County City Clerk read a copy of a letter from the County of ACKNOWLEDGEMENT OF Los Angeles acknowledging receipt of Resolution No. 606 RESOLUTION NO. 606 of the City of West Covina requesting review of the Cityge Smier System preliminary plans for a seer system. ANNEXATION PROCEEDINGS City Attorney presented and read a petition signed by the Report of City Attorney nine owners of property involved in Annexation District No. n5, requesting that, since there has been a suit filed regarding the legality of the annexation, the City Council initiate a new pro- ceedings to annex the territory to the City in such manner that there can be no question as to the validity of the anneation, OPENING OF BIDS Mayor Hurst announced this is the time and place for Police Cars, Street Dept. opening bids for tto new police ears, a truck for the Truck and Patching Materials Street Department, and for patching materials. PUBLIC HEARING Mayor Hurst announced this is the time and place for PRECISE PLAN NO. 31 public hearing on appeal of Henry 0. Wackerbarth from and decision of the Planning Commission on Precise Plan ZONE CHANGE No. 30 No. 31 and Zone Change No. 30, requesting change from HELD OVER R=A (L.A. County A-1) to R=3 and Cd3 on property located at the SE corner of Orange Ave. and San Bernardino Rd. Area is under Annexation District No. 118 proceedingso At the beginning of the hearing, Mayor Hurst announced that all those wishing to testify in connection with arW of the hearings to be held would be sworn in by City Clerk, At this time, Mr. Wackerbarth, Mr. Owen Sloan and Mr. Marc Gross were sworn in. City Engineer read Resolution No. 202 of the Planning, Commission recommending disapproval 40 of Precise Plan No. 31, and Resolution No. 203 denying Zone Change No. 30. The formal appeal of the applicant was also presented. Mr, Henry 0. Wackerbarth, 1702 E. San Bernardino Road, the applicant, presented his case, stating he had revised the plan since it vas first submitted and is now asking for Cm2 and R,-j zoning except for the corner on which he has asked for Cm3 in order to install a super service station. Mr. Wackerbarth also reviewed development of the area and presented traffic counts and comparison of assessed valuation of properties. Also speaking in favor of the plan was Mr. Max Gross, 2355 San Bernardino Rd., who stated he felt a market was necessary in the area and that such a development would improve the surrounding property. -2- O.C. 10-25-54 Wackerbarth Test jLnoa I want to state that I was present at the hearing (before the Planning Commission) and I don't believe Commissioner Braun voted against this . . There was a little confus- ion at the time, but he voted and he corrected his vote and his vote was in favor of it. . , . Commissioner Brain voted in favor of this. But he corrected it and voted in favor of the application. Mr. Newton Green, at the conclusion of the second hearing, stated that at first he was against this application, but that seeing that practically, all of the opposition had beery withdr-awn, he was in favor of it, so that it seems to me that there are three men for it and three against it. At the time this matter was first here, fir. Kay asked as to whether or not we %ould go through with the annexation regardless of the classification. We couldn't accept a more unfavorable zoning than we had . . . We cant take an R-1 zoning. I have before me a•map of Tract 17140. Subdivision of the south half of Lot l of Tract 220. I own the north half. In the lower half of our block, Tract 17140 was subdivided into 64 lots. If we accept an R 1 zoning under the classification of the City of West Covina, we can only get 42 lots in this subdivision, and for that reason we could not accept an R-1 zoning, -Aiich gives us the right to subdivide and have only 42 lots. Unless we can have a +more favorable zoning, than we have now,. I will have to withdraw the application. We are asking that the northerly 3601 of this property be given commercial zoningo The first time this matter was up our proposed plan - we asked for 3800 for commercial zoning and 1200 for R-3 zoning, There was objection to that and we filed a new plan in which we in which we asked for the lower 1409 to go into an R=1 zone for private residence and that we have on the northerly 36W commercial zoning. We have asked for a C-2 zone and we are perfectly agreeable to having the northerly 360o zoned C-2 with the exception of the corner. Asked for C®3 for the corner for a super service station. It just seems to me that we cannot put in a filling station restricted as it is under the new ordinarxe and we expect to compete with three super service stations directly across the street. The application for zoning states three reasons vhy we feel that we are entitled to this. In our application for zone change, we tried to answer this first question, and I just want to call to your attention here to our state- ment . . . . . . . Not desirable for residential property because of the traffic con- ditions on San Bernardino Road. Have obtained traffic counts . . . and here Mr. Wackerbarth presented detailed statements and outlined developments in the area and .presented pictures. He also conpared the property valuation for residential, commercial and industrial purposos and presented a chart of surrounding properties showing assessed valuations. He also presented a document carrying 90 signatures of residents of the area approving commercial zoning. C.C. m 10-25-54 Precise Plan No. 31 & Zone Chance No. 90 Speaking in opposition was Mr. Owen Sloan, who lives directly to the crest of the subject property. Mr. Sloan felt that, living directly across the street, a super service sta- tion would be very objectionable, and felt that the south side of San Bernardino Road should remain residential. There being no further testimony, hearing was declared closed. Motion by Councilman Katy, seconded by Councilman Sperline, and carried, that this pro- posal be held over for further stud. Mayor Hurst, deeming himself disqualified, did not participate in this hearing. PUBLIC HEARING Mayor Hurst announced this is the time and place for •MODIFICATION OF ZONE MAP public hearing on proposed removal of Col area on Sunset Proposed Removal of C®1 Area Ave. between Francisquito Ave. and Merced Ave. from the on Sunset Ave. between zone map. City Engineer read Resolution No. 204 of the Francisquito & Mere Aves. Planning Comanission recommending removal of the C area APPROVED at this location. Mr. James Maul, 151 E. Badillo, Covina, and Mrs. Olive Britt, Sunset Ave., were sworn in by City Clerk, and both testified in opposition to removal of the C zone. There being no farther testimony, heaving was declared closed. Motion by ounci]man Van Horn, seconded by Councilman Sperline, that the potential Col zone on Sunset Ave. between Francisquito and Merced Avenues be removed provided it be replaced at a new location in the area. Britt Harry M. & Olive Ma Britt covering property located at the south corner of Sunset HELD OVER Ave. and Merced Ave. City Engineer reviewed -Planning Commission Resolutions Nos. 192 and 193 denying Precise Plan and Variance. Motion by Councilman Brown,, seconded by Councilman Kay, that decision be held over until recommendations are received from the Planning Commission as to where one or more C zones should be located in this general area. Eichenbaum of Joseph K. Eichenbaum, covering property located at CONTINUED the SW corner of Barranca St. and Workman Ave. (12.7 acres) be continued until December 13, 1954. PUBLIC HEARING Mayor Hurst announced this is the time and place for PRECISE PLAN NO. 35 public baring on Precise Plan No. 35 and Zone Variance and No. 128 of Joseph K. Eichenbaum, requesting variance • ZONE VARIANCE NO. 128 from R A (County A 1) to C-2 on property located at the Joseph K. Eichenbaum southwest corner of Workman Ave. and Barrancs St, HELD OVER (Property is under Annexation District No. 125.) City Engineer read Resolutions No. 208 and 209 of the Planning Commission, recommending approval of Precise Plan and Zone Variance. At this time, Mrs. Samuels and Mr. Grant Tuaraill were sworn in by City Clerk. Mrs. Samuels, repre- senting the applicant, described the plan for development of the property. Speaking in opposition was Mr. Grant Terrill , 660 Camelia Drive, who pointed out that the surrounding area to the east is already residential or is proposed residential, and that there is a school across the street. There being no further testimony, hearing was declared closed. Motion by Councilman 5perline, seconded by Councilman Brown, and carried, that this proposal be taken under advisement. PUBLIC HEARING Mayor Hurst announced this is the time and place for ZONE CHANGE NO. 31 public hearing on Zon Change No. 31 of Max and Tillie Max & Tillie Ross Ross, requesting change from R-A to C-3 on property APPROVED located at 159 S. Glendora Ave. City Engineer read Resolution No. 210 of the Planning Commission recommend- ing approval of the zone change. There being no oral or written testimony, hearing was declared closed. Motion by Councilman Sperl.ine, seconded by Councilman Van Horn, and carried, that Zone Change No. 31 be approved in accordance with conditions outlined in Resolution No. 210 of the Planning Commission, and the additional stipulation that a drainage letter be provided from the property owner south of this parcel accepting drainage from this area. • PUBLIC HEARING Mayor Hurst announced this is the time and place for ZONE VARIANCE NO. 125 public hearing on appeal of M. K. Darby and.Associates, M. K. Darby from the decision of the Planning Commission on Zone APPROVED Variance No. 125, for service station use of property located at the HE corner of Glendora Ave. and Service Ave. Mr. Darby was sworn in by City Clerk. City Engineer read Planning Commission Resolu- tion No. 201 denying variance. Mr. Darby, 912 California Ave., one of the applicants, stated that because of developments in the area and those proposed, he felt the property was good only for business. The map of the proposed Vincent Avenue extension was reviewed to determine what effect this would have on the subject property. Motion by Councilman-Sperline, seconded by Councilman Brown, and carried, that Zone Variance No. 125 be approved subject to the following recommendations of the City Engineers 1) That the area for the widening of Glendora Avenue be deeded to the City of West Covina. This to include street lights and sidewalks. 3) That a 69 masonry wall be constructed adjacent to residentially improved property. 4) That adequate water supply and fire protection be provided in accordance with Ordinance No. 237. 5) That all bonds, fees and deposits for improvements be posted before building permits are issued. 6) That the variance conform to the plot plan submitted for the area. HELFRICK ANNEXATION Councilmen Kay and Sperline reported as a committee on Committee Report their investigation of the proposed Helfrick annexation at the east end of the city, to the effect that it would be of no advantage to the city to annex this property at the present time, particularly to consider it for commercial development.
