Item No. 16 - PUBLIC HEARING TO CONSIDER A RESOLUTION ADOPTING FEES AND CHARGES FOR SERVICES PROVIDED BY THE WEST COVINA HEATLH DEPARTMENTAGENDA ITEM NO. 16 Xft AGENDA STAFF REPORT City of West Covina I Office of the City Manager DATE: May 4, 2021 TO: Mayor and City Council FROM: David Carmany City Manager SUBJECT: PUBLIC HEARING TO CONSIDER A RESOLUTION ADOPTING FEES AND CHARGES FOR SERVICES PROVIDED BY THE WEST COVINA HEALTH DEPARTMENT RECOMMENDATION: It is recommended that the City Council conduct a public hearing and adopt the following resolution: RESOLUTION NO.2021-34 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ESTABLISHING FEES AND CHARGES FOR SERVICES PROVIDED BY THE WEST COVINA HEALTH DEPARTMENT BACKGROUND: The COVID-19 pandemic created a regulatory compliance crisis for West Covina's local businesses, especially in the vital food service sector. The community, restaurants, grocers and other essential food providers requested and required information and compliance assistance that was not available from the County as they tried to meet the needs of more than ten million residents with little capacity to address the needs of the West Covina community. In order to fill this void, the City is initiating establishment of a City Health Department to ensure protection of public health through this pandemic and preparing for future needs as they may occur. The City anticipates utilizing multiple available revenue sources including grants, fees, subventions and contracts to initiate and maintain public health services, with American Rescue Plan Act funding utilized as a one-time transition supplement. The City of West Covina currently receives its public health services through the Los Angeles County Department of Public Health (County Health Department). In 1936, the City of West Covina adopted Resolution No. 2, consenting to the enforcement of all orders, quarantine regulations and rules prescribed by the State Board of Health, of all statutes relating to public health and to vital statistics by the County of Los Angeles (County) Health Officer within West Covina limits. In 1963, West Covina entered into its current Health Services Agreement (Agreement) with the County. Pursuant to the Agreement, the County provides health department services, including the enforcement of all ordinances relating to health and sanitation, inspections and related functions. The City's Health Code, which adopts by reference the County's Public Health Code, is set forth in Article II (Health Code) of Chapter 13 (Health and Sanitation) of the West Covina Municipal Code. On March 4, 2020, Governor Newsom proclaimed a state of emergency to exist in the State of California in response to the COVID-19 outbreak. Since the state of emergency was declared, Governor Newsom along with the County Health Department have imposed health orders aimed at curbing the spread of the virus. Attachments Attachment No. 1 - Resolution No. 2021-24 Attachment No. 2 - Exhibit A Table of Fees CITY COUNCIL GOALS & OBJECTIVES: Enhance City Facilities and Infrastructure Protect Public Safety ATTACHMENT NO.1 RESOLUTION NO.2021-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ESTABLISHING FEES AND CHARGES FOR SERVICES PROVIDED BY THE WEST COVINA HEALTH DEPARTMENT WHEREAS, on April 6, 2020, the City Council of the City of West Covina adopted Ordinance No. 2479, adopting by reference provisions of the Los Angeles County Code relating to public health in connection with the establishment of a West Covina Health Department; and WHEREAS, pursuant to Ordinance No. 2479, fees and charges relating to public health services will be established by resolution of the City Council; and WHEREAS, the City Council of the City of West Covina adopted Ordinance No. 1939 on August 16, 1994, codified at Article IX (Fee and Service Charge Revenue/Cost Comparison System) of Chapter 2 (Administration) of the West Covina Municipal Code, establishing the City's policy as to the recovery of costs for providing City services and establishing a mechanism for ensuring that the fees adopted by the City do not exceed the reasonable estimated cost of providing the services for which the fees are charged; and WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the City is authorized to adopt and implement rates, fees, and charges for municipal services; provided, however, that such rates, fees, and/or charges do not exceed the estimated reasonable cost of providing such services; and WHEREAS, California Government Code section 66016 requires notice to be given and data be made available at specified times prior to the adoption of new rates, fees, and charges, or prior to adoption of increases in existing rates, fees, and charges; and WHEREAS, California Government Code section 66018 requires notice to be published in accordance with California Government Code section 6062a and data be made available conceming rates, fees, and charges prior to conducting a public hearing with respect to the adoption of new rates, fees, and charges, or the adoption of increases in rates, fees, and charges for which no other procedure is provided by law; and WHEREAS, pursuant to California Government Code sections 66016 and 66018, the City Council has held at least one public hearing, as part of a regularly scheduled meeting, at which oral and written presentations could be made with respect to the rates, fees and charges contemplated by this resolution; and WHEREAS, City staff has developed a proposed fee schedule for services provided by the West Covina Health Department based on the fee schedule adopted by Los Angeles County, which has historically provided public health services to the City; and WHEREAS, the City Council desires to implement the proposed new rates, fees, and charges, for various services provided by the West Covina Health Department as set forth herein; and WHEREAS, all legal prerequisites to the adoption of this resolution have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES RESOLVE HEREBY AS FOLLOWS: SECTION 1. RECITALS. The City Council hereby finds and determines that the above recitals are true and correct. SECTION 2. REASONABLE COST FINDING. The City Council hereby finds and determines that based upon the data, information, analysis, and oral and written documentation presented to the City Council concerning the rates, fees, and charges described in Exhibit A," attached hereto and incorporated herein by this reference, do not exceed the established reasonable cost of providing the service for which the rates, fees, or charges are levied. SECTION 3. FEE SCHEDULE ADOPTION. The rates, fees, and charges set forth in Exhibit "A" are hereby adopted and approved as the rates, fees, and charges for the services identified for each such rate, fee, and/or charge. Such rates, fees, and charges shall be collected by the City's Finance Department when services are provided by the City or its designated contractors. SECTION 4. SEPARATE FEE FOR EACH PURPOSE. All fees set by this resolution are for each identified process. Where fees are indicated on a per unit of measurement basis, the fee is for each identified unit or portion thereof within the indicated ranges of such units. SECTION 5. ADDITIONAL FEES. Additional fees shall be required for each additional process or service that is requested or required, including when the requestor's delay increases costs, or if the original fee charged was too low in error. SECTION 6. REFUNDS. Unless otherwise provided in the West Covina Municipal Code or state law, in the event the person requesting the service withdraws his/her/its application or otherwise terminates the request for service before completion of the provision of the service, or if an error is made in calculating the fee, the City shall determine if any refund is owing, based on whether all costs reasonably borne have been incurred or committed, as well as the cost of refunding the fee. An amount not spent or committed shall be refunded, minus the administrative cost of processing the refund. Any extra amount charged in error shall be refunded without deduction. Notwithstanding the foregoing, refund amounts of twenty dollars ($20.00) or less shall be refunded only upon written request of the fee payor. SECTION 7. ANNUAL ADJUSTMENT OF FEES. The fees, rates, and charges set forth in the Public Health Fee Schedule attached hereto as Exhibit "A" may be adjusted on July 1 of each year by an escalation factor equal to changes in the Consumer Price Index for All Urban Consumers for the Los Angeles area ("CPI-U'), published by the U.S. Department of Labor, Bureau of Labor Statistics, which shall be calculated each May based on changes in the CPI-U from the previous May. Such annual adjustment may be approved by the City Manager and shall be incorporated into the Public Health Fee Schedule. In no event shall an increase in any rate, fee, or charge exceed the reasonable cost of providing the service for which such rate, fee, or charge is identified. SECTION &INTERPRETATION OFRESOLUTION. Administrative interpretations of this resolution, including but not limited to provisions for waiver and appeal, shall be determined by the City Manager as set forth in West Covina Municipal Code section 2-407. SECTION 9. EFFECTIVE DATE. All fees, rates, and charges adopted by this resolution shall take effect on July 1, 2021. SECTION 10. CERTIFICATION. The City Clerk shall certify to the adoption of this resolution and shall enter the same in the book of original resolutions. APPROVED AND ADOPTED this 4th day of May, 2021. In addition, the pandemic has impacted communities differently throughout Los Angeles County. Los Angeles County is one of the largest counties in the nation at 4,084 square miles, and has the largest population in the nation, with nearly 10 million residents, who account for 27% of California's population. The combination of the County's vast geographic area with the significant population size make it difficult to address the specific needs of communities that are impacted differently by the pandemic with one -size -fits -all policies. Each community and region within the County have had drastically different case rates and hospitalization numbers. West Covina has had relatively low infection rates compared to the Countywide rates even during the times the pandemic was surging in the County. On December 1, 2020, in response to complaints from residents and the business community and a desire to provide a more appropriate response to the pandemic based on West Covina's data, the West Covina City Council directed staff to explore methods to improve local public health — including alternatives to the County Health Department. On December 9, 2020, the City engaged Valley Physicians Medical Group, through Dr. P. Basil Vassantachart, MD, to provide consulting services relating to evaluating options for establishing a local health department. On February 23, 2021, the City Council adopted Resolution 2021-15 and Urgency Ordinance No. 2476, terminating the Los Angeles County Health Officer services identified in Health and Safety Code section 10 13 75. Staff submitted certified copies to the County by the March 1, 2021 deadline (Attachment No. 3). The termination will be effective July 1, 2021. To terminate the County's services, the City is required to provide notice of termination of the Health Services Agreement at least 30 days prior to the end of the fiscal year, or by May 31, 2021. The City received a letter dated February 23, 2021 from the County Health Department stating the County Health Department will continue to serve West Covina in its current capacity (Attachment No. 4). The City intends for services paid for by local property taxes continue to benefit the community. On March 16, 2021, the City Council introduced Ordinance No. 2478 and Ordinance No. 2479, and set the date for the public hearing regarding Ordinance No. 2479 for April 6, 2021. On April 6, 2021, the City Council adopted Ordinance No. 2478 and Ordinance No. 2479. DISCUSSION: Ordinance No. 2479 adopted by reference provisions of the Los Angeles County Code relating to health. However, the ordinance included minor amendments to the County's Code relating to penalties and fees, which cannot be adopted by reference. Pursuant to the provisions of Ordinance No. 2479, which will be codified in Article II of Chapter 13 of the West Covina Municipal Code, fees and charges for public health services will be established by resolution of the City Council. Accordingly, the City Council needs to adopt a resolution establishing a written schedule of fees for services provided by the West Covina Health Department. The proposed fee schedule (Exhibit A) reflects all fees that the Health Department could provide services for, and mirrors LA County's fee schedule. Since LA County has provided services to City residents at the rates set forth in its fee schedule, staff determined that it would be reasonable for the City to adopt and charge the same rates, since the same services will be provided by the City. All proposed fees are set at rates which ensure the fees charged by the City (a) provide for reasonable cost recovery in providing services, (b) do not exceed the cost of providing the service, and (c) are charged to the specific individuals or groups benefiting from the service. The proposed fees will ensure both cost recovery and appropriate staffing levels so that reviews and inspections are completed in a timely manner. The fee schedule will be reviewed periodically to determine if there should be increases or decreases based on the cost of providing services. The proposed resolution authorizes an annual adjustment to the fees in an amount equal to the change in the Consumer Price Index for Los Angeles County. The annual adjustment may be approved by the City Manager. The new fees will be effective on July 1, 2021.
