12-27-1954 - Regular Meeting - Minutes• MINUTES OF THE REGULAR MEETING OF 'DIE CITY COUNCIL CITY OF WEST COVINAs CALIFORNIA DECEMBER 27, 1954 Meeting called to order at 8:10 Y.M. at the West Covina City Hall, with Rev. Donald Locher of the West Covina Methodist Church giving the invocation. Present: Mayor Hurst, and Councilmen Sperlines Van Horse Kaye Brown Absent: None Others City Attorneys City Clerk, City Engineer,, City Administrator. MINUTES Minutes of December 13., 1954 had no additions or corrections and were APPROVED approved as submitted. ORAL COMMUNICATIONS None WRITTEN City Engineer, Mr. Pontow, presented `Lone Variance No..121, Precise COMMUNICATIONS Plan No.34, Charles Zug. Mayor Hurst suggested that this be taken up after Item No.8 on the Agenda and designated as No.8®A. City Attorney, Mr. Cornyn, presented a letter regarding the sales tax ordinance suggested by the Council. The Council will determine the tax rate, effective date,, and other information required for the development of the proper Ordinance. PUBLIC HEARING ZONE VARIANCE N0.134 COVINA SCHOOL MSTR. (HELD OVER) REFERRED BACK TO PLANNING COMMISSION Mayor Hurst announced that this is the time and place for public hearing on Zone Variance No.134. Location: North side of Vine Avenue between Azusa Avenue and Holler- book Street. Request R-A to R-2 (K-6 School Use.) Approved by Planning Commission Resolution No.219a All those present offering testimony at this hearing were sworn in by the City Clerk. • Mr. Ray Burkhart, 4947 N. Ben Lomond Ave., West Covina, spoks in favor indicating that this site had been chosen because it was best suited to serve as a school site for future student growth in the area, it was well centered to serve the particular area, and could be met under.the present financial limitations. Mr. T.H. McKay of 317 W. Main Streets Alhambra, Mr. M.D. Young of 2049 E. Vine Ave.,, West CoeLna, and Mr. Allen Sutherland of 232 S. Butterfield Road, West Covina., spoke in opposition stating that this site was objected to on the grounds that it does not conform to the Master Plan of Schools, that there had been no indication that it was to be eonsiderad for a school sites that it was in a better type residential area and would greatly depreciate surrounding property value. It was also noted by Mr. Young that the Master Plan of Schools showed a possible school site not too distant from the one chosen by the Covina School District. Letters were also read by the City Cleric from Mr. F.E. Cooney, Presi- dent of C & M. Homes, Mr. Grant Chapman and Mr. R.M. Philleo opposing the variance. No further testimonies were presented., hearing was declared closed. Motion by Councilman Sperline, seconded by Councilman Kay and carried that Zone Variance No.134 be referred back to the Planning Commission for further study for the following reasons: -1- C.C. Minutes 12m27-54 1. Does not conform to Master Plan of proposed school sites. 2. No.proof presented showing that effort had been.wade to obtain property shown on Master Plan of school sites. 3. Overloads this area with schools. 4. Deprives the City of too much tax free area. • 5. Property is located in section that has been sold . for subdivision of best. type residences based on fact that school would not be located here. Request from R-A: to R-2 for Church, Parish and School Use. Recommended by Planning Commission,, Resolution No.221. No testimony was presented and hearing van declared chased. Motion by Councilman Sperline, seconded by Councilman Brown that this Zone Variance No. 138 be approved subject to recommendations of Planning Commission as follows: l.. That necessary widening of Citrus Street be deeded to. City of West Covina. 2. That all street improvements outlined in Section.49.of Ordinance No.22% including utilities, be installed accordingly and meet the approval of City. Engineer. This to include street lights and sidewalks along Citrus Street'a • 3.. That adequate fire protection be provided.:. 4. That a legal description of the area be furnished. 5. That the subject area be fenced along North, West and South sides. 6. That the subject area conform to proposed R.OW of Los Angeles County Flood Control.Dfstrict. 7. Location: • Mary Bell Watkins North side of Merced Avenue 360 feet east of Lark Ellen Ave. DENIED Request R-A to R-2 Church Use. A request had been received from applicant asking for postponement from the regular Dec. 133, 1954 City Coancil meeting to the regular meeting of December 27, 19549 which was granted by the Councilo. A letter was read by the City Clark from William E. Cornell, Attorney for Mary Bell Watkins that the appeal was being abandoned and that Council dear this application "without prejudice" pending subsequent filing of a new applica- tion for zone variance at a future time. Mr. Richard Fedderson of 1512 E. Fortner Street, West Covina, asked that the City Council either grant or deny this Zone Variance, not using the words "without prejudice No further testimony was offered, hearing was declared closed. Motion by Councilmen KV, seconded by Councilman Sperline and carried that Zone Variance No.131 be denied. Passed on roll call as follows: Ayes: Coundlmen Hay, Sperline, Hurst, Van Horn, Brown Noes: None Absent: None ZONE VARIANCE NO.121 It was noted that hearings had been conducted on this PRECISE PLAN N0.34 property and because of study of rezoning it was held up. Charles Zug It was also brought out that this request had been brougit APPROVED forward long before any attempt had been made to rezone the City. City Council had also referred application back to Planning Commission and asked for recommendation by December 27. A motion was made by Councilman Van Horn, seconded by Councilman Brown, and carried, that this zone variance be granted subject to the two year time limit and upon the following re- comnendations of the City Engineer: 1. That all street improvements outlined in Section 49 of Ordinance No.225, including utilities, be installed accordingly and meet the approval of the City EngLneer. This to include street lights and sidewalks. 2. That the area for the widening of Azusa Aveo be deeded to the City of West Covina. 3. That adequate water supply and fire protection be provided in accordance with Ordinance No. 237. 4. That all bonds; fees and deposits be posted tefore building pe rmit s are issued. 0 • C.C. That a height limit of one story be imposed on all buildings within the proposed district. c. Advertising signs should be at least 500 removed from adjoining residential properties, and the height of same should be no higher than the one-story height of the buildings. d. Only one entrance and exit should be allowed on Azusa Avenue and Workman for the service station site on the northwest corner. e. A minimum distance of at least 1009 should be required for the entrance off of Workman Ave. into the main portion of the business area from Azusa Avenue.
