Resolution - 8242RESOLUTION NO. 8242 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, RELATING TO THE DISSOLUTION OF THE SAN GABRIEL VALLEY FIRE AUTHORITY. WHEREAS, on or about March 14, 1986, the Cities of Covina and West • Covina entered into a Joint Powers Agreement for the purpose of establishing .a consolidated fire, paramedic, and related public safety communication service between the member agencies known as the San Gabriel Valley Fire Authority (Authority); WHEREAS, the primary purpose of said consolidation of services was to provide a centralized joint effort for the development, implementation, operation, and maintenance of such services for the mutual benefit and cost savings.for each City and in the best interests of the citizens of each member agency. WHEREAS, events and circumstances have undermined the purpose and intent of the consolidation including but not limited to the following: a. Action by the Covina City Council on May 16, 1988 and adoption by the Authority Board on May 24, 1988 to: 1) Maintain Covina's traditional levels of Fire Suppression Service and Manning, meaning that an additional firefighter position to man the Covina station would be required beyond that provided for in the 1987-88 Authority Budget; 2) The inclusion of station locations and manning requirements in any Memorandum of Understanding (MOU) between the Authority and the Fire Union; and 3) The inclusion in any MOU between the Authority and the Fire Association, of the present station locations and manning levels as set forth in the existing but expired MOU between the City of Covina and its Fire Union. b. The approval of additional budget modifications for 1988-89 for funding three additional firefighter positions by the City of Covina and the Authority Board and the rejection of such modifications by the City of West Covina. c. The discontinuation of funding by an August 8, 1988 action by the City of West Covina for three engineer positions as required under the terms and conditions of the existing but expired MOU between the City of Covina and its Fire Union. d. The appointment on May 2, 1988 by the City of Covina Council of a Citizens' Committee for the purpose of studying the fire services provided under the Authority, wherein its report to the Council on September 6 indicated that the level and quality of fire services provided to the City of Covina had been negatively impacted since the formation of the Authority, and that the services would not improve under the less than harmonious relationship between Covina and West Covina. WHEREAS, the City of West Covina disagrees that the level and quality of fire and paramedic services provided by the Authority to the citizens of Covina have been negatively impacted; • • • 0 WHEREAS, the imposition on the City of West Covina of manning levels as set forth in the MOU between Covina and the Fire Union resulting in additional costs and budget requests beyond those contemplated in the adoption of both the 1987-88 and 1988-89 Authority budgets have eroded the primary goal of the Authority of providing better quality and higher levels of fire services at less cost to both member agencies; WHEREAS, there are fundamental differences and conflicts of interests between the City of Covina and the City of West Covina as to provisions to be included in a Memorandum of Understanding thereby encumbering the final acceptance and approval of an MOU between the Authority and the Union by the respective member agencies legislative bodies. WHEREAS, on September 20, 1988, the City 'Council of the City of Covina has taken action to direct the City Attorney and City Manager to withdraw from the San Gabriel Valley Fire Authority as soon as practical; NOW, THEREFORE, the City Council of the City of West Covina, in mutual agreement with the September 20 action taken by the City Council of the City of Covina and due to the events and circumstances as stated herein, does hereby resolve, declare, and order as follows: SECTION 1. That by mutual agreement the San Gabriel Valley Fire Authority be dissolved as soon as possible. SECTION 2. Appropriate City Staff is directed to meet with the appropriate City of Covina Staff to provide for dissolution of the San Gabriel Valley Fire Authority as soon as possible. SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution and the same shall thereupon take effect and be enforced. 1988 PASSED, APPROVED AND ADOPTED this 26th day of September , .
