Resolution - 7064RESOLUTION NO. 7064 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, VACATING AND ABAN- DONING A PORTION OF A STREET WHICH HAS BEEN • SUPERSEDED BY REALIGNMENT (GARVEY AVENUE SOUTH[ GLENDORA AVENUE) WHEREAS, The State of California has widened the San Bernardino Freeway and realigned a portion of Garvey Avenue South; and WHEREAS, The Atrium Project.is designed to utilize all of Garvey Avenue South and the excess portion of Glendora Avenue beyond its 40 foot half sheet width per the f9aster Plan of Streets, adjacent to the Atrium Project; and WHEREAS, the City of West Covina Redevelopment Agency, the adjacent property owner, has requested the vacation of the above -mentioned portions of Garvey Avenue South and Glendora Avenue, for better utilization of its property. NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: SECTION 1. Pursuant to Sections 8330 to 8334, inclusive, of the Streets and Highways Code, the City Council of the City of West Covina hereby finds and determines that the following described portion of Holt,Avenue has been superseded by realign- ment: Those portions of Lot 169 and Arroyo Avenue of E. J. Baldwin's fourth subdivision of a part of the Rancho La Puente, in the City of West Covina, in the County of Los Angeles, State of . California, as per map recorded in Book 186 of Maps, in the Office of the County Recorder of said County, described as follows: Beginning at the intersection of the Northeasterly line and its Southeasterly prolongation of State Street, 80.00 feet wide, with the Northwesterly line of GlendoraoAvenue, 80.00 feet wide; thence along said Northwesterly line North 44 degrees 40 minutes 30 seconds East 1339.20 feet to a point on the South right-of-way line and its Easterly prolongation of the San Ber- nardino Freeway per State of California right-of-way Map No. 07-LA-10-35.5 and No. 07-LA-10-35.8; thence along said South right-of-way North 88.degrees 56 minutes 53 seconds West, 581.31 feet to the beginning of a curve concave Southerly, having a radius of 1354.50 feet, and a central angle of 03 degrees 26 minutes 00 seconds; thence Westerly along said curve 81.17 feet; thence continuing along said South right-of-way, South 87 degrees 37 minutes 07 seconds West 771.59 feet to the beginning of a curve concave Southeasterly, having a radius of 329.50 feet, and a central angle of 60 degrees 59 minutes 40 seconds; thence Southwesterly along said curve 350.77 feet; thence continuing • along said South right-of-way. South 26 degrees 37 minutes 27 seconds West 43.64 feet, more or less, to a point on said Northeasterly line of State Street, 80.00 feet wide; thence along said Northeasterly line South 48 degrees 09 minutes 10 seconds East, 1063.38 feet, more or less, to the point of begin- ning. Except from those portions lying within the lines of the land described therein all oil, gas, minerals and other hydrocarbon substances in and under said land below a depth of 500 feet without the right of surface entry, as excepted and reserved by Atlantic Richfield Company, a corporation, formerly the Atlantic Refining Company, successor by merger to Richfield Oil Corporation, a Corporation, recorded March 6, 1968 in Book D 3931 Page 615, official records. n U • U i CJ Also except from those portions lying withinithe,lands described in condemnation actions in Superior Court Los Angeles County case numbers C452702, C452701, C452645, C452648, C452642, C452644, C452641, and C429035 all oil, gas and mineral sub- stances, together with the right to explore for and extract such substances, provided that the surface opening of any well, hole, shaft.or other means of exploring for, reaching or extract- ing such substances shall not be located within the Central Business District Redevelopment project, and shall not penetrate any part orportion of said project area within 500 feet of the surface thereof. RESERVING AND EXPECTING ALSO from said vacation .the permanent easement and right at any time, or from time to time, to con- struct, maintain, operate, replace, remove, and renew sanitary sewers, and appurtenant structures thereof and to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and traffic control pur- poses and for transportation control or distribution of electric energy and water lines, including access and the right to keep the property free from inflammable materials, and wood growth.., and otherwise protect the same from.all hazards, in, upon, and over the street or part thereof proposed to be vacated. SECTION 2. Those portions of existing Garvey Avenue South and Glendora Avenue described in Section l.hereof are hereby summarily vacated and abandoned. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified copy thereof to be recorded in the office of the County Recorder of said County.
