02-12-1947 - Regular Meeting - MinutesRegular Meeting of the West Covina City Council February 12, 1947 The Meeting was called to order at 8:00 P.M. Present Batchelder, Daniels, Hurst, Schabarum, Van Horn Absent None Minutes'of the February 5th. meeting read and approved. Matter of Percy Jacksons salary as Building Inspector was discussed. No regular policy was officially established. Motion was made by Daniels that salary of $350.00 be paid for the month of January 1947. Seconded by Van Horn and carried. The Mayor called for presentation of plans to the Council of proposals for the establishment of a business center in West Covina. . Mr. Bell offered a plan taking in approximately 118.acres touching Garvey from California to Lark Ellen extending both north and south of the highway. He read the proposal and left both a copy of proposal and map on file with the City Clerk. Copy of proposal filed in City Clerks on Center Proposal" file.. Mr. Anderson owner of the gasoline station at Sunset and Garvey submitted a letter from the West Covina Business Improvement Ass- ociation setting forth their proposal for a business center. A copy of this letter is filed in City Clerks "Business Center Proposals" file. Mr. 0. D. Harbert stated that he hopes to have a proposal to offer at Orange and Garvey but that he has not as yet had a definite reply from the largest land owaer in the parcel that he wants to include in his plans. Mayor Batchelder told the Council that he wished to go on record as having offered his property at 254 E. Workman and that he would offer his home to serve as a City Hall. He said that he wanted it clearly understood that he did not care to make ]his offer a competative one but that if other offerings failed there would be a bona fide proposition to consider. . Schabarum asked if he would give his offer in writing and how about a right of way. The Mayor answered this by saying that he would give the proposal in writing at such time that it would not become competative and that a right of way would of course be arranged. He asked the Council to only consider his offer a suggestion or idea at present. Mr. Struthers a building material man was present for the purpose of inquiring about a varience for a building supply business. He said that due to the nature of the business and the great demand at this time for building material it was necessary to know at once if he could depend on being allowed to build and operate, He said that any area large enough to operate would be suitable and that it did not have to be on Garvey. Daniels asked if 90 days would be too long a time for him to wait for an answer. He said that he would have to confer with his associates. The time is now ripe for conditions might change in 90 days to such and extent that it might not be advantageous to establish such a business in West Covina later. Schabarum asked if he would be satisfied if the Counsil would either tell him where he could locate in 90 days or issue him a varience #f zoning plans are not settled then.Daniels said in other words we either tell you where the business section will be located or locate you by varience. Struthers said then that he would have to wait. • Otto Worthy complained about the drainage of water onto his property located between Merced and Francisquito on Walnut. He said that water coming off of the street of a neighboring subdivision would flood his house if something was not done about it before the next heavy rain. Danils told him that it would have to be inspected before anything could be done. Worthy then asked about the two trees in front of the West Covina School House. He said that they were on City property and would have to be moved to make way for driveway on account of the building program. He had been quoted a price of $120.00 for the removal of both trees. Council deligated the street commissoner to take care of the matter in the best possible way. Bills for January read by City Clerk. Daniels moved that they be paid. He said that Mr. V11s thought that they should be placed in a special fund with a letter from subdividers containing the necessary amount of cash deposit ao,,t authorizing the City to use such fund for that purpose. The matter of handling Fire Plugs on Lane Tract referred to City Engineer Ells for his recommendation. Resolution #97 was offered Daniels to accept the resignation of City Attorney Smith and to express the sincere appreciation of the City Council for the many years of faithful and efficient service rendered The City of tidiest m Covina. Schabaruseconded and it was carried by unanimous vote. The new City Attorney was authorized to draw up a Resolution with proper wording. • Mr. Sam Zimmerman of Baldwin Park was appointed the new City Attor- ney. Daniels moved for the appointment salary of $50.00 a month retroactive February 1, 1947. Hurst seconded and motion carried by unanimous vote of -*q, .The City Clerk was also instructed to send a copy'to Mr.Smith. Councilman. Hurst suggested that a gift be sent to Mr.Smith. Van Horn moved that the City of West Covina send a gift of appreciation for gust service to Mr.Smith. Hurst seconded- Motion carried. Daniels mehtinned that a complaint had been made to him on Harbert's Arrow Sign on the highway at Orange and Garvey. It was referred to the Chief of Police. City Clerk was instructed to also pay the retiring City Attorney, Lance Smith, for the month of February, 1947. Discussion took place as to proper yearly license charge for various. businesses but no decision was made. Ordinance #132 Repealing Ordinances #33 80-90-110 which were amendments to Ordinance #39 creating cones for business. ( These were cancelled because applicants had not availed themselves of the varience priviliges granted them within 6 months from date of issuances Adoption of this ordinance was moved by Hurst seconded by Schabarum and the vote stood as follows Ayes: Batchelder, Daniels, Hurst, Schabarum, Van Horn Noes: None Absent: None City treasurers report and also one from City Auditor were read by City Clerk Daniels moved that a Planning Commission for the City of West Covina be appointed and also that a City Planner be employed. Hurst seconded --motion carried. . -` The application for varience for business from B . Rhea Lan at 1540 Garvey was brought before the Council. Hurst moved that du to the decission of the Council to appoint'a Planning Commissioneo•who would • handle all such matters that this varience be denied and the $25.00 check issued to City as application fees be returned. Daniels seconded and motion carried. Letter read from Harold Duff subdivider of Tract 13988 asking that the City withold $60.?9 for amount on deposit for fire plugs and that the rest of the funds hold as a guarantee f oi� completion of street Improvements.be closed out•. Letter read from Elianor Samuels requesting settlement of her street improvemOnt deposit on Tract 138920 was also read. Both letters referred to City Engineer for recommendation.
