. Eastman of the West Covina School District, and that work is ready to proceed. Mr. Bloom, representing; those people petitioning in this matter, stated that he had the assurance that the necessary action would be taken and further mentioned the area between Azusa and Lark Ellen Street. Stuart Avenue, a 60 foot street from curb to curb with two, 40 foot streets running into it, at Azusa Avenue. It was desired this intersection be given the same Island treatment as the intersection of Lark Ellen and Stuart Street.and the matter be referred to the Police Department for coordination of work with the Street Department to have work done here also to insure the safety of children going to school. COUNCIL COMMITTEES, REPORTS Councilman Mottinger: The 'Pony League Baseball Associationt came before the Parks and Recreation Commission requesting permission to play baseball at the future Orange -Merced Park site. Now that we have made arrangements to procure this site --I believe it would be in order to grant permission for them to build a ball diamond so long as it is approved by the Park Commission and in conformance with.the tenative City Park Plan. • Motion by Councilman Mottinger, seconded by -Councilman Kay and carried that permis- sion be granted to use the park site in conformance with Parks &'Recreation Com- mission recommendations (to Council) and in conformance to the Plot Plan of the Park. Councilman Mottinger Tole are having the problem of getting water into Comida, Park. The line crosses private property and the Parks and Recreation Commission would like - to obtain authori- zation from the Council to get the necessary agreements underway to bring water into this area.. • Motion by Councilman Mottinger,seconded by Councilman Crumley and carried that Mr. Gerschler be instructed to proceed with the negotiations of the necessary agreements to carry this plan through. Councilman Pittenger.° Where did we leave this tackle football mAtter? I think we should consider some stipulations in regard to this program. It is'not under the playground and director program at all. Mayor Brown: Neither are the baseball leagues. -13- • CX. 2­11-57 Page fourteen Councilman Pittenger: That is true but I believe the baseball leagues are covered by proper insurance. Councilman Mottingerm I believe this matter is going to come up in the recrea.__ ation program very shortly. Mayor Brown: I think it might be well to have the insurance policies on -the various baseball leagues posted with the City also. Councilman Kay: I have noticed several things happening on the Planning Commission and Council regarding information we are given. We have the Agenda on the Thursday prior to the meeting to be held but we see many matters only on the evening of.the meeting — such as Precise Plans and Subdivision Maps. It would possibly be of great benefit to members of the Council, particularly in matters of public hearings, if copies of Precise Plans were furnished us to study the technicalities prior to meetings, rather than have so many hearings held over because of only on -sight inspection at the meeting itself. This also might help us to expedite these matters along more rapidly. • Councilman Mottinger: I agree with Councilman Kay and if possible, furnish other information that could be available to us ahead of time. City Manager: We are working on,such an idea of Agenda Closing and I think we are coming up with an answer to this parti- cular question. We work many times under an extremely tight schedule in regard to Agenda items and we believe definite scheduling rules should be established for everyone concerned.. There.is the possibility of a brief report _form on each item, possible summary of facts and perhaps, if the Council so wishes, a -map on the,items requiring them. These things might be coordinated • on colored paper so that the Council members will imediately know it is an Agenda item. Mayor Prown< Perhaps the Council could have a brief summary prior to the hearings on March 11. I believe the thinking of various persons inwriting might aid our outlook on them. City Manager: It might be rather difficult as we would not know just exactly what things you might question. Mayor Brown: I think such particular cases would be where the City spends some money. • Councilman Kay: I think -we should have facts and various thoughts on different matters before us. If they have been before the Planning Commission they are already public property. -14- • C.C. 2-11-57 Page fifteen Councilman Kayg I have discussed with the Planning Commission the possibility of obtaining typical traffic counts on most of the streets of any importance in the City. Many considerations are given regarding zoning .requests with opposition'to zoning because of traffic. If we established a background data,'up®to-dates of traffic on many of our streets it might help in rendering a decision. City Manager: We have an allocation of funds but in trying to get someone to run these things you are in difficulty. It takes a traffic man to coordinate these things, and a larger personnel to make this type information of any use. Possibly something could be • done on a quarterly basis. The matter of the possibility'of a 'no solicitors' ordinance was discussed and it was cDnsensus this might be a matter which should be further studied. The City Attorney stated that The League of California Cities now has a brief out on this subject at the present time.on-w]7'4t is called the Green River Ordinance which deals with business solicitation, and. if members of the Council could obtain copies it would give some idea of how far such a matter may go. The City Clerk will obtain copies of this brief for the Council members. • REPORTS - CITY MANAGER TRACT NODS 18205 and 18575 Location: Michelle Street between Azusa Avenue and Hollenbeck Street. Request City participation in the installation of Sanitary Sewers. Sanitation Engineer presented report to the Council at their regular meeting on January 14, 1957. Matter referred to the City Manager for full report and recommendation. City Manager: . This matter was referred to me..and I have gone ahead with ,the investigation of this matter. The Council has been kept advised of the additional facts obtained and are aware of the possible improvement within the very near future. • We have been successful with the subdivider west of Azusa and south of Merced Avenue and it would be my recommendation this work be done concurrently on the basis that the contractor install sewers easterly of -Azusa and at the time of this installation the contractor west of Azusa Avenue will install his sewers - so there will be a sewer to drain to when this is completed. I would recommend the Cityparticipate in this because of the necessity and }health problem and appropriate the amount of $3100.00 for this particular project with teimbursement to'be made over a period of time. Held over from Council meeting of January 14.,'1957; held over from meeting of January 28th pending comparison report form City Manager regarding experience of other cities. City Manager -stated this request had been taken care of but that all the informa- tion had not, as yet, been received. COOPERATIVE STREET PROJECT Location: 1046 So. Meeker Street. • Curb and Gutter Installation The City Manager recommended that the amount of $320.00 be approved and appropriated for these improvements, as with other cooperative street projects. The 'contractor is still working in the area would do the installation. - Motion by Councilman Pittenger, seconded by Councilman Crumley that authorization be given for the appropriation of city funds in the amount of $320.00 for the city°s participation in the installation of 200 lineal feet of curb and gutter at the locution stated. We feel it would be of tractor for Cityvs greater benefit to the property owners and that work in weed abatement more could be'accomplished if the City did this APPROVED work itself rather than letting to a contrar-tor. We had the item of a small tractor in our budget, but we feel that more can be accomplished if the size of this particular equip- ment is increased. The cost of a larger piece of equipment would be $1500.00 • over and above the $3500.00 allotted in the budget. This amount would be recovered by the billing to the respective.properties for the work done'and we feel this equipment would serve many other purposes of work in the City. It would appear the City of West Covina's share is going to be reduced from $13,600.00 to about .%5,700.00 but just how it will actually affect us we do not know because the formula is a very complex. one. We have requested the (County) Park Department. to explain it to us so that we do know. We may be cut in dollar value, but all we are concerned with is if we are going to ha.-e the same kind of program, this we do not know. A meeting is to be held on February 20th in Los Angeles at the County Offices on this particular subject. YOUTH ACTIVITY DAY Motion by Councilman Mottinger, seconded by Councilman APPROVED Pittenger and carried that the plan submitted by the City Employees Association for a Youth Activity Day'be supported. OFFICIAL CITY HOLIDAY Motion by Councilman Kay., seconded by Councilman February 22, 1957 Pittenger and carried that February 22, 1957 be declared APPROVED as an official city, holiday. The City Clerk presented and read a communication from George E. Brown, Jr. a Councilman of the City of Monterey Park in regard to Los Angeles County establish- ing a refuse disposal site in the City of Monterey Park which stated the points to which his objection was confined in regard to this matter. The City Attorney stated that this communication raised points in which no other city should be involved, that is, the merit of t4h;is- partibtftar dump, which is of no concern to the City of West Covina.
