Resolution - 7197RESOLUTION NO. 7197 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA MAKING ENVIRONMENTAL FINDINGS NECESSARY FOR THE PROPOSED DISPOSITION AND DEVELOPMENT AGREEMENT, BETWEEN THE • REDEVELOPMENT AGENCY OF THE CITY OF WEST COVINA, DEVELOPMENT RESEARCH CORPORATION AND THE PARKING AUTHORITY OF THE CITY OF WEST COVINA FOR THE SALE AND DEVELOPMENT OF CERTAIN REAL PROPERTY LOCATED IN THE WEST COVINA CENTRAL BUSINESS DISTRICT. • WHEREAS, a Final Environmental Impact Report on proposed amendments to the Redevelopment Plan ("Redevelopment Plan") for the West Covina Central Business District Redevelopment Project ("Project") was adopted by the Redevelopment Agency of the City of West Covina ("Agency") on May 9, 1977, and a Final Environmental Impact Report was adopted by the Agency on the Second Amendment to the Redevelopment Plan on June 23, 1980; and WHEREAS, Final Environmental Impact Report No. 1979-6, which considered the environmental impacts of two amendments to the West Covina General Plan, two zone changes, a precise plan of design, and a parcel map, was prepared by the Agency and certified by the City Council of the City of West Covina on January 26, 1981; and WHEREAS, the Agency proposes to enter into a Disposition and Development Agreement (the "DDA") with Development Research Corporation ("Developer") and the Parking Authority of the City of West Covina for the sale of certain real property ("Site") within the Project area and the development of the Site for a commercial office building, including a multi -screen movie theater, and related uses (the "Development"), and in connection therewith prepared an Initial Study of the environmental effects of said proposed DDA; and WHEREAS, said Initial Study conforms to the requirements of the California Environmental Quality Act of 1970 (Public Resources Code, Section 21000 et seq.), the "Guidelines for the Implementation of the California Environmental Quality Act of 197011, as amended, adopted by the Secretary for Resources of the State of California, and the Procedures for Implementation of the California Environmental Quality Act of 1970 adopted by resolution of the Agency; and WHEREAS, a duly noticed joint public hearing was held on the proposed DDA by the Agency and the City Council of the City of West Covina on June 9, 1986, at which time all persons were given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of West Covina as follows: 1. The City Council hereby approves and adopts the Initial Study and Negative Declaration with respect to the proposed DDA between the Agency and the Developer. 2. The City Council hereby certifies that the information contained in the Initial Study, the Negative Declaration and in the above -referenced previous Environmental Impact Reports has been reviewed and considered by the members of the City Council. 0 3. The City Council hereby finds and determines as follows: (a) No substantial changes are proposed in the Development, or with respect to the circumstances under which the Development is to be undertaken, which will require major revisions in the above - referenced Environmental Impact Reports previously adopted due to the involvement of new environmental impacts not covered in said previous Environmental Impact Reports; (b) No Subsequent or Supplement to EIR is necessary or required; and -1- (c) The proposed action will have no significant effect on the environment, except as identified and considered in the previous EIRs. 4. The Secretary shall certify the adoption of this Resolution.
