SCHEDULED MATTERS A. RECEIVE BIDS PROJECT C-45 Location: Cameron Avenue from Lark Ellen Pvenue to 100 feet east of Fernwood Street and a section of Lark Ellen Avenue from Cameron Avenue to Larkwood Street. Street improvements ® Excavation, removal of existing pavement, 211 Plant mixed surfacing on untreated surface - 811 cross gutter. 'This review is required when the lowest bid is in excess of the -estimate and budgeted gas tax funds. The low bid for this project is approximately 14% above the budgeted -as tax funds and 9 t_1 approved estimates. WRITTEN COMMUNICATIONS PROPOSED ANNEXATION NO. 2 The City Clerk:presented and read a communication to COUNTY SANITATION DISTRICT from the County Sanitation District of Los Angeles NO. 22 OF L OS ANGELES COUNTY County, dated November 9. 1956, which stated, in (Mullender Avenue Annex) part that petitions had been received from owners of property in the vicinity of Mullender and Walnut !Avenues to annex approximately 19 acres to the County Sanitation District No. 22 of Los Angeles County under the provisions of County Sanitation District A.ct, as amenaed. Motion passed on roll call as follows: Ayes: Counclmen Mottinger, Crumley, Pittenger, Kay Noes: None Absent: Mayor Brown ZONE VARIANCE The City Clerk presented and read a communication 7^;,Test Covina Little Learzue from the West Covina Little League, dated November REFERRED TO PARKS & RECREATION 14, 1956, requesting cooperation in obtaining a 00'=SION AND PLANNING COia1ISSION Zone Variance for the property owned by the Valencia Water Company for use as a playground. Location: South of Garvey Avenue, east of Citrus Street, Councilman Kay: In regard to this matter I believe some discussion has gone forward on this but is it at the proper stage to be presented to the Council, Mr.. Petrie? Mr. Petrie: At the last discussion I had with the representatives of the Little League it was indicated that the Council would parti- cipate with them and assist in whatever way they could do so. However, I understand that the Valencia Heights grater Company has reached no decision so far as the Board action is concerned but there still seems to be some interest in working with the City in this matter. It was our understanding that the Board would take this under consideration at their next regular Meeting and advise us of their official action. -2- • • C.C. 11-26-56 Page three Zone Variance for Little League - Continued Mr. Petrie - Continued: In keeping with the Council's indication here a t-,reek or so ago with the members ,of the Little League perhaps this matter should be referred to the Planning Commission and 'be held over until this matter comes to a decision. Mr. Gerschler: An application presented by parties of the Little LeaFua Groups would reserve the operation in the hands of the Little League group and would not place the responsibility - upon the City. It would be my suggestion to the Council that the same plan as we use in schools be used here -- waiving the planning fees, and entertain a variance submitted by the Little League group. Councilman Mottinger: I believe this might be -referred to the Parks and Recreation Commission and the Planning Commission for their action and I think it is certainly in order that fees be waived for this application for variance. Motion by Councilman Mottinner, seconded by Councilman Crumley and carried that this matter be referred to the Parks and Recreation Commission and Planning CAmmissiOn. Glendora Avenue The City Clerk stated that there were five new applicants in this list, Larry Cude, Alfred Gebhardt, Thomas Ashbaugh, Columbia Pest Control -and Garvin Associates who would be required to obtain a business license form the City of West Covina. Motion by Councilman Pittenger, seconded by Councilman Mottinner and carried that all the applications received to sell Christmas trees in the City of West Covina be approved subject to the followings 1) Conformance to the regulations of the Fire Department and Police Department. 2) Obtaining license from the City by the new applicants. 3) No trees to be placed on publicly owned property. -3- C.C. 11.-26-56 Page four LETTER FROM CITY OF City Manager: I had handed to me, at the beginning HERMUSA BEACH IN REGARD of this meeting a letter addressed to the City Councils TO POLLUTION OF SANTA of Los Angeles County from the City of Hermsoa Beach MONICA BAY in regard to a nuisance suit that has prevailed in connection with the polution of the waters of Santa Monica Bays They would like a resolution of approval of the Council in regard to their stated policy against pollution and contamination of natural resources. I feel that their request is sound but that such action may affect some intergovernmental relationships, therefore, I think it should be • given further study before any hasty or ill-conceived action might be taken. Motion by Councilman Crumley, seconded by Councilman Pittenger and carried that this matter be ,given further study and perusal by the City Manager and a full report be presented to the Council. III. CITY ATTORNEY A. RESOLUTIONS RESOLUTION NO. 1031 Location: Orange Avenue south of Fairgrove Avenue. ACCEPT BOND The City Attorney presented and read Resolution No. 1031 Sanitary Sewers accepting Seaboard Surety Company Bond No. 521369 LA Tract No. 21630 and in the amount of $27,500.00 for sanitary sewers in adjacent area. CITY CLERK The City Clerk presented and read the report of the Citrus Municipal Court for the month of October, 1956, with the city's share of Traffic Violations indicated in the amount of $75434.88. ANNEXATION REPORT The City Clerk stated that a communication had Portion of San Bernardino Road been received from the County of Los Angeles (Ramona Boulevard) Board of Supervisors, that annexation to the City of West Covina of a portion of unincorporated territory consisting solely of a portion of San Bernardino Road.had been completed. V. CITY TREASURER • The City Treasurer's report for the month of October, 1956, was accepted to be placed on file. VI. PUBLIC WORKS A. CITY ENGINEER 1. Subdivisions TENTATIVE MAP Location: Northeast corner of Merced and Walnut Avenues. Tract No. 23222 5.9 Acres - 24 Lots - Area District II. Approved by the Bodger & Sons Planning Commission September 5, 19569 Held over by the HELD OVER City Council pending the consideration of park site and report of Bodger & Sons regarding said proposed park site. Motion by Councilman Mottinger, seconded by Councilman Crumley and-4 carried that Tentative Map of Tract No. 232.22 be held over with the consent of .-.he subdivider, until next regular meeting.of Council on December 10, 1956. M C.C. 11-26-56 Page seven ACCEPT STREET IMPROSIEMENTS Upon the recommendation of the City Engineer, motion Tract No. 19236 by Councilman Crumley, seconded by Councilman Pittenger Frank Layton and carried that street improvements in Tract No. APPROVED 19236 be accepted and authorization be given for the release of Founders' Insurance Company bond in the amount of $6,500.00, subject to a deposit- in the amount of $70.00 for trees and sign not installed to date. ACCEPT STREET IMPROVMENTS Upon the recommendation of the City Engineer, motion. Tract No. 20692 by Councilman Mottinger, seconded by Councilman E.B.Snoddy Pittenger and carried that street improvements in APPROVED Tract Noe 20692 be accepted and authorization be given for the release of the balance remaining on deposit for street improvements in the amount of 33 53.01 2.. Richard Brown, in resurfacing portion Engineer for McDonald Bros., Tract No. 14068, we of Fairgrove Avenue submit the .following recommendations for City partici- REFERRED TO CITY MANAGER pation in the lowering and impveving of Fairgrove Avenue in West Covina: 1) The City will pay to the County of Los Angeles Road Department the sum of 765.60 for resurfacing 9570 square feet of paving on Fairgrove Avenue at a unit price of $0.08 per square foot. (T,,,e center line of said street is the City boundary.) 2) The subdivider will remove the existing pavement, as indicated on the plan and profiles of said tract. 3) The subdivider may stockpile the old pavement and use for base material. 4) The subdivider will grade Fairgrove Avenue and the transition on Sunset Avenue and be.,responsible for the pavement construction of the transition area, inasmuch as it is temporary construction only. 5) The subdivider vTill constuct the aggregate base within the City's construc- tion limits. If approved, funds for this work would be drawn from the General Fund. City Engineer: The subdivider who is in the County territory would. be willing to advance the funds that are necessary upon the condition he would be reimbursed at some later date. Councilman Mottinger- I think this problem comes up quite often as to whether we have money in the budget for this. -7- C.C. 11-26-56 Tract No. 14068 - Continued Page eight Mr. Petrie: This is not a budget item and it would have to be taken out of the unappropriated reserve. Councilman Mottinger: Apparently the developer is willing to go ahead if we tell him that some time we will pay him, but I think we are going to have to take time payment on it. Mr. Petrie: Perhaps on these matters we should have firm recommendation before it reaches the Council. City Engineer: The subdivider would like to be assured we would be willing to enter into this. It would probably be several months from now before we could do any actual construction, however, I think that some evidence of assurance that this is under consideration would be sufficient at this time. Motion by Councilman Crumley9 seconded by Councilman Mottinger and carried that this matter be referred to the City Manager for further study but that it is consensus that the Council looks with favor on this matter. CITY PARTICIPATION IN. Location: South Lark Ellen Avenue, between Vine INSTALL?'::TION OF STREET and Portner Avenues. PTPRO7EMENTS City Engineer: This report was requested as a result REFERRED TO CITY MANAGER of a petition from the property owners in this area. It is my recommendation that the City participate in this project at the cost of $2.bn per front foot to property owners with the City°s share in the amount of $900.00 to be drawn from General Funds and the time limit to be effective as soon as all deposits from the petitioners have been received.. Motion by Councilman Pittenger, seconded by Councilman Crumley and seconded that this matter be referred to the City Manager for further study and report as to the method of financing. PROJECT NO. C-39 Location: Vine Avenue from Bubbling Well Road east to • Walnut Avenue. (Presbyterian Church) Upon recommendation of the City Engineer, motion by Councilman Pittenger, seconded by Councilman Mottinger and carried that street improvements in Project No. C-39 be accepted and approved. PROPERTY %1NERS PETITION Location: East side of California Avenue., immediately FOR CURBS AND GUTTERS south of Blue Ash Road. City Participation City Engineer: The Engineering Department can see REFERRED TO CITY MANAGER no reason for not accepting deposits, if the Council wishes to authorize the city participation expense of approximately $450.00. It would be much the same procedure -as we used for the property owners on North Willow Avenue recently and it would mean approving the curb and gutter installation by private contract and and pavement construction work by city forces. These are the last-, three pieces of property on California Avenue.in this general location not tay..cg curbs and gutters. SANITATION 1. Reimbursement Agreements • REIMBURSEMENT AGREEMENT Location: Orange Avenue, south of Fairgrove Avenue. NO. 12 Motion by Councilman Pittenger, seconded by Councilman Tract No. 21639 Crumley and carried that Reimbursement Agreement No. 12 APPROVED be approved subject to the recommendations of the Sanitation Engineer. 2. Sewer Facilities TRACT NO. 21231 Location: Florence and Walnut Avenues. Request that HELD OVER the remaining portion of the cash deposit in the amount of d$7,850.00 be released. It was consensus that this matter of sewer facilities in Tract No. 21231 be held over, at the request of the Sanitation Engineer, until_ the next regular meeting of the Council. VII. CCMIZSSIC NS, COMMIT`PEES Ao PLANNING COMMISSION 1. Annexations WEST COVINA WESTERLY Location: North side of Elliott Avenue, between ANNEXATION DISTRICT NO. 151 Sunset and Puente Avenues. On November 13, 1956 the HELD OVER City Council referred the matter to the Planning Commission for review and report. . City Attorney: I believe this matter has been set for hearing on December 10, 1956, and I do not think any action is necessary tonight. This report should be held over until the public hearing. 2. Subdivisions TENTATIVE MAP Tentative Maps of Tract No. 16637 were presented by the Tract No. 16637 City Engineer. Location: North side of Rowland Avenue, L.R. Geiselman between Azusa Avenue and Leaf Avenue, 5 Lots - Area District APPROVED II. Approved by the Planning Commission at the meeting of November 21, 19560 C.C. 11-26- 56 Page ten Tentative Map Tract No. 16637 , Continued Recommendations were read by Mr. Gerschler as follows: 1) That all street improvements outlined in Section 49, of Ordinance No. 2259 including utilities, be installed accordingly and meet the approval of the City Engineer. This to include sanitary sewers, and the south curb and gutter on the north traffic lane. 2) That driveway turnarounds be provided for all lots. • Motion by Councilman Pittenger, seconded by Councilman Mottinger and carried that Tentative Map of Tract No. 16637 be approved subject to the recommendations of the Planning Commission and City Engineer, with the further stipulation that this be subject to sidewalk ordinance which may be in effect. VIII. REPORTS - CITY MANAGER STATE MAINTENANCE OF Under agreement with the State Highways Department, and FREE6TAY ELECTRIC in connection with the San Bernardino Freeway, we must INSTALLATIONS maintain certain electrical installations. We are not APPROVED equipped with personnel or equipment to do this type of work and we have tried to effect an agreement with the St to that they, for the present, see to the maintenance. Such maintenance for light g will cost �370.30 which they ask that we deposit with them. I believe this cost is very reasonable in regard to the amount of maintenance required, it would cost more at the present'time for the City to attempt such maintenance. Motion by Councilman Pittenger, seconded by Councilman Mottinger that the amount of $370.30 be deposited with the State Highways Department by the City of West Covina for the maintenance of electrical installations on the San Bernardino Freeway underpasses in the City of West Covina. We SYSTEM are now interested in placing Azusa Avenue south of the San Bernardino Freeway on the State fligh.,ray System and E believe that such an arrangement should be given the approval by all agencies concerned, However, this means the introduction in legislature of a Bill to again place this section of road on the State Highway System. This is more or less a progress report, we will keep you advised of developments. There is a meeting of the East San Gabriel Valley Plann.inf Commission on Thursday November 29, 1956, in the City of La Verne. _10® 0 C.C. 11-26-56 Page eleven Also on that same evening the Civil Defense and Disaster units throughout the area are to participate in activity not based on a Civil Defense problem but on some type of natural disaster which could take place in the area. LEAGUE, DIRECTORS MEETING Thursday, December 6, 1956, in Pasadena. INITIATING OF PROCEEDINGS FOR SPECIAL ELECTION IN FEBRUARY, 1957 Acquisition and improvement of Park and Recreation sites and Facilities. APPROVED Councilman Mottinger: At the last meeting we approved the Master Plan of Parks and Recreation Facilities and since that time much consideration b,3.s 'been given to the means of financing the recommendaL tions as presented by the Parks and Recreation Commission. On the basis of these considerations I would like to.make the following motion. Motion by Councilman Mottinger, seconded by Councilman Pittenger and carried that the C;ty Attorney be instructed to initiate the necessary proceedings providing for a special election in February, 1957, upon the proposition for a bond issue in the amount of $195009000.00 the proceeds of which are to be used for the acquisition and improvement of park and recreation sites and facilities in the City of West Covina pursuant to the Master Plan for such facilities heretofore adopted and approved. SCHOOL CROSSING GUARD The City Clerk presented and read a communication dated Cameron & Pima Streets November 21, 1956, per Mrs. Betty DeFreece and written REFERRED TO THE at the request of the Cameron School Parent-Teacher CHIEF OF POLICE Association Board and Mr. Norbert Fuelling, Principal of the Cameron School, that it is extremely important to Irve a school crossing guard stationed at the Crosswalk of Cameron and Pima Streets because of the speed of traffic on Cameron Avenue. It was stated that a. g,uard is warranted at least during the school hours of the kinder- garten through the fourth grade. Motion by Councilman Crumley, seconded by -Councilman Mottinger and carried that this matter be referred to the Chief of Police for recommendation as to traffic guards, and that the matter should be reported to the City Mangager for the Council. • SIGNATURE AUTHORIZATION Mr. Walters: It has come to my attention that no one OF THE MAYOR PRO TEN is authorized to sign demands in the absence of the Mayor IN ABSENCE OF MAYOR and it would be my recommendation that a Mayor Pro Tem APPROVED. be authorized, in the absence of the Mayor, to sign any and all demands.
