GARVEY AVENUE SOUTH WEST COVINA, CALIFORNIA 91790 MINUTES CALL TO ORDER A Regular Meeting of West Covina City Council was called to order on Tuesday November 20, 2019 at 7:00 p.m. in the Council Chambers located at 144 West Garvey Avenue South, West Covina, California, by Mayor Johnson. REPORTING OUT FROM CLOSED SESSION City Attorney Porter stated there was no reportable action taken during closed session. CHANGES TO THE AGENDA City Manager Freeland announced the following changes: Item # 13 — revised ordinance has been provided to the Council with changes to bring the item into compliance with state law. Item # 10 — This item has been pulled from the agenda and will be reagenized for a subsequent meeting following the reorganization of the new City Council. PRESENTATIONS Proclamation proclaiming November 24, 2018 as Small Business Saturday Mayor Johnson presented Economic Development Specialist Karen Ko a Proclamation in recognition of Saturday November 24, 2018 as Small Business Saturday. Ms. Ko recognized the Salad Box, Bun Street and Cherry Blossom Nation Salon as 2018 Local Favorite Small Businesses in West Covina. CITY MANAGER'S OFFICE 5) Termination of the Human Services Consortium of the East San Gabriel Valley (LA Works) Joint Powers Authority (JPA) CARRIED 5-0: to adopt RESOLUTION NO.2018-131 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, TERMINATING THE SEPTEMBER 11, 1979 JOINT POWERS AGREEMENT ENTERED INTO BETWEEN THE CITIES OF WEST COVINA, COVINA, AZUSA AND GLENDORA, AND DISSOLVING THE HUMAN SERVICES CONSORTIUM OF THE EAST SAN GABRIEL VALLEY (LA WORKS), to terminate the LA Works JPA. 6) Extension of Communications Site Lease Agreement with Mt. San Antonio College CARRIED 5-0: to authorize the City Manager to execute a five-year Lease Agreement Extension with Mount San Antonio College (Mt. SAC) for the placement of its radio antennas on the BKK Communications Tower. 7) Cancellation of the January 1, 2019, City Council Meeting CARRIED 5-0: to cancel the January 1, 2019 City Council Meeting. 8) File Server Storage Upgrade CARRIED 5-0: to authorize the City Manager, or his designee, to execute an agreement with DELL EMC to purchase new servers for data storage expansion, for the City Council Chambers for an amount not to exceed $46,363.02. 9) Appointment of City Commissioner CARRIED 5-0: to receive and file the informational report. COMMUNITY DEVELOPMENT 10) Extension of the Exclusive Negotiation Agreement with Singpoli Group LLC for Development of Former BKK Landfill (APN No.'s: 8735-002-906, 8735-002-909, 8735-002-910,8735-002-018) ACTION: MOTION BY COUNCILMEMBER WARSHAW AND SECONDED BY COUNCILMEMBER TOMA, CARRIED 5-0: to remove the item from the agenda and will be heard at a subsequent meeting. Approve Willdan for City Engineer services for $160 per hour not to exceed $115,500 through September 1, 2019; and 2. Upon submittal of a development application, authorize the City Manager to execute agreements for professional services. PUBLIC SERVICES 12) Galster & Heritage Park Trail Improvement Projects CARRIED 5-0: to adopt RESOLUTION NO.2018-132 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A BUDGET AMENDMENT FOR THE FISCAL YEAR COMMENCING JULY 1, 2018, AND ENDING JUNE 30, 2019 (Trail Improvements at Galster Park and Heritage Park) END OF CONSENT CALENDAR REORDER OF AGENDA ITEMS Mayor Johnson requested Item # 17 be moved forward and considered prior to Item # 13. Planning Director Anderson presented the staff report. Assistant City Clerk Butler stated no written objections have been received. Mayor Johnson opened the Public Hearing. There was no wishing to speak; therefore, Mayor Johnson closed the Public Hearing. ACTION: MOTION BY SPENCE, SECOND BY TOMA, CARRIED 5-0 to introduce, waive further reading and give first reading to ORDINANCE NO.2447 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA. CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE ARTICLE XVI, WASTE REDUCTION, REUSE AND RECYCLING OF CONSTRUCTION AND DEMOLITION DEBRIS, OF CHAPTER 7, BUILDINGS AND BUILDING REGULATIONS, TO BE CONSISTENT WITH THE REQUIREMENTS OF CALIFORNIA GREEN BUILDING STANDARDS CODE, CORRECT NECESSARY LANGUAGE TO REFLECT THE CITY DEPARTMENTS ORGANIZATION, AND REMOVING RE -ROOFING PROJECTS FROM PROJECTS REQUIRED TO MEET THE DIVERSION REQUIREMENTS 14) Code Amendment No. 18-02 Accessory Dwelling Units General and Statutory Exemption Mayor Johnson announced the Public Hearing matter, Assistant City Clerk Butler verified that proper legal notice was given and Mayor Johnson opened the Public Hearing. ACTION: MOTION BY WU, SECOND BY SPENCE, FAILED 2-3 (TOMA, WARSHAW, JOHNSON) to amend the proposed ordinance to have applicable lot size coverage be consistent with state law, maintain setbacks at 5 feet, remove minimum lot size of 12,000 square feet. ACTION: MOTION BY WU, SECOND BY SPENCE, FAILED 2-3 (TOMA, WARSHAW, JOHNSON) to amend the proposed ordinance to change the minimum lot size to 7,000 square feet.
