Resolution - 71750 L� • RESOLUTION NO. 7175 A RESOLUTION OF THE'CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING THE JOINT.RESOLUTION OF THE BOARD OF SUPERVISORS OF. THE COUNTY OF LOS ANGELES, THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 22 OF THE. COUNTY OF LOS ANGELES, AND THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUES RESULTING FROM ANNEXATION TO COUNTY SANITATION DISTRICT NO. 22 BEING ANNEXATION NO. 22-242. WHEREAS, there is a certain area within the City of West Covina which is to be annexed to the County Sanitation District of the County of Los Angeles; and WHEREAS, pursuant to Section 99 and 99.1 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies who receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange -of property tax revenues by resolution; and WHEREAS, there has been prepared a joint resolution of the Board of Supervisors of the County of Los Angeles, the Board of Directors of County Sanitation District No. 22 of the County of Los Angeles, and the City Council of the City of West Covina; and WHEREAS, this joint, resolution specifies the negotiated exchange of property tax revenues for Annexation No. 22-242 for each fiscal year com- mencing on and after July 1, 1986. NOW, THEREFORE., the City Council of the City of West Covina does hereby resolve.as follows: SECTION 1. That the joint resolution -of the Board of Supervisors of the County.of Los Angeles, the Board of Directors of..County. Sanitation District No. 22 of the County of Los Angeles, and the.City Council of the City of West Covina approving and accepting negotiated exchange of property tax revenues resulting from an annexation to County Sanitation District No. 22 being Annexation No. 22-242 is hereby adopted. SECTION 2. That the Mayor and City Clerk are hereby authorized to execute said joint resolution indicating adoption by the City Council of the City of West Covina. SECTION 3. That the City Clerk shall certify to the adoption of this resolution and shall send a certified copy of this resolution and the executed joint resolution to the County Sanitation Districts of the County of Los Angeles. For each fiscal year commencing on and after July 1, 1987 • or after the effective date of this jurisdictional change, which- ever is later, the County Auditor shall transfer to County Sanitation District No. 22 a total of 1.0686 % of the Annual Tax Increment attributable to tFie land area encompassed within Annexation No. 242 . Said percentage has been determined on the basis of the following contributions. No additional transfer of property tax revenues shall be made from any other taxing agencies to County Sanitation District No. 22 as a result of this annexation. 4: No transfer of property tax revenues from properties within a community redevelopment project shall be made during the period that the entire tax increment is legally committed for repayment of the redevelopment project costs. The 1986-19'7 assessed valuation shall be used as the tax base for future tax increment determinations relative to this resolution. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board of Directors of County Sanitation District No. 22 and the governing bodies of the taxing agencies signatory hereto. NOW, THEREFORE, BE IT RESOLVED as follows: 0 1. The negotiated exchange of property tax revenues between the County of Los Angeles and the City of West Covina • resulting from the annexation of unincorporated territory to the City of West Covina, identified as "Annexation 240," is approved and accepted. • 2. For fiscal years commencing on and after July 1, 1987, or after the effective date of this jurisdictional change, whichever is later, property tax revenue in the amount of One Thousand Two Hundred Eighty -Three Dollars ($1,283) is ordered transferred from the County of Los Angeles to the City of West Covina. In addition, for each fiscal year commencing on and after July 1, 1987, or after the effective date of this jurisdictional change, whichever is later, a portion of the incremental tax growth attribu- table to the Tax Rate Areas in West Covina "Annexation 240," as identified below, shall be transferred to the City of West Covina, and the County of Los Angeles' share of incre- mental tax growth shall be reduced accordingly: Tax Rate Area % of ATI 2218 17.5 2224 17.2 3. For fiscal years commencing on and after July 1, 1987, or after the effective date of this jurisdictional change, whichever is later, all property tax revenue received by the Consolidated Fire Protection District attri- . -2- butable to the West Covina "Annexation 240" area shall be transferred to the County of Los Angeles. 4. For fiscal years commencing on and after July 1, 1987, or after the effective date of this jurisdictional • change, whichever is later, all property tax revenue received by Road District No. 1 attributable to the West Covina "Annexation 240" area shall be transferred to the County of Los Angeles. 5. For fiscal years commencing on and after July 1, 1987, or after the effective date of this jurisdictional change, whichever is later, all property tax revenue received by Garo Lighting District attributable to the West Covina "Annexation 240" area shall be transferred to the County of Los Angeles. 6. The Consolidated Sewer Maintenance District receives no property tax revenue. Therefore, there shall be no transfer of property tax revenue from the Consolidated Sewer Maintenance District to either the City of West Covina or the County of Los Angeles, attributable to the West Covina "Annexation 240" area. 7. No other transfers of property tax revenue shall be made to the City of West Covina as a result of "Annexation 240." 0 -3- The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles and by the City Council of the City of West Covina.
