STREET LIGHTS The City Engineer presented and head a petition from WILLOW AVE. property owners requesting street lights on Willow Avenue APPROVED between Garvey Blvd. and Pacific Avenue. The City Engineer stated, "The City Manager has been informed of this request and I have checked the installations which would'be inste13.-,d on the existing wood poles. There are sufficient funds in the current Lighting and >1aiatanence Fund, and in order to en- able this matter to be put into operation a motion will be needed from the Council author- izing this street lighting system to be maintained." Motion by Councilman Snerlins, seconded by Councilman Brown that authorization be granted for the maintanence of a street lighting system on Willow Avenue between Garvey Blvd. and Pacific Avenue. Mr. W. Nollac, Sanitation Engineer, stated that he had a communication from Mr. H.L. Johnson in ,agard to the Cameron Avenue Sewer Trunk Extension and requested this item be added to the a;enda. mm r PUBLIC HEARING Mayor Hurst stated that this is the time PRECISE PLAN NO. 68 and place for public hearing on Precise and Plan No.`68 and Zone Change No. 63. ZONE.CHANGE NO. 63 Location- Sunset Avenue between Del Vale Street and Francisquito Avenue, Requests Brown, Peterson, MCCarville C-1. Maps were presented by the City Read and Knight Engineer. Mr. M. Gersch.ler presented and DENIED read Resolutions No. 327 and 328 of the Planning Commission recommending disapproval of this Precise Plan and Zone Change. The orginal recommendations as presented to the Planning Commission were read as follows: 1) "That all street improvements outlined in Section 49 of Ordinance No. 225, including utilities, be installed accordingly and meet the approval of the City Engineer., 'This to include street lights, sidewalks and sanitary sewers. 2) That dimension on Sunset Avenue conform to dedicated R.O.W. - 501 �) That the site be graded to drain to Sunset Avenue or Francisquito Avenue. 4) That the 6-foot masonry walls along the northwest and southwest sides be constructed as indicated. Said walls to conform to building set back lines of adjacent Rml property. 5) That excavation and grading conform to Ordinance No. 384. 6) That adequate water supply and fire protection be provided. 7). That all bonds, fees and deposits be posted before building permits are issued. 8) That building be limited to one story in height. 9) That"the construction of commercial buildings be started within two years. 10) That disposition of.existing buildings be indicated. All those wishing to present testimony in this matter were sworn in by the City Clerk, Mr. P. Schabaram of 2122 Cameron,Avenue, representing applicants, spoke in favor. "I just wanted to give the history of this particular intersection and the zone change. Also the tract in which this property is involved which is Tract No. 12505. The sub- division was developed in or approximately around 1949 when it was in Los Angeles County area. Approximately two years later it was annexed to the City of West Covina. In 'the restrictions, both as it was developed by the County and.amended for ..annexation, stated that Lots No'. 60 through 64 as indicated on the Precise Plan be set aside For future commercial development as and when the City Fathers, at that -time the County officials, deemed it necessary. We have endeavored to present this in compliance with those re- strictions. Approximately a year ago a zone change was requested for the corner lot, one of five lots, and to the best of my knowledge the only reason for denial, was based upon the fact,that the property in question was too small. We have endeavored to pre- sent this for your consideration and to meet that opposition with this Precise Plan as you see it. Mr. Schabaram, service type shops and stores and a need for a gas station at the inter- section." Mr. M.W. Brown of 1717 South Sunset Avenue spoke in favor. "I am one of the property owners in this application and what I might.add is that the desirability of the use here as residences on this-corner,is decreasing because of increased traffic and what we anticipate from other activity from across the street. There are heavy trucks coming in from the Freeway and traffic is getting steadily worse." Mrs. Vienalli of 1734 So. Cabana spoke in opposition. 'We bought our home here four years ago and our property backs up to this property up'for rezoning,, There was traffic when people moved here.. I am not in. favor of rezoning..,.I have small. children who have to go to the corner of Cabana to get the school bus, and feel this proposed zoning creates addi- tional danger as the more business that comes in here the more transit trade we will have in this area. We bought here because we understood it would be residential. I do not think that a filling station is necessary as we have one already on one corner and we need none on the other. We have a lot of shopping centers now, and a new district coming in across the street., which takes care of all th-e necessary shopping requirements." Mr. R. Footer of 11836 Bryant Road, El Monte spoke in opposition. "I own the vacant lot on the corner of Cabana and Francisquito. I think that to change this property in ques- tion to commercial zoning will only increase the traffic problem. Most of the heavy truck traffic is now due to construction going on in the area but when the area is completely built up I believe a lot of the heavy traffic will leave. At one time Francisquito was posted from Glendora north against anything over 6000 lbs. gross load. I believe that if this zoning is granted it will benefit only a few and not the neighborhood as a unit." There was no further testimony presented, the hearing was declared closed. Councilman Sperline- I believe that Mr. Schabaram stated that when this tract was subdivided the deed restrictions stat edv either prior to or aft6,f amendment in annexation, that these lots would be marked as potential. commercial. Mayor Hurst: In front of these lots there is area for a service road, you have incorporated that area into parking and the Pre- ci:e Plan. Would we as a city deed that back to these people? Mr. Schabaram: As to the future road. I checked that as closely as I could and the 42-foot strip as granted is an option to the City of West Covina which they may excercise in- definitely, The City as yet, does not own that prop- erty so until such time as they are ready to improve it they can probably incorporate it into their plan. At this point a resolution,vacating your option'particularly.as to the service station parcel may be necessary. As to the other, it would be a matter of the property owners dedicating an _additional strip -above 42° for parking much as the Glendora development and West Covina Center. Councilman Van Horne Perhaps there is not an adequate need for commercial area here now. However, I think this corner has been set aside for future business. Councilman Sperlineo I wonder if there is any big interest in developing this corner immediately? Mr. Brown do you have any major companies or stores interested in immediate development? Perhaps this commercial zone is a little premature when we are going to have to tear out houses to develop it. Mr. Brown: The corner would be developed very shortly, and we thought we would have enough time to enable us to plan the remainder properly first. Mr. Schabaram: As indicated on the Precise Plan the Tidewater Oil Company has indicated a very definite interest. -in the Service Station ana the only thing that holds us back is a decision on zoning. Motion by Councilman Brown, seconded by:.Councilman Van Horn and carried to uphold the decision of the Planning Commission and that Precise Plan No. 68 and Zone Change No. 63 be denied. ;.PRECISE PLAN NO. 44 (Revised) Maps were presented by the City Engineer. Location: and Northeast corner of Garvey Avenue and Irwindale Avenue. ZONE CHANGE NO. 38 Request: Adoption of Official Precise Plan. Request: Sponseller & Son C-2 Uses. Existing zone: R-A, potential C-1, R®3 and APPROVED R-1. The Planning Commission recommended at their meeting of February 1, 1956 the zoning as shown on map entitled Zone Study No. 11, subject to concurrent approval of a revised precise plan con- forming to recommendations made for Zone Change No. 38 if submitted., Mayor Hurst: We have had this plan before us at a public hearing. It went back to the Planning Commission with the re- commendation that some affirmative action be taken. "We did not agree with the Planning Commission's decision on the cull ­de -sac street for several reasona. 'We had a study made by Mr. Johnson, Engineer, and I believe the study was submitted to you for consideration. We refer back to the flan submitted originally, which is the plan sent to the Plannin.g.Commission with the request that it be recommended for approval. The cul-de-sac°s are too long, they are against your zoning ordinance and there is no way to get storm water out. If you have read Mr. Johnson's Letter you would have an under- standing of this. We are just requesting that the City Council grant us original C=2 zoning. Mayor Hurst, This property .falls within proposed zone. Four hundred feet of frontage has been taken away because, we asked for an off - ramp from the freeway. •Mr. Sponse.l,l,er, This left us with a. plan that cannot 'be chopped up, With the original, design we feel, we can give advantages'to the surrounding property owners and 'to the City also. The .following recommendations from City Engineer were submitted by the City Engineer. 1. Deed and improve 25 ft. lane to City of West Covina from Broadmoor Avenue to Irwin- dale Avenue on the north property linen 2. Require 6 ft. masonry wall along the northerly and easterly line where developed as R-1 use with wall being reduced to 42}9 for all front yard set backs. (25 ft.) . 3. Require 5 ft. chain link fence bordering southside of 25 ft. lane. 4. 1.01 sanitary sewer and drainage easement deeded to the City from Broadmoor Avenue to the east property .Line (along north property line). 5. The proposed layout for buildings and.pump islands in. service station area be subject to the approval of planning and Safety Committee. 6. That all excavating and grading work conform to provisions of Ordinance No. 384. '�. All exterior lighting be installed and maintained in a manner eliminating any nuisance to adjacent residential property. S. Provide floor plan and layout showing the intended use for all proposed buildings, with sufficient parking to be provided as specified by Ordinance No. 325 'to acco.-mrao- 46 date those uses. 9. That all. street improvements outlined in Section 49, Ordinance No. 225, including utilities, be installed accordingly and meet the approval of the City Engineer. This to include curb and gutters on both sides of 25 ft. lane, and also to include street lights, sidewalks and sanitary sewers. 10. That the Precise Plan conform to the proposed.R.O.W. of the State Division of Highways. 11. . That all signs conform to the provisions of Ordinance No. 41.8 and be attached to buildings. 12. That adequate water supply and fire protection be provided as required by Ordinance No. 237. 13. That all bonds, fees and deposits for improvements be posted before building permits are issued. Motion by Councilman Sperline, seconded by Councilman Brown and carried, tha-r, Zone. Change No. 58 be approved subject to conformance with Precise Plan No. 44 (Revised) and subject to the property being posted with signs stipulating C-2 zoning. PETITION FOR CHANGE Petition was presented and read by the City Clerk from property OF STREET NAME owners requesting that necessary procedures be taken to change McNutt Drive the name McNutt Drive to Hillhaven Drive. Petition further to stated that this Tract No. l?045 had originally been advertised Hillhaven Drive as Hillhaven therefore the name was more appropriate and that-, (Tract No. 17045) street signs had not been installed to date so there would be (APPROVED) rn cost for added replacements. It was stated by one of the petitioners that about 90 to 95 per cent.,of the people had signed this petition. Motion by Councilman Sperline, seconded by Councilman Van Horn and carried that the City Attorney be authorized to draw up the necessary Resolution to change the name McNutt Drive 'to Hillhaven Drive. 5m 0 G.C, 2u14-56 r TENTATIVE MAP Tentative Maps of Tract No. 21755,were presented by TRACT NO. 21755 the City Engineer. Location- NW corner of Azusa Walker -Built Homes Avenue and Merced Avenue 20 Acres - 65 Lots Area APPROVED District• -II -A. Recommended for approval by the Plfnnbng Commission on February 1, 1956. Recommen- dations were read by Mr. Gerschler as follows- 1)_. That all lots conform to Area ➢ip�*rict 11 A requirements. 2) That all street improvements outlined in Section 49 of Ordinance No. 225, including utilities, be installed accordingly and meet the approval of the City Engineer, this to include sanitary sewers. 3) That a 5-foot masonry wall. be constructed along rear yards of Lots 22 to 26 and Lot 65 on Azusa Avenue, instead of-5-foot picket fence. Dedicate vehicular access rights along Azusa Avenue to Lots 22 through 26 and 65 and along Merced Avenue to Lots 8 and 62. 5) That the subdivider request the opening of one -foot Lot No. 65 in Tract No. 21029 for.street and highway purposes. 6) That the disposition of, any existing.buildings be shown. 7) That driveway turnarounds be provided for Lots 53 through 65. 8) That street names and all parkway tree p14nting be subject to the approval of the City Engineer. It was further stipulated in the motion of. the Planning Commission that a sidewalk be required along the full length of the,map on Merced Avenue and that the typical Section "AA" along Azusa Avenue may be modified to include sidewalk if that is required by the F.H.A. Motion by Councilman Van Horn, seconded by Councilman Spe.:=sie and carried that Tentative Map of Tract No. 21755 be approved subject to the recorrne�:lations of the City Engineer and the planning Commission. Motion by Councilman Brown, seconded by Councilman Sperline and carried that upon recommendation of the City Engineer a time extension of six (6) months be granted (8/9/56) for the filing of Final Map of Tract -No. 20551 and that Sanitary Sewers be provided for said 'tract. City Engineer stated that -sewers had been required on this tract and are available. Motion by Councilman Sperline, seconded by Councilman Brown and carried, that upon recommendation of the City Engineer a time extension of six (6) months be granted (8/9/56) for the filing of Final Map of Tract No. 17101. Upon recommendation of the Sanitation Engineer motion by Councilman Sperline, seconded by 'Councilman Brown and carried, that sewer facilities in Tract No.'14458 be accepted and authorization be given for the release cash deposit in the amount of $1015.90.
