SUBJECT: CONSIDERATION OF CODE AMENDMENT NO. 20-07 REGARDING SALES OF
ALCOHOLIC BEVERAGES AT SERVICE STATIONS
RECOMMENDATION:
It is recommended that the City Council consider initiating Code Amendment No. 20-07 to consider sales of
alcoholic beverages at service stations, by adopting the following resolution:
RESOLUTION NO.2020-93 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, INITIATING CODE AMENDMENT NO.20-07 RELATED TO THE SALE
OF ALCOHOLIC BEVERAGES AT SERVICE STATIONS
BACKGROUND:
At the August 4, 2020 City Council Meeting, the City Council discussed a request from Council member
Lloyd Johnson to reconsider whether alcoholic beverages may be sold at service stations. The City Council
directed that a resolution be brought to a subsequent meeting to initiate a potential code amendment.
DISCUSSION:
If the City Council initiates the code amendment, a public hearing will be scheduled to allow the Planning
Commission to discuss the code amendment. Following a formal recommendation from the Planning
Commission, the City Council will also be required to conduct a public hearing before any changes to the
existing code would become effective.
OPTIONS:
The City Council has the following options:
1. Adopt staff's recommendation;
2. Receive and file the report thereby declining to initiate a code amendment;
3. Provide alternative direction.

ENVIRONMENTAL REVIEW:
The proposed code amendment is exempt from the provisions of the California Environmental Quality Act
(CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines in that it consists of a code amendment
initiation, which does not have the potential for causing a significant effect on the environment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, INITIATING CODE AMENDMENT NO. 20-07
RELATED TO THE SALE OF ALCOHOLIC BEVERAGES AT SERVICE
STATIONS
WHEREAS, on September 1, 2020, the City Council considered the initiation of a code
amendment related to the sale of alcoholic beverages at service stations; and
WHEREAS, the studies and investigations made by the City Council reveal the following
facts:
The Municipal Code currently prohibits the sale of alcoholic beverages at service
stations.
2. Due to changed conditions in the business community and the fact that service
stations today may generally include the accessory use of convenience markets, it
is appropriate to consider the removal of the prohibition of the sale of alcoholic
beverages at service stations.
3. The proposed action is considered to be exempt from the provisions of the
Caldornia Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3)
of the CEQA Guidelines, in that the proposed action consists of a code
amendment, which does not have the potential for causing a significant effect on
the environment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. In conformance with Section 26-153(a)(3) of the West Covina Municipal
Code, the City Council does hereby initiate a Code Amendment related to the sale of alcoholic
beverages as anincidental use at service stations.
SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall enter
the same in the book of original resolutions and it shall become effective immediately.
