Resolution - 7993RESOLUTION NO. 7993 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING SUPPLE- MENT NO. 21 - LOCAL AGENCY STATE AGREEMENT NO. 07-5259 AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID SUPPLEMENT NO. 21. WHEREAS, the City of West Covina and the State of . California has entered into Local Agency State Agreement No. 07-5259 for the purpose of expanding Federal funds with the City of West Covina; and WHEREAS, the City desires to implement a Federal Aid Urban project within the City of West Covina pursuant to the Federal Highway Safety Act; and WHEREAS, it is necessary to execute a program supple- ment in order to implement said project; NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council of the City of West Covina does hereby approve Program Supplement No. 21, Local Agency State Agreement No. 07-5259, and author-izes.the Mayor and City Clerk to execute said Program Supplement No. 21. SECTION 2. The City Clerk of the City of West Covina shall certify to the adoption of this resolution and is hereby directed to transmit a copy of Program Supplement No. 21, to the California Department of Transportation, District 7. DATE: January 2, 1987 This Program Supplement Is hereby Incorporated Into the Local Agency -State Agreement for Federal -Aid which was entered Into between the LOCAL AGENCY and the STATE on 6-13-77 and Is subject to all the terms and conditions thereof. This Program Supplement is adopted In accordance with Paragraph 2 of Article 11 of the aforementioned Master Agreement under authority of Resolution No. ,approved by the LOCAL AGENCY on (See copy attached). The Local Agency further stipulates that as a condition to payment of funds obligated to this project. It accepts and will comply with the Convenante or remarks set forth on the following pages. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the City of West Covina at regular intervals or as required for efficient operation of the completed improvements. 2. The City of West Covina will advertise, award and administer this project. The City will obtain State's concurrence prior to either award or rejection of contract. 3. In awarding, or agreeing to award the contract, the Local Agency agrees the payment of Federal funds will be limited to the detail estimate amount approved by the Federal Highway Administration in the Federal -Aid Project Agreement (PR-2), or its modification PR-2A, and accepts any increases in Local Agency funds. 4. The availability of Federal Funds will be subject to meeting deadlines and/or other conditions as may be imposed by the Director upon the recommendation of the FAU Advisory Committee. 5. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances” contained in the aforementioned Master Agreement for Federal -Aid Program. SMY-3
