RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA CERTIFYING THAT THE AGENCY HAS
REVIEWED AND CONSIDERED INFORMATION CONTAINED
IN THE INITIAL STUDY AND A FINAL
ENVIRONMENTAL IMPACT REPORT FOR THE
DEVELOPMENT PROPOSED PURSUANT TO A RESTATED
DISPOSITION AND DEVELOPMENT AGREEMENT WITH
WATT INVESTMENT PROPERTIES, INC.; MAKING
CERTAIN FINDINGS AND DETERMINATIONS REGARDING

ENVIRONMENTAL IMPACTS OF SAID PROPOSED
DEVELOPMENT; AND ADOPTING A STATEMENT OF
OVERRIDING CONSIDERATIONS
WHEREAS, pursuant to the California Environmental
Quality Act ("CEQA") and State and Agency Guidelines adopted
pursuant thereto, the Redevelopment Agency of the City of West
Covina ("Agency") prepared a Final Environmental Impact Report
("EIR") with respect to a proposed development described as the
Vincent -Glendora Center Site ("Site") in the Central Business
District Redevelopment Project; and
WHEREAS, the City Council on October 4, 1982, after a
duly noticed joint public hearing, by Resolution No. 6605
certified that the Council had reviewed and considered the
information contained in said EIR, made certain findings and
determinations regarding the environmental impacts of the
proposed development, adopted a Statement of Overriding
Considerations with respect to the unavoidable significant
effects of the development, and by Resolution No. 6606 approved
the execution of a Disposition and Development Agreement for the
sale and development of the Site ("Vincent -Glendora DDA"); and
WHEREAS, the Agency terminated the Vincent -Glendora DDA
and on April 28, 1986 the Council by Resolution No. 7174 approved
the execution of a Disposition and Development Agreement with
Watt Investment Properties, Inc. ("Watt Agreement") for the sale
and development of the Site ("Atrium Development"); and
WHEREAS, the Council, pursuant to an Initial Study of
1986 and review of the October 4, 1982 EIR and the other previous
environmental documents for the Project Area, found and
determined that the proposed Atrium Development pursuant to the
Watt Agreement would have no significant effect on the
environment except as identified and considered in the EIR of
October 4, 1982; and
WHEREAS, the Agency now proposes to enter into a
Restated Disposition and Development Agreement with Watt
Investment Properties, Inc. ("Restated Agreement") in order to
accommodate a reconfiguration of the Site, a redesign of the
• improvements to be developed thereon, and a change in
conveyancing, which Restated Agreement amends, supersedes and
replaces the Watt Agreement in its entirety; and
WHEREAS, the Agency has prepared and reviewed an
Initial Study dated June 2, 1987 to determine if the proposed
development pursuant to the Restated Agreement ("The Lakes at
West Covina Development") will have significant effects on the
environment in addition to those identified in the Initial Study
of 1986, the EIR of 1982 and the other previous environmental
documents for the Project Area; and
WHEREAS, the Agency and the Council have considered the
environmental effects of the proposed Development as shown in the
Initial Study of June 2, 1987, the Initial Study of 1986 and the
EIR;
• NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of West Covina as follows:
1. The City Council hereby certifies that the
information contained in the Initial Study of June 2, 1987, the
Initial Study of 1986 and the EIR of 1982 has been reviewed and
considered by the Council.
2. The City Council hereby further certifies that the
• significant environmental effects of The Lakes at West Covina
Development considered in the Initial Study of June 2, 1987, the
Initial Study of 1986 and the EIR have been considered and
recognized by the Council.
3. The City Council hereby finds and determines that:
a. No substantial changes are proposed in The
Lakes at West Covina Development, or with respect to the
circumstances under which the Development is to be undertaken,
which will require major or important revisions in the EIR
previously certified, due to the involvement of new significant
environmental impacts not covered in the EIR;
b. No new information of substantial importance
to the Development has become available which was not known or
could not have been known at the time the EIR was certified as
complete, and which shows that the Development will have any
significant effects not discussed previously in the EIR, or that
any significant effects previously examined will be substantially
more severe than shown in the EIR, or that any mitigation
measures or alternatives previously found not to be feasible or
not previously considered would substantially reduce or lessen
any significant effects of the Development on the environment;
C. No subsequent EIR or supplement or addendum to
the EIR is necessary or required; and
d. The development and operation of The Lakes at
West Covina Development pursuant to the Restated Agreement will
have no significant effect on the environment except as
identified and considered in the EIR.
4. Based upon the Initial Study of June 2, 1987, the
Initial Study of 1986 and other information in the record, the
City Council hereby approves and adopts the EIR of October 4,
1982 and the Findings and Determinations and Statement of
Overriding Considerations contained in City Council Resolution
No. 6605 for The Lakes at West Covina Development.
5. The City Council hereby authorizes and directs that
a Notice of Determination with respect to the Initial Study of
• June 2, 1987, the Initial Study of 1986 and the Environmental
Impact Report pertaining to the proposed Restated Disposition and
Development Agreement, if approved, and all other Agency actions
taken in furtherance thereof be filed.
6. The City Clerk shall certify to the adoption of
this Resolution.

Covina at a regular meeting thereof held on the 22nd day of
June 1987, by the following vote:
