A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,
• CALIFORNIA, APPROVING TENTATIVE PARCEL MAP NO. 18250 AND
CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT
THEREFOR. (Summerwood Garden Homes)
THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES
RESOLVE AS FOLLOWS:
WHEREAS, there was filed with the City of West
•
Covina, a verified application on the forms prescribed in
Chapters 20 and 26, Article VI, of the West Covina Municipal
Code, for the physical development of that certain property
generally described as follows:
Lots 22 and 42 of Tract No. 31987 as per Map
recorded in Book 899, Pages 88 through 91 of Maps, in
the Office of the Los Angeles County Recorder; and
WHEREAS, hearings on said applications were duly
noticed and conducted by the Planning Commission on May 20,
1987, and June 3, 1987, at which time the applications were
denied; and
WHEREAS, the action of the Planning Commission was
appealed to the June 22, 1987, City Council meeting for hearing
and consideration; and
WHEREAS, after proper legal notice, the City Council
held a hearing on said appeal on June 22, 1987; and
WHEREAS, studies and investigations made by the
City Council and in its behalf reveal the following facts:
1. The applicant is requesting approval of a two -lot
tentative parcel map for the purpose of converting
two duplexes to a four -unit condominium project at
the above location.
2. Findings necessary for approval of a tentative parcel
map:
a. The proposed map is consistent with the General
Plan designation of "Medium Density Residential
(8.1-15.0) since it serves a development with a
less intense proposed density of 6.7 units/acre.
b. The previously approved and physically unchanged
development plan that this map serves
demonstrates that the design and improvement of
the subdivision are consistent with applicable
General and Specific Plans.
C. The previously approved and physically unchanged
development plan that this map serves
demonstrates that the site is physically suitable
for the type of development proposed.
d. The previously approved and physically unchanged
development plan that this map serves
demonstrates that the site is physically suitable
for the proposed density of development.
e. The design of the subdivision and the proposed
improvements will not cause any environmental
damage or injure fish, wildlife or their habitat
because there are no proposed physical changes to
• the site or its use.
f. The design of the subdivision or the type of
improvements will in no way affect or cause any
public health problems because there are no
proposed physical changes to the site or its use.
g. The design of the subdivision or the type of
• improvements will not conflict with the easements
acquired by the public for access through or use
of property within the proposed subdivision.
There will be no change in any public easements.
3. Based upon the findings of an initial study, it has
been determined that the proposed project will not
have significant impact on the environment. A
Negative Declaration of Environmental Impact has been
prepared for the proposed project pursuant to the
requirements of the California Environmental Quality
Act of 1970.
4. The subject parcel map was filed in conjunction with
PCD-1, Development Plan No. 23, Revision No. 1,
Unclassified Use Permit No. 337 (e) and Variance No.
886 (e). Approval of this map is contingent upon
approval of the applications filed in conjunction
with this map.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
does hereby APPROVE the subject Tentative Parcel Map and the
Negative Declaration of Environmental Impact is hereby
CERTIFIED, subject to the provisions of the West CovinaMunicipal
Code, provided that the physical development of the herein
described property shall conform to said map and the following
conditions which, except as otherwise expressly indicated, shall
be fully performed and completed or shall be secured by bank or
cash deposit satisfactory to the Planning Director before the use
or occupancy of the property is commenced and before the
recordation of a final map in the Office of the Los Angeles
County Recorder, and the violation of any of which shall be
grounds for revocation of said parcel map by the Planning
Commission or City Council. The tentative parcel map shall not
be effective for any purpose until the owner of the property
involved (or his duly authorized representative) has filed at the
office of the Planning Director his affidavit stating he is aware
of, and accepts, all conditions of this parcel map as stated
below:
1. Comply with Tentative Parcel Map No. 18250, dated
May 20, 1987.
2. Comply with all requirements of the MF-8 Zone, except
where modified by variance.
3. Engineering Department Requirements:
a. Comply with all conditions contained in Planning
Resolution No. 567.
b. Sanitary sewers shall be provided to each "lot"
in compliance with Municipal Code Chapter 23,
Article 2, and to the satisfaction of the City
Engineer.

C. Prior to approval of a final map, all of the
following requirements shall be satisfied:
An itemized cost estimate for all on -site
• and off -site improvements to be con-
structed, except buildings, shall be sub-
mitted to the Engineering Department for
approval. Based upon the approved cost
estimates, required fees shall be paid and
improvement securities for all on -site and
off -site improvements, except buildings,
and 100% labor/material securities for all
• off -site improvements, shall be posted
prior to final approval of the plans.
d. The proposed subdivision shall conform to Munici-
pal Code Chapter 20 - Subdivisions.
4. Fire Department Requirements:
No requirements.
5. Police Department Requirements:
No requirements.
6. Building Department Requirements:
a. All units to be totally independent on utilities
use.
b. All construction to meet standards of the
applicable construction codes of the City.
FINALLY RESOLVED, that the City Clerk shall certify to the
adoption of this Resolution.
