Resolution - 7080• RESOLUTION NO. 7080 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, INITIATING AN AMENDMENT TO CHAPTER 26 OF THE MUNICIPAL CODE RELATING TO FORTUNE TELLING. WHEREAS, on August 12, 1985, the City Council received from Bob Adams, a request for consideration of an amendment to the Municipal Code to permit fortune telling services in the City of West Covina; and WHEREAS, the City Council directed staff to prepare a report on the options that would be available to the City Council to consider regulations in compliance with the court's decision; and WHEREAS, on August 15, 1985, the California Supreme Court declared Section 8.52.060 of the Azusa Municipal Code prohibiting fortune telling for consideration, unconstitutional; and WHEREAS, on August 26, 1985, the City Council received a report from staff that presented options that are available for consideration of allowing fortune telling and similar uses in Office (0-P) and Retail -Commercial (N-C, S-C and R-C) zoning districts. WHEREAS, the City of West Covina will adopt an urgency ordinance on September 9, 1985 to meet the final date of that decision; and WHEREAS, the City Council believes that the Planning Commission consideration of such an amendment to the Municipal Code would be appropriate. NOW THEREFORE BE IT RESOLVED, the City Council of the City of West Covina does hereby initiate an amendment to Chapter 26 of the Municipal Code pertaining to allowing fortune telling in Office and Retail -Commercial zoning districts. FINALLY RESOLVED, that the City Clerk shall certify to the adoption of this Resolution. ADOPTED AND APPROVED this 26th day of August, 1985.
