• A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, AMENDING
THE DESTRUCTION OF OBSOLETE RECORDS
• POLICY OF THE WEST COVINA POLICE
DEPARTMENT BY APPROVING THE DESTRUCTION
OF DUPLICATE RECORDS LESS THAN TWO YEARS
OLD
WHEREAS, in 1981, by Resolution No. 6447, the City
Council established a Destruction of Obsolete Records Policy for the
West Covina Police Department; and
WHEREAS, Section 34090 of the California Government
Code provides that with the approval of the City Council and the
written consent of the City Attorney, the head of a City department
may destroy any record, document, instrument, book or paper under his
charge without making a copy thereof, if the same is no longer required,
provided that certain records are exempt from the provisions of said
section, as specifically enumerated in Sections 34090.5 and 34090.6
of the Government Code; and
WHEREAS, Section 34090.7 of the Government Code allows
the City Council to prescribe a procedure under which duplicates of City
records less than two years old may be destroyed if they are no longer
required; and
WHEREAS, the City Attorney has reviewed and approved
in writing the amendment to the Police Department's Destruction of
Obsolete Records Policy in accordance with the provisions of Section
34090.
NOW, THEREFORE, be it resolved by the City Council
of the City of West Covina as follows:
SECTION 1. The West Covina Police Department's
Destruction of Obsolete Records Policy is hereby amended by adding
Schedule 9 as Subsection I of Section III as follows:
I. Schedule 9. The following records may be
destroyed without microfilming in less
than two years if they are no longer
required.
1. Duplicates of City records, except that of
. a video recording medium, such as a video tape
or film, shall not be destroyed or erased for a
period of at least ninety (90) days after
occurrence of the event recorded thereon.
SECTION 2. The West Covina Police Department's
Destruction of Obsolete Records Policy is hereby amended by adding
the definition of duplicate City records to the Categories of Records
as follows:
• DUPLICATES OF CITY RECORDS: Includes video recording
mediums, such as video tapes and

films, if the City keeps another record, such as
written minutes or an audio tape recording, of the
event which is recorded in the video medium.
SECTION 3. The City Clerk shall certify to the
passage and adoption of this resolution and the same shall thereupon
take effect and be enforced.
