Locher giving the invocation. Hohnson; Acting Director of Public Works. • MINUTES Minutes of December 5, 1955 were approved as corrected. Minutes of March 26, APPROVED 1956 and April 2, 1956 were approved as submitted. TIME EXTENSION City Clerk presented and reed a communication from Suburban OMAHA WATER COMPANY Water Systems, dated April 6, 1956 per C. H. Deitz, Secretary one Year which stated as follows. "We have purchased the property ( ) belonging to the Omaha Water Company, which is located at APPROVED North side of Service Avenue, East of Dawley and North side of Herring Avenue, West of Lark Ellen. The Escrow on this property will be closed April 12, 1956 Your letter of October 18, 1954, referring to Ordinance No. 342, 343 Section 1 - Conditions under which variance was granted, Item 3 - That all said requirements to be complied with and completed within eighteen (18) months of the effective date, of this ordinance. Inasmuch as we will be the owners of said mentioned property about the time the eighteen (18) months expires, we hereby,request an extension of from eight (8) months to one year in which to comply with the requirements as set forth in Zone Variance No. 113 and 114 _ Zone Variance No. 115 - Ordinance No. 344, covering another property was abandoned, so we would have no interest in securing an extension on this item." Motion by Councilman Kay, seconded by Councilman Sperline and carried that a time extension of one (1) year to.date of 4-12-57 be granted. •REPORT FROM CITY ENGINEER ON City Clerk presented and read report as follows: PETITION REQUEST FOR IMPROVEMENT "Improvement of Orange Avenue in a manner similar OF WATER DRAINAGE PROBLEM. to the way in which El Monte Ave. or Peck Road is ORANGE.AVENUE - BADILLO STREET now improved with a V section concrete pavement SOUTHERLY TO WORKMAN AVE. with concrete curbs and gutters 1811 wide. Estimated cost of such a project would approximate $80,000.00. This construction would confine the greater portion of the drainage water within the Orange Avenue pavement section. Such a project would later require the construction of storm drains and reconstruction of .the V shaped drainage streets in order.to"ma.ke the street improvements conform to our standard street sections. Such V shaped.dra.in- age streets have proved to be an unsatisfactory solution in other areas. Such"projects usually* result in large expenditures which probably could be better applied to the .initi`al construction of storm drains. C.C. 4. 9=56 -2- Report Cont'd. Partial relief could be provided on Orange Avenue by the construction of concrete curbs and gutters_, driveway openings and pavement in accordance with plans and profiles now available in our office. These plans contemplate the use of a flatcrown section in connection with improvements similar to those of our standard street specifications. We estimate cost of this project to approximate $50,000.00. The water carrying capa- city of this proposed improvement would be more than the street is now carrying, but less than 1/2 the capacity of the above mentioned V type section pavement. A third solution to the problem would be the construction of a 7,400 Lin. feet of 10 ft. diameter.conerete pipe storm drain in Badillo Avenue from Vincent Avenue to the Big Dalton Wash in accordance with'our Preliminary Master Plan of Collector Storm Drains t an estimated cost of $5030200.00.- This project is rightfully a regional or area roblem which should be paid for by the properties benefitted. By resolution to the County. Board of Supervisors., you have requested that they recommend the inclusion of the improvement of the San Dimas Flash in the Comprehensive Plan approved by the U.S. Congress or include same within the program of the Los Angeles County Flood Control District. To date, the Board of Supervisors have not answered your request. This project is only feasible after the U.S. Army Engineers have provided capacity for the water in the Big Dalton 'Bash and it is incumbent upon the City of West Covina and the other agencies to commit themselves to the c aapletion of this proposal. As you will recall, the Los Angeles County Counsel has ruled against the diversion of drainage waters from this area to the Big Dalton Wash. The County Counsel also implied that an injunction could be obtained against this diversion -if the occasion demanded. When the improvement of the'Big Dalton Wash is completed, the injunction situation can probably be elimintaed. A fourth solution to the problem would be the construction of 13,200 Lin. Ft. of storm drain from Vincent Avenue along Badillo Avenue and Orange A-renue'to the Walnut Creek Wash. The approximate cost of such a project would amount to $1,000,000,00. Such . a project could be initiated at this time at the expense of all benef itted properties by assessment district methods. Such an assessment district would require the approval of the majority of the owners of the benefitted property. We would estimate that the ,owners, -of such.,benefitted property.may.be.:ultimately assessed between $400..00 and 500.00 four each xesidehtial lot under such proceedings. We do not recommend such assessment proceedings for the reason that in the event of a second county -wide storm drain bond issue, these same properties may be also assessed for drainage improvements in the county area without receiving any direct benefit from the second county bond 0'ssue. We believe that the most practical solution to the problem can be attained on the partial: relief basis and would recommend that the City Council authorize the Engineering Depart'- ment to proceed with such a project when financial coverage of the project can be at We also recommend that the City Cohncil request a public hearing on the San Dimas Wash improvements project before the County Board of Supervisors. Motion by Councilman Sperline, seconded by Councilman Brown and carried that authori= zation be given to the Engineering Department to proceed with such a project as has been described in the above report as a. potential relief project as soon as financial coverage of the project can be obtained. C.C. 4-9-56 -3- Motion_,by Councilman Sperline, seconded by Councilman Brown and carried that the City Council request.public hearing on the San Dimas Wash improvements before the County Board of Supervisors. MASTER.PLAN OF City Manager, Mr. Petrie, stated, Pursuant to our report to .STORM,DF-:AINS you last week concerning.the Master Plan of Strom Drain program we have looked into this matter further. We can finance money (for this project) through the Federal government which can be repaid at"the time of completion of the project or not repaid'if the project not completed. .- would like Mr. Johnson to report on the advances made in this respect and receive _ ma`s approval, if Council so dd'sires, that we proceed with this matter. Mr. Johnson Acting Director of Public Works Mr. Petrie has summarized the matter in general. Such funds are authorized for advantage or munici- palaties for advance planning and studies for detailed plans. There are certain restrictions and requirements attached to these funds. We are almost ready to present ` this to you but my feeling is that Mr. Petrie is very experienced in handling this type of financing and there are certain pitfalls involved, so I ask that you give him and me authority to confer with these people.and bring in final details at a subsequent meeting. The availability of these funds is one reason why I have pressed for this storm drain project and if it i� possible to obtain them we should do so rather than spend funds out of our local general budget. Motion by`Councilmari Brown, seconded by Councilman Kay and Carried that authorization be given to go ahead with preliminary report and presentation to the Council. INSERT CONTINUATION OF ANNEXATION NO. 139 HERE PUBLIC HEARING PRECISE PLAN NO. 78 and ZONE CHANGE NO. 72 Re.ade. & Knight,,,,. "EiEL ; OVER.: No. 248 and of the *-mrHurst stated that this is the time and place for public hearing on Precise Plan No. 78 and Zone Change No. 72. Location: West side of Sunset Avenue, between Francisquito Avenue and Delvale Street. Request : C-1 and R-P Uses., Existing Zones R-1. Maps were presented by the City Engineer. Mr. Gerschler read Resolutions Planning Commission recommending denial. The recommendations of the City Engineer read as follows: 1) That this proposed plan and zone change application be disapproved until such time as it can be made to conform with street improvements and requirements of the Planning Commission and City Council in connection with Plan No. 46 and Zone Change No. 40.­ This involves the construction of a service road where the applicant is proposing construction of a pump island. .All those wishing to bresent testimony in this matter were sworn in by the City Clerk. Mr. P. Shabarum of 2122 Cameron Street spoke in favor as follows As -you recall I was before this body about two months ago, at which time we were making an appeal,.relating to the decision of the Planning Commission for request of zoning for.,five lots of which these lots are a portion. We are back again in regard to appeal as to the.thought of the Plann�ng Commission in this matter. We are trying to ask for two specific uses which will not be taken care of in all the twelve acres now zoned for C.C. 4-9-56 -4- commercial across the street. I am submitting architectural drawings of what possible development could be placed here. The two uses are a service station'a.nd medical offices. Hospital facilities are under construction, and almost completed, about one mile to the west making this an excellent placement from a docstors point of view. There are no other medical offices within a mile -radius of this proposed site. Medical offices will be a good.buffer between other use and existing residence's.. As to the service station. The intersection is at major and secondary highway. The secondary highway being the heavier traveled of the two hours between 7 A.M and 7 P.M. We also have Tidewater Associated Oil Company intdfested in this property and the only �thing in our way is a change of zone.1t (At the request of Mr. Shabarum,-Mr. Gerschler ead communications from Mr. Fishbeck and Mr. F.J. Miller of the Tidewater Associated Oil Company substantiating his statement of the interest of this company to build a service station th this site if zoning obtained) "As to the property, as it exists at this time you are all well aware of the tract as it is now. In the first place it was poorly engineered in that now during rains and irrigation of near -by properties flooding problem exists, sometimes quite seriously. The depth of the lots are 236t which was found to be not satisfactory from'standpoint. of.property owners to keep portions of front and rear yards well maintained, bringing about usightliness. This will be cleared if zoning is granted. Noises and -congestion, which will continue to increase at this. intersection, is a detriment to property for present use of residences. In conclusion. Our repeated efforts to get this property zoned is based on two facts. In the not too distant past it was determined to be a potential zoning of commercial somewhere in here. The general zoning practices of the City have been such that in all but one case commercial zoning has been granted at more than one corner of';any intersection. Councilman Kay: Haventt we entered into agreements on this proposed service road? `City Engineers We have requested developers on the SE side of Sunset Avenue to improve service road. The Plans and Profiles are drawn and approved and money has been posted for improvement. Councilman Kay: Does service road property belong to the city? City Engineer: It is an option for city to open the service road at their will and pleasure. Councilman Kay: Wasn't there a program discussed in regard to continuation of service road?. City Engineer: Yes. That proposal extended from Francisquito Ave to Delvale St. and based upon co-operation of the property owners at a designated amount per lineal foot. We wrote to all property owners regarding this and received no answer whatever from them. 1 r C.C. 4-9-56 -5- PP 78 2C 72 Cont'd. Councilman Kayr In view of this it was intention of Council to go ahead with service road. Mr. Shabarum, wouldn't that effect your plans? Mr. Shabarum: My thinking would be to forego this service road as concerns service station site and that could be accomplished in two different. ways. Service road could run through service station, or a half cul-de-sac could be put in just south of the service station site. One of those two ways would require city's releasing option on 125 feet. Councilman Hurst: City Engineer: Councilman Van Horn. - City Engineer: Is that a future street? It is dedicated as a future street on the map. It is my understanding that an entrance *could come.out on Sunset somewhere. There would be an opening near the north end of the service road. Mr. R. Godlove of 1736.S. Cabana spoke in opposition. "I have property west of this, behind this property. As.far as what the applicant wants to place here we are more interested in gas station. 'I cannot see the compatability of a gas station and a medical center. By adding a gas station you will not cut down on thetraffic and noise situation. It would only maka it more disagreeable., These people brought here about a year ago and the situation has not changed any from that time. They realized the situation when they purchased here." Mr...M. W. Brown of 1717 Sunset Avenue spoke in opposition. "I live adjacent to this proposed development and it is not a happy thought to realize I may be living next to a gas station. I can't see where such a proposal would help the situation a bit. I was before this body in favor of ;developing of'five lots and I think that develop- ment was.much better than one proposed. I,believe that this corner was purchased purely "An speculation. People who own it do not evri live there it is rented out." Mr. R. Peterson of 1729 Sunset Avenue spoke in opposition. "I take issue with point of the need for a filling station. I have counted nine filling stations within a mile of this proposed site and I do not consider that such a use here would be consi- dered necessary. In regard to the flood condition, I could do the same thing if I filled my driveway and ditch so that water wouldn't run by. The'lots adjacent to this area are kept up very well. It is just these two lots on corner that are not kept up as they should be." Mr. E. M. Wolfrank of 1738'Cabana stated, "There has been talk about unkept front lots. Everybody knows service road is supposed to be there which rifles give big lots, but when service road is put in believe it will be easier to keep. I am opposed to service station because every corner now has one on it and do not think we need any more." Mr. J. Ramming of 1764 S. Cabana stated, "Think the matter has been well stated in opposition. As far as gas stations, we have enough around this area and as for medical buildings I think there is also adequate amount of those. One thing I can't see is that houses that are less than five years old should be torn down to make way for filling station and medical building. C.C. 4-9-56 -6- ..:,There was:-no;further testimony presented, the hearing was declared closed. Councilman Van Horn: I do not know how to act on this because of the matter of the service road. I don't think we could affirm or deny this zoning until we know what will happen regarding the service road. I think city made a mistake in giving twelve acre commercial zoning across the street. I think this corner should have been treated equally instead of such large zoning at one site. Mayor'Hursts Mr. Pontow, do you think you could furnish a map showing dis- position of this service road?How it is proposed and how it could be handled? City Engineerr Yes, I believe such a map could be made up regarding this mattee. in time for next meeting. Motion by Councilman Van Horn, seconded by 'Councilman Sperline and carried that Precise Plan No..78 and Zone Change No. 72 be held over until next Monday evening, April 16. Mayor Hurst presented a Certificate from Institute for Training in Municipal Admini- stration to Mr. Robert Flotten, City Clerk, and congratulated him upon the successful completion of the course in Technique of Municipal Administration which he attended at Mt. San Antonio College. PUBLIC HEARING Mayor Hurst stated that this is the time and place for public PRECISE PLAN NO. 80 hearing on Precise Plan No. 80 and Zone Change No.*62. Location: and West side of Barranca Street, between Walnut Creek Wash and ZONE CHANGE NO. 62 Virginia Avenue. Requests R-3 use and adoption of Official Arthur.-M. Daniels Precise Plan. Existing zone: R-A, potential R-3. Recommended HELD OVER for approval by the Planning Commission on 3-21-56. Maps were presented by the City Engineer. Mr. Gerschler read resolutions of Planning Commission recommending approval. Recommendations of the City Engineer were read as follows: 1). That 'all street improvements outlined in Section 49, Ordinance No. 225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include street lights, sidewalks and sanitary sewers. That the precise plan conform to the proposed R.O.W. of the State Division of High- ways and the Los Angeles County Flood Control District. 3) That all necessary widening of Barranca Street and -area for Walwest Drive be deeded to the City of West Covina. 4) That all buildings not exceed two (2) stories in heighth. 5) That all exterior lighting be installed and maintained in a manner elimination any nuisance to adjacent residential property. 6) That adequate water supply and fire protection be provided as required by Ordinance No. 451 7) That all excavating and grading work conform to provisions of Ordinancq No. 384. C 4 9. -,56 ; -7- PP No. 80 and ZC No. 62 Conttd. 8) That all bonds, fees and deposits for improvements be posted before building permits `are issued. 9) That a 6-foot masonry wall he constructed along the.southerly side of Walwest Drive and along the westerly side of Berranca Street. 10), That'any divisions of the property for purposes of sale be accomplished as a sub- division.under the provisions of Ordinance No. 225, specifically Art. III & IV. 11) That a one foot lot at the westerly end of Walwest Drive be deeded to the City of WOst Covina in Fee Simple *2) .That Block Study No. 41 be revised accordingly with the present limits of Vander - terminating in cul-de-sac. 13) That.all existing buildings be removed or demolished. 14Y That'the use of the property shall be for R-3, multiple family residential use only, in conformance with this Precise Plan. It•was further stipulated in the motion of the Planning Commission that a 241 alley be provided approximately -at the.center of the apartment area shown, from Walwest Drive to rear northern'alley. Alley on the easterly side of.the area to be increased to thirty (30) feet pavement. All those wishing to present testimony on this matter were sworn by the City Clerk::. Mr. ,Daniels., applicant, of 818 Dancove Drive stated'as follows. - "My reasons for requesting for firm zoning has been bought up at previous -meetings and I am submitting two architectural drawings as prepared by Maul and Pulver, Architects. Mr. Maul, who is.here this evening, will be glad to answer any questions which may be requested in regard to,.these plans., .Werould like an opportunity for rebuttal, feeling it is >not `necessary for.us ;just now to again riteratepoints brought up' at previous meetings-, . Gerschler presented and:read a communication from Mr.. R. Boyd of 246 S. Barranca favor of this Zone Change and Precise Plana Mr.-L. Martin of 3238 E. Rolt Avenue spoke in favor.stating he felt that the community needed something of this type and"that it. would not be a detriment to the surrounding area. Mr._J Mauls architect, bf 151 E. Badillo in Covina stated, "I would like to provide some explanation in regard to architectrral.points. The whole plan is laid out around sx`;;large,central courts. Each apartment faces on of these courts. Each apartment has a small private patio. I believe this area can support such R-3 zoning. There is a large eliff.on one -side and proposed County Flood Control on other making it a relatively secluded section by itself, so it is pretty well buffered. It is close to the freeway ar)d large intersection making it very nice for any commuters who are working in Los Angeles. It is iii a,good locality to serve workers of the May Company. It will be particularly good�for the executives who are used to living in a predomin4tely apartment area as they will find 'this a fine development and with sufzroundings they would be used to. 10 C4. 4-9-56 PP No. 80 & No. 62.,Contd. Mr.. Cullen of 3150 Virginia Avenue spoke in opposition. "I would like to digtess in regard to my affiliations. I have no political affiliations. My interest in this is purely on a local resident basis. I am prohibited by agreement of employment to refrain from.politi.cal activity. The planning basis on this will lead us down one road. We have gone.over this before and it is an old. story. In considering this change of zone I believe it is a change ifipattern of the use of this area. To have such a change should reflect three elements ttranslation or adoption of a zone. 1he need should be considered, proper location d compatability of uses. This plan represents latest plan) but none of the plan is .,developed so we can see no need for translating this when so many other R-3 areas are undeveloped. That this is a reasonable location for such a plan is highly doubtful. 0 'The natural'boundary of this wash has been transgressed on a potential basis. The development around this area has changed the nature of it to a great extent and there is no longer a compatable use for this type of development on adjacent land. We have ...no quarrel with the sketches as presented, except that neighbors might look on rock roofs.. Mr. Cullen: The single family residential use fronts this property on three sides, with natural barrier on fourth sides Architect has led ,us to believe this serves a need to house the people working for the May Company project .coming in. I do not think we wish to be known as*a bedroom for the May Company. This brings in a great density of population on ten acres and I believe it could be divided,into thirty lots which would conform in size to the surrounding development which is in existence. Single family dwellings would place 90 to 100 people whereas units of .this,property would place 350 people here. Perhaps the plan is fine, but take it across the Wash to the north directly across from the May Company. T also have objection to carports. Carports are not necessary. Most of the residences ave.,,garage's­. T e 192 carports sitting out there.is not in accordance with neigh- .';� o hav de '7el _.opmen For these reasons we ask you not to consider this matter just because property happens to '& considered potential R-3. e It will be in nature of a complete change in the neigh- rhood and some consideration and thought should be given to surrounding properties." 400 Mr. Heredia of 138.S.' Barranca spoke in opposition. "I have a few points to make. This .matter may.not have gone this far if the people affected had been notified originally of chahgb of.zoning* No one in this area knew of this change and I would say that 98% of those in the area are against it. There seems to be other things that are more importantithan the correctness of the Precise Plan. I would like to ask if any thought has been given to,traffic congestion? Has any thought been given to the problem of school children walking -to school in this heavy traffic? In regard to proposed over- pass to area. 'There have been no denials that the service road will be underneath, the overpass and not available to Barranca Street, In regard to sewers. Will such a'hook-up be permitted to May Company sewer as had been stated? I checked with flood control people. I understand that they would like to have this project as far removed as possible.This project, if once approved, will not have anything in common with present zoning. 1 ask you present, before this matter is voted upon, that these points be checked foi the good of the community and area in question. C.C. 4-.9 -56 9- PP 80 & zc 62 Contt.d In view of these unanswered question, which should be resolved, and in view of,the fact that Daniels and two other people are only ones interested in this project going thiough,.it is fair.*to assume that Daniels started this without regard for neighborhood and interests of the people living in the area. Thdnewspaper articles bring the May Company in as if they were interested in this project. The May Company representative dropped it immediately when he knew how the neighbors felt.. A -new buyer has been secured pending city's conclusion of this zoning. view of my responsibility to my family and neighbors I ask that before'voting on this O.t,ake into consideration all the facts brought out tonight,.that they be investigated and a report made. I would also like to state that if this is brought to vote at this meeting that Mayor Hurst., whose relation to the applicant has not been legally dissolvedp .take no' -:part in discussion or vote. Mr.'Alsop of 130 Barr'anca'Street stated, "I am directly opposite this property. From _a monetary standpoint I could gain from this- project* going in but I am not interested as -such. It seems -this thing is a question of need. Everybody brings out the May Com- pany is going to 'change the face of West -Covina. I do not believe that anyone who just works for the May Company is going to be able to afford to live in this project. At least that is the conclusion that I draw from Just looking at the architects drawings. Mr. Abrams of 2907 Mesa Drive. "One thing we are interested in., particularly where we are situated, is the nature of the roofs going in. I believe there are deed restric- tions -as to the nature of- roofs on Mesa Drive. Ilbelieve it is up to the city fathers to protect the, view of thos e 4bove and think there should be the elimination of white rock roofs on this project. I feel that it is premature to make a decision at this time .in y w,of questions raisedi 6 This project,will be wedged into the best area in.this who�d/.'Yalley. There are two sections on Mesa Drive that people are hesitating to put - chase ,because ,they do not know what is going in'below. We certainly do not want to dis,courage _--people wha,want'' to put homes . in here. If - Daniels *was going to put this in himself and it was feasible to the area perhaps protest would not be quite so strong. However,, we do not know who is going to m9as with this part.of,the city." Or'. Egley2,Attorney for Mr. Daniels, of 151 E. Badillo stated as follows: "There was notice and due process given in regard to adoption of the zone map of West Covina as it now st.andso With.help,you (Council) had established this area as being g6od for potential R-3. It is my understanding of the situation of zoning law and zoning ordi- ' nance:in"th6 City that what is before you tonight is desirable R-3 I with a Precise Plan presented in accordance with established zoning ordinances and recommendations.of the Planning Commission. Y6t have adequate ordinances for traffic problems. This is not a city -without experience in handling new problems. The zone issue is whether the .Pre.cise..Plan as presented is sufficient to conform to R-3 type of development. This Council -is entitled to set boundaries, position of buildings, height limit and all other thihgs."conne,eted with a precise plan. You 'have had hearing as to whether this would be.,R=3 or.R-1. It was presented to citizens in advance as to how this land would develop. If every time a plan comes up before this Council in which a precise plan is proposed for existing and potential zoning that you are going to reconsider the zoning which 'Should have been given at the time of the change then you should amend the ord- _10- PP 30 & ZC 62 Cont'd. inance or have a complete new ordinance. If there is a question as to whether this should be ' R-1 or R-3' then apparently the requirements for zone change should be re- examined* It appears there is a need for this. The May Company has nothing to do with this. It happens to be across from a development of the May Company. That provides a need for people to have such type of housing Where you have a large commercial development you have a need for apartment dwellings. You have locality where you have access offreewayclose to Barrance Street over -pass. You are not loading up local streets nor posing any additional police problems. You have compatibility with surrounding area to the extent of large commercial develop- *nt on the north. There are residential on East., West and South but adequate provisions Or that in setting up to the south 9 six foot wall and wall on Barranca Street side so wall is insulating apartment house area very well. Mr. Daniels said, before I came up here, if there is any opposition to white rock roof it would not ' be necessary to have them asi-it would not be impoftant to the success of this project* You have gone over question as to whether this is good R-3 property. The question is whether precise plan as presented is sufficient to meet existing requirements on R-3. Mr. J. Swanson of 2625 Vanderhoof Drive stated "The most serious idea comes from the nature of planning and the situation is that if this is put in we are talking about 20 units per acre. I doubt if there is anything of such density anywhere else in the City without good access. I have heard the argument many times as to what do you do where potential zoning exists. I thihk what you should consider here tonight is to exercise discretion to reduce number of dwelling units per.acre to be developed. I seriously doubt if you can justify more than ten. Council took all requests under advisement and then studied situations and sections. In studying we reported back by various sections. We did not consider any individual case by having individual hearing in regard to potential zoning in certain areas. I .think we have possibly backed ourselves into a corner and that it would have been easier if p;topped a 't the Wash.
