Resolution - 8413RESOLUTION NO. 8413 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFYING THE NEGATIVE • DECLARATION OF ENVIRONMENTAL IMPACT FOR GENERAL PLAN AMENDMENT NO. III-89-11, ZONE CHANGE NO. 626 AND TENTATIVE PARCEL MAP NO. 21415. (Frank DePietrO and Sons) WHEREAS, there were filed with the City of West Covina, verified applications on forms prescribed in Chapter 26, Article VI, of the West Covina Municipal Code, requesting approval of a general plan amendment, zone change and tentative parcel map; on that certain property generally described as follows: Parcel 18 on Page 24 of Map Book 8458 and Parcels 11 and 27 on Page 25 of Map Book 8458 of the Los Angeles County Assessor's Records; and WHEREAS, the proposed project -.is considered a "project" pursuant to the terms of the California Environmental Quality Act (CEQA) of 1970, as amended; and WHEREAS, an initial study was prepared for said project; and WHEREAS, based upon the findings of an initial study, it was determined that the proposed project will not have a significant impact on the environment; and WHEREAS, a Negative Declaration of Environmental Impact was prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act of 1970, as amended, and mitigation measures were included in said Negative Declaration of Environmental Impact in support of the finding that there was not a significant effect on the environment caused by this project. NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: 1. After receiving and considering all determinations, studies, documents, and recommendations, as well as other appropriate public comments, the City Council of the City of West Covina hereby certifies the Negative Declaration of Environmental Impact subject to compliance with mitigation measures that are recommended in the Negative Declaration of Environmental Impact as outlined below: a. The location of a future ingress-engress point on Yaleton Avenue shall maintain the maximum distance reasonably possible from the adjacent residential property to the north in order to minimize potential noise impacts. b. Future development of the site shall be subject to architectural review via the precise plan process. C. Demolition and grading activity shall comply with the City's noise and grading ordinances. 2. The City Clerk shall certify to the adoption of this Resolution. OE Page 2 0 ADOPTED AND APPROVED this 30th day of October, 1989.
