MINUTES
October 22, 1956
The meeting was called to order by Mayor Brown at 8;03 P.M. in the guest
Covina City Hall, with the Reverend Mickel giving the invocation.
Present: Mayor Brown, Councilmen Mottinger, Crumle,;r, Pittenger, Kay

MINUTES On Page 9 of the Minutes of October 8, 1956, under the heading
APPROVED 'Subdi.Yrisions', the motions of Council on Time Extensions for.
Tract No. 19768 and Tracl-, ;`:o. 22.630 were corrected to include

BIDS - Sanitary Sewers - Continued
Location: North side of Garvey Avenue,, between Toland and Maplewood Avenues.
The Sanitation Engineer stated that an affadavit of publication is in the
files and that on the lowest bid received. there was an error in extensions
which resulted in raising the bid price twenty-ti-,To cents ($.22) so that bid
amount shows $8,691.97.
The Sanitation Engineer stated that it was the recommendation of the Sanitation
Department that the sub -divider be instructed to award the contract -to the.
lowest responsible bidder, Robert A. Johnson Company, if he so desires, in the
amount of $89691.97.
• Motion by Councilman Pittenger, seconded by Councilman Kay and carried, that
authorization be --iven for the sub -divider to proceed with the award of contract
to the Robert A. Johnson Company in the amount of $8,691.97, if he so desires,
as recommended by the Sanitation Department.
B. PUSLIC HEARINGS
Southerly Annexation Mayor Brown stated that this was the time and place
No. 147 (Bodger) for public hearing on Southerly Annexation No. 147.
APPROVED Location: Northwest corner of Francisquito Avenue and
Walnut Avenue. Approximately 10 Acres. Recommended
for approval by the Planning Commission on August 15,
1956. Planning Commission Resolution No. 411G.
Maps were presented by the City Engineer, who stated that the following items
were contained in the annexation folder:
a) Petition for annexation
b) Statement accepting city's 1)nded indebtedness..
c) Letter from the County Boundary Commission certifying boundaries
d) Copy of Resolution No. 1009 giving notice of date of hearing
e) Affidavit of posting
f) Affidavit of contiguous territory by the City Engineer.
g) Affidavit of publishing in the West Covina Tribune and Pasadena Star
• News.
h) Affidavit of compliance from City Clerk.
Mr. Gerschler presented and read Resolution No. 414 of the Planning Commission
recommending approval of Southerly Annexation No. 147.
There was no testimony presented, the hearing was declared closed.
Motion by Councilman Kay, seconded by Councilman Pittenger and carried that
Southerly Annexation No. 147 be approved subject to the recommendations of
the City Engineer and Planning Commission and subject to the property owners
agreen:ant to annex to Sanitation District No. 22.

Discussion was held on this matter by members of the Council. It was consensus
that bond amount should be on the basis of the actual cost and not on the
basis of estimate and that since, in the past, a similar point had come up
and been held penidng until actual bid acceptance., it should also be done
in this matter.
The Sanitation Engineer stated that, the amount of the bid recommended to be
accepted in regard to .this tract i.Tculd include house connections where as
actual amount of $8,112.22 includes the street improvements with the sewers
and not the house -connections.
Tile City Manager stated that he felt there was a revision in procedure which
must be adopted in such matters, rather than approve acceptance with the
proviso that additional Bond or Deposit should be added.
Motion by Councilmen Mottinger, seconded by Councilman Crumley and carried
that the action on Resolution No. 1020 be held over pending "he action of the
sub -divider at which time the bond should be in the amount of the contract
and the bond in full amount of work done on public property.

City Manager: Mr. Bodger has met with me and Councilman Mottinger,
and agreed to review the type of Draft we are preparing
for consideration of City acquisition for this addition
to City Park System. The City Attorney has reviewed this Draft and it should
be back in our hands shortly, and when we do receive it we are again going to
meet with Mr. Lodger. However, Mr. Bodger did state that he would not want
this map tied up any great length of time because of these negotiations.
Councilman Mottinger: I believe that Mr. Bodger will be agreeable to selling
a portion of this property to us and I believe it
might be possible to hold. this Tentative Map over
a bit longer. I do not believe it would place a restriction on him.

.Councilman Kay: I believe we do have to pass this within a certain
time', and I do not think we can tie it up indefinitely.
City Attorney: I think that this map should be niven some consideration
and he (Mr. Bodger) can withhold action on the map.
However, I believe that a motion would be in order,
if you so desired, to hold this matter over by reason of the .fact that the owner
has stated his willingness to dispose of a portion of this property for a park
site and there is a pending proposed agreement between all parties. I
believe you might hold it over for three weeks.
Motion by Councilman Mottinger, seconded by Councilman Pittenger and carried,
that Tentative Map of Tract No, 23222 he held over due to the fact that there
is action pending on the City's procurement of a portion of this property for
a City Park Site.
ACCEPT STREET IMPROVEMENTS Upon recommendation by the City Engineer, motion
Tract No. 21431 by Councilman Kay, seconded br Councilman
APPROVED Mottinger and carried that street improvements
in Tract No. 21431 be accepted and authorization
be given for the release or Pacific Employers
Insurance Company Bond No. 01-B-50366 in the amount of $7,000.00, subject to
receipt of deposit of A200.00 for street trees and signs not installed to date.
• TIME EXTENSION - Upon recommendation of the City Engineer, motion
Tract No. 21913 by Councilman Mottinger, seconded by Council -
October 24, 1957 man Kay and carried, that the request for time
APPROTTED extension to October 24, 1957 on filing of
final map of Tract No. 21913 be approve4, subject
to the installation of sewers, if available, at
time of filing of final map and also subject to sidewalk policy in affect at
that time.

APPROVED 790 feet.
Upon recommendation of the City Engineer,
motion by Councilman Pittenger, seconded by
Councilman Kay and carried that street improvements in Project No. C-31 be
accepted and authorization be given for the release of. the Fidelity and Casualty
Company of New York Bond No. S-10402.90 in the amount of $4,754.14 covering
materials and labor and performance of` contract.
B. SANITA"TION

REIMBURSEMENT AGREEMENT Location: .Workman and Maplewood Avenues. Upon
NO. 18 recommendation of the. Sanitation Engineer,
Tract No. 20551 motion by Councilman Pittenger, seconded by

Agreement No. 18 be approved, and authorization
be given for the Mayor and the City Clerk to
execute said reimbursement agreement in the amount of $3,13P.77 or 38.75% of
total contract cost of mainline sewers, whichever is the lesser amount-.
2. Accept Sewer Facilities
TRACT NO. 21452 Location-. California Avenue and Michelle Street.
APPROVED Upon recommendation of the Sanitation Engineer,
motion by Councilman Crumley, seconded by Council-
man Pittenger and carried, that sewer facilities
in Tract No. 21452 be approved and authorization be' given for the release of
Pacific Employer's Insurance Company Bond No. 11-B-
50393. in the amount of
$19,500.00.

Maps.were presented by the City Engineer,
and Resolution No. 436 was read by Mr. Gerschler, recommending approval of
this Annexation by the Planning Commission, under Zone R-1, Area District I.
Motion by Councilman Kay, seconded by Councilman Pittenger and carried that
the City Attorney be instructed to bring in a Resolution setting the earliest
possible date for public hearing on Annexation District No. 150.

2. Zoning Matters
PRECISE PLAN NO. 93 (revised) Location: North side of Garvey Avenue between
and Conlon and Roberto Avenues. On June 20, 1956,
ZONE CHANGE NO. 83 Planning Commission recommended approval of
Frank and Frances De Pietro vC-1,v portion only and denied request for R-2
REQUEST FO`R R-2 DENIED R and R-3 portions. On August 15, 1956, Planning
R-3 PORTION REFERRED TO Commission recommended approval on Precise Plan
PLANNING C=SSION No. 93 (revised). On September 24, 1956, the
City Council referred case back to Planning
Commission for review of revised maps for R-2
and R-3 portions. Planning. Commission at their meeting of October 17, 1956"
reviewed this matter and reaffirmed denial of R-2 and R-3 portions only.
• Councilman,Kay:, I think that perhaps the R-2 zoning granted on
Harbert Street may be unrealistic. Maybe it
should be R-3' although I relieve the existing
zone of R-1 should remain as it is. However, I think that the heavier use
granted as R-2 is almost impractical and perhaps we should give that R-3
but leave the R-1 zoning alone.
Councilman Pittenger: I think we have been quite consistent in other
matters in granting R-3 next to commercial
zoning and then back to R-1 zoning.
Mr. Gerschler: The Planning Commission did review the idea
of making this R-3 but without any formal action
on i.t. It was thought that R-3 might be more
appropriate, but with restrictions -as to buildings being one-story in height.
Councilman Kay: It might be that we could deny the request for
that part to be R192 and approve the request for
that.part to be R-3, subject to approval of a
Precise Plan.on it.
Mr. Gerschler: I wish to point out that in procedure of.a
Precise Plan to restrict building height would
entail starting from the beginning, whereas a
Variance procedure could start at Planning Commission level and would permit
• regulation as to building height and any other possible recommendations.
Motion by Councilman Kay, seconded by Councilman Mottinger and carried that
application request for R-2 zoning on R-1 zone be denied, and application
may be made for ?one Variance on that portion requested for R-3 only, with the
Planning Commission to be instructed that it is the thinking of the City Council
that R-3 zoning be granted on that part of the application with the restriction
of single story buildings, plus any other recommendations the Commission feels
should apply.

COUNTY.RIDING AND HIKING TRAIL Mr. Gerschler: The County Park Department is
WALNUT CREEK WASH currently making up a budget in which they
wish to include financial means to build the
necessary undercrossings when the bridges are
constructed across Walnut Creek Wash, and would be in conjunction with the
County plan on this matter. In view of the fact that the Planning Commission
recently approved a Master Plan of Riding and Hiking Trails in the City,
along the Wash, they ask for the tentative approval. of this Council of the
County plan to enable them to insert such a request in their budget.
Motion by Councilman Mottinger, seconded by Councilman Pittenger and carried,
that the County Park Department be informed that the City ;ou.ncil of the City
of6,dest Covina .rives tentative approval of such a Master Plan to use Walnut
Creek ?dash as a Riding and Hiking Trail.
• REQUEST PERMISSION Mr. Gerschler presented and read a communication
TO CONSTRUCT MODEL requesting permission to construct model homes on
H011:'F Lots No. 19, 20, and 21 in Tentative Tract No. 22831
Horny Corporation located at the northwest corner of Service and California
APPROVED Avenues, prior to recordation of the final map.
It was -the recommendation of the Planning Department
that request be granted subject to receipt of an affidavit by the Horny Corpora-
tion guaranteeing the recordation of final. map in conformity with the ordinance
of tine City of T7est Covina and tentative map on file prior to the issuance of
occupancy permits by the Department of Health and Safety.
Motion by Councilman Crumley, seconded by Councilman Mottinger and carried that
request to construct model homes be approved subject to no occupancy permit
being issued until such time as all improvements required are installed.
CITIZ,,ENS SAFETY Councilman Crumley stated that he, with the Mayor and
ORGANIZATION the City Manager, had recently attended a meeting of
the National Safety Council and in view of certain
recommendations and matters that came up at this
meeting he felt t.iere might be some discussion that could be held in a study
meeting regarding the possiblility of forming a Citizens' Safety Organization
to which would be delegated certain responsibilities for traffic safety.. It
-yas his opinion that because of the tremendous growth of this area there is
a real safety problem and that such a matter is everyone's concern and that it
• should be a matter of interest to all citizens as well as the Police Department
and City Officials.
VIII. REPORTS - CITY MANAGER
AZUSA AVENUE II'!TROVE?Ti TT The City Manager stated that the California State
Highway Division had made recommendation for the
nest budget regarding; Azusa Avenue improvement, and
that. if this matter is carried through it w-)uld see early improvements of
Azusa ".venue north of the Freeway and that perhaps this City's labours on
behalf of this matter haire not been in vain.

AMBULANCE SERVICE City Manager.- This matter is concerned with the
extension of ambulance service contract on a month
to month basis pending re -negotiation. I believe
you should indicate that the termination order at the last meeting of the Council
be dropped and the old contract be renewed on a month to month basis with idea
in mind that the new contract will be in your hands in November;
Motion by Councilman Kay, seconded by Councilman Crumley and carried that the
recommendations of the City Manager regarding adoption of Ambulance Service
contract be accepted.
BUS SERVICE DISCUSSION Various complaints and matters pertaining to bus
service will be handled with the Traffic Department
of the Metropolitan Coach Lines and a report will
• possibly be forthcoming at the next regular meeting of the Council.
CONFERENCE Council was informed that this conference was
LEAGUE OF CALIFORNIA CITIES to start Monday, October 29, 1956.
CITY'S AN1��t1AL BIRTHDAY PARTY Mrs. Townsend has informed us that the city's
annual birthday party will be held at the
South Hills Country Club on February 8, 1957,
although the official birthdate is February 5. 1957.
POST AUDIT WORK The City Manager stated that.three proposals
had been received from auditing firms for
post auditing work, and were as follows:
Price ?,'aterhouse Company $3500.00 maximum per year
Peat, Marwick, Mitchell & Co. 2300.00 average per three years
Cotton & Francisco 1200.00 per year
It was stated by the City Manager that services could be arranged for three
year period but it was his opinion that if the Council desired this service
on annual basis there would be little or no change in price from .year to .year
and this would permit a change in case services did not prove adequate or
satisfactory.
Motion by Councilman Crumley, seconded by Councilman Kay and carried, that the
• bid of Cotton and Francisco be accepted in the amount of $1200.00 per year
for annual audit.

DRAWINGS FOR CITY HALL We are making preliminary arrangements for the
AND PUBLIC SAFETY BUILDINGS drafting of schematic drawings for the City Hall
and Public Safety Buildings.
C-D AND DISASTER PROGRAM We are working also on plans for Civil Defense
and disaster program which will. probably be
before the Council within the next three weeks.
This involves not only Civil Defense matters but earthquake and flood emergency.
UNDERPASS AT LARK ILLEN Mrs. M. Van Dame spoke in regard to the possibility
AVENUE of having an underpass at Lark Ellen Avenue, and
also at Hollenbeck, as people had contacted her
on these matters and the general idea.was, they
were not going to be adequate.
Mayor Brown stated that trips to Sacramento had been made to indicate there
were various phases in the construction of the freeway that the City felt were
not good, nor adequate, and the best the City could get at the time was to try
the present layout for awhile and to come back if it should not prove out.
Mayor Brown further stated that this was open on the State level for reconsidera-
tion at a la ter time if proved necessary.
CIVIL. -DEFENSE A spokesman, Bob Baer, for this organization stated
ORGANATION that it was their understanding that the resigna-
tion of Colonel Wether°by as Civil Defense Director
was now fully in effect and it had tieen hoped
there would be a new Director for this organization to keep it active and to
tie it to the City officially.
City Manager: We realize that Colonel Wetherby does not wish
to continue in this capacity and we had someone
recommended to us,, 'but at a salary which we could
not sustain. However, we did contact the City of Covina to see if they would
be willing to have a joint program in this regard, particularly since they
had no program set up, and so far there has been no word from them in regard
to this possiblility. We have, or are getting, almost all the necessary
equipment recommended by Colonel �niether°by and the only thing we need is a
replacement for the Colonel. If it should prove that we have to take it over
ourselves and work with the Civil -Defense we will, and pledge to that end.
Councilman Mottinger: Is there any possibility we could enter into
program with a Director on a temporary basis,
realizing that we could not continue without
assistance of a neighboring city?
City Manager: The gentleman recommended would want this as
a permanent job rather than a temporary one.
Also it is a demandingand exacting job and we
need someone to get in there and to keep at it.
Councilman Kay: I do not think that at the present time we are
in any position to act in regard to who would,
or might head this organization.

City Manager:
Perhaps in view of the contacts I have made with
the City of Covina this Council might wish to go
on record as requesting such a mutual program
with the City of Covina.
Mayor Brown:
Would it be possible to contact other adjacent
cities? I do not believe any of the adjacent
cities have any type of Civil Defense program and
it will certainly prove necessary to have.oneo
Councilman Mottinger:.
Might it be worthwhile to move the amount in
the budget of Civil Defense allocation to pay
a salary of a director?
Councilman Crumley:
This amount was for those things suggested for

need them.

I think we should explore the possibility of a

mutual program with Covina thoroughly. I do not
think that La Puente or Baldwin Park could be
concerned with these things

City Manager:
There was some discussion that perhaps the Mayors
of these two cities could further discuss this
matter. h do not wish to imply at all that there
has been no co-operation but
it is just that they are probably busy with their
own problems and it also might very well be they are working on this particular
matter at the present time.

APPROVE DEMANDS
Motion by Councilman Pittenger, seconded by
Councilman Crumley and carried, that the Demands
as listed in the amount of $114,134.23 be approved
subject to the Audit of the
Auditing Committee.
