MINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY COUNCIL
CITY OF WEST COVINA, CALIFORNIA
October 3,, 1955
Meeting was called to order at 8s10 p.m. at the West Covina City Hall.
Present: Councilmen Sperline (Acting Mayor), Brown, Kay, Van Horne
Absent: T,uayor Hurst
Others Present: City Clerk and Administrator, City Attorney, City Engineer,
Planning Technician, Acting Director of•Publi.c Works (part time).
ORAL COMMUNICATIONS None
WRITTEN COMMUNICATIONS City Clerk presented and read communication} from Covina
School District, per Paul B. Salmon, District Superin-
tendent, requesting crossing guard at the intersection of Rowland and Azusa Avenues
between the hours of 9:00 to 9:45 a.m. and 4<00 to'.4:45 p.m. Request is being made
as a result of traffic survey conducted by West Covina Police Department. Motion
by Councilman Brown, seconded by Councilman Kay, and carried,,' to authorize expendi-
ture for another crossing guard at intersection of Rowland and Azusa Avenues
between the hours of W0-9:45 a.m. and 4:00-4:45 p.m. in the. event.that present
personnel cannot takeocare of this particular problem. Passed on roll call as
follows:
Ayes: Councilmen Sperline, Kay, Van Horn, Brown.
Noes: None
Absent: Mayor Hurst
City Clerk presented and read communication from Sponseller & Sons regarding Zone
Change No. 38, Unclassified Use Permit No. 10 and Precise Plan No. 44. Desire to
appeal decision of Planning Commission on September 19, 1955, which'denied this
Zone Change at public hearing. They do not believe that Planning Commission was
fair and just in their decision. Motion by Councilman Brown, seconded by Council-
man Kay, and carried, that date be set for hearing on this appeal October 24, 1955.
Mr. Burroughs of the State Highway Division stated that prior to this time they
were supposed to acquire property at. -NE corner of Irwindale and Garvey for an off -
ramp which was requested by the City, and because of Planning Commission's action
Sponseller now refuses to sign. Up to the present time the Highway Division only
has permission for right of entry for construction, and, consequently, if Sponseller
withdraws this right of entry there would be no off ramp. Sponseller verbally gave
to State of California right to go on his property to constrict an qff-ramp but now,
because Highway Division has no contract actually -signed this off -ramp may be lost
unless the zoning on this corner, is straightened out. Mr. Burroughs did not think
that hearing held up until October 24th will do any harm.
Councilman Sperline. Direct City Clerk to notify Mr. Sponseller that hearing on
this matter will be held October 24th.

BID AWARDED Motion by Councilman Brown, seconded by Cpjncilr}4n_Kay,
STREET ROLLER and carried, that bid be _awarded to Essick.Machirlery
Company of Los Angeles as lowest responsible bi4jor for
street roller at $4,790.00, that Mayor and City Clerk be authorized to execute
the contract and bids be returned to the unsuccessful bidders. Passed on roll
call as follows:
Ayes: Councilmen Sperline, Brown, Van Horn, Kay.

Absent: Councilman Hurst.
Councilman Brown. stated- that...at..the time. City. advertised, .for .roller bids, we
• also advertised for trailer bids but did not feel that specificatiope wer p made
clear regarding trailer. After talking with Street Department and City Engineer,
he thinksit would be advisable to have a motion to re,ject..trailer bids and read-
vertise for bids. Motion by Councilman Van Horn, seconded by Councilman Kay, and
carried, that all trailer bids be.rejected and returned to bidders, and that City
readvertise for trailer bids. Specifications on trailer to be developed by Street
Commissioner, City Engineer, and Street Foreman.

BID AWARDED Motion by Councilman Van Horn, seconded by Councilman Kay,
1ff- Ton Ford Truck and carried, that bid be awarded to Organ-4ayburn Motor
Pick -Up Body Company of San Gabriel as lowest responsible bidder for
Ford Truck at total..price of $1,627.42, that Mayor and
City Clerk be authorized to execute the contract and bids be returned to; the unsuc-
cessful bidders. Passed on roll call as follows:

D1S_C.USSION OF LOT FEES Mr. Gerschler of the Planning Department sated that the

Planning Dept. this meeting but should be completed to en,ble matter to

PROCEDURE ORDINANCE Councilman. Kay presented a copy of Procedu�e Ord Nance of
the City of Coronado which sets forth genotdl or4br of
business in conducting a Council meeting. Councilman Kay suggested that this copy
be submitted, along with four or five recommendations that he, Councilman Kay, has
made and any that might be forthcoming from other Council members tp the 'Qity
Attorney to see if such a type of ordinance could be drawn up for Wppt Covina to
tie various things down as to procedure'. He believessuch a P'rocedutie Ord. nance
would be a good thing to have in the City. Motion by Councilman Va#-Horn, seconded -
by Councilman Brown, and carried, that the -copy of Procedure Ordinance'of-the City
of Coronado be.given to the City Attorney to use as._a basis for a similar ordinance
in West Covina and copies of which to be presented to members of the Council for
further study. Councilman Sperline not voting.

CIVIL DEFENSE CONFERENCE City Clerk presented and read letter directed to Mayor
SACRAMENTO Hurst regarding conference called at Sacramento, to be
Attendance of Col. Wetherby held October 13 and 14 of local government officials
APPROVED charged with responsibility of Civil Defense because
of many changes in Civil Defense planning:ar}d nded for
discussion. Motion by Councilman Brown, seconded by Councilman Kay, and carried,
that the attendance of Col. Wetherby to Civil Defense conference be approved and
expenses not to exceed $125.00, with itemized account to be presented. Passed on
roll call as follows:

GLENDORA & BARBARA AVENUES City Clerk presented and read report from City
APPROVED Engineer regarding possibility of owners constructing
sidewalks along the southeast side of Glendora Avenue
adjacent to Lots 61 and 62 in Tract No. 12785 and in view of expressions of Mr.
Rugen, owner of Lot 61 in Tract 12785 at 604 Barbara Avenue and Mr. Bates, owner of
Lot 62 of Tract No. 12785 at 928 South Glendora Avenue recommendations were as fol-
lows:
1. "That the City of West Covina provide for necessary excavation
and widening of asphaltic pavement on aggregate base in front of
said lots 61 and 62 of Glendora Avenue. This work would not
include the construction of concrete curbs, gutter; or sidewalk.
The work could be conveniently installed in connection with im-
provements to be installed with Mr. Hotchkiss' precise plan,
which adjoins the subject property on the south. We estimate
the cost of this work to be done by the City at $1,525.00."
Councilman Sperline I feel if we put sidewalks in we are definitely setting up a
policy. We are allowed to widen street and improve streets.
Councilman Kay We have established that we can do asphalting and owner curbs
and gutters.
• Councilman Van Horn If we do the asphalting of this street would we do this with
others?
Councilman Brown We have been doing this on other places in older developments
where property is improved but not on new ones.
Councilman Sperline Street is in bad condition at point spoken of, and I think we
are justified in fixing this street.
City Engineer Supposing a situation developed'similar to this whereby Ctiunci..
declared the situation to be unsafe on account of children
walking to and from school. If the Council decided it was a
safety problem could they order in sidewalks within a 2 mile
radius of school with tax assessment on owners?

City Attorney You may under 1911 Act install sidewalks under assessment.
Council may order at cost of property owners where a hazard
exists. You'should not spend City funds to put in a side-
walk. City may form a district and install without consent
of property owners if a hazard exists. You may repair
streets, install streets, etc., but when you come to side-
walks that is something else. I do not think you should
favor any one section with these,
Councilman Sperline If we can put something in that at least will help to elimingte
any hazard in walking along Glendora Avenue we should do so.
Councilman Vas %rn Is this the only place that has such a hazard to school
children?
Councilman Brown This is the worst one and I know that the other hazardous
place will probably be alleviated in the near future, as soo�
as the improvements go in.
Motion by Councilman Brown, seconded by Councilman Kay, and.carried, that--the---
recommendationof the Gity Enginoer be approved and authorize the expenditure,
not to exceed $1,999.999 for necessary excavation and widening of asphaltic
pavement on aggregate base in front of said lots 61 and 62 on Glendora avenue.
REPORT OF CITY
a) Transfer of employee - City Administrator stated that a
ADMINISTRATOR
study had been made of this problem and findings are that a
transfer of a man from Parks and Recreation to Street Depart -
men -tat this time would be very inadvisable until we
straighten out our employment situation.
b) Employment of two men - Street Dept.. - City Administrator°
stated that this matter also should be held over.as same
situation applies as in regard to transfer of employees.
c) Plans and Specifications m Sanitary Facilities - Council-
man Van Horn stated that Jr. Gerschler has stated that he
does not have the time to. -get plans and specifications for
rest rooms to be installed in our two city parks and wishes
to know if it would be possible to receive authorization
from the Council to hire some outside help to get these plans
completed. I believe if this authorization is given we can
leave -it up to Mr. Gerschler to see that the job is done.
Mr. Gerschler
I feel that the cost of this plan would not exceed $400.00.
Motion by Councilman
Van Horn, seconded by Councilman Brown, that authorization be
given to obtain outside help for drawing up plans and specifications of rest rooms
for two parks with cost not to exceed $400.00. Passed on roll call as follows:

BURNING REGULATIONS Communication was presented and read from Fire Chief Hardin
regarding what recommendations can be given for open burning
and incinerator burning as applies with rulings on these matters set forth by Air
Pollution Board and Los Angeles County Board of Supervisors.
Motion by Councilman Kay, seconded by Councilman Brown, and carried, that until
legal question is resolved, "Rule 54, Outside Open Burning", remain the same in
City as in effect at the present time.
Motion of Councilman Kay that City Attorney be instructed to draw up an ordinance
that is in accordance with County and Air Pollution District in regard to incinerator
burning being done in the evening hours was withdrawn,
EMPLOYMENT OF Motion by Councilman Kay, seconded by Councilman Brown, that
NEW FIREMEN effective October 10, 1955, at a startingwage of $319.00 per
month the following men are to be employed as firemen in the
City of West Covina with the usual 6 months probationary period: Dale Co Andrus,
Robert L. Madsen, Darrell D. Dotter, Harry No Taber, Charles E. Harrison, Earl Re

CIVIL DEFENSE BUILDING Councilman Van Horn stated.that he wished the approval of
USE BY ORGANIZATIONS Council. that Parks and Recreation Commission will have
final authority to give approval to all organizations
using the Civil Defense Building for recreation facilities
through a letter from Colonel Wetherbyo Motion by Councilman Van Horn, seconded

BUILDING DEPT. REPORT City Clerk presented and read Building Dept. report for
HELD OVER September, 1955o Recommend this be held over until
regular meeting on October 10, 1955.
APPLICATION FOR Motion by Councilman Kay, seconded by Councilman Brown,
CHRISTMAS TREE and carried, that October 24, 19559 be the deadline in
SALE PERMITS which application for permits to sell Christmas trees
can be acted on by the -Council.
BARRANCA STREET Motion by Councilman Brown, seconded by Councilman Kay9
INTERCHANGE and carried, that Director of Public Works be authorized
to submit letter recommending approval of plans of Barranc4
Street Interchange dated September 27, 1955., providing an additional off ramp be
established in NE section.

Works. Since Council had not been able to study these
recommendations it was consensus that this be held over
for further study until meeting of October.10, 1955, with
be made and presented to members of Council.
Councilman Brown presented and read communication from
Acting Director of Public Works recommending that effective
immediately soil compaction tests be required on all street
accredited soil engineer and approved by City Engineer
Motion by Councilman Brown, seconded by Councilman Kay,
compaction tests as indicated by Acting Director.of Public
HOLLENBECK ST. BRIDGE City Engineer stated that he had asked a contractor,
WALK -WAY Mr,, Zoelle, the cost of building a foot bridge on
Hollenbeck Street -,over Walnut Creek Wash. After going
down to look at -this location it was found there was no place to attach it on
the outside of the bridge. Only possibility is a walk -way or suspension bridge
over the Wash. City Engineer to develop facts and report further.
