A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF -
WEST COVINA, CALIFORNIA, MODIFYING THE DECISION
OF THE PLANNING COMMISSION APPROVING VARIANCE
NO. 881, SUBJECT TO ALL CONDITIONS ENUMERATED IN
PLANNING COMMISSION RESOLUTION NO. 10-86-3484
EXCEPT CONDITIONS NOS..3A AND 3B, AS AMENDED.
The City Council of the City of West Covina, California,
does resolve as follows:
WHEREAS, there was filed with the City of West Covina, a
10 certified application on the forms prescribed in Chapter 26,
Article VI of the West Covina Municipal Code for a variance from
certain standards of the Municipal Code on that certain property
described as follows:
portions of Lots 74, 93, 94, 95 and 96 of Tract
No. 930 as per map recorded in Book.17, pages 38 and
39 of Maps, in the office of the Los -Angeles County
Recorder; and
WHEREAS, this variance is categorically exempt, Class 5,
from the requirements of CEQA as a minor alteration in land use
limitations on a slope of less than 20 percent, which does not
result in any changes in land use or density; and -
WHEREAS, hearings on said application were duly noticed
and conducted by the Planning Commission on October 1, 1986, at
which time said application was approved; and
WHEREAS, certain conditions of approval of the Planning
Commission were appealed to the City Council.at its meeting of
October 27, 1986, for hearing and consideration; and
WHEREAS, after proper and legal notice the City Council
held hearings on said Planning Commission action on.October 27,
1986; and
WHEREAS, the findings necessary.for.approval of a
variance have been met as stated in Planning Commission
Resolution No. 10-86-3484; and
WHEREAS, the applicant sought relief from two sections
of the Engineering Department requirements, Conditions No. 3a
and 3b, which read as follows:
a. The required street improvements shall include that portion
of Virginia Avenue from Barranca Street to westerly driveway
to new parking lot contiguous to subject property. .(Curb
and gutter in place of A.C. berm).
b. Five-foot wide sidewalks shall be constructed along Virginia
Avenue from Barranca Street to westerly driveway to new
parking lot adjacent to curb; and
WHEREAS, upon review of this matter with the
City Attorney, it was determined that since required public works
improvements must bear a reasonable relationship to on -site
improvements, conditions of approval Nos. 3a and 3b of Resolution
No. 10-86-3484 are excessive for the'on-site improvements.
NOW, THEREFORE, BE IT RESOLVED, that the findings and
decision in Planning Commission Resolution No. 10-86-3484 be
modified and the City Council does hereby APPROVE the requested
Variance'No. 881, subject to all conditions as stated in
Resolution No. 10-86-3484 except condition 3b, which has been
deleted, and condition 3a, which has been amended below, the
Violation of any one of which shall be grounds for revocation of
the Variance by..the Planning Commission or
City Council:
3a..The required street improvements shall include that portion
• of Virginia Avenue adjacent.to the proposed parking lotto be
approved by Planning Director's Modification (curb and gutter
in place of A. C. berm).
FINALLY,RESOLVED, that .the City Clerk shall certify to the
adoption of this Resolution.
