2584_Attachment_1_-_Resolution_2024-67_-_FFA_and_FMA_ADR_AgreementRESOLUTION NO. 2024-67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING LABOR MANAGEMENT WORKERS’ COMPENSATION ALTERNATIVE DISPUTE RESOLUTION AGREEMENTS BETWEEN THE CITY OF WEST COVINA AND THE WEST COVINA FIREFIGHTERS’ ASSOCIATION, I.A.F.F., LOCAL 3226 AND THE WEST COVINA FIRE MANAGEMENT ASSOCIATION The City Council of the City of West Covina hereby finds and declares as follows: WHEREAS, California Labor Code section 3201.7 provides employers and recognized bargaining units a means for providing alternative dispute resolution programs for workers’ compensation disputes; and WHEREAS, the City of West Covina (“City”) and the West Covina Firefighters’ Association, I.A.F.F., Local 3226 (“WCFFA”) desire to enter into an agreement that provides an alternative dispute resolution process for workers’ compensation claims pursuant to California Labor Code section 3201.7; and WHEREAS, the City and the West Covina Fire Management Association (“WCFMA”) desire to enter into an agreement that provides an alternative dispute resolution process for workers’ compensation claims pursuant to California Labor Code section 3201.7; and WHEREAS, the City and the WCFFA have met and conferred in good faith and negotiated a Labor Management Workers’ Compensation Alternative Dispute Resolution Agreement, attached hereto as Exhibit “A,” that provides active employees and retirees claiming compensable injuries under Division 4 of the California Labor Code with an expedited procedure to resolve disputes in accordance with the provisions of the agreement and to facilitate those employees’ prompt recovery and return to work; and WHEREAS, the City and the WCFMA have met and conferred in good faith and negotiated a Labor Management Workers’ Compensation Alternative Dispute Resolution Agreement, attached hereto as Exhibit “B,” that provides active employees and retirees claiming compensable injuries under Division 4 of the California Labor Code with an expedited procedure to resolve disputes in accordance with the provisions of the agreement and to facilitate those employees’ prompt recovery and return to work; and WHEREAS, the City Council desires to approve the Labor Management Workers’ Compensation Alternative Dispute Resolution Agreements with the WCFFA and the WCFMA. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby approves the Labor Management Workers’ Compensation Alternative Dispute Resolution Agreements between the City of West Covina and the WCFFA and the WCFMA, attached hereto as Exhibits A and B. SECTION 2. The City Council authorizes the City Manager to execute the Agreements on behalf of the City, in substantially the form as attached and in such final form as approved by the City Attorney. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall enter the same in the book of original resolutions and it shall become effective immediately.
