October 10, 1955
Meeting was called to order by Mayor Hurst at 8:15 p.m. at the West Covina
City Hall. 1.
Present: Mayor Hurst, Councilmen Kay, Van Horn, Brown, Sperline.
Absent: City Treasurer
Others: City Engineer, City Clerk, and City Administrator, City Attorney,
M. Gerschler, Planning Dept.; Mr. Nollac, Sanitation Dept. Engineer.
MINUTES APPROVED Minutes of regular meeting of City Council on September
26; 1955, were approved as submitted. Minutes of ad-
journed regular meeting of October 3, 1955, were corrected to show on first item,
page 5, "Rule 57tt, Outside Open Burning" instead of "Rule 54". Minutes were
approved as corrected.
ORAL COMMUNICATIONS None.
ITEM NOT ON AGENDA Mr. Jennings; Chairman of the Citizens League of West
Covina stated that on"October 5, 1955, the West Covina
Citizens League drew up petition calling for adoption of ordinance for creation
of City Manager, a copy of which was mailed'to members of the City Council on
October 6. Mr. Jennings stated that there had'been most deliberate consideration
given to the drafting of this ordinance and reviewed by two attorneys experienced
in municipal law. We are prepared to secure sufficient signatures to place this
proposal before public for adoption and feel it will serve the best interests of
City to adopt this ordinance so Council can proceed with obtaining City Manager.
Mayor Hurst stated that this matter would be designated on Agenda as Item No. 32.
WRITTEN COMMUNICATIONS City Clerk presented and read letter from the Mayor of
. the City of Azusa extending an invitation to attend
Azusa's Golden Days Parade on October 15, 1955, at 2:00 p.m., with special grand-
stand seating to be available for members of Council and their families.
City Clerk presented and read communication from Paul B. Salmon, District Super-
intendent of Covina School District thanking City for recent action taken to
protect children attending Traweek School.
City Clerk stated that he had copy of affidavit of publication of notice in regard
to matter referred to by Mr. Jennings, Chairman of Citizens League of West Covina.
ANNEXATION NO. 134 Mayor Hurst stated that this is the time and place for
Tenmen Enterprises, Inc. public hearing on Annexation No. 134. Location: north
APPROVED of Cameron Avenue and east of'Barranca Street. Approxi-
materly 6.5 acres. Maps presented by City Engineer.
Mr. Gerschler stated that recommendation from Planning Commission was that this be
approved provided that strip 52¢ wide by 300t long be excluded from annexation.

Councilman Kayo When this matter went before Boundaries Commission, did it include
strip in it at that time? Has it been recertified to exclude this
strip?
City Attorney: Believe it was recertified and resubmitted to Boundaries Commission
on basis of not including the 52 x .300 ft. strip and in that case
you may consider this map tonight.
Sanitation Engrg Mr. Nollac stated that in conjunction with annexation request re-
quirement that area be annexed to Sanitation District No. 22, prior
• to completion of annexation.

City Engineer stated that file on Annexation District No. 134 included the"'following
items:

Motion 'by Councilman Kay, seconded by Councilman Brown, and carried, that Annexation
No. 134 be approved subject to annexation under Rml Area District IV, that it be
annexed to Sanitation District No. 22 prior .to completion of annexation district.
PRECISE PLAN NO. 27 (Revised) Mayor Hurst stated that this is the time and place
Eugene L. & Louise E. Wood for public hearing on Precise Plan No. 27 (Revised).
APPROVED Location: SW corner of California Avenue and Garvey .
Avenue.. Maps were presented by City Engineer.
Mr. Gerschler read Resolution. No. 296 of the Planning Commission recommending
approval of Precise Flan No. 27 (Revised). All those wishing to present testimony
were sworn in by City Clerk. Mr. Eugene L. Wood of 191 E. Rowland Avenue spoke in'
favor, stating that original Precise Plan revised to provided more return on property.
• Location for service station in relation to highway makes it excessively good for
traffic coming o££ freeway.and advantageous to City., and ground allotted to it is
small. Have reduced size of buildings to provide adequate parking in compliance
with rules and regulations of the City. No further testimony; hearing declared
closed. Motion by Councilman Kay, seconded by Councilman Sperline, and carried, that
Precise Plan No. 27 (Revised) be approved subject to recommendations of Planning
Commission and to requirements of_Cut and Fill Ordinance No. 384. Passed on roll

PRECISE PLAN NO. 58 Mayor Hurst stated that this is the time and place for public
and hearing on Precise Plan No. 58 and Zone Change No. 52.
ZONE CHANGE N0.52 Location: SE corner of Azusa Avenue and Larkwood Avenue.
Siegel-Constr. Co. Request R-P. Maps were presented by City Engineer. Mr. Gerschler
DENIED read Resolutions No. 288 and 289 of the Planning Commission
recommending disapproval of Precise Flan No. 58 and Zone Change
No. 52. All those wishing to present testimony were sworn in by City Clerk. City
Clerk presented and read communication of appeal from Stephen W. Cunningham & Associ-
ates, Inc., per -Mr. Edward J. Till, dated September 13, 19555 which stated that it
was an erroneous assumptidn-on the part of Planning Commission in that there was no
justification for any other than R-1 use in area. Because of -the fact that property
immediately to the west will be developed to an elementary school.and property immedi-
ately to the south will be developed to a church, both as permitted with Zone R-2
under City's ordinance. Letter further stated that there was sufficient area to not
qualify as -a "spot zoning" and that it is unreasonable that residents within community
adjacent to a_church and elementary school should have to travel approximately one
mile to the north, two miles to the west and several miles to the south in order to
arrive at an area where medical -dental needs can be met. Mr. E. J. Till of 3727
Wilshire Blvd., Los Angeles, stated that as pointed out in letter read by City Clerk
that are circumstances that merit Council's consideration, particularly that there
are no medical or dental services available in this immediate area, and.,feel there is
a demand for this type of servicing.
Councilman Kay: Is .your proposed usage medical usage only?
Mr. Till: Yes, it is not commercial under any sense of the word. Plans pre-
pared for this area are as near to residential as possible, with no
garish advertisements. Do not believe there will be any disturbance to TV or radio
because of use of electrical apparatus for medical practice, and feel Azusa Avenue
is fast becoming undesirable for residential purposes.,
Mr. I. Siegel of 560 S. Fenimore St., Covina, stated: 'Want to explain reasons why
we have applied for rezoning of these lots. I.am not going to say no one can live on
lots on Azusa but it has been proven that houses fronting on Azusa are less desirable.
First house built in this development was at Azusa and Cortez in 1954. At that time
Azusa did not carry much traffic and there was not a great deal of development to the
south.. After home had been complete we realized that opposition of public to living
on heavily trafficked thoroughfare was very great. Development of these lots for
• buildings serving doctors and dentists is not going to be detrimental to the surround-
ing area, and this type of usage has been shown to work out in other areas of City,
case in point is at Irwindale and Rowland, with no damage or annoyance to surrounding
neighborhood.
Mr. R. Reynolds of 1925 E. Larkwood spoke in opposition, presenting to City Clerk for
the record petition in opposition of those property owners adjacent to this area.
Mr. Reynolds stated that -this would be the only block.on east side of Azusa that would
have any business in it at all, all the rest is residential. Thought it would be
residential R-1 when purchased property and cannot see any reason to change it now.
City Clerk read petition opposing this change which contained some 30 names.
Mr. D. Lawson of 642 S. Cajon stated that property owner on east side of Azusa Avenue,
just south of Mr. Siegel's property tried to secure a zone variance for similar pur-
pose and was turned down. If a change of zone is granted in this case, or variance
issued, this party will immediately reapply for a change also, and would like to know
on what grounds you could make one variance and refuse another.

Mr. Till-. We never alleged that property could not be used for single
family resident purposes but that this type of improvement is
more desirable and would bring more to the City than three
single family residences which would not be as desirable in
this locality. I still feel there is a need within the community
in the area for a project of this type.

Councilman Kay: I am inclined to agree with the opposition in that at time of
subdivision it was Rml and that while we have granted this type
of zoning on Azusa it was done prior to zoning.
Councilman Sperline: Since the time we granted -any R-P zoning north of Garvey we
have gone over completely, our overall zoning map in detail as
to where to allow this type of zoning in the city. I am
inclined to go with those in opposition and Planning Commission.
Councilman Brown, Ifeel I must go along with Planning Commission.
Motion by Councilman Kay, seconded by Councilman Van Horn, and carried, that Precise
Plan. No. 58 and Zone Change No. 52, upholding the decision of the Planning Commission.,
be denied.

Vine Avenue made on October 6, 1953, in favor of new locality which was accepted by
Resolution No. 813.this evening; Motion by Councilman Brown, seconded by Councilman Kay,
and carried, that authorization be given to Mayor and City Clerk to execute this

Mr. Nollac., Sanitation Engineer, stated that he would recommend sanitary sewers if
Cameron Avenue sewer trunk line were availabb in six months for hookup.
• Mr. H. L. Johnson stated, on the extension of the alley, being it is desirable for
planning purposes, we would prefer to have it come out to Azusa Avenue rather than
through individual street. Prefer it along rear of lot. Object to requirement.of
a drainage easement which is seemingly for benefit on private property entirely to
the east and serves no purpose to our subdivision. There was consideration to taRe
drainage northward.
City Engineer stated, proposed easement between Lots No. 6 and 7. At the time we
were discussing this amongst departments we did not know.provisions had been made
that Tract No. 20935 was to take care od drainage from school property. I would
recommend leave drainage easement requirement in, subject to evidence that such an

Hillside ,Area Street Improvements--contd.
Councilman Sperlineo I am wondering about point in these conditions regarding
street lights at intersections and other points as designated
by City Engineer. If we had a maximum or minimum distance for these in these
recommendations I believe it might eliminate any future developments. You might
have a block, because of necessity, 1000 to 1500 ft. long. Perhaps we will need
lighting at least every 400 or 500 feet. Police Department feels that adequate
lighting in areas are very essential.
Councilman Van Horn.* Not knowing what these -distances may be this should be de-
signated by City -Engineer just where they should goo
• Councilman Kay: I do not think these hillside areas want to see lights like in
the City. Need at curves, intersections, but to require lights
every 300 or 400 feet is going to nullify effects of rural type development. I feel
lights would only be where demanded for safety, except intersections where they would
be needed.
Councilman Hurst.* I believe we should pass this and perhaps Police Dept. could
come up with something that we can all go along with, then we
may be able to change this instead of just using the judgment of City Engineer
regarding lighting.

for Street Improvements - Area District IV Hillside -Subdivisions be approved and
adopted as specifications applicable to the development of hillside properties in
Area District IV (residential) and that all developers be required to comply in

CITY PROJECT NO.C-23 City Engineer stated, City improvement project in which
ACCEPT STREET IMPROVEMENTS we undertook to provide curb and gutters on Meeker, a
Meeker Ave. street already developed b y residences. We sent out
DISAPPROVED letters early in planning stage and asked cooperation of
• owners along street to put in improvements at rate of
$1.35 per front foot which we estimated would pay for curb and gutters. Some two
years has elapsed since starting and completion. There were more signatures than
payments and we wrote another letter telling people we could not pave their property
unless payment of cost of this work was forthcoming. We let contract on basis of
only six lots not paid. Contractor has completed contract and we recommend on that
basis we accept street improvements according to contract and authorize release of
Performance, Labor, and Material Bond No. 323399 written by General Casualty Co. of
America and authorize release of amount of final payment of $533.23.
A motion to -authorize release of $533.23 for improvements done on Meeker Avenue was
withdrawn.
Councilman Brown: The road is raveling already and it is not up to specifications.
Do not feel it should be accepted for the City of West Covina.

PLANS Precise Plans was read by Mr. Gerschler as follows:
It would appear to be impractical -from t,be standpoint of administrative procedure
to levy and collect lot fees on Precise Plans for the following reasons:
The amount of the fee would have'to be set either on an acreage basis,
on the estimated value of proposed improvements or as a flat fee for
each approved plan. A fee based on acreage.would be difficult to re-
concile when past or future subdivisions would require the payment of
$25.00 per lot, under the provisions of Ordinance No. 225.
A fee based on the estimated value of improvements would not be prat-
tical.becaus.e.it would....tend....to inequitably assess those property
owners least responsible.for the need for -park facilities. It would
also be a cumbersome and time consuming task to'arrive at the actual
amount of the fee to be charged.
A flat fee for each approved plan would be the simplest method, admin-
istratively, if it were possible to integrate such a fee with the
system now being emp]Wed under the Subdivision Ordinance.
• The conclusions which may be drawn from this are; that whatever method
of assessment is employed, it should not conflict with the procedure
presently being followed in the case of Subdivisions and it must 'be
equitable to those being assessed.
Under a separate report which will be submitted at an early date, I will attempt
to outline the necessity of requiring the filing of a Subdivision,or Record of
Survey Map for each lot split in the Multiple Family, Professional Commercial or
Manufacturing Zones and also the advantages gained by requiring the filing of a
Certificate of Survey for each approved Precise Plan. If the City of West Covina
were to levy their established lot fee, presently 25.00 on each Certificate of
Survey, the result would be, in my opinion, a fair, equitable and practical manner
by which the problem of lot fees on Precise Plans could be accomplished.

REPORTS OF City Administrator stated that ordinances covering the new,,'personnel--
ADMINISTRATOR system and the City Manager had been. 'prepare.d by the City Hai �"'staff,
and presented to the Cit4 Council for their review. I now understand
that an ordinance has been presented by the Citizens° League regarding the City
Manager°s position, and I recommend that the City Council meet and review these 3
items as soon as possible.in view of the fact that we have now completed our review
of applicants for this position. There have been approximately 20 applicants of
which 6 only meet the qualifications established by the City Council. I recommend
that the Council review the applications as soon as possible so that we may notify
the applicants when they may appear for their personal interview. We shouldclave
the City Manager's ordinance and the personnel system ordinance resolved so'irtrha"t when
the new officer comes in he will have an ordinance to conform too
Mr. Nollac, Sanitation Engineer, who is the USNR is now required to take his two
week training cruise with the U. So Navy and has inquired with respect to his pay.
In checking we find that most employers pay the difference between what a man gets
from the U. So Government and what his pay is. Ino Mr. Nollaces case this would
amount to approximately $70.00 and I would recommend we pay Mr. Nollac the difference
between government pay and City pay. Motion by Councilman Brown, seconded by
Councilman Kay, and carried, that the recommendation of City Administrator that
Mr. Nollac be paid the difference between his government pay and City pay be approved.

City Administrator stated..that.notice has been received from County Boundaries
Commission giving notice of proposal filed b y City of Covina on "North Annexation
District No. 27" to be annexed to Covina. This area is in the northeast section
of Covina. Recommend no objection. No action necessary.
City Administrator read communication from Frank J. Weiss, Attorney, 1012 E. Hunting-
ton Drive, Arcadia, requesting on the behalf of Mr. & Mrs. William Killian, of
1311 E. Thackery St., West Covina, that permission be granted to allow the Killians
to continue raising Chinchillas on'their-property for a period of six months
and that the Building Dept. be authorized to allow,the Edison 'Co. to hook up the
new wiring, if the wiring passes inspection, to prevent loss of these valuable
animals. Killians had purchased this property in September of 1954 for purpose of
raising chinchllas upon representation by the former owner and broker that the
property was zoned Aml, and they were not aware of proper zoning until new wiring
was inspected and actual zoning was pointed out to them. Motion by Councilman

approve installation of wiring to be used for a period not to exceed six (6) months.

City Administrator read communication from Acting Director of Public Works to
East San Gabriel Valley Planning Committee recommending that this Committee
recommend to East San Gabriel Valley City Engineers that they commence necessary
studies for priority lists for special improvement projects as early as possible
as planning for budgeting of funds for Los Angeles County Dept. for 1956-57 has
already commenced.
City Administrator read communication from Mr. Harold Johnson in regard to possi-
bility of spending new -Section 1890 Planning Funds for purpose of developing road
• plans on Service Ave. along the Civic Center. Also discussed with Mr. Cramer,, the
City and County Projects Engineer for State -Highway to have this portion of Service
Avenue declared a street of major importance so City could progrgm State Gas Tax
Funds for the construction thereof. -Need of vicinity, map,, typical cross section.,
and an estimated'A.D.T. count to -justify approval of Service Avenue for street of
major importance, and how it ties into Sunset Avenue, a major street. Form will be
sent and Mr. Johnson feels this should be taken care of at once by Engineering Dept.
City Administrator presented and read report of Col. Wetherby regarding use of
Civil Defense Building and Police Department report.
Councilman Kayo I have a matter which I feel should be brought out. We had a case
tonight regarding curb and gutters and I believe that policies of
the Council regarding things of this nature should have Resolutions written up so
that such matters are routine when they come before use thus, we -would -not need to
trust to memory each time. Various departments should prepare Resolutions covering
all matters of.policy so there.never will be any question in the future.

CITY MANAGER ORDINANCE Mayor Hurst stated that there is a City Manager Ordinance
drawn up by City staff and one been presented by Citizen's
League and there will be a committee meeting to discuss this matter.
Councilman Kays If we are going to -discuss proposed ordinance that has been
hmcbd to us don't you think we should perhaps ask some of
those who presented this ordinance to attend this committee
meeting?
Mayor Hurst:. I think we should first go through these ordinances then if
you wish to bring others in that would be fine.
Mr. Jennings: Citizens' League spent considerable amount of time on this
ordinance and we wish the Council to adopt it as presented
and include in the ordinance that it be offered to public
for adoption at election in April next year.
Mr. Swanson: Is it considered proper to hold a closed meeting'on the
consideration of these ordinances?
Mayor Hurst Study meetings are always in order as long as no decisions
are made.
Mr. Jett I am not familiar with this ordinance or committee that
1432 Danes Dr. adopted it but if they are notified of any meeting that you
are going to consider adopting a resolution or ordinance
they propose I wish to be present.
Suggestion was made that perhaps copies of ordinance drawn up by City staff could
be sent to Citizens' League for perusal. City Administrator stated this could be done.
