Resolution - 8191RESOLUTION NO. 8191 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING PRECISE PLAN NO. 801, REVISION NO. 1 . (Vincent Manno). • WHEREAS, there were filed with the City of West Covina, verified applications on forms prescribed in Chapter 26, Article VI, of the West Covina Municipal Code, requiring approval of a precise plan relating to the construction of an office professional building on that certain property generally described as follows: Parcel Map No. 19312 recorded in the Office of the Los Angeles County Recorder; and WHEREAS, hearings on said application were duly noticed and conducted by the Planning Commission on April, 6, 1988, and April 20, 1988, at which time the application was denied; and WHEREAS, the action of the Planning Commission was appealed by the applicant after proper legal notice to the May 23, 1988, City Council meeting for hearing and consideration; and WHEREAS, studies and investigations made by the City Council and in its behalf reveal the following facts: 1. The applicant is requesting approval of a revision to a Precise Plan for a 7,820-square foot commercial building. 2. Modification of the building footprint was necessitated by a revision to the property boundaries as a part of the approval of Parcel Map No. 19312. 3. Relocation of the trash enclosure was required by Condition 16b of City Council Resolution No. 8061. 4. The project meets or exceeds all requirements of the Neighborhood -Commercial (N-C) Zone, except where modified by Variance No. 888. 5. Appropriate findings for approval of a precise plan of design are as follows: a. That consideration has been given and restric- tions imposed to the extent necessary to permit the same degree of enjoyment to the subject property, but subject to the same degree of protection of adjoining properties as would be accorded in normal circumstances by the standard restrictions imposed by the Municipal Code. i Page 2 b. That strict adherence to the development standards of the applicable zone and the proposed precise plan will not measurably depreciate • property values in the vicinity or interfere with the use or enjoyment of property in the vicinity or endanger the public peace, health, safety, or general welfare. • 6. A Negative Declaration of Environmental Impact was previously approved by the City Council of the City of West Covina on June 22, 1987. • NOW, THEREFORE, the City Council of the City of West Covina, California, does hereby resolve as follows: 1. On the basis of the evidence presented, both oral and documentary, the Planning Commission makes the following findings: a. That the project has been designed in conformance with all city codes and regulations, except for a previously approved variance for front yard setback. b. That the project is designed to be architec- turally consistent with the abutting property to the north. C. That the proposed revisions are minor in nature and do not significantly alter the previously approved project, but were actually required by conditions of the original approval. 2. That pursuant to all of the evidence presented, both oral and documentary, and further based on the findings above the Precise Plan of Design No. 801, Revision 1, is approved subject to the provisions of the West Covina Municipal Code, provided that the physical development of the herein described property shall conform to said precise plan and the conditions set forth herein which, except as otherwise expressly indicated, shall be fully performed and completed or shall be secured by bank or cash deposit satisfactory to the Planning Director before the use or occupancy of the property is commenced and before a Certificate of Occupancy is issued, and the violation of any of which shall be grounds for revocation of said Precise Plan by the Planning Commission or City Council. 3. That the Precise Plan shall not be effective for any purpose until the owner of the property involved (or his duly authorized representative) has filed at the Office of the Planning Director his affidavit stating • he is aware of, and accepts, all conditions of this Precise Plan as set forth below. • Page 3 • 4. That the approval of the precise plan is subject to the following conditions: a. Comply with Study Plan "A", dated April 6, 1988. • b. Comply with Exhibit 1 (Elevations). c. Comply with all Conditions of Approval listed in • City Council Resolution No. 9061, except Conditions 1 and 2. d. No grading or building activity shall commence on the site until an eight (8) foot high (as measured from the highest adjacent grade) masonry block wall is constructed along the easterly property line. e. Upon submittal of written proof, to the Planning Director, of permission from the owner of the property at 1815 East Pioneer Drive (in order of preference): i. The existing eight -foot block wall on the property at 1815 East Pioneer Drive shall be demolished and an eight -foot block wall shall be constructed as required in Condition (d); or ii. An eight -foot block wall shall be con- structed as required in Condition (d) and shall be made to connect with the existing eight -foot block wall on the property at 1815 East Pioneer Drive. f. If written proof of permission from the owner of the property at 1815 East Pioneer Drive is not received for either of the options in Condition (e), an eight -foot block wall shall be con- structed, as required in Condition (d), stopping at the north starting point of the existing eight -foot block wall on the property at 1815 East Pioneer Drive. The owner or future owners of the property at 1815 East Pioneer Drive shall have the right, at their own expense to connect the two walls to eliminate the gap between them. 5.
