Resolution - No. 2023-57RESOLUTION NO. 2023-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE APPLICATION FOR AND ACCEPTANCE OF 2021 AND 2022 STATE HOMELAND SECURITY GRANTS AND AUTHORIZING THE ACTING CITY MANAGER TO EXECUTE ALL GRANT AGREEMENTS AND RELATED ASSURANCES THE CITY COUNCIL OF THE CITY OF WEST COVINA HEREBY FINDS, DETERMINES, AND DECLARES AS FOLLOWS: WHEREAS, the U.S. Department of Homeland Security, through the Office of Grants and Training, has provided financial assistance for the State Homeland Security Program (SHSP) directly to the California Governor's Office of Emergency Services (Cal OES); and WHEREAS, the Cal OES provides said funds to the County of Los Angeles, as its subgrantee, and the County of Los Angeles is responsible for managing and overseeing the SHSP funds that are distributed to other jurisdictions within Los Angeles County; and WHEREAS, for Grant Year 2021, the City is eligible to receive $72,000.00 in SHSP grant funds; and WHEREAS, for Grant Year 2022, the City is eligible to receive $45,577.00 in SHSP grant funds; and WHEREAS, to receive the SHSP grant funds, the City is required to enter into Subrecipient Agreements with the County of Los Angeles and make assurances in connection therewith; and WHEREAS, the City Council desires to approve the 2021 and 2022 SHSP applications and grant awards and authorize the Acting City Manager to execute all required agreements and make all required assurances. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The City Council hereby approves the application for and acceptance of the 2021 and 2022 State Homeland Security Program grants. SECTION 2. The City Council hereby authorizes the Acting City Manager to execute any and all grant agreements for the 2021 and 2022 State Homeland Security Program grants, in such form as approved by the City Attorney, including, but not limited to, the Subrecipient Agreements with the County of Los Angeles, and all assurances required in connection therewith. The City Council further authorizes the City Manager to accept and appropriate additional funds made available to the City through the 2021 and/or 2022 State Homeland Security Program grants and execute any documents required to accept and/or expend such additional funds, in such form as approved by the City Attorney and the Finance Director. SECTION 3. The City Council hereby agrees as follows for the 2021 and 2022 State Homeland Security Program grants: a. To provide all matching funds required for the grant project(s) and that any cash match will be appropriated as required; b. Any liability arising out of the performance of the agreement(s) shall be the responsibility of the City and the City Council; C. Grant funds shall not be used to supplant expenditures controlled by the City Council; d. The City is authorized by the City Council to apply for federal assistance, and the institutional, managerial and financial capability (including funds sufficient to pay the non-federal share of project cost, if any) to ensure proper planning, management and completion of the project(s) described in the application(s); and e. Official executing the agreement(s) is authorized by the City. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall enter the same in the book of original resolutions and it shall become effective immediately.
