Don Locher of the West Covina Methodist Church giving the Invocation. Present: Mayor Hurst, Councilmen Kay, Sperline, Browne Absent: Councilman Van Horn. Others: City Engineer, City Clerk and Administrator, City Attorney; M. Gerschler, Planning Division; City Treasurer. MINUTES APPROVED Minutes of October 10, 1955, were corrected as follows: Page 6, Item 2, should show Zone Change No. 55 instead of Precise Plan No. 55. Minutes of October 10, 1955, were approved as corrected. Minutes of the adjourned regular meeting of October 17, 1955, were approved as sub- mitted. ORAL COMMUNICATIONS None ITEM NOT ON AGENDA Mr. W. S. Jennings, Chairman of the Citizens' League of West Covina, presented to the City Council for the records a written communication requesting that the Council place the City Manager Ordinance on the April 1956 municipal ballot for ratification by the voters. The communication further stated that the League takes the position that it is not desirable -that ordinance may be altered by a•simple majority vote of the Council and feels that any changes that may be required in time can and should be submitted to the voters for ratification. STERLING THEATRE CO. City Clerk presented and read an appeal from the decision REQUEST FOR APPEAL of the Planning Commission regarding the Sterling Theatre Co., Inc., Zone Variance and Unclassified Use-'ermit for an open=air theatre in West Covina, the petition for which had been denied by the Planning Commission on October 19, 1955, after public hearing. Mayor''Hurst stated that hearing of this appeal of the Sterling Theatre Co. would be heard at -the next regular meeting of the Council on November 14, 1955. CIVIL DEFENSE REPORT Col. Wetherby read written reports on conferences held Governor's Conference regarding Civil Defense and presented them to the City at Sacramento Clerk for the record. Report on Governor's Conference Conference on Survival stated that the State will furnish complete stenographic Planning at Los Angeles report on the entire conference and when received will . Col. L. A. Wetherby be furnished to the Councilmen. M CC 10/24/55 OPENING OF BIDS City Clerk stated that he had affidavits of publication in Trailer West Covina Trilune and the Pasadena Star New8. Advertisement NO BIDS RECEIVED also given to Green Sheet, but no bids have been received on this trailer. This was probably due to the fact that there are special specifications regarding this trailer. It was consensus of the Council that City readvertise for bids. REPORT OF City Clerk stated that he had been directed by the Council to OUTSIDE AUDITORS obtain the services of an outside auditing firm to audit the formal books of account of the City of West Covina. Introduced Mr. Malcolm and Mr. Syapin of ?rice -Waterhouse Co., auditors, who have now completed the audit. Mr. Malcolm stated that reports were in two parts financial statements alone and suggestions related to improving certain procedures. 10 'Copies of each part were presented to the City Clerk. For the record.9 Mr. Malcolm reported that all accounts were in order. Fund and bank balances all checked and correct. Six applications has been received, two from business firms, one from Post 790 ' . American Legion, and the remainder from churches., with all in good order. City Attorney: "The applicant is asking for a different zoning and this should go back to Planning Commission. Now if applicant wishes to have C-2 zoning believe it should go back to Planning Commission as they have.,not considered application for potential C-2." Maps were APPROVED piesented by City.Engineer. Mr, Gerschler, Planning Commission Secretary, read Resolutions Nos, 302, 303, and 304 of Planning Commission approving this Precise Plan, Zone Change and Zone Variance. Mr. Pink, applicant, was present and stated that he would like to have the applica- tions approved as recommended by Planning Commission and that he was willing to pro= vide full width street improvements in the proposed realignment of Valinda Avenue it area which he now controls which lies north of the 445-39 ft. dimensioning line and improvements for half street for the remaining portion which lies south of the 445-39 ft. dimension line, No further testimony was presented and hearing was declared closed'. Councilman Sperline questioned as to whether the building height in C-1, thirty- five feet., was high enough for this type of use to which the. applicant answered in the affirmative. Motion by Councilman Sperline, seconded by Councilman Brown, that Precise Plan No. 60 (Revised), Zone Change No. 53 and Zone Variance No. 158 be approved subjectto recommendations of City Engineer and Planning Commission, and subject to improve- ments*as outlined by'City Engineerregardingproposed realignment of Valinda Avenue which include full improvements north of the line with 445-39 dimension and half street improvements on the remaining portion, and with further stipulation that con- struction must be started within the two-year. time limit. Hardin. -Chief - BURNING HOURS of the Fire Department. 'Fire Chief Hardin recommended -that FOR INCINERATORS Council adopt County Ordinance No. 6771, or a similar one providing majority of surrounding cities also pass similar ordinances. Further recommendations were that this ordinance include amendments to Fire Prevention Ordinance No. 315, paragraph (a) and (b) - section 2601 ® article 26 defining location of incinerators., making all butning of combustible waste materials permitted subject to restriction of Air Pollution Control District,, with other addi- tions to be made before Ordinance is drawn. Fire Chief Hardin also wished opinion of Council whether the City intends to comply with Rule 57 of Air Pollution Control District :rules and regulations or whether a variance can be obtained for burning trees and subdivision construction materials as requested.
