The meeting was called to order by Mayor Brown.at 8:05 P.M. in the nTest

James Pittenger, with a group of 4-H Club Members, led those present in the
Council. Chambers in the Pledge of. a.11egiance.
Councilman Mottinger gave the Invocation.

It was the City Engineerls .recommendation that since the low bid of Crowell
& Larson exceeds the,Division of HighiJays approved estimate, it will be necessary
to refer these bids to the Highway Department for review and report and action
• on .this matter should be r•<<ith.held until a recommendation based on the Highway
report can be made by the Enginee.ring Department.
Motion by Councilman Pittenger, seconded by Councilna.n Kn, and carried that
the matter of the bids on Project C-1GO be held over and referred back to the
Engineering Department for report.

It was the recommendation of the City Engineer that the low bid of -Crowell
8 Larson be accepted.
Motion by Councilman Motion€per, seconded by Councilman 1ri;.riLey and carried
the low bid of Crowell Qr La.rson in the amount of $4,-PO9.71 on Project C• 50
be accepted, and all other bids and bid bonds be returned to the unsuccessful
bidders.

Maps were presented by Mr. Gerschl.er, who presented and .read Resolution No. 432
of the Planning Commission recommending approval of Zane Change No. 90.
Remarks were .read as follows:
1) The subject property was indicated as potential. C-1 on the Zoning Map
adopted in 1947.
• 2) The area zoned Potential C-1 has a depth of 150 feet along the southerly
side of the previous R.O.W. of Garvey '.venue. ,
3) The acouisition of additional land by the State Division of Highways for
the construction of -the pan -Bernardino Freeway reduced the usable land
for private use to an approximate depth of 57 .feet.
it is the opinion, based on common development standards, that such a
strip of land would not be suitable for commercial developement. An
increase in depth through further zoning actions would have to extend into
a substantially developed residential area. Such an extension Would be
difficult to justify at the present time. It is our further opinion that
through the application of a Precise Plan for the subject area, it may be
best suited for. R-3 Multiple Family Uses.

Mayor Brown: Some of the discussion by Council on this Precise Plar,
No. 100 does not go along -with the thinking of „he
Planning Commission, or My& the thinking is the same

Precise Plan No. 100 - Continued
Mr. H. Erickson, Attorney, of 104 South Glendora i`.,venue stated as follows,
I am appearing with Mr. DtAmelio, attorney] and am representing some of the
various owners of this property as well as myself. 1 have appeared on behalf
of myself in the past and this is the first time I have appeared on the behalf
of other parties.
I am all for a civic center and a beautiful civic center. I am all for a
• financial center and would like to see a 20-story bvilding there sometime,
but that is a long time in the future and 1 do not feel that the owners of
the property should have to build the type of civic center in their area that
the City is going to build with public funds. There comes a point Ken the
City goes too far in what it can do to control an owner's property. There
comes a point when owners Rust rise up and decide they do not want any dictating
of what use of property should be, which appears what is going to happen in
this case if this ordinance goes through as now planned. I recognize He thing
before us is Precise Plan No. 100, but there appears to be no question from
all I have beard, read Phd seen here tonight that this is all C-R zoning,
and we do not want C-R Toning, we do not want Precise Plan No. 100.
The Precise Plan has certain objections. Even aftpr the Precise Plan is
attached you will have to come in with a Precise Plan ;gaih and R seems
unnecessary aid will further restrict and take time to develop. This plan
takes a great deal of land. It takes land for street widening, sidewalks,
landscaping, walkways, parkins" and 30 feet reserved in rear for a street.
I compute 85 feet of land taken already and on a 100 foot lot you could not
build a 7Feanut Stand' on the.pronprtv nr nrnyid- -orkKE. That is confisca-
tory in that it takes so much land that a person cannot develop the land, as
passed, on a 100 foot lot. There is 400 feet -here, but the land belongs to
the owner and is being taken away from him.

With a Afoot frontage you cannot build a building.
You are required, it appears to me, to buy another 50 a6.,t, orcier to L-e
• able to build a building and come in with a 1 to 4 ratio.
Getting away from the Precise Plan, because, we do not want Precise Flan No.
100, we want C-2 and nothing else, it is our position that o-aners have� C-2
zoninF and any action to change that by imposing this Precise Ran 100 is
illegal.
At least two of the oinners., as I have studied it, have come in with applicUions,
Kr. Jett came in with an application and plans that were disapproved by the
Planning 'Commission tecause of something that did not even exist. it is my
position that a City or a Planning Commission cannot disapprove a plan on a
basis that does not exist; namely C-R zoning, which had not been passed.

them. We c,!o not want this Precise Plan because we want; 0-2 zoning.
All that is necessary, u? der. the ordinance, where potential. 2 is, is to come
in with proper plans and if they are proper they should have 02 zoning. THE
CG2 was passed and approved after public hearing two years sago. Since that time

"I am in opt)osition to this on my tr,,n, on account of the o=,ariership of a piece
of property on the north side of the San Bernardino Freeway running from Orange
Avenue to Lang Avenue with 286 feet frontage on the Freeway and 250 feet deep
north west, in the vicinit:v of this proposed civic center zone.
There was something said about 'buffers' and th-s freeway is a 'man size'
buffer and I do. not think it is logical to ego across such a wide freeway and
include property such as mine. It definitely would seem that is reacaino a little
too far to protect the City Civic Center. I am ready now to do something about
this property since the freeway has almost reached its completion but this puts
on further restrictions. I had firm C--1 zoning ;ranted in September, 1952 and
I feel I should not be included in this civic center zone."
The City Clerk presented and read a letter dated November 1, 195,6 from the Chamber
of Commerce of the City of West Covina, per Arnold F. Thorsen, President, which
stated that a motion by MT. Howard Erickson and a second by Mr. A. Jett formally
recorded the Chamber of Commerce as opposing :the C--R Zone Ordinance, being
Ordinance No. 496 as now approved, and opposing the application of this zoning
and other restrictions to the proposed Civic Center Area, being Precise Plan
No. 100.
There was no further• testimony presented, the hearing was declared closed.
Mr. Gerschler: I wish to point out that the purpose of Precise Plan 100
is to develop the physical development of the property
and not the permissible uses of zoninf3.
It would be to the best interests to continue with the same character of any
properties that may presently be started or partially developed, and so far as
the north side of the Freeway is concerned, the only condition that applies wou'Ld
be that signs woiild be regulated.

Councilman Crumleye Despite the fact that this Precise Flan is being tried in
the newspaper, I do not think we should dignify that by
talking about it here, but nevertheless there are some
things I believe should be clarified. We finally get down to the fact Uhat
after six meeting with the owners, where we.thought we had reached an agreement
all the way around, with their suggestions of architectural overlay and certain
other restrictions being taken into consideration, now we find we are back to
your wanting nothing but straight C-2 which means it is desirable from standpoint
of owners to develop C-2. 1,16 have a community duty to our citisen.s and an
economic duty toward the owners; Some place between is the proper place to take
in the development of this Land. Tn order +o .,,ossi.bly see if this place can
be. reached I would amain be willing to sit down with the owners to discuss it.
Councilman Mottin ger: I am in accord with the remarks made 'by Councilman Crumley.
I.n sitting on the committee we definitely left with the
impression that a meeting of minds had been reached.
However, as time progressed -there has been criticism of the.plan, although none
were presented through Council or through proper channel.. It has been tried
through -the Press instead of coming to us with the proper or direct approach.
This is the first criticism we have had presented to us, but we are anxious to
do what is right to properly develop this property. So far as the owners are
concerned we do.not wish to stop them but we also must have the interest of the
citizens in mind. I also would be willing to sit in discussion with owners if
anything; constructive could be gained out of it. We must develop this compatible
• with owners and citi7zen:s.
Councilman Kaye There is a lot of confusion and misunderstanding on the
part of the applicants and the group in opposition to
C-R and Precise Plan No. 1.00. I do not believe that the
mechanics involved are clear. I think some persons have tried to make 'hay" -
in the newspapers, some with actual misunderstanding and some intentional mis-
understanding. lie do not wish to stop development of this area but -to protect
the development going in here. Much of the ideas for control in this area were
initiated by those on opposition.
Mr. Shaw: I think you people are doing a good job to protect this
civic center but I understood that architectural overlay
was for the type of building. If you were to 'build modern,
we would build.modern and that was my idea regarding architectural overlay.

the.request of the Council that the City Manager look into this matter.

City Manager.- This matter is still progressing.today. We are at an
impasse? in trying to assist the school district either
to finance removal but the fact remains that this is not
the best time of the year to move Palm trees and they might be lost. Mr. Johnson,
the Director of Public �dprks, and myself thought that liTe might reduce the standard
roadway section to 140 feet at this point, to maintain the trees at tha east and '
West side of the street. Forty feet is not a standard section but by restrict"IM.g
or prohibiting parking on Lark Ellen Avenue and providing a service (drive east.
of this present parkway; it would help us maintain -these trees and provide
additional storage space for nirkinc' for high school events. ' GIe think it would
serve the area quite, well, at this location. If we could contact the school
district With respect to amending these plans, we would like to do this rather
than removing the trees and destroying them as it'is not food to replant them
at this time of the year.

stated as follows:

ing for cars during athletic events and durinT school hours and would also be
a. safety factor. We received a price on removaA of these trees but this is a

Mr. F. DeLay: As a point of information I Would like to state that abovit,
four years ago trees were taken out of Lark Ellen Avenue
because of a subdivision going in end required 80 foot
street width. Their was a deluge of petitions, containin17 some 700 names, to the
City Council against the trees being taken out.

I think that Mr. Delay's information should merit some
thought in this situation. I think we should save the
trees.
Mayor Brown-- I think we should do what we can to save the trees but

Councilman Crumley: I attended a meeting of the Police Chiefs of the
Last San Gabriel. Valley and found coordination
between the Police Chiefs in the area is highly
developed and has accomplished a great deal in passing back and forth information
regarding various types of criminal activity in the area. They also spoke of
various problems encountered, and methods used which have been a great deal of
help in apprehending criminals.
I would like to propose that we refer to the Planning Commission a request to
have 'them study our ordinances for C-2. C-3 and M zones9 in view that property
so zoned cannot 'be developed for Lesser purposes. I: think we should require
further control over zoning ordinances than we now have in them. We have a
good deal of CW 2 but have no assurance it will develt)p that, way and not into
C-1 or even C-3 into C-1. I think we should put snrrie controls on that sort of
thing and make zoning firm. If any do come in with something else, come in
with a Zone Change Application.

emergency we have first call on vehicular e-quipment. There is an arrangement
whereby the City could contract for use of this equipment under emergency
requirements.
