A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, DENYING LOT LINE ADJUSTMENT NO. 70.

WHEREAS, there was filed with the City of West Covina a
verified application on forms prescribed in Chapter 20 of the
West Covina Municipal Code requesting approval of a Lot Line
Adjustment on that certain property generally described as
follows:
Lots 25 and 61 of Tract No. 39468, and
WHEREAS, on July 10, 1989, the City Council referred the
matter to the Planning Commission; and
WHEREAS, the Planning Commission, upon giving the required
notice did on the 20th day of September, 1989, conduct a duly
advertised public hearing to consider said application; and
WHEREAS, the Planning Commission adopted Resolution
No. 9-89-3772 recommending to the City Council Denial of Lot
Line Adjustment No. 70; and
WHEREAS, on October 9, 1989, the City Council conducted a
duly noticed public hearing to consider Lot Line Adjustment
No. 70; and
WHEREAS, on October 9, 1989, the City Council approved the
proposed lot line adjustment by a 4-1 vote, with the
understanding that a resolution which incorporated conditions
of approval be returned to the Council for consideration; and
WHEREAS, on October 30, 1989, the City Council reviewed
and denied the subject resolution approving the adjustments and
conditions; and
WHEREAS, a motion was made to reconsider the Council's
previous action of tentative approval for the proposed lot line
adjustment; and
WHEREAS, upon reconsideration of the proposed project, the
City Council voted 4-1 to deny the proposed lot line
adjustment and to adopt a resolution so stating.
NOW, THEREFORE, the City Council of the City of West
Covina does hereby resolve as follows:
WHEREAS, studies and investigations made by this
Council and in its behalf reveal the following facts:
1. Tract Map No. 39468 contains both single-family and common
Open Space lots under the provisions of Section 26-696 of
the City's Municipal Code which allows density transfers
to preserve portions of the tract to be preserved in an
essentially natural state for Open Space purposes for
recreational, scenic, and wildlife habitat uses.
2. The applicants are requesting approval of a Lot Line
Adjustment to remove 3,500 square feet of land from Lot
61, a common Open Space parcel of Tract 39468 and add said
land to Lot 25, a single family residential parcel also of
Tract 39468.

• 3. Section 26-696 of the Municipal Code does not provide for
private ownership of open space areas.
4. Granting the lot line adjustment and conveying the
property at issue to the applicant does not conform to the
West Covina General Plan.
5. The proposed project is Categorically Exempt under
Class 15 of the California Environmental Quality Act of
1970, as amended.
NOW, THEREFORE, the City Council of the City of West
Covina does resolve as follows:
SECTION NO. 1: Removal of 3500 square feet of common Open
Space for private use would violate the City's Hillside
Ordinance which allows for the maintenance of Open Space
through density transfers, would not conform to the General
Plan, and would set an undesirable precedent as other citizens
who wish to do likewise could petition the City for similar
approvals resulting in decreased Open Space and a reduction of
the common good.
SECTION NO. 2: That pursuant to all evidence presented,
both oral and documentary, Lot Line Adjustment No. 70 is
denied.
