06-18-2019 - Item 11 - Consideration of Ordinance Amending Animal Control RegulationsAGENDA ITEM NO. 11 AGENDA STAFF REPORT City of West Covina | Office of the City Manager DATE:June 18, 2019 TO:Mayor and City Council FROM:David Carmany Interim City Manager SUBJECT:CONSIDERATION OF ORDINANCE AMENDING ANIMAL CONTROL REGULATIONS RECOMMENDATION: It is recommended that the City Council adopt, give first reading, and waive further reading for the following ordinances related to animal control: URGENCY ORDINANCE NO. 2458 - AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA AMENDING CHAPTER 6 OF THE CITY OF WEST COVINA MUNICIPAL CODE ORDINANCE NO. 2459 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA AMENDING CHAPTER 6 OF THE CITY OF WEST COVINA MUNICIPAL CODE BACKGROUND: At the October 16, 2018 City Council Meeting, the City Council approved a two-year agreement with Inland Valley Humane Society & S.P.C.A. to provide animal care and control services beginning July 1, 2019. The City's current contract with the Los Angeles County Department of Animal Care and Control expires June 30, 2019. DISCUSSION: On July 1, 2019, the Inland Valley Humane Society & S.P.C.A. (IVHS) will assume responsibility for the City of West Covina's animal care and control from Los Angeles County Department of Animal Care and Control. IVHS is a private, non-profit, full-access animal shelter dedicated to providing a safe refuge for animals in the community. Due to this operational change, the City needs to update its municipal code so that IVHS can effectively and legally enforce laws related to animals within the City boundaries such as licensing, animal cruelty, vicious dogs, leash law violation, etc. City staff is proposing minor changes to the language of Title 10 of Los Angeles County (Chapter 6 of the City of West Covina's Municipal Code), which was previously adopted by the City Council as a requirement of contracting with Los Angeles County. Included for Council's consideration, there is an urgency ordinance which enables IVHS to enforce necessary laws beginning July 1, 2019. In addition, there is a regular ordinance which becomes effective 30 days after adoption. Both are needed for Council approval to properly enforce the City's municpal code in a timely fashion. LEGAL REVIEW: The City Attorney has approved the related ordinances. OPTIONS: The City Council has the following options: 1.Approve staff's recommendation; or 2.Provide alternative direction.
