Parking Requirement Study Mayor Brown: "In discussing this particular problem, Frank Bandy we find that a building permit had been issued prior to the change in our ordinance. Although we realize it is going to make a shortage of parking in that area Council would be satisfied of the requirements of professional uses only be placed in the upper story and development of area not exceed 5000 s ? uare feet." Mr. Bandy said these requirements would be met. Mr. G. McCormick of 311 So. Bandy Avenue stated., "If, by professional uses., you meandoctorts,offices in this bUilding.I,believe that someprovision,.should be made for:ptoper shielding -of building to.eliminate'.interferenc'e on television sets'.: Diathermic apparatus,, and other such types of machines, can completely black out four or five block area of television receiving sets. I, have also taken some records of parking in this area And find that'empty lot adjacent to • these building, which are not improved, have had as many as 7 or 8 cars parking on them for unlimited time. This parking problem also presents the possibility of patrons of this particular building using parking spaces. that are actually provided for people from other uses." Mayor Brownt If such conditions occur it would be possible that we will have to post a two hour parking time limit in the Area. In the matter of television interference I believe there are certain FCC require- ments that must be met in such matters, plus the fact that perhaps the applicant might see that everything is done to eliminate such possible electrical disturbance. Adj. ceC. 6-4-56 -2- Motion by Councilman Pittenger.. seconded by Councilman Kay and carried that authorization be given for the issuance of building permit for a. second story at 336-1 So. Glendora Avenue provided the second story area. to be developed shall not exceed 5000 square feet in area, shall be used for professional office uses only and not for retail sales and in the event there be any change in use additional parking must be provided in accordance with the existing ordinance, Mr. Sutherland questioned as to how this would affect his property which could also have a problem similar to this, although at the present time no such request has been forthcoming. It was consensus thatMr. Sutherland's case would be considered individually, • when and if presented to authorities, and that some equitable solution could possibly be worked out at that time. PERMITS TO SELL FIREWORKS The City Manager stated that the applications of Veterans of Foreign Wars these organizations for permission to sell fireworks American Legion had received the approval of the State Fire Marshall, APPROVED and our Cityrs Fire Department'. with the exception' of the location requested'at 3030 East Garvey Blvd., and -recommended this matter be approved by Council. Motion by Councilman Mottinger, seconded by Councilman Kay and carried that .authorization be given for the sale of fireworks by the Veterans of Foreign Wars and American Legion at designated locations, with the exception of location at 3030 East Garvey Blvd'.', and subject to State fire rules and regulations and any rules and regulations as set forth by City of West 'Covina Fire Department. RESOLUTION NO 961 City Attorney presented and read Resolution No. 961 OPENING FOR FUTURE STREET "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STREET AND HIGHVIAY PURPOSES WEST COVINA, CALIFORNIA. ACCEPTING AND DEDICATING Tract No. 12505 CERTAIN REAL PROPERTY TO THE CITY OF WEST CCVINA ADOPTED FOR STREET AND HIGHWAY PURPOSES." Parts of Lots 56 to 64 inclusive, to be known and denominated as service road and includedinand made.a part of Sunset Ave. Tract No. 12505. Berger) Location: NW corner of Merced and Sunset Avenues. Motion by Councilman Kay, seconded by Councilman Pittenger and carried that Grdi- hance No. 476 be given its first reading. REPORTS OF CITY MI=GER City Manager stated that copies of report by Civil CIVIL DEFENSE DIRECTOR Defense Director Col. Wetherby has been presented REPORT. to Council for their perusal .and any additional comments which they might like to add to those of Col. Wetherby. This report is in connection with evacuation plan in Los Angeles area in case of emergency and each community has been asked to make comments on such an interim plan. REPORTS OF CITY CLERK A short report was given by Mr. Flotten in regard to his attendance at the National Conference ,of -- --- Municipal Clerks in New Orleans. REPORTS OF COI,MTTEES Councilman Kay stated that the staff had submitted their report back to the committee members in regard to the Daniels property and he wished to suggest that a meeting of the committee members of the Council and Planning Commission be held Saturday morning June 9 and that Mr. Gerschler so notify committee members of the Planning Commission. Councilman Crumley stated that he and Councilman Mottinger will meet a week from Thursday, June 14, with Planning Commission, City Engineer and consultant to discuss zoning ordinance of C-R zoning.. Adj. c.c. 6-4-56 -5- Councilman Pittenger presented a short report on Mayors and Councilmen conference .held in Monterey conducted by officers of League of California Cities., ORCHID WEST COVINA City Manager presented and read a communication from Mrs. Murray Spencer of 1014 Pima stating that an Orchid had been officially registered with Royal'Orrchid Nurseries,,,'.St, Albans,, Hertfordshire, England"'and named "Cattleya West Covinatt after the City of West Covina through the efforts of her husband who is an amateur Orchid grower. 'It was consensus that a letter be drafted by the City Manager expressing the cityts thanks for such thoughtfulness. . ZONE CHANGE NO. 78 Motion by Councilman Pittenger, seconded by Council - TRACT MAP NG 21014 man Mottinger and carried that the action of this Tenmen Enterprise Council of April 23, 1956 be rescinded in regard to Action to Change Rescinded referring this Zone Change No. 78 and Tract Map No. 21014 back to the Planning Commission for recon- sideration to be changed back from Area District III to Area District IV and that this matter be permitted the zoning granted by former Council action ie; Area' District III. Councilman Pittenger stated that no action had been taken by the Planning Commission in this matter and that he,believed the people concerned in this matter were entitled to a decision. Mr. C. Hemler of 271 So. Bandy Avenue spoke in regard to alleviation of the nuisance of flashing advertising signs on commercial buildings on Glendora Avenue close to residences. City Attorney stated that if residents feel this is a nuisance they may file civil action to stop the nuisance, in which case they would need their own attorney, or if they thought it involved a nuisance from a criminal stand -point they have the right to go to the District Attorney to abate such nuisance. However, it ,was ,further.stated by the City Attorney, that if the sign, or:signs., conform .to .the local ordinance one would say the nuisance does not exist. On the.other hand if nuisance does exist then ordinance should be changed. Mr. Gerschler stated the sign owners have given some indication a shield would be used to deflect the light, but they have agreed to dim onnect flashing part. Mr. Hemler stated thatone sign was still using flasher. Councilman Mottinger stated that everything possible was being done to try to work this out amicably for both residents and owners.of signs, and it would very possibly succeed. Mr. B. Lowry question as to some type of restrictions placed on remainder of property Mr. Gerschler stated that an amendment to ordinance was under study and just such restrictions for other sections being worked on.
