COMMUNICATIONS of Appeal to the City Council and asking for hearing from
the decision of the Planning Commission on Precise Plan No. 86

and Zone Chance No. 77, Date for hearing on this matter was set by Council for
May 28, 1956.
Mayor Brown stated that further communications, as presented by the City Clerk,
regarding request for hearing and notice of appeal from applicants of Zone Change
No. 71, Precise Plan and Reclassification No. 74 and Precise Plan and Reclassi-
fication No. 75 need not be reads unless so desired, as members of Council had
copies of communications and this matter had already been set for hearing at
regular meeting of May 14, 1956.

Inc. of Van Nuys and that. authorization be given to the Mayor and City Clerk
to execute the contract.

at request of applicants because of changes to be made

Mr. Gerscl-Ller presented and read Resolutions No. 247 and No. 248 of the Planning
Commission reco.,11mending denial of this application. It was stated that public
hearings before Council had been held on , this matter but it would be reviewed at
this time for the benefit of new members of the Council.
Councilman Crumley: With 12 acres on the east already zoned commercial I
believe this is 'spot zoning.' I do not think this is
good zoning and I am not in favor of it.
Councilman Mottinger: I did not hear previous testimony presented on
this matter, but in vip.w of the 'Planning Commission
recommendation for denial I would go along with their decision.
Councilman Kay: I believe, in my opinion, the main consideration
is that we have houses existing on properties here
and many times we have encountered pro-lblems in such a situation as this. I do
not believe there is a desperate need for such a change at this time and I do
not think applicants request is a justified need at this time.
Councilman Pittenger: I would go along with the dicision of the Planning
Commission.
Mayor Brown: I agree with the views of the Council and would
go along with the decision of the Planning Commission
also.
Motion by Councilman Motting.'er, seconded by Councilman Kay and carried that the
recommendation of the Planning Commission be accepted and Precise Plan No. 78
be denied.

PUBLIC HEARING CONTINUED Mayor Brown stated that this is the time and place

and Change No. 70. Location: East side of Sunset
ZONE CHANGE NO. 70 Avenue, north of Roseway Street between Bruce and
Waldrip and Mautz Sunset Avenues. Request: Adoption of Official
DENIED Precise Plan and R-P. Existing Zone: R-A. Held
over from April. 23, 1956 to May 7, 1956 at request
of applicant because of -absence of their representative. Denied by Planning
Commission on March Pl. 1956.

Maps were presented by the City Engineer. Mr. Gerschler presented and read
Resolutions of the Planning Commission recommending denial. Recommendations of
City Engineer were previously read at meeting April 23, 1956. There was no
testimony presented, the hearing was declared closed.
Councilman Kay: On these lots No. 20 and 21 in Tract No. 19505, is that
going to be R-1 or is it being built at present time.
Mr. Gerschler: It exists on there at present time.
Councilman Mottinger: What would be non -conforming use?
Mro Gerschler: The rear northerly half of this property has an auto
repair garage which is conducted as a part time business.
We found that this came into existence quite a. few years prior to the zoning
ordinance; thereby it becomes a non -conforming use and has a remaining abatement
period of 23 years before they are forced to abate. The Planning Commission
mentioned that perhaps there would be other means of handling this under means
.now in process such as fire and safety laws.
Councilman Pittengert How near are residences to this property? What of
potential danger now?
Mr. Gerschler: Residences within 100 feet. I find that the degree
of danger, upon verbal communication with the Fire
Chief, is little or none to the surrounding properties at the present time.
Councilman Mottinger: What about the placement of the City Yard? Is that
something that is going to he permanent? Is that
compatible with the zoning? I ask this question as City should conform to proper
zoning too.
Councilman Kay: I believe we have in process at the present time
zoning regarding municiple buildings that are adding
to our zoning ordinance,
Mr. Gerschler: Whether the placement of the City Yard is permanent
• is a question not fully resolved. However, we have
prepared a Master Plan for the development of the City Yard and have shown
on this a substantial set -back and proper landscaping treatment and have gone
to some length to give compatable surroundings.
Councilman Kay: One factor is that this Tract No. 19505, and Tract
No. 19453 there, are both developed. I do not parti-
cularly recall whether Tract No. 2190P is developed or nots, but it has gone
R-1 and is directly across from the City Yard so I do not think that request
on basis that City Yard or school across the street is detrimental is based on
fact. To request variance or zone change in this case to R-P or R-3 when it is
apparent other property is being developed under R-1 leads me to believe that
a request of this type is not in order -at this time.

Councilman Crumley, It appears it is being all developed as R-1 and I believe
there is sufficient R-P elsewhere. On that basis it does
rot appear to me that there is good or sufficient reasons for R-P zoning here.

No. 77 and Zone Change No. 70 be denied.
TENTATIVE MAP Tentative Maps of Tract No. 18283 were presented by the City

Mr. Gerschler: I wish to bring to the attention of the Council that item
10 on the Agenda, Precise Plan and Reclassification No. R4
(1405), which has been set for hearing on May 28 is contiguous and dependent upon
this Tentative Map. The Planning Commission was satisfied that proper relationship
exists the two. However, you may wish to hold this map over pending hearing on
the Precise Plan and Reclassification.
City Attorney.- I see no objection to Council holding over the decision on
this Tentative Map until hearing of proposed Precise Plan
and Reclassification No. 84 (1405) on May R8.
Mr. Berger, Applicant., I would have no objection to this map being held over in
conjuction with hearin,r,, of Precise Plan and Reclassification.
It was consensus that Tentative Map of Tract No. 18283 be held over, with the consent
of the applicant, in conjunction with hearing to be held May ?8., 1956 on Precise
Plan and Reclassification No. 84 (1405).
REQUEST FOR CITY PARTICIPATION Petitions from home owners on Vine Avenue between
IN IMPROVEMENT PROGRAM Tract No. 21042 and Pima A-enue. Held over from
April 23 for City Engineerts report.
City Engineer: Under Metes and Pounds Subdivision No. 135-127 we
required Mr. Harold Barnes to furnish full street
• improvement on Vine Avenue across 165 foot frontage. Immediately the people in the
neighborhood adjacent asked if they could participate in project, by furnishing
cost of curb and gutters and so petitioned Council.
After we studied the situation we found certain facts existed which I have presented
to you in a report dated April 20, 1956 and the purpose for bringing, this before
the Council tonight is to secure your authorization to proceed with the project on
some sort of basis. We are making this suggestion to see what you (Council) think
of the proposal and desire to knm,,, whether or not we should prodeed further along
these lines.
Councilman Mottinger: Where do we stand if only lesser amount would want
this project done and remainder do not?

City Engineer: We will make a complete survey and if we can get 80 or 85 per
cent in accord with it we usually are justified to go ahead on
that basis.
Motion by Councilman Kay,, seconded by Councilman Crumley and carried that authoriza,-
tion be given to see if a satisfactory arrangement can be worked out with property
owners and City in this matter and present back to City Council.
City Manager: I believe this is by subscription and not under 1911 Act. In
event 15 per cent do not wish to enter into it who will share
it with other property owners? We have., under -1;his arrangement, no legal process
for making expenditure lien against the property.
Councilman Kay: Inthe past, sections were left out.
City Manager: I believe that is very impractical,, and think it should be made
plain that this action of Council indicates proceeding along
lines indicated with full report to be made to Council before any actual work authori-
zation takes place.
STREET LO�qERING Location: Yarnell Avenue and Meeker Avenue. Additional authori-

City Engineer: This tract is under construction and as indicated in report the
City did. agree to participate in the lowering of Yarnell Avenue.
We now find that our cul-de-sac street, Meeker Avenue, is so narrow that if we do
not rebuild that portion we cannot construct a safe surface. We recommend that we
participate in lowering the existing pavement on this street and further eliminate
the need of having to go in at a later date and lower the whole pavement.

authorization be given for City's participation in cost of lowering existing Meeker
Avenue pavement in connection with subdivision improvements in the amount of 59F6.00.

association wants to prove it can be of benefit to the community and suggests the
observing of a Youth Day program by vote of the people for an outstanding high
school student. They would establish a fund and ballot program to place the student
with the highest number of votes as Mayor, next highest as Councilmen and so on
through the entire city organization and then have these young people take over for
the day. The money from the voting process would be used for playground equipment
to be placed in the city parks.

Mr6 Kupferer I believe this program would be beneficial in many
ways and would be accepted with approval of Council in
back of it. Believe it would prove interesting to the ;young people and at.the same
time benefit children as they would gain playground equipment.
City Manager: The point I would like to make is that the Employee's
Association is not concerned with their problems alone.
Motion by Council Crumley, seconded by Councilman Mottinger and carried that the
City Council endorse this proposed activity to its fullest extent.
SPECIAL CENSUS REPORT City Manager stated that filing of official certificate
• of special census had been made in Washington, D.C. and
brings the census count to 35,986 with copies being sent to. proper State offices.
This would bring us in an additional revenue of $66,500 depending on amount of
monies to be distributed and refunded. There is approximately $39,000 'In Lieu Fund,
$26,000 State Gas Tax Fund and $5,500 in County Gas Tax Fund. "These figures are
not official but until such time as distribution is known I believe this is what
we can go by."
REMOVAL OR SALVAGE OF City Manager: "On site of civic center there is an
BUILDINGS ON CIVIC old home and accessory buildings. We feel these build -
CENTER SITE ings are valueless and should be removed to enhance the
APPROVED property. 'There is a safety problem in regard to
buildings. Two fires have been set. We have determined
through our departments that these buildings are valueless but would like to have
authorization forbids on removal or salvage of these buildings. If no bids are
received I believe we should destroy and remove them from the area."
Motion by Councilman Kay, seconded by Councilman Pittenger and carried that on the
recommendation of the City Manager authorization be given to advertise for bids
on the removal or salvage of buildings on Civic Center Site, and if no bids are
forthcoming (City) should destroy and remove them from the area.
ATTENDANCE City Clerk, Mr. Flotten, requested formal permission of the
NATIONAL CONFERENCE Council to attend a. National Conference of Municipal Clerks
MUNICIPAL CLERKS in New Orleans from May ,21 to 26, and further requested
• May 21-26, 1956 that if possible the City absorb the cost of attendance
Robert Flotten at conference. Mr. Flotten further stated that he was
willing to absorb the cost of actual traveling and would
use his va.ctaion period for travel time required.
Councilman Crumley: I believe a voucher could be kept in regard to mileage
there and back, and also include reasonable conference
cost.
City Manager; I believe that the suggestion of Councilman Crumley that
necessary and reasonable expenses be allowed is fair.: In
that Mr. Flotten is willing to use his vacation for the time required.there will
be enough gain from this meeting to warrent this. It should be left open and subject
to audit on return, of necessary and reasonable expenses.

It is our intention to have a resolution on the matter of policy regarding attendance
at matters of this sort.
Motion by Councilman Mottinger, seconded by Councilman Crumley that Mr. Flotten
be authorized to attend the conference of National Institue of Municipal Clerks
in New Cleans from May 21 to 26, and that necessary and reasonable expenses be
allowed subject to audit upon return from subject conference.

APPLICATION FOR ALCOHOL City Clerk presented and read application for lic�lor
BEVERAGE LICENSE license by Earle I. Magusin.at 204 So. Glendora Avenue.
Earle I. Magusin City Clerk stated that he had a number of complaints from
business people on Glendora Avenue against allowing another
liquor location in the area, and not sure how this protest should be approached.
City Attorney: If the City Council feels this might be objectionable they
can record their objections with the Board of Equaliza-
tion thro-gh the City Manager.
Motion by Councilman Crumley, seconded by Councilman Mottinger and carried that this
matter be investigated by the City Manager.
City Manager questioned as to -the fact that if necessary and possible under dates
shown on application and other conditions of permit should a protest be made and
a report given.
It was consensus that the matter be handled in this manner if deemed necessary
upon investigation by the City Manager.
PUBLIC TRANSPORTATION Mrs. M. VanDame of 1532_E. Garvey Blvd. brought to the
FARE RAISE attention of Council the matter of a State public hearing
on ..Thursday to hear those in protest or in favor of a
public .transportation fare raise. Mrs. VanDame further stated that this would
encompass public transportation facilities out here and in her experience there is
now no better bus transportation or more rapid schedules than there were ten years -
ago. It was her contention that a representative should be sent to protest raising
of fares unless the public transportation facilities are improved to give half-
hour schedules during peak hours at least.
Motion by Councilman Pittenger, seconded by Councilman Kay and carried that authori-
zation be given to have a representative attend this hearing.
There was no further business, the meeting was adjourned at 9:40 P.M.

"Section 1. On March 26, 1956, said City
Council adopted its Resolution No. 909 declaring
its intention to call a special annexation
election in certain uninhabited territory, as more
particularly described therein and therein designa-
ted and identified as "Northerly Annexation District
No. 138," and fixing a time and place for protest
by property owners. Said resolution gave notice
that on the 23rd day of April, 1956, at the hour
of 8:00 p.m. in the Council Chamber of the City
Hall of the City of West Covina, any person owning
real property so proposed to be annexed and having
any objection to the proposed annexation might
appear before said City Council and show cause
why such territory should not be annexed.
Section 2. Said City.Council hereby finds
that substantial protests were filed not later than
the hour set for hearing objections pursuant to said
notice. Said City Council further hereby finds that
it will not be in the best interests of said terri-
tory and the owners and residents therein or the
City of West Covina to proceed with said proposed
annexation.
Section 3. Said annexation proceedings are
hereby terminated, without the necessity of calling
said special election.
