Resolution - 8423RESOLUTION NO. 8423 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR THE CORTEZ COMMUNITY PARK SPECIFIC PLAN AMENDMENT NO. 3. WHEREAS, the City Council on June 13, 1977, adopted a Specific Plan of the City entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE COMMUNITY PARK SPECIFIC PLAN ON CORTEZ (RESOLUTION NO. 5473). WHEREAS, the City of West Covina initiated a request for the approval of a Specific Plan Amendment to allow for the construction of an approximate 8,000 square foot annex building to an existing senior citizen center, the removal of an existing recreation building, the possible conversion of the fire station into a historical museum, and the expansion of the park's southern parking lot. WHEREAS, the proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act (CEQA); and WHEREAS, an initial study was prepared for said project; and WHEREAS, based upon the findings of an initial study, it was determined that although the proposed project could have a significant effect on the environment, these effects have been successfully reduced to a level of insignificance by mitigation measures which have been incorporated as conditions of approval for the project; and WHEREAS, a Negative Declaration of Environmental Impact was prepared for the proposed project pursuant to the requirements of 'the California Environmental Quality Act of 1970, as amended, and mitigation measures were included in said Negative Declaration in support of the finding that there was not a significant effect on the environment caused by this project. NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: 1. After receiving and considering all determinations, studies, documents, and recommendations, as well as other appropriate public comments, the City Council of the City of West Covina hereby certifies the Negative Declaration of Environmental Impact subject to compliance with the mitigation measures incorporated therein as outlined below: • a. Submit a grading and drainage plan to the City Engineer for review and approval. b. All grading shall comply with Chapter 9 of the West Covina Municipal Code and Chapter 70 of the Uniform Building Code. 233 Res. No. 8423 CORTEZ SPECIFIC/PLAN/3/CC/CEQA - Page 2 of 3 • C. Normal wetting procedures or other dust palliative measures shall be followed during demolition and excavation activities to reduce fugitive dust emissions in order to meet AQMD Rule 403 requirements. d. A landscape and automatic irrigation plan shall be submitted to the Planning Department for review and approval prior to the issuance of building permits. • e. Grading and construction activity shall comply with the City's grading and noise ordinances. Lighting on the site shall comply with Section 26-519 of the West Covina Municipal Code and Planning Commission Resolution No. 2513. g. The project proposal entails the spanning of the annex building over a drainage swale that was formally a part of the Walnut Creek Wash. Any concerns or permit requirements received from the Department of Fish and Game will be complied with. h. The project shall meet any and all monitoring or reporting requirements necessary to ensure compliance with the mitigation measures contained in the Negative Declaration, as those may be determined. The project construction will cease immediately upon written notice of a violation of such requirements and that such a provision may be made a part of any agreement with the City. FINALLY RESOLVED, the City Clerk shall certify to the adoption of this Resolution. ADOPTED AND APPROVED this 13th day of November, 1989. ATTEST: City Clef 233 Res.
