• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, DENYING ZONE CHANGE
NO. 603 AND UNCLASSIFIED USE PERMIT NO. 336 AND
CERTIFYING THE NEGATIVE DECLARATION OF ENVIR-
ONMENTAL IMPACT AS IT RELATES THERETO. (Donald Cotten)

•
The City Council of the City of West Covina, California,
does resolve as follows:
WHEREAS, there were filed with the City of West Covina,
certified applications on forms prescribed in Chapter 26, Article VI
of the West Covina Municipal Code requesting a zone change from
Planned -Industrial (I-P) to Service -Commercial (S-C), and approval
of an unclassified use permit for the physical development of a
three-story, thirty-nine (39) unit motel on that certain property
described as follows:
Lots 37, 38 and 39 of Tract No. 11798, in
the City of West Covina, County of Los Angeles,
State of California, as per maps recorded in
Book 220, Pages 20 and 21 of Maps, in the Office
of the County Recorder of said County; and
WHEREAS, the Planning Commission at a duly noticed public
hearing on March 18, 1987, reviewed the applicant's requests for a
zone change from Planned -Industrial (I-P) to Service -Commercial
(S-C) Zone and an unclassified use permit for a thirty-nine (39)
unit motel; and
WHEREAS, the Planning Commission expressed its concern
with the incompatibility of the proposed motel with the residential
neighborhood, the impact of motel traffic on the residential
neighborhood, the high density (number of units) proposed for the
motel, the awkward access to the motel from the San Bernardino
Freeway, the possibility of the loss of patrons to more accessible
motels, the lack of motel amenities and the need for more
landscaping; and
WHEREAS, the Planning Commission at its duly noticed
public hearing of March 18, 1987, determined that the proposed motel
was incompatible with the residential neighborhood and had not met
the findings necessary for approval of a zone change or an
unclassified use permit and denied the application; and
WHEREAS, on April 27, 1987, the City Council of the City
of West Covina, California, conducted a duly advertised public
• hearing on Zone Change No. 603 and Unclassified Use Permit No. 336
and the Negative Declaration of Environmental Impact relating
thereto and concluded that the findings necessary for approval of a
zone change or an unclassified use permit had not been met, to wit:
a. The City Council finds that, of the five findings required
to be met before an unclassified use permit may be
granted, four have not been met inasmuch as:
•
i. Concern has been expressed regarding the location of
& the proposed motel, which might be afforded awkward
ii. access from the freeway, or other unforeseen
circumstances that could result in future reduction in
the quality of services, and/or cause the attraction
of undesirable patrons. The vicinity of the motel
could become detrimental to the health, safety and
welfare of persons residing in the area, particularly
for children required to wait in front of the subject
site for transportation to school.
iii. The proposed density of 39 units and required parking,
39 spaces, precludes the inclusion of a recreation
room, swimming pool or other amenities which reflect a
high quality development. With the proposed density,
the subject site cannot afford on -site vehicular
circulation without use of the public alley at the
rear of the property; which prevents the construction
of a continuous six-foot high block wall at that
location that would ensure the compatibility with the
single-family residential neighborhood.to the north.
V. The proposed motel land use is -consistent with the
General Plan designation of Service and Neighborhood
Commercial for the subject site with the approval of
an unclassified use permit.
b. The City Council finds that, of the five findings required
to be met before a zone change may be granted, the
following have not been met inasmuch as:
ii. The proposed zone change permits a land use that lacks
& compatibility with adjacent single-family property and
iii. which also has the potential to be detrimental to the
public health, safety and welfare of persons residing
in the area, as per the unclassified use permit
finding (a) and (b).
V. Although the proposed zone change is consistent with
the current General Plan, the recently completed
Freeway Corridor Feasibility Study, which provides the
guidelines for future reworking of the General Plan
and subsequent development along the freeway, suggests
that multiple family will be more appropriate in the
subject location.
C. The City Council finds that approval of such zone change
and unclassified use permit would permit a use that is
incompatible with adjoining and existing single-family
residential properties.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of West Covina, California, does hereby deny Zone Change
No. 603 and Unclassified Use Permit No. 336 and does certify the
Negative Declaration of Environmental Impact as'it relates thereto
as being in compliance with the requirements of the California
Environmental Quality Act of 1970 (CEQA), as amended.

adoption of this Resolution.
