`;. 18,1944 and as there were no objectilns they were declared
approved as read.
Petition was presented signed by a- group of .East End residents
requesting the. City -Council to go on record with a protest
against the establishment of .an Off -Sale Liquor store at 506
East State Highway (Garvey) by Louis, Dela.ye and Chester L.Srnith.
The demand was to protest the issuance of such licenses to said
parties by the State Board of Equalization of California.
I.t was roved by Councilman HursWAhe Council adopt the attached
Resolution # 68 the motion was seconded by Councilman Daniels
and the vote stood as follows
Ayes- Batchelder,Daniels,Hurst ,Van Horn
Absent 11-rossberg
Noes -None
The City Clerk was . instructed to forward _.�Lhe;opyeof this Resolution
.along with the petitions received from residents to the State
Board of Equalization,S:acramento,.California at once so that they
would arrive there before the 29th day of October,1944 the last
filing date.
,-A motion was made b,, Councilman Van Horn that the city purchase
.the buildmng occupied by the City Hall at 361 '`lest State Highways,.
;;;Vest Covina,Calif. (description of the property being as follows ((,+,
lots 4,5&. 6 in tract 11798 Reap Book of Los Angeles County,Calif.)
at a price of $5,750.00 the funds to be borrowed by the General.
• Fund from the Street Improvement Fund of the City and that the
General Fund pay the loan to the Street Improvement -Fund at the
rate of $500.00 or more per year t.mg6bheru*1th interest at the rate
• of 1/2 of if per annum.
This motion was seconded by Councilman Hurst and the vote stood as
follows. Yeas- Bitchelder,Daniels,Hurst,Van Horn
Noes- None
Absent,Mossberg
It was moved by Councilman Daniels that -Councilman V== Horn be
authorized to purchase Kitchen fixtures and equipment necessary
to fit up .the rear room of building -as living quarters for the
Chief of Police and family so -that at all times there would be
some one at the police station or City Hell to receive emergency
calls. The motion was seconded by Councilman Hurst and it
passed by, vote stated. Ayes- Bat chelder,Daniels,Hurst nVan Horn
Noes -None.- Absent Mossberg.
As ther was no fut r business meeting was declared adjourned.

Tht protests have been filed by citizens living in the
-vicinity of the location where the proposed liquor business

The City Council after due investigation and consideration
of the matter finds, that the establishment of this liquor
business at 'said location would be contrary to public
morals and the public welfare and that the premipes are not zoned.b.

PETITION OF FREDERICK SPENCER -�
TO THE CITY OF WEST COVINA, STATE OF CALIFORNIA; AND TO THE
HONORABLE MAYOR AND THE CITY COUNCIL:
The petitioner, Frederick Spencer, states that he is a citizen and
resident of the City of West Covina; that he owns his owl -home and
residence property therein at #640 Virginia Road (and is called the

petitioner herein) and states and petitions as follows.:.
States that Louis DeLaye and Lester L. Smith are applying to the
State Board of Equalization of the State of California for the is-
suance of liquor licenses to be issued for the premises at #506 E.
Garvey Bvd., City of West Covina (called herein the 'premises') as
follows: 1) The transfer of an 'off sale distilled spirits license'
to the present applicants from Mervin R. Hoskins and Chester L.
Smith (#C-9362 -H) from location 613 Front St., Norwalk,, California;.
2) the issuance of a wine bottling and packaging license; 3) issu-
ance of an off sale beer and wine license,
The petitioner refers to and makes a part hereof city ordinances
#31 and #82 of the City of West Covina.

Refers to and includes herein a certain protest, or protests, dat-
ed October 18, 1944, executed by this petitioner and others,, and
protesting to the State Board of Equalization against the issuance
of a liquor license for the premises, and herdtofore filed with
yourselves for transmission.

Petitioner refers to any information now possessed by any employee
or official,of said city and makes same a part hereof,

The petitioner eaffirms and restates all statements made by him in
the verified ption referred to and adds specifically that young
children live 16 residence about 250 feet from the premises and take
their recreation and perform other activities with the premises in
plain view of them.
V
The petitioner further states that the 'premises' afie the same prem-
ises for which a 'zone variance' was granted by ordinance #82; that
such variance.permitted only a structure for the operation of a res-
taurant. That no_ other'l,.variance has been granted for such premises
and that under the laws of the city of West Covina the applicants
could not legally conduct an off sale or bottling liquor establishment
on the premises; but that the same would be a misdemeanor,

WHEREFORE the petitioner petitions an requests that the City of
West Covina do file with and presen to the State Board of Equal-
ization of the .State of California against granting said licenses
or any of them to the applicants the grounds that their issu-
ance would and will be contrary to public welfare and morals, and
upon the facts existing which tend to and do disqualify the prem-
ises in question, and upon such other grounds and facts as are
known, or may become known, to the city council and other of-.
ficials of the City of West Covina; to the end that a hearing may
be ordereel by the State Board cif Equalization to determine the
