A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, APPROVING A PERSONNEL RULE CHANGE AMENDING RULE XIII,
COMPLAINT AND GRIEVANCE PROCEDURES, RESOLUTION NO. 1276, PERSONNEL
RULES AS AMENDED AND RESOLUTION NO. 6653.
Is WHEREAS, the City of West Covina has an established grievance procedure;
and
WHEREAS, the organizational structure of the City of West Covina contains
a Division Manager level of responsibility within its chart of administration;
and
WHEREAS, the Personnel Commission recommends revision of the Personnel
• Rules to include Division Managers in the Grievance process;
NOW THEREFORE, the City Council of the City of West Covina resolves as
follows:
SECTION 1. That Rule XIII .5 of Resolution No. 1276, relating to the
grievance procedure is hereby amended to read as follows:
"Step 4: If the grievance is not satisfactorily resolved in Step 3, the
grievant(s) may, within seven (7) calendar days of receipt of the Department
Head's decision, submit the grievance to the Personnel Director for
consideration by the -E4-ty-Division Manager. Such submittal shall include
the original of the grievance form, a basis upon which the grievant(s)
takes issue with the position of his Department Head. The 444- Division
Manager or his designee shall meet with the grievant and take such
investigative action as he.deems necessary. The grievant(s) shall be
informed in writing of the -C-4-ty- Division Manager's decision within fourteen
(14) calendar days of receipt of the grievance.
Step 5: If the grievant(s) is not satisfied with the 44i;y- Division
Manager's decision, he may, by written notification to the Personnel
Director, within seven (7) calendar days of receipt of the - 4-y Division
Manager's decision, request that the grievance be submitted to the Personnel
Commission. The Personnel Director shall submit said request, together
with copies of all the pertinent forms, documents, and materials concerned,
to the Personnel Commission. The Personnel Commission shall make such
investigation and hold such hearings as it requires and certify its findings
as provided in Section 2-257 of the Municipal Code."
SECTION 2. That this revised procedure shall be applicable to employees
in classes represented by the West Covina Police Officer's Association, the United
Firefighters of Covina/West Covina Local 2415, AFL-CIO, the West Covina City
General Employee's Association, the California League of City Employee
Associations, and the West Covina Communications Operator's Association.
SECTION 3. The effective date of this Resolution is May 12, 1986.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
