FEB ® 4 2019 Apparently you are considering undoing a ruling that you put in place only 2 ycAlaa g Division regarding the building of "guest houses" in West Covina. At that time the issue was researched, analyzed, debated & resolved satisfactorily to the vast majority of the people that were concerned. And rules were created & put in place to address similar situations that would occur in the future. A recent planning committee meeting confirmed the validity of those rules. Now, it seems, you are in the process of undoing all that was accomplished at that time. Thus my confusion. Why would you do this? Why would you deliberately want to put West Covina on a path to high density housing and the problems that come with it —congested parking, loss of privacy, overcrowded schools, over taxed city services, etc? Per Webster's dictionary: "suburb -------- smaller community adjacent to a city; the residential area on the outskirts of a large town or city." West Covina is a suburb. I have lived in West Covina for 50 years. I believe that the vast majority of people live here because they much prefer the characteristics & advantages that the SUBURB of West Covina offers. As representatives of the people of West Covina you have an obligation to preserve the dynamics of the place that these people have chosen to live. It makes no sense that you would deliberately do something that could eventually drastically affect the quality of life for these people. It would seem that there is more to this than meets the eye. From my friends & neighbors there certainly is no hue & cry to build guest houses. If, in fact, you have a friend or associate that you want to favor, I'm sure you can grant them a variance to the existing laws, assuming it doesn't impinge on the lives of their neighbors. But, to impose on the other 100,000 + people of West Covina is just wrong. Your own planning committee & the majority of concerned citizens have told you this is not a good idea. If you really want to listen to the people who voted for you, &, if you really want to do what is best for West Covina, this should not even be an issue. Apparently, the Council believes that for some unknown reason it is imperative to change the City's code related to ADUs immediately exposing the City to additional changes when state regulations are issued, in opposition to majority opinion on the matter, in opposition to its own Planning Commission recommendations, and to benefit only a few residents of our city. We are opposed to any changes until final state regulations are finalized and issued. We do sympathize with those individuals who may have elder -care issues, but honestly believe that the issue is much more complex than to simply relax the existing ordinance governing ADUs. To help you understand our position, on behalf of my wife and myself, I offer the following comments. I was born in Pomona, my wife was born in Hollywood, we were both raised in La Puente, and chose to live in West Covina because of its suburban and reasonably open environment, location, and reputation. We chose the location of our home 38 years ago for several reasons that I won't address here, but many of those would be changed negatively should ADU requirements be changed. We happen to live next door to a home behind which an ADU was built in 2014, and which was the topic of let's call them, "energetic" discussions and public comments before the Planning Commission. Although not completely satisfied with the results, my wife and I understand the dilemma that faced this Commission and the City who worked to resolve as many concerns as possible within the guidelines of the then existing ordinance to minimize the impact on all parties affected, and to develop an ordinance that would prevent future negative impact on existing residents. Yet, here we are again. I'll start with our conclusion. The City has an ordinance that has functioned well for the last 4 years, and it appears from discussions in past Planning Commission meetings that there have been and are in fact very few requests to build detached ADUs. As my dad used to say, "why fix it if it ain't broke?". The requested changes may benefit a few interested parties annually based on historical inquiries, but potentially affect many in a negative manner. Why do we feel this way? It appears that many residents have chosen to use existing 2 car garages for other purposes forcing them to rely on driveways at times, and streets. The result is poor appearance, congestion and decreased home values Second, I have heard comments that the current ordinance disincentivizes residents from building an ADU, and residents instead subdivide interior portions of a home, and/or convert garage space to living quarters. I believe that financial concerns and the avoidance of a permitting process are what incentivize residents to do this. It is less expensive to subdivide interior spaces and to "convert" a garage, and to bypass the City's permitting process, than to invest in and to build an ADU. Also, there is no reassessment of values for property taxes. Third, I do not believe that more population density as a result of ADUs will enhance homeowner values. Perhaps realtors may state this, but I suggest that formal studies may in fact challenge the notion. We along with many residents purchased homes in West Covina because of its suburban charm, and openness. Adding units and people will negatively impact that appeal and will not in fact increase values. We chose to live here rather than Los Angeles or other surrounding large cities to avoid the related density issues. Millennials enjoy portability and do not consider home ownership a vital concern as earlier generations did, and they tend to enjoy a more urban flavor where they live. However, I believe that many people still share our dream and enjoyment of a great city in a suburban and open atmosphere like West Covina. Fourth, personally we are blessed with a reasonably good view of the San Gabriel mountains and regularly remark while sitting on our patio how fortunate we are to be able to enjoy such a treasure in our area. Again, changing and relaxing the existing ordinance has the potential to take something away from us that we did not believe could or would be taken away from us, and is in fact something we sacrificed to purchase some 38 years ago. Fifth is the impact on municipal services including fire and safety, the sewer system and utilities. We understand that utilities are not controlled by the City and that the City's water supplier has assured it that it has "adequate" supplies to provide for the potential expansion. However, we are constantly reminded by Suburban Water of the need to conserve water use due to drought, by watering restrictions imposed on us, by the rising cost of water, and certainly by the new "green", or brown lawns and dying landscaping. How can this assurance be "reasonably" provided or accepted? It does not appear that studies have been conducted on the impact of increased noise, safety concerns related to fire suppression, and law and code enforcement, or even how to monitor, control and regulate the illegal conversion of property to residential rentals, and contradicting the intended uses of ADUs. With the potential to add 2,000 - 3,000 units based on information provided and using a conservative result, all services will be strained beyond capacity and present newer and larger financial burdens on the City and our community. Dale & Wendy Duncan Sixth, increasing the maximum square footage from 800 to 1,200 square feet is tantamount to allowing multiple residences on a lot intended for one residence, and it flies in the face of the intended purpose of an ADU. Finally, and what may be considered the most egregious aspect of the Council's proposed changes relates to reducing the current setback requirement from 25 feet to 5 feet. This is without any significant discussion or consideration of its impact on neighbors, and most certainly not an attempt at some type of reasonable compromise between the current and proposed setback restrictions. This is essential to maintain the privacy expected, assumed, and deserved for every resident's quiet enjoyment of their homes and yards. A setback of 5 feet will be an infringement of our privacy. Would you like to have an ADU overlooking your property with picture windows and intimate views of your yard and living quarters? Would you like to have your view of our surrounding area interrupted and/or destroyed by the addition of an ADU? Much has been said about the high cost of living and shortage of housing. The proposed changes do nothing to mitigate the high cost of housing, and construction of permitted ADUs will only be affordable by those with resources and will not in fact lessen housing shortages in our area. ADUs are intended for elderly parents as eloquently stated by Mayor Pro -Tern Wu. Assuming children may want to continue living with parents which is a major assumption, the proposed changes may be beneficial to again, a few residents with resources. It will not however alleviate housing shortages and again, is designed to benefit a few while impacting many. I urge the City Council to refrain from making any changes currently, to allow its Planning Commission to function as intended providing the Council with its recommendations after duly considering the opinions of city residents, the analysis of the projected increase in required City services, and conformity with legislation when enacted by the state. I have resided at �or 30 years. This letter is to address the issue of ADUs (hereinafter "dwelling"). In 2014, my neighbors on Fircroft put tip the dwelling (pictures attached). The dwelling is 5 feet from my back wall! My husband and I were never informed by anyone at West Covina City Planning Department that our neighbors were planning, and had been approved, to build a dwelling behind their- house. Had anyone from City Planning contacted us we would have informed them that our lot on Shasta sits much lower than the neighbor's lot on Fircroft. As a result, the dwelling is much higher than our wall. City Planning did not consider the impact it would have on us and my neighbors on the north and south side on Shasta. Although the dwelling may look great from our neighbor's perspective, it does not look great from our perspective. We have a beautiful back yard shadowed by an eyesore. We open our sliding door from our fancily room and that's what we see. There is hardly any room behind the dwelling for landscaping to cover the back of the dwelling facing our yard. Moreover, I am concerned that any landscaping between the dwelling and my back wall could eventually disturb the foundation, particularly close to our pool. I know this is old news and there is nothing that can be done about it now. Unfortunately, once a dwelling goes up it doesn't come down. We are stuck with this view, but we would like to prevent this from happening to anyone else. I couldn't attend the September 11, 2018 Planning Commission meeting, but I watched the video. Commissioner Sheena Heng addresses a property on Inspiration Point on how extending towards the back and any future additions would block the neighbors view and would impact the neighbors' yard. She mentions how the majority of home owners bought their homes for the view. Frankly, it is a slap in our face. So because we live at the bottom of the lull and don't have a view of DTLA we don't matter? Our homes may not be over a million dollars, but they are easily half a million. Ms. Heng also mentioned the re -sale value and how one neighbor had to sell their house because of the obstructed view. The dwelling on Fircroft will most likely affect the future sale of our home. We used to be able to see trees and mountains. Who wants a -view of a dwelling? Ms. Lee mentions "property value is dependent on the aesthetics of my property and converting my home to a duplex by attaching an ADU that's not the way that we are going to preserve the charm of West Covina. Realtors can tell you a detach guest house holds more property value than a duplex." Adding an extra bedroom with a bathroom also adds more property value: If the setback is changed from 25 fee to 5 feet a homeowner could potentially be staring at 3 dwelling walls. City of West Covina Municipal Code. As a retired Senior Planner, having worked in Diamond Bar, Claremont, Chino Hills and retiring from the City of Azusa, I have dealt with the impact of accessory dwelling units on single family residential areas, both negative and positive. When properly constructed and in compliance with reasonable. codes of the city, accessory units can be an asset to the community. Unfortunately however, in my experience, the negatives of ill-considered and intrusive accessory units, such as those which will be allowed under the proposed code amendment, vastly out -weigh the positives for the community. The proposed Code amendment is an example of broad and flimsy standards which can be readily exploited for the gain of a few property owners, to the detriment of the many West Covina property owners who voted for you, as council members, to look out for our best interests. The Planning Commission, after multiple study sessions which included public testimony and input, recommended against removing the required minimum lot size for accessory units; recommended against reducing the required setbacks for accessory units; and against increasing the allowed size of an accessory unit from 800 to 1200 sq.ft. (In 2017, the Planning Commission had already increase the allowed accessory unit size from 600 sq.ft. to 800 sq.ft.) Construction of accessory structures under the new proposed Code Amendment would decease the distance between dwelling units on adjacent lots, resulting in a reduction of open space in residential areas and would cause an increase of noise, a limiting of air flow and a reduction of access to sunlight, all health concerns. The new proposed amendment would also lead to a reduction in the heretofore expected privacy enjoyed by the residents of West Covina. The resulting increase in residential density and associated increase in traffic and parking congestion would be quickly apparent and unwelcome to current residents, who purchased residential property in West Covina with the expectation of adequate privacy and adequate residential parking. The City of West Covina already has generous code standards in place that allow accessory units to be constructed within existing residential units; more generous that many other cities in the San Gabriel Valley. Personally, I have already remodeled my home to accommodate my 91 year old father; my brother added a bedroom and bath suite to his home for his mother-in-law and a neighbor added a bedroom/bath suite for his adult son and daughter-in-law. In all cases, existing code standards were used and there was no need to reduce or negatively impact the amenities of adjacent neighbors in, order to provide for our parents and loved ones. In addition, one very important concern is the enforcing of the proposed new standards, which currently require that the property owner reside in the primary structure and which allow the accessory unit to be rented out to anyone. An increase in larger rental units (proposed to be increased to 1,200 sq.ft.), with up to 2 bedrooms, in single family areas will trigger an increase of the code enforcement budget to adequately provide the additional manpower, money and time needed to ensure compliance with this regulation. With the proliferation of AIR B&B's and Craig's List rentals, it will be difficult to ensure the continued single-family density of the single family residential areas. The expected single-family areas will increase in density and be utilized as multi -family zones without the proper safeguards and in direct conflict with the expectation of the residents of West Covina. We could have built a dwelling for her when she fast came to stay with us. She was still independent and able to move around. Mr. Tabatabai (sp?) says that in his culture it is shameful to put parents in a home and Ms. Lee is concerned about her grandmother being elderly, but either one has any issue with moving them into a dwelling away from the main house. What happens when the parent/grandparent can no longer take care of themselves, or dies? Who is going to live in the dwelling? My mom still lives with us. She is 97 years old and yes in our culture it is frowned upon to put a parent in a home, but sometimes there is no other choice for their own safety and well-being.: It is not shameful if they are going to be provided with 24/7 care. Fortunately, I have a wonderful caregiver who comes and stays with her while my husband and I are at work, but once we get home it is up to us to care for her. She is where we can keep an eye on her, not across our yard. It is a well-known fact that most dwelling are used as rentals. Homeowners started by renting bedrooms in their home to supplement their income. The idea of adding a dwelling means additional income. Ms. Lee not only wants the setback changed but also wants the current 800 sq. ft. changed to 1200 sq. ft. That is not the size of a dwelling, it is the size of a single family home! If you're lucky enough to have the square footage, then add a bedroom for your aging parent/grandparent. Don't use the "I need to have a place for my parent/grandparent) as an excuse to build a dwelling when in reality it is most likely to be used as a rental. If the occupa submit plans that would shield the new addition from the existing structure, such as a common wall or a locked door. I understand that the lay terminology for these ADU's is "granny flats". This terminology renders a description of a quiet, elderly woman as the ADU's at happens when "granny" dies? Who will Occupy occupant, Haw quaint. But wh the ADU ? Another "granny", or perhaps another family member? Or perhaps several people who don't mind sharing facilities in a trade-off for low rent? Where will these people park? Probably on city streets that are already structures used by current residents and home -owners asp parking storage units. West Covina was conceived as a suburb of single family residences. Although times change, YOU have the capacity to retain that concept by not allowing high - density housing in our neighborhood. Just because a minority of the population figures if they are vocal enough, adamant enough and persistent enough in their effort to modify current rules, thatYOU will grant them their request.
