Resolution - 7247RESOLUTION NO. 7247 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 5772 APPROV- ING THE MAXIMUM RATES FOR NONHAZARDOUS WASTE DISPOSAL AT THE BKK LANDFILL IN THE CITY OF WEST COVINA. The City Council of the City of West Covina does resolve as follows: isSECTION 1. The maximum rates contained in Resolution Pdo. 5772 are amended as follows: MAXIMUM RATES FOR WASTE DISPOSAL AT THE BKK COMPANY LANDFILL (WEST COVINA) SOLID WASTE Group III and IV Materials: Maximum rates for residential and commercial rubbish, demolition debris, yard trimmings and other Group II and III materials will be the same as the refuse, solid inert material, hard -to -handle bulky material, .minimum charge and pull -off fees approved by the Sanitation Districts of Los Angeles County for the neighboring Spadra and Puente Hills landfills. Said approved fees are incorporated herein and made a part thereof by reference. Special Note: Approved Sanitation District rates do not include State and County taxes or fees which may be imposed. These rates do not include the City Business License Tax. City Business License Tax and State and County fees may be added to the approved Sanitation District rates for both solid and liquid waste, as applicable. A surcharge of one dollar ($1.00) per ton may be added to Sanitation District rates for wastes received after 12:00 P.M. each working day. A surcharge of $3.50 per ton may be added to provide the funds necessary for the development, processing and implementation of a revised waste discharge permit for the Class III disposal area. Failure to receive or implement the revised permit may be cause for the review of the expenditure of the funds resulting from this surcharge. The City shall be entitled to dispose of its own waste material at the landfill site and shall not be subject to the imposition of any disposal fees. SECTION 2. Validity of Resolution. If any section, subsection, sentence, clause, phrase or portion of this resolution is for any reason held to be invalid or unconsti- tutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this resolution. The City Council hereby declares that it would have adopted this resolution and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, phrases, or portions be declared invalid or unconstitutional.
