Resolution - 8424RESOLUTION NO. 8424 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF • WEST COVINA APPROVING THE CORTEZ COMMUNITY PARK SPECIFIC PLAN TO ALLOW THE CONSTRUCTION OF A SENIOR CITIZEN ANNEX BUILDING, REMOVAL OF AN EXISTING RECREATION BUILDING, POSSIBLE CONVERSION OF THE FIRE STATION INTO A HISTORICAL MUSEUM, AND THE EXPANSION OF THE PARK'S SOUTHERN PARKING LOT. WHEREAS, the City Council on June 13, 1977, adopted a Specific Plan of the City entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE COMMUNITY PARK SPECIFIC PLAN ON CORTEZ STREET (RESOLUTION NO. 5473); AND WHEREAS, the seventeen (17) acre park site is currently developed with amenities including a senior citizen center, recreational building, two (2) baseball diamonds, a multipurpose field, tot lot and play area, picnic shelters, interconnecting hardscape walkway, fire substation, parking areas, bocci ball courts, security lighting, and restroom facilities; and WHEREAS, based upon recent data pertaining to the usage of the park, the need for certain park improvements has become apparent; and WHEREAS, on May 11, 1987, the City of West Covina initiated a request for said park improvements; and WHEREAS, on September 27, 1989, the proposed amendment was considered and recommended for approval at a joint community meeting between the Recreation and Parks Commission and the Human Resources Commission; and WHEREAS, on October 18, 1989, the Planning Commission, upon giving the required notice did conduct a duly advertised public hearing as prescribed by law to consider the proposed amendment; and WHEREAS, upon reviewing and considering the proposed amendment the Planning Commission voted on October 18, 1989, to recommend to the City Council that it adopt a resolution amending the Cortez Community Park Specific Plan; and WHEREAS, the City Council, upon giving the required notice did on November 13, 1989, conduct a duly advertised public hearing as prescribed by law to consider said amendment; and WHEREAS, based on the evidence presented to the City Council, both oral and documentary, the City Council finds as follows: • 1. The proposed amendment is consistent with the City's General Plan policy for development of a community park in West Covina. 2. The proposed amendment is consistent with the General Plan Environmental Quality Element which adopts, as a goal, "the periodic evaluation of the facilities in parks." 232 Res. The proposed amendment is planned and designed in a manner which is consistent with the Cortez Community Park Specific Plan prepared by the Department of Parks and Recreation. 4. The proposed amendment incorporates design features which promote the appearance and safety aspects of the park and its facilities. 5. An initial study was prepared for the proposed amendment and has disclosed that although the proposed project could have a significant effect on the environment, these effects have been successfully reduced to a level of insignificance as mitigation measures which have been incorporated into the project's design and added as conditions of approval. A Negative Declaration of Environmental Impact has therefore been prepared for the proposed project. 6. That the Civil Air Patrol is currently using a building (known as the "Rocket Room") at Cortez Park and that the Civil Air Patrol be allowed to continue such use 1 year from the date the senior center construction is certified as complete. Should the Civil Air Patrol desire to make significant changes or additions to the building, the CAP shall first obtain City Council approval. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of West Covina does hereby approve the Cortez Community Park Specific Plan Amendment No. 3 to allow for the construction of a senior citizen annex building adjacent to and northwest of existing senior citizen center, the removal of the existing Cortez Recreation Building, the possible conversion of the fire station into a historical museum, and the expansion of the park's southern parking lot subject to the following conditions: a. Comply with Study Plan "A". b. Submit a grading and drainage plan to the City Engineer for review and approval. C. All grading shall comply with Chapter 9 of the West Covina Municipal Code and Chapter 70 of the Uniform Building Code. d. Normal wetting procedures or other dust palliative measures shall be followed during demolition and excavation activities to reduce fugitive dust emissions in order to meet AQMD Rule 403 requirements. e. A landscape and automatic irrigation plan shall be submitted to the Planning Department for review and approval prior to the issuance of building permits. • f. Grading and construction activity shall comply with the City's grading and noise ordinances. g. Lighting on the site shall comply with Section 26-519 of the West Covina Municipal Code and Planning Commission Resolution No. 2513. 232 Res. No. 8424 CORTEZ SPECIFIC/PLAN/3/CC/RES. - Page 3 of 3 • h. The project proposal entails the spanning of the annex building over a drainage swale that was formally a part of the Walnut Creek Wash. Any concerns or permit requirements received from the Department of Fish and Game will be complied with. i. The project shall meet any and all monitoring or reporting requirements necessary to ensure compliance with the mitigation measures contained in the Negative Declaration, as those may be determined. The project construction will cease immediately upon written notice of a violation of such requirements and that such a provision may be made a part of any agreement with the City. FINALLY RESOLVED, the City Clerk shall certify to the adoption of this Resolution.
