January 23, 1956 The meet ng was called to order by Mayor Hurst at 8-.40 p.m. at the West Covina City Hall wit the Rev. Freed. Present-. Mayor Hurst, Councilmen Sperline, Kay, Van Horn, Brown. Absent: None Also Present: City Managers-Iss"t. Administrative Officer and City Clerk, City Attorney, City-Trea*su-rer.-Ci-ty Engineer, Mr. Gerschler, Planning Dept.; Mr. Nollac, Sanitation Engineer. MINUTES APPROVED The minutes of the -regular meeting of the City Council of January 9 1956q and the minutes of the adjourned regular meeting Council January 16, 1956,, were approved as submitted. ; the City of ORAL COMP`1=ATIONS None WRITTEN .. MMUNICATIONS A communication was presented and read by the City Clerk, dated January 23, 1956, per Mrs. Riegel, Chairman of the Parks and Recreation Commission., requesting that representation of one or two people from West Covina be permitted to attend the State of California Recreation Convention at San Diego February 12 through February 15, 1956. The expenditure for this trip, for one persons, would be $100.00. Motion by Councilman Van Horn, seconded by Councilman Sperline., and carried, that the expenditure of �100.00 be authorized to cover the cost of sending a delegate to the State of California Recreation Convention. Noes., None AbsentNone • A communication was presented and read by the City Clerk, dated January 23, 1956, per Mrs. Riegels, Chairman of the Parks and Recreation Commission., extending an invitation ., to the City Council to accompany the Commission on a -tour of the City of Lynwood Community Center, which includes a swimming pool stadium, on January 30, 1956, start- ing at 4 p.m. Mayor Hu st stated that the Council members., in any large number, would not be able to attend this tour because of other commitments. However, it was further stated that if It all possible this date for the tour could be changed to January 31, 1956, a better representation of the Council may be available. A commun cation was presented and read, dated January 16., 1956, from the County of Los Angeles Registrar of Voters Department requesting permission to use the Council Chambers at the City Hall and the Civil Defense Building as polling places for the coming elections in June and November of 1956. A commun cation was presented and read by the City Clerk, dated January 18, 19569 from the City of Covina per Clark Chapman, City Clerk. This communication enclosed Resolution No. 668 of the City Council of Covina protesting the Northerly Annexation District No. 139 to the City of West Covina and notifying 'this City that Resolution • No. 668 had been approved and passed at a regular meeting of the City Council of the City of 6ovina on January 16, 1956, This Resolution was accepted to be filed for the records A commmmn cation was presented and read by the City Clerk, dated January 20, 19569 from the State Water Resources Board of the State of California, acknowledging the receipt of Resolution No. 857 adopted by the West Covina City Council,, It was further stated in this communication: "this appears to be a matter of concern primarily to the County Board of Supervisors of Los Angeles County. If the supervisors of Los Angeles �ou torecommend that the proposed project be included in the comprehensive plan .for the s Angeles drainage area you may be sure it will receive the support of the Stat4 Water Resources Board in furthering the project." A notice of public hearing was presented by the City Clerk in the matter of application of the SZLn Jose Hills Water Company for authority to adjust its rates for water ser- vide. This hearing is to be held February 8. 1956, at 10 am. in the Cortez Civil Defense,13uilding. Motion bCouncilman Sperline, seconded by Councilman Kay, and carried, that authoriza- tion be iven the City Manager, or any department heads designated by the City Manager, to atteni this protest hearing. The City Engineer presented and read a communication from Mr. H. L. Johnson requesting Permission to lower. about 600 ft. of Azusa Avenue adjacent to Tract No. 22004. The City Engineer stated., "The expenditures for'this work would amount to about $6,384.90 according to the estimate at the present time. The purpose of this request is to • enable Mr. Johnson to proceed with the design of plans for this tract. At the time the Final Map will be presented there may be definite figures for this work. It would be paid cut of County Aid to Cities funds. I would recommend that permission be granted,to proceed along these lines." Motion by Councilman Brown, seconded by Councilman Kay, and carried, that upon recom- mendatior of the City Engineer Mr. Johnson be permitted to proceed with design on recommened basis. The City Engineer presented and read a communication from the Covina Union High School District in regard to what they plan to do for street improvements along with the con- structior of the high school, and requesting the City to construct new pavement between Fresent edge of existing pavement and new curb and gutters. The City Engineer stated., "I have ch6cked into the files on the original zoning and also the Planning Commissicin's conditions on Zone Variance No. 164 and both of these'zoning matters required that the school install complete street improvements.'? -2- -.3- CC 1/23 56 Written Communications—conttd.. Applicants: Melvin Brown,, R. G. Peterson, Leonard McCarville, Claude V. Read, and William.B. Knight.- Denied by Planning Commission on January 4., 1956. Appealed to the City Council. After checking by the Engineering Dept., it was the recommendation that the bid be awarded to the Harvey Construction Company as the lowest responsible bidder in the amount oi 319,936.86. Motion byCouncilman Sperline, seconded by Councilman Brown, that the contract for Project C-29 be awarded to the Harvey Construction Company of El Monte, in the amount Harvey of $19,93-6.86 as the lowest responsible bidder.,'with $17,000.00 to be paid with County Aid and balance to be assumed by the City. That the bid bonds be returned to the unsuccessful bidders and that the Mayor and the City Clerk be authorized to exe- cute the contract agreement. The City Clerk presented and read a communication dated January 23., 1956, from Lawrence Moser,, M. D-., requesting the removal of his application from the agenda and to tempor- arily postpone further hearings on this matter.' A petition was accepted 'to be filed for the records from property owners -protesting -this Zone Change and Precise Plan. Motion by Councilman Sperline, seconded by Councilman Brown, and carried, that the application for Precise Plan No. 67 and Zone Change No. 59 be held in abeyance until the appl cant makes a new formal application for a new hearing on this matter, and at which ti e the property owners shall be properly notified and proper notices published. Nos. 17 & 35) of Citrus Street and North of San Bernardino Freeway. Granada Development Company Maps were presented by City Engineer. Mr, Gerschler APPROVED presented and read Planning Commission's Resolution 4 No. 32-9 recommending approval of this Precise Plan. Recommenqations were read by Mr. Gerschler as follows: • 1) That area for street widening along Citrus Street, Workman Avenue, Barranca Street, and frontage road be deeded to the City of West Covina. 2) That all street improvements outlined in Section 49 of Ordinance No. 2259 including utilities, be installed accordingly and meet the approval of the City Engineer. TREASURER'S REPORT Treasurers report for December, 1955, was accepted to be filed for the record. -10, i� • -11 1/23/56 SALARY NERATION CHANGE City Clerk stated that the actual starting salary of City Finance Officer Mr. Walters should have been $641..00 per month; whereas Walters he had been started at the salary of $650.00. 88Mr.. Walters° salary has now been reduced to the correct amount, putting him in the correct salary bracket No. 45 and will enable him to receive his regular six months raise.48 The City Clerk stated that it was his belief that a esolution would be necessary to make this change. The Cit Manager stated that this salary change of Mr. Walters puts him in the correct -salary racket as designated and if it is recognized by the City Council and City Attorney. it can be handled as an administrative problem rather than one of drawing up a resolution. ST T LIGHTS City Clerk presented and read a communication dated Willow Avenue. January 19, 1956, from F. E. Huffman and C. R. James of REFERRED TO CITY MGR. North Willow Avenue petitioning the City for installation of street lights on Willow Avenue between Garvey Avenue and Pac fic Avenue. This communication further stated that the Engineering Department had inf rmed the petitioners that installation could be made on the existing wood poles a no cost except for current and maintenance. It was consensus that this matter be referred to the City Manager for appropriate action. CITY OF POMONA Motion by Councilman Brown, seconded by Councilman Sperline POLICY ON BURNING RULE #57 and carried., that the policy adopted by the City of Pomona OPTED as reflected in their letter sent to,the Board of Super- visors and Air Pollution District regarding relief on Burning Rule No. 57 be formally adopted and forwarded to the proper authorities regard- ing the Council Qs affirmation of this communication. INCINERATOR City Clerk presented and read a communication from the BURNING ORDINANCE City of San Marino indicating they had passed an ordinance SA MARINO prohibiting -the burning of certain specific materials in REFERRE TO FIRE CHIEF incinerators. Motion by Councilman Kay, seconded by Councilman Van Horn, and carried, that this matter be referre to Fire Chief Hardin for recommendations. BALDWIN PARK CEREMONIES The City Manager stated that an invitation had been ex- tneded to the city officials of West Covina to attend the Baldwin Park Incorporation ceremonies to be held at 4:30 p.m. January 25, 1956, at the Jon s School. ORDINA E PROHIBITING Councilman Sperline stated that to date there was no SHUFFLE OARD, PIN -BALL ordinance in the City to prohibit the use of such things MACHINE , ETC. IN CITY as shuffleboard, pin -ball machines and other types along REFERRE TO CITY MGR. this -line. He felt it was a matter which should be looked into, and, if possible, to outlaw them. This matter was referred to the City Manager for recommendation.
