Resolution - 6985RESOLUTION NO. 6985 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING PRECISE_PLAN NO. 606, REVISION 1, AND CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT THEREFORE, AS AMENDED BY THREE CONDITIONS STATED HEREIN. • The City Council of the City of West Covina, California, does hereby resolve as follows: WHEREAS, there was filed with the City of West Covina, a verified application on the forms prescribed in Chapter 26, Article VI, of the West Covina Municipal Code, requesting Revision No. 1 to Precise Plan No. 606 to allow the construction of a two-story, 15,216 square foot building addition to an existing automobile dealership, on that certain property in the Service -Commercial (S-C) Zone, generally described as follows: Portions of Parcels 1 and 2 of Parcel Map No. 2330 in the City of West Covina, County of Los Angeles, State of California, as per Map Book 33, Page 25 of Parcel Maps, in the Office of the County Recorder of said County; and WHEREAS, the Planning Commission, upon giving the required notice, did on the 6th day of February, 1985, conduct a duly advertised public hearing as prescribed by law to consider said application, and at which time the application was approved; and WHEREAS, the action of the Planning Commission was appealed to the March 11, 1985, City Council meeting for hearings and consideration; and WHEREAS, the City Council did review the proposed project and recommended certain provision be included to read as.follows: 1. Temporary buildings be removed. 2. Loud speakers be removed. 3. All servicing of automobiles to be done in designated service bays as indicated on the precise plan; and WHEREAS, studies and investigations made by this Council and in its.behalf reveal the following facts: 1. The applicant is requesting a revision to a precise plan of design for a 15,216-square foot building addition to an existing automobile dealership on a 1.6-acre parcel at the above location in the location in the Service -Commercial (S-C) Zone. 2. The precise plan meets or exceeds the development standards of the S-C Zone. 3. Findings necessary for approval of a precise plan of design: Page 2 a. In reviewing the precise plan, it has been found that consideration has been given and • restrictions imposed to the extent necessary to permit the same degree of enjoyment of the subject property, but subject to the same degree of protection of adjoining properties, as would be accorded in normal circumstances, by the standard restrictions imposed by the Municipal Code. • b. The proposed precise plan will not depreciate property values in the vicinity or interfere with the use or enjoyment of property in the vicinity or endanger the public peace, health, safety or general welfare. 4. An initial study has shown that, because of its location in a developed area, its compliance with the General Plan, Redevelopment Plan and Municipal Code Development Standards and its compatibility with surrounding zoning and development, the expansion of the use will not result in producing any significant impacts on the environment and an Environmental Impact Report and supplemental Negative Declaration of Environmental Impact have been prepared; and NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby APPROVE Precise Plan No. 606, Revision 1, and CERTIFY the Negative Declaration of Environmental Impact therefor, subject to the provisions of the West Covina Municipal Code, provided that the physical development of the herein described property shall conform to said Plan and the following conditions which, except as otherwise expressly indicated, shall be fully performed and completed or shall be secured by bank or cash deposit satisfactory to the Planning Director before the use or occupancy of the property is commenced and before a Certificate of Occupancy is issued, and the violation of any of which shall be grounds for revocation of said Precise Plan by the Planning Commission or City Council. The Precise Plan shall not be effective for any purpose until the owner of the property involved (or his duly authorized representative) has filed at the office of the Planning Director his affidavit stating he is aware of, and accepts, all conditions of this Precise Plan as stated below: 1. Comply with Study Plan "A" dated February 6 1985. 2. Comply with Exhibit No. 1 (Elevations). 3. Comply with all requirements of the S-C Zone. 4. Prior to the issuance of any building permits, all of • the following requirements shall be satisfied: a. The applicant shall submit a detailed landscaping plan to the Planning Director for review and approval. Said plan to include type, size and quantity of landscaping materials, as well as a fully automatic comprehensive irrigation system. Landscape areas are to be kept free of litter and diseased or dead plants. Page 3 b. A parking lot lighting plan showing electroiler • types and locations, average illumination levels, points of minimum illumination and photometric data in conformance with Planning Commission Resolution No. 2513 and as requested shall be submitted and approved by the Planning Director and City Engineer. The detailed exterior lighting plan shall show location, type and illumination levels of . lighting on both the new and used car facilities. The new lighting plan shall provide lower intensity lighting than the presently existing lighting with light from the fixtures directed 90 degrees toward the ground.. c. All signs for both the new and used car facility shall conform to the present provisions of the West Covina Municipal Code. 5. Temporary buildings be removed. 6. Loud speakers be removed. 7. All servicing of automobiles to be done in designated service bays as indicated on the precise plan. 8. Unused driveway entrances shall be removed where shown on Study Plan "A". 9. All ground -mounted, wall -mounted and/or roof -mounted equipment not shown on the approved Study Plans, shall be screened from public view in a manner that is architecturally compatible with the main building. Plans and elevations indicating the type of equipment and method of concealment shall be submitted to the Planning Director for review and approval prior to the issuance of building permits. 10. All utilities shall be installed underground. 11. Provide street trees with tree wells and bubblers at approximately 35-foot intervals, where indicated on Study Plan "A". 12. Engineering Department Requirements: a. Parking lot and driveway improvements on private property shall comply with Planning Commission Resolution No. 2513 and be constructed to the City of West Covina Standards. • b. Prior to issuance of a Building Permit, all of the following requirements shall be satisfied: i. A final grading and drainage plan showing existing and proposed elevations and drainage structures and showing existing and proposed on -site and off -site improvements shall be submitted to and approved by the Planning, Building and Engineering Departments. Page 4 ii. An itemized cost estimate for all on -site and off -site improvements to be • constructed, except buildings, shall be submitted to the Engineering Department for approval. Based upon the approved cost estimates, required fees shall be paid and improvement securities for all on -site and off -site improvements, except buildings, and 100% labor/material securities for all off -site improvements, shall be posted • prior to final approval of the plans. c. Covenant to hold two or more parcels as one shall be recorded with the Los Angeles County Recorder. A copy of the recorded document shall be filed with the City Engineer. 13. Building Department Requirements: a. Comply with all requirements of the following Codes of the City and State: i. 1979 Uniform Building Code ii. 1979 Uniform Plumbing Code iii. 1979 Uniform Mechanical Code iv. 1978 National Electric Code v. West Covina Security Ordinance vi. Title 24-25 State of California Energy/Insulation Regulations and Handicapped Persons Standards. 14. Fire Department Requirements: Trim back or remove trees at east driveway by canopy as shown on Study Plan "A". 15. Police Department Requirements: No requirements. 16. Redevelopment Agency Requirements: No requirements. 17. All conditions required as part of Precise Plan No. 606 shall remain in effect and shall be considered enforceable together with any conditions required as part of this Revision 1. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of West Covina does hereby adopt a resolution approving Precise Plan No. 606, Revision 1, and certify the . Negative Declaration of Environmental Impact as it relates thereto as being in compliance with the requirements of the California Environmental Quality Act of 1970 (CEQA), as amended.
