F. Freed of the Bethany Baptist Church giving the in- vocation. Present: Mayor Hurst, Councilmen Sperline, Kay, Van Horn, Brown. Absent: None • . Others: City Clerk and City -Administrator, City Engineer, City Treasurer, City Attorney; M. Gerschler, Planning Division; Mr. Nollac, Sani- tation Engineer. MINUTES APPROVED Minutes of regular meeting of November 14, 1955, should be corrected to show (pages 1, 2, 3, & 4) Unclassified Use Permit No. 11 instead of Unclassified Use Permit No. 10 in heading and wher, ever else referred to. The minutes of the Adjourned Regular meeting of November 21, 1955,, were approved as submitted. PAINT MACHINE BIDS City Administrator stated that advertisements for bids on paint machine had been made, with affidavits of pub- lications in Green Sheet, Pasadena Star News, and West Covina Tribune.in order, but no bids had been received. Recommendation that this item be obtained on the open market, as we know several firms making this type of machine to fit our specifications. It was consensus of Council -that this item.be obtained on mar- ket, and authorization be given to the City Administrator that this be done. ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS None PUBLIC HEARING Mayor Hurst stated that this is -the time and place for Zone Change No. 60 public hearing on Zone Change No, 60. Location:NW Babson & Associates corner of Badillo Street and Orange Avenue. Request APPROVED C-2 to C-1. Mr. Gerschler presented and read Resolution No, 312 of the Planning Commission recommending approval of this zone change as follows: 1) That the proposed development conform to the adopted Precise Plan for the urea, and to all the conditions attached thereto. 2) That sanitary sewers be provided. Mr. Gerschler stated that since there is no Precise Plan involved in this matter, the maps to be considered are 3001 radius maps, All those wishing to present -2- CC ll/28/55 ZC #60--contd. testimony were sworn in by City Clerk. Mr. A. Hathcock of West Covina spoke in favor, "I wish to.speak in favor of this rezoning due to the fact that I have property across the street and have anticipated asking for a zone change to C-1 because I feel that C-2 is a heavy commercial zone and do not believe this loca- lity should be considered as a heavy commercial zone." Mr. J. Renee° of 1819 Kenoak Drive spoke in opposition, "I wish to state that I am not opposed to the lower part of this area going to C-1, but I do not feel that the five (5) lots adjacent to Kenoak Drive should be allowed this zoning. I feel that the five lots across the street from Kenoak Drive should be given an R-1 zoning., Mr. J. Howell of 1906 Kenoak Drive also spoke in opposition and stated that his arguments were.in accord with Mr. Renee's. Mr. C. L. Mossberg of South Citrus Street stated, "I do not know whether I .should explain any further in regard to this matter but this area has been zoned since 1947 and application does not change the zone in any manner except 'up- grading' it and I do not believe there would be any detrimental effect from what there'is today. The development will be very high, and I will be glad to answer any questions. I was unable to attend the Planning Commission meeting on this matter and therefore had no chance to explain the situation in regards to R-1 zoning change as suggested by Planning Commission. However, if this was done it would eliminate all the parking and make the area useless with the market going in. Councilman Kays Will there be a considerableportion of Lots 1 through 5 used for building? Mr. Mossberg: The building lines are about 30 ft. from Kenoak Drive and 25 ft. to adjacent house, but there has to be a 6' masonry wall put in. Councilman Van Horn: This entire area was zoned C-2 and when this developer came in and built these homes it was under the condition that this was C-2. These people (applicant) can put up C-2 on entire lots without the City being able to do anything about it, but if they want to put • C-1 in I would rather have that than C-2. I think that if the property owners knew the difference between 6-1 and C-2 they would rather have C-1 themselves., I think this should be granted C-1 and the five lots under question left in zoning of C-1 because if it is not done it can go C-2 and the residents will be. far worse off with that type zoning. Councilman Kay: I think it was unfortunate that originally these five lots in question were made C-2, but I think that they (applicant) would have a good legal basis against the City if this was changed to R-1, and I do feel to reverse the situation would be unfair. We are bound by the considera- tion of what has been given, and it is better with C-1 than C-2. It is a much more restricted zone, and I believe we would be in a poor spot legally if we asked part to be put in R-1 zone. -2 - -3m cc 11/28/55 ZC #60--contd. Motion by Councilman Van Horn, seconded by Councilman Sperline, and carried, that Zone Change No. 60 be approved subject to recommendations of City Engineer And to the Precise Plan already adopted, with further -stipulation that it be subject'to Cut and Fill Ordinance. Mayor Hurst stated that this is the time and place Modification of Overall for public hearing on Modification of Overall Precise Precise Plan in C-3 Central Plan in C-3 Central Business Area. Maps were presented Business Area by City Engineer. Mr. Gerschler read Resolution HELD OVER No. 313 of the Planning Commission recommending approval. All those wishing to present testimony were sworn in by the City Clerk. Mr. Gerschler stated, "Some months ago an application was made for.an extension at rear of a building on property fronting on Garvey Ave., and City Council -instructed us to investigate the application. We submitted, at that time, a three -page report which stated in essence that it was a -question of where the location of the rear access road was in'this area and,also whether or not this addition was encroaching on access road and should be reserved. Applicant and his engineer arrived at a plan that was satisfactory and was then granted permission for building permit. However, it was vitally necessary that we get in on this entire triangle to pin down -where service roads would follow so that we could get access to parking areas, routes of public protection facilities and sewer mains. The Safety Committee asked every department head to make recommendations, which were taken to the Planning Com- mittee and we began study and work with it and assembled facts. At that point we called a meeting of the property owners and through three meetings came to this plan which is before you. The plan is to anticipate future building which will be done in the area and design service roads to fit... There were several points brought out, but I think we were able to resolve serious questions. -Generally speaking, the property owners are satisfied with this pplan we came out with. One point to bring out is that this corner (Toland property), reserved for access to parking area, and granted through variance. The .exact location of that driveway is meant to be flex- ible. At the present time it falls entirely on Toland property. It is the intention of the Planning Committee to have this particular drive flexible to give property owners in the area opportunity to work out where they want it. The boundaries are within limits of two (2) adjacent property fines, shown immediately to the north and immediately to the south. Mr. F. DeLay of 19253-E. Cameron Avenue, representing West Covina Development Corpor- ation.stated as follows: 'Talking about Toland access. There is shown a 25 ft. access and feel . it should be 35 ft., 25 for road with 5 ft. walks. So long as Toland services 290 ft. of Garvey frontage this 40 ft. service. road is satisfactory from standpoint of ingress and egress. The lot to the south is a 125 ft. lot. If you took 290 ft. frontage and 125 ft, and broke in proportion; 35 ft. is adequate. We �3- -4- CC 11/28/55 Mod,'of Overall PP-C-3-Central Bus. Area--contd. feel that this 20' alleyway across Rasmussen property and liquor store would be ..very congested to serve east and west traffic through 20' alley. That is why we are interested in 35' Toland area. Mr. Murray,representing Mr. Clayton's property south of this property, north of Walnut:Creek Wash, between Glendora Avenue to California Avenue and south of Schl.anger'property. Vincent Avenue extension goes through the middle of it. "We have been away and have not kept up with this matter, but through others we have had reports. We have no opposition to serve the best interests of the community but we would like to have action delayed on this to study in fuller contemplation for development of .our area. Would like to request delay of final action of the whole map and development in the light of what plans we may have in mind by the end of the year," Mr. DeLay called attention to the half street on this plan at the northwest corner, stores would be fronting on this half street and he did not think this is a good idea if it could be avoided. Mr. A. Jett of 258 S. Glendora Ave., speaking for Mr. Tessler, stated that he would like a decision on this matter tonight as, referring to upper triangle portion, ..some part of this has been sold. Did not think that this decision would affect lower portion as referred to by Mr. Murray. No further. testimony, .hearing declared closed. Motion of..Councilman Sperline, seconded by'Councilman Brown to.approve was withdrawn in the light of suggestions presented, and this matter was held over for further dis- cussion and study. FINAL MAP Final 'naps of Tract No. 21479 were presented by. City Engineer. Tract No. 21479 Location: south side of Cameron Avenue, east of Barranca Myers -Smith, Inc. Street. 25 acres, 40 lots, Area District IV. City Engineer APPROVED recommended approval of Final Map of Tract No. 21479 subject to the following items: 1) City Engineer's approval of plans and profiles. 2) Receipt of utility maps. 3) Receipt of Soil Test report. Noes: None Absent: None REPORT OF FIRE CHIEF Councilman.Kay presented communication from the Fire Chief of Re: Burning Hours West Covina which stated that after attending Mayors' Confer - in City of West Covina ence in Pasadena there had been nothing new to report in regard to any change of open burning, as put forth in County Air Pollution Rule ##57, and rules were still in effect countywide. Report further stated that if the Council desires to pass such an ordinance regarding burning regula- tions in the City he, (Fire Chief), would like to submit amendments to Fire Ordinance No. 315 to be presented to the City Attorney for modification of Fire Ordinance No. 315. Council authorized that Fire Chief submit amendments to City Attorney for possible modification of Fire Ordinance No. 315. FIRE EXTINGUISHERS Councilman Kay presented request from the Fire Chief that the .PUBLIC BUILDINGS City Council authorize the placing of First Aid Fire Extin- guishers.i.n City's public buildings., -City yard, and in heavy trucks and equipment. Motion by Councilman Kay, seconded by Councilman Sperline, and carried, that this matter be referred to the City Administrator for recommendations. MUTUAL FIRE DEPT. AID Councilman Kay stated that Fire Chief had requested he be TO CITIES authorized to contact the cities of Covina, Azusa, and • Glendora for the idea of a mutual aid plan among these cities, 'v& th this plan to be presel.:.d to these various administrative officers for approval. At the present time there is only a verbal agreement regarding this mutual aid and we must have a working agreement authorized by the City Council. UNBARRICADID STREETS Councilman Brown stated that there is trouble with unbarri- caded streets (where work is 'being done). "I believe that the ordinance be carried out which gives us authority to cite anyone who does not keep their .job adequately barricaded or posted,'if any are once warned and then do not take care of it adequately.
